The powers and duties of officers and employees Commissioner of Police (a) In exercise of the powers conferred by section 6 of the Calcutta Police Act, 1866 (Bengal Act IV of 1866), and by section 18 of the Code of Criminal Procedure, 1898 (Act V of 1898), the State Government appoints the Commissioner to be a Presidency Magistrate in Calcutta and empowers him to sit singly as a Presidency Magistrate. (b) The State Government vests the Commissioner with the powers of a Magistrate of the First Class to be exercised within the limits of the suburbs of Calcutta. The said powers shall be exercised by him for preserving the peace, preventing and detecting crime, apprehending and detaining offenders in order to their being brought before a Magistrate and for the performance of any other duties imposed upon him by any law for the time being in force. (c) In exercise of the powers conferred by sub-section (1) of section 144 of the Code of Criminal Procedure, 1898 (Act V of 1898), the State Government vests the Commissioner with the power to issue orders under section 144 of the Criminal Procedure Code in the town and the suburbs of Calcutta.
