Replies to the Migration and Resettlement Memo in the
ABD Inspection between 15th to 22nd May. 2017 Questions related to LAR
20. Qinzhou subproject: As is known by the Inspection Delegation, land acuquisition, except the demolition of the 3 houses along the Road No. 3 still under disgussion, has been completed. Based on the “one household one construction slot” policy, 129 houses in the migration resettlement spot are ready for reconstruction. Besides, 77 apartments are meanwhile provided to affected households. Reply: As far as the 3 households along Road No. 3 are concerned, negotiation is still in progress.
21. ADB funding will be extended to the construction of 700 meters on No. 2 Road extension. Related LAR can be handled with the original No. 2 Road together. The due diligence report had been completed prior to January 2017. The improvement of the Binhai Lu (coastal highway) is now listed as new subprojuct. 114 mu collective land and 52 households will be affected. All AHs wang to acquire their reconstruction slot in a same resettlement spot. Prior to 30th, June, 2017, the base and the ground floor of 1500 resettlement slot will be completed. Inventory and surveying statistics and updated LAR plan has been submitted. The inspection delegation reminded an another amount of 30 million CNY shall be on schedule to ensure the progress of the project. Reply: The preparation for the construction of 700 meters on No. 2 Road extension and the improvement of the Binhai Lu (coastal highway) is being organized. LAR work has not begun yet.
22. Fangchenggang-jiangshan subproject: Land acquisition within the red line has been completed. But the housing demolition and resettlement for Honghua Road construction is slow, because the 25 AHs, this time influenced by the Jiangshan Overbridge, are involved in a second resettlement in a short time, it is now rather difficult for the two sides to reach a consensus. The IA will change the design of the bridge in the project, so as to settle the problem. Prior to the April 2017, 97 households are to move, among which 83 households has signed the resettlement agreement. The negotiation with the rest 14 households affected will also be completed before 31st, May, 2017. Agreement has been reached on the LAR with the gas station (K12+900) and the local police station (K12+700). The delegation acknowledges the progress on the house demolition work in the project while emphasizes more attention on the construction of the Resettlement Spot. Also, the delegation expressed the necessity of an updated LAR plan in time, to ensure the construction of resettlement within the time limit of the project. In addition, the inspection delegation plans to use the remenant of the fund for the upgrading of the Dongxing Dadao, on condition that the due diligence report excludes the possibility of LAR. Reply: The progress of land acquisition is encouraging, with only five households to move. Although the updated design has been approved, the land acquisition concerning the Jiangshan Gas Station is not settled yet. The municipal government is now helping settling the LA concerning the Jiangshan Police Station. All house demolition work are expected to
complete before 15th of September. The widening and upgrading of Dongxing Dadao will not involve any land acquisition.
23. Maoling subproject in Fangchenggang: The land needed shrinks to 56.4 mu, among which 38.6 mu will be acquired for Wastewater Treatment Plant and Sewerage Network. 33.2 mu land had been acquired and land leveling work had been completed before 2015. But the deligation was informed that the rest 4.5 mu land has not been acquired due to the compensation dispute with the AHs. A lasting compensation problem unsolved may lead to the delay of the construction and the whole project. Considering the proposal from the IA about using the domestic fund for the above mentioned subproject, the delegation would like to point out that even if the domestic fund is to used in the construction, since the sub is still in the coverage of the ADB, the rest part of LAR will also be conducted under the supervision of ADB. Reply: The land dispute on the remaining 5.4 mu has not been settled yet. The main reason is that the APs did not know that land acquired will be used for the construction of wastewater treatment plant, the start of the construction would help to solve the problem.
24. For the next phase, the Resettlement, Monitoring and Evaluation Report shall focus on the preparation and distribution of the homestead construction slot, as well as the land compensation dispute concerning the Maoling Wastewater Treatment Plant. PMO agrees that the report, including gender action program and social action program, can be submitted before 30th, September, 2017 and 31st, March, 2018. Reply: The evaluation and the report will be completed as required.

1.1 Project Description
The Asian Development Bank (ADB) financed Guangxi Beibu Gulf Cities Development
Project (loan number: 2821-PRC, hereinafter referred to as the "project") consists of municipal
infrastructure construction projects in the southwestern cities of Fangchenggang, Qinzhou City,
Beihai City; consulting services and a training and capacity building sub-project package. This
project as a total invests of US$ 406.8 million, including the ADB loans, US$ 0.2 billion. Three
city sub-project implementation units are shown in table 1-1. The three project component
locations and main impacts are shown in Table 1-2.

Total land acquisition involves 4910.02 Mu, affecting 20 communities (Villages), 2 enterprises, 1456 households, 6394 people and 101 households nonresidentially affected. The total resettlement expenditure estimated is CNY 492,590,000. See Table 1-3.

1.2 Resettlement Policy and Framework
The project land acquisition and resettlement (LAR) is implemented on PRC’s and local governments’ relevant laws, regulations and policies, and requirements of Asian Development Bank (ADB) involuntary resettlement. The laws and regulations include: (i) State Council Document 28: State Council Decision to Deepen Reform and Strictly Enforce Land Administration (2004); (ii) Implementation Stipulations of Land Administration Law of PRC (1998); (iii) Land Administration Law of Guangxi Zhuang Autonomous Region (GZAR); (iv) GZAR Guidelines for Implementation of the Urban House Demolition Management Regulation of the PRC; and (v) local relevant laws and regulations.
The LAR purpose is to improve APs’ living standard which is at least not lower due to land acquisition. The principle of the compensation and entitlements established for the Project are as follows: (i) compensation and entitlements provided must be adequate to allow APs to at least maintain their pre-project living standard, with the prospect of improvement; (ii) compensation and entitlements provided are based on market value or replacement value and must be adequate; (iii) the area and duration of temporary land occupation should be reduced to the minimum; (iv) lands occupied and structures or attachments built after the deadline regulated by local government will not be compensated; (v) adequate compensation should be provided to the APs timely; (vi) all the APs should be adequately informed about compensation rates and standards, livelihood and income restoration plans and project progress; and (vii) close monitoring and timely actions should be carried out to identify and resolve any problems.
1.3 Progress of Resettlement Implementation
By 31st, July., 2017, Land acquisition had been competed 97.8%, ie. 4804.13 mu. Sufficient progress has been made in house demolition and relocation. A summary of resettlement progress of each project component is listed in Table 1-4.

1.4 External Monitoring and Evaluation on Resettlement
Shanghai Yiji Construction Engineering Consulting Company is an individual external resettlement monitor for the Project. By 31st july, 2017, eight external resettlement monitoring and evaluation (M&E) were completed.

1) Follow-up investigation of the production and livelihood of villages and villagers affected by land acquisition and house demolition for a better understanding of the progress of land acquisition and the restoration of production and livelihood of APs; 2) Follow-up investigation of enterprises/undertaking units affected by land acquisition and house demolition for a better understanding of LAR impacts on those units and the restoration of production and operation; 3) Understanding of the progress of land acquisition, house demolition, compensation and relocation, and conducting external resettlement monitoring and evaluation against RPs; 4) Collection of APs’ opinions: interview affected villagers, staff of affected enterprises and resettlement implementation units, as well as APs having complaints, for a better understanding of APs’ opinions; informing project resettlement and land acquisition offices about the opinions and suggestions of APs and affected enterprises; providing suggestions to help improving resettlement with smoother and more effective land acquisition and house demolition. 5) Investigation in the temporary land acquisition 6) Investigation in the distribution and usage of the compensation 7) Investigation in the restoration of the life of people affected 8) Investigation in the construction of the resettlements 9) Investigation in the help to the vulnerable group 10) Investigation in the consultant and participation of the public 11) Investigation in complain handling 12) Investigation in the implementation of mitigation measures
