New Facts in the False Art Collection Press Release 8 June 2011 New facts in the false art collection "Werner Jägers" case released. In August 2008, began in Germany what has now become the biggest scandal of fake artworks in Europe since the end of the Second World War. In this dismal affair in which art buyers have lost millions, a German major auction house now also risks its reputation. The case, led by the prosecutor of the city of Cologne, in which AV Modern & Contemporary collaborated, is now almost ready and the identity of the four main defendants who will go to trial next September are known. Wolfgang Beltracchi, 60, his wife Helen Beltracchi, 52, the sister of the latter Jeanette Spurzem, 53, and Otto Schulte-Kellinghaus, 67, inventor of the second false art collection of the case ("Sammlung Wilhelm Knops") and responsible for the logistics of the whole operation, will face charges of organized fraud, forgery and risk up to ten years of prison. Fourteen paintings, on the forty-seven set in question, are part of a first indictment. For the thirty-three- remaining works (including twenty that unfortunately could not be found), another legal procedure has been established. During his official declaration of 10th May, Günter Feld - General Attorney of Cologne - announced that charges might also be brought against Professor Henrik Hanstein, director of the important German auction house Lempertz. It appears Hanstein supposedly didn’t proceed to a thorough authentication as legally mandatory for a number of artworks in the case before they were put on sale by his company. A large part of the fakes put into circulation on the market since 1995, were signed to pass for leading German expressionists painters such as Max Pechstein or Heinrich Campendonk, thus taking advantage of lacks in historical documentation during World War II. Angel Department of Art University of Toronto Year of convocation: 2017 In 1937, under Gestapo orders, the Nazis forced the Düsseldorf-born Jewish art dealer Max Stern to sell over 200 of his family’s paintings at Lempertz, a Cologne-based auction house. Stern kept this fact a secret for the rest of his life despite escaping from Europe to Montreal, Canada, where he settled and became one of the country’s leading art dealers by the mid-twentieth century. A decade after Stern’s death in 1987, his heirs (McGill University, Concordia University, and The Hebrew University of Jerusalem) discovered the details of what he had lost, and how in the post-war years Stern travelled to Germany in an attempt to reclaim his art. To honour the memory of Max Stern, they founded the Montreal- based Max Stern Art Restitution Project in 2002, dedicated to regaining ownership of his art and to the study of Holocaust-era plunder and recovery. This dissertation presents the histories and circumstances of the first twelve paintings claimed by the organization in the context of the broader history of Nazi-looted art between 1933-2012. Organized into thematic chapters, the dissertation documents how, by following a carefully devised approach of moral persuasion that combines practices like publicity, provenance studies, law enforcement, and legal precedents, the Max Stern Art Restitution Project set international precedents in the return of cultural property.

    AUTHENTICATION IN ART Art News Service Art Law: Expert Found Liable For Opinion On Fake Max Ernst Painting Peter Bert Posted on May 28, 2013 Le Monde reported yesterday that art historian and former Centre George Pompidou director Werner Spies had been ordered to pay damages in the order of EUR 650,000 to the purchaser of a painting. Tremblement de terre purportedly was a work of Max Ernst. Spies, a world-leading expert on Max Ernst and Pablo Picasso, had, according to the Tribunal de grande instance de Nanterre, authenticated the painting and delivered an expert opinion on which the purchaser had relied. Tremblement de terre, however, turned out to be fake. It had been produced by Wolfgang Beltracchi, the man at the centre of Germany’s biggest art scandal for decades. The Economist, in an article at the end of last year, concluded that “fear of litigation is hobbling the art market“. The Economist looked at the reactions of various foundations and authentication boards to the rising litigation risk, with most of the examples being drawn from the United States. There, the Andy Warhol Foundation dissolved its authentication board as a result of enormous legal costs incurred in defending claims by collectors. The Keith Haring Foundation stopped authenticating works, as did the Roy Lichtenstein Foundation. This new French judgment and a similar judgment by the District Court (Landgericht) Cologne of September 2012 which held auction house Lempertz liable over a fake Heinrich Campendonk painting, also by Beltracchi, appear to indicate that in Europe, in the wake of the Beltracchi scandal, the legal risks to experts and auction houses are also increasing.
