Reviewers and general readers found little with which to quibble in the book’s main contention that the traditional post-talmudic authorities developed the halakhah with diversity, flexibility, and creativity. What did cause offence, for both Orthodox and Reform critics, was the final chapter, ‘Towards a Non- Fundamentalist Halakhah’, which puts forward the view that it is both desirable and possible to preserve the halakhic system, albeit in a more dynamic form than in the past, even now that it has been demonstrated by the massive researches of the historical school that the halakhah did not simply drop down from Heaven but has had a history. I confess that I thought twice before adding this controversial and speculative chapter to the book, and was tempted to omit the chapter from this revised edition so as not to obscure the book’s basic thesis, which is that the traditional halakhists operated, consciously or subconsciously, in re- sponse to a felt need to make their halakhic decisions conform to their general stance on what Judaism demands of its adherents. Yet to have ignored the new historical challenge to the halakhic system would have been cowardly and dishonest. In this new introduction I try to defend the view presented in the final chapter against strictures from the right and left wings, as well as describing, at least in outline, further work that has been done by scholars in the area covered by the book as a whole. First, reference should be made to a book of the utmost relevance to the themes treated in A Tree of Life that has appeared in the Orthodox Forum series of the Rabbi Isaac Elhanan Theological Seminary, Rabbinic Authority and Personal Autonomy.1 The basic problem to which the Modern Orthodox essayists in the book address themselves is to what extent a contemporary Orthodox rabbi can be innovative and creative in his halakhic decisions. These writers agonize in one way or another over the dilemma of Modern Orthodox rabbis who seek to follow the halakhic process typical of rabbis of the old school while accepting, unlike the latter, many of the values of Western thought and culture. 1 Edited by Moshe Z. See also my review in the Jewish Journal of Sociology. xii introduction to the second edition The opening essay in this book exposes the flaws in the notion, preva- lent among the h.aredim or ultra-Orthodox today, that the gedolim (‘great ones’, chiefly the (unelected) members of the Council of Sages of Agudat Yisrael) have a kind of built-in guarantee that their opinions, even in political matters such as attitudes towards Zionism and the State of Israel, are as infallible as what the h.aredim call da’as torah, the view of the Torah, to reject which is to reject the very word of God.2 Far from such a view being traditional and Orthodox it is, in fact, modern, since it only emerged under the influence of hasidic veneration of the tsadik in the early twentieth century.

    IDEAL" AND "REAL" IN CLASSICAL JEWISH POLITICAL THEORY Gerald J.Blidstein This essay considers the degree to which Jewish political and legal ? ? theory allows and, indeed, mandates the recognition that the Torah legislates an ideal law which is not appropriate for situations of social and political stress, and the degree to which such situations are really the historical norm rather than the exception. The Talmud, it is shown, adum brates this concept, but in a fairly marginal form.Maimonides places it at center stage of societal governance, apparently expecting that a Jewish so ciety will of necessity be thrown back upon this option; but he also sug gests guidelines for its regulation. R. Nissim of Barcelona (fourteenth century) both expands the concept and also relaxes the Maimonidean re strictions on its use. This final form of the doctrine receives a thorough critique at the hands of Isaac Abrabanel; but it also serves as the linchpin for much contemporary argument for the legitimacy of Israeli legislation from a classical Jewish perspective. The relationship of law and political theory to reality, that is, to the actual doings of people in society and to the concrete problems faced by societies, is undoubtedly complex.     eSharp Issue 20: New Horizons A Fresh Perspective on the History of Hasidic Judaism Eva van Loenen (University of Southampton) Introduction In this article, I shall examine the history of Hasidic Judaism, a mystical,1 ultra-orthodox2 branch of Judaism, which values joyfully worshipping God’s presence in nature as highly as the strict observance of the laws of Torah3 and Talmud.4 In spite of being understudied, the history of Hasidic Judaism has divided historians until today. Indeed, Hasidic Jewish history is not one monolithic, clear-cut, straightforward chronicle. Rather, each scholar has created his own narrative and each one is as different as its author. While a brief introduction such as this cannot enter into all the myriad divergences and similarities between these stories, what I will attempt to do here is to incorporate and compare an array of different views in order to summarise the history of Hasidism and provide a more objective analysis, which has not yet been undertaken. Furthermore, my historical introduction in Hasidic Judaism will exemplify how mystical branches of mainstream religions might develop and shed light on an under-researched division of Judaism. The main focus of 1 Mystical movements strive for a personal experience of God or of his presence and values intuitive, spiritual insight or revelationary knowledge. The knowledge gained is generally ‘esoteric’ (‘within’ or hidden), leading to the term ‘esotericism’ as opposed to exoteric, based on the external reality which can be attested by anyone. 2 Ultra-orthodox Jews adhere most strictly to Jewish law as the holy word of God, delivered perfectly and completely to Moses on Mount Sinai.

As a result, incunabu- la share many characteristics with manuscripts, such as leaving a blank space for the first letter or word to be embellshed with an ornamental woodcut, a colophon at the end of the work rather than a title page, and the use of signatures but no pagination.2 The Gutenberg Bibles, for example, were printed with blank spaces to be completed by calligra- phers, accounting for the varying appearance of the surviving Bibles.     The Talmud On Transitivity Shlomo Naeh∗ and Uzi Segal† September 3, 2009 Abstract Transitivity is a fundamental requirement for consistency. Legal systems, especially when composed over time and by different agen- cies, may encounter nontransitive cycles. This paper shows that treat- ments of violations of transitivity already appear in the rabbinic lit- erature, starting with the Mishnah and the Talmud (1st–5th c CE). This literature offers several solutions that are similar to those used in the modern economic literature, as well as some other solutions that may be adopted in modern situations. We analyze several examples. Most systems have some built-in resolution mechanisms, for example, legislative agencies are ranked as are courts. Such mechanisms are suitable for solving conflicts where two rules contradict each other — for example, when laws are declared unconstitutional or when higher courts nullify decisions made by lower courts. There is another type of inconsistency, where any pair of two legislations is consistent, but two laws in conjunction imply a conclusion that is opposed by another law.
