Referendum on early elections: The case of Slovakia in the European context Marián Giba* Vincent Bujňák** Summary: The referendum initiative of 2021 is the fourth attempt in Slo- vakia to call a referendum on early parliamentary elections in less than 30 years. The aim of this article is to answer the question of whether the shortening of the parliamentary term by referendum is in accordance with the Slovak Constitution. Since the shortening of parliamentary term by ref- erendum is a constitutional issue which is a question of identity common to all European democracies, the authors analyse the existence of such direct democracy instrument in the Council of Europe member states and compare the relevant constitutional framework with the Slovak Constitution. The authors’ opinion is that the referendum on early elections contradicts not only several constitutional provisions, but also the overall philosophy of the Slovak Constitution and Western-type democracy. Introduction After two unsuccessful and relatively older attempts in 2000 and 2004, the idea to demand early parliamentary elections through a referendum emerged in Slo- vakia once again. The initiative comes formally from a popular petition.1 In reality, this petition is organized by several opposition political parties. DEVOLUTION OR DECONSTRUCTION CZECHO-SLOVAK STYLE Eric Stein * This essay is a part of a broaderstudy entitled "Post-communist Con- stitution-making: Confessions of a Comparatist" which focuses on Czechoslovakia. The present Czech and Slovak Federative Republic is a unique variant offederalism. It is composed of only two component units (shades of Leb- anon, Cyprus, perhaps Belgium), and it is seriously asymmetric: demo- graphically, there are twice as many Czechs and Moravians in the Czech Republic as there are Slovaks in the Slovak Republic; economically, the Czech area has been highly industrialized while Slovak industrialization has come much later and is less diversified; historically, the Czech lands have had a long tradition of politicaland cultural identity even as part of the Austro-HungarianEmpire, while the Slovaks remained under an op- pressive Hungarian dominance for a thousand years until the establish- ment of the Czechoslovak Republic in 1918. -

John Marshall On the Independence of the Judiciary The judiciary is the third branch of the government (the third state power) with the responsibility of applying the laws to speci#c cases and settling all disputes. The independence of the judiciary according to Parmatma Sharan “is a corner stone of ever democratic government and upon it is built the structure of civil liberty. This structure is destroyed, the moment, the judiciary becomes susceptible to political pressure.”1 The organization of the judiciary must be based on the following features: the ap- pointment of only highly quali#ed and experienced judges; the method of appointing judges must be fair, systematic, e$ective and transparent; the method of removing judges should be di%cult; no single entity should have the power to remove judges; nevertheless, this does not mean that judges should be untouchable. A worse state of things (Michel Montaigne would surely would agree including with regard to the judiciary) cannot be imagined than “where wickedness comes to be legitimate, and assumes, with the magistrates’ permission, the cloak of virtue (…) The most extreme sort of injustice, according to Plato, is where that which is unjust should be reputed for just. -

102th CONGRESS Printed for the use of the 1st Session Commission on Security and Cooperation in Europe ELECTIONS IN CZECHOSLOVAKIA JUNE 1992 A Report Prepared by the Staff of the Commission on Security and Cooperation in Europe ABOUT THE ORGANIZATION (OSCE) The Conference on Security and Cooperation in Europe, also known as the Helsinki process, traces its origin to the signing of the Helsinki Final Act in Finland on August 1, 1975, by the leaders of 33 European countries, the United States and Canada. Since then, its membership has expanded to 55, reflecting the breakup of the Soviet Union, Czechoslovakia, and Yugoslavia. (The Federal Republic of Yugoslavia, Serbia and Montenegro, has been suspended since 1992, leaving the number of countries fully participating at 54.) As of January 1, 1995, the formal name of the Helsinki process was changed to the Organization for Security and Cooperation in Europe (OSCE). The OSCE is engaged in standard setting in fields including military security, economic and envi- ronmental cooperation, and human rights and humanitarian concerns. In addition, it undertakes a variety of preventive diplomacy initiatives designed to prevent, manage and resolve conflict within and among the participating States. The OSCE has its main office in Vienna, Austria, where weekly meetings of permanent represen- tatives are held. In addition, specialized seminars and meetings are convened in various locations and periodic consultations among Senior Officials, Ministers and Heads of State or Government are held. This paper is a comparative treatment of fiscal decentralization since 1993 and more recent reforms of public administration, the two efforts representing the foundation of the New System. Czech experience is invoked simply to provide an appropriate benchmark for the evaluation of Slovakia‟s New System introduced in 2004, including the 19% “flat tax” and other striking measures in local public finance.
