James P. Lyons, described Thomas Aquinas’s importance in the study of marriage as follows: Saint Thomas and his school have perhaps done more than any other theologians to clarify the structure of marriage and to indicate its place in the divine order of things . But beyond this, Thomism has a special value in a study of marriage, and especially in a study of the philosophical note of the essential structure of marriage. For Thomism is, par excellence, [quoting Gilson] ‘the theology of the natural.’1 Lyons also quotes L. Misserey who commented on the French translation of the Supplement to the Summa Theologiae, “Without any exaggeration one can say that Saint Thomas has laid out for future generations the diagram of Christian marriage.”2 In fact, it would not be inaccurate to say that until the 1960s, Saint Thomas’s doctrine of marriage was considered synonymous with official Catholic teaching. The Dismissal of Thomistic Marriage Theology However, since mid-century the prevalent social tumult has largely conduced to the rejection of Saint Thomas’s treatment of marriage. The same forces that militated against the Church’s perennial teaching singled out Saint Thomas in particular. In his 1993 article, “Le remedium concupiscentiae comme fin du mariage,” Theo Belmans, O. Praem., catalogues numerous scholars and theologians spanning the 20th century who criticized Saint Thomas’s teaching on matrimony.3 Belmans’s more extensive work, Le sens objectif de l’agir humain: pour relire la morale conjugale de Saint Thomas, appearing as it did 1 J.P. Among the authors Belmans cites as directly rejecting or contradicting Aquinas’s teaching are H. Doms, J. Fuchs, Bernhard Haering, J.-M. Aubert, B. Krempel, L. Janssens, Richard McCormick, John Noonan, M. Mueller, D. M. Pruemmer, to name only a few; Belmans traces the roots of this movement to the 19th century work of F. X. Linsenmann. 1 toward the end of the period of greatest tumult and confusion, contains an even more exhaustive list of opponents of Saint Thomas on this subject.4 Undoubtedly part of the reason for this antagonism was the very fact that Saint Thomas was identified with Church teaching. The comprehensiveness that made him universally praised and consulted up until that time brought him under attack afterward. Certainly his very emphasis on order and law

He was thinking, he said, of the Jesuit scholar Norris Clarke, whose phil- osophical work aimed at showing how Thomas Aquinas could make sense even of the process philosophers Alfred North Whitehead and Charles Hartshorne. At Fordham University my then-girlfriend Cathy (now my wife) would take me to lunch with Father Clarke, then in his late eighties, a spry gnome-like character who would re- gale us with his intellectual adventures of bringing St. Thomas to every conceivable endeavor. Upon his mentioning a lunch date with the Dalai Lama, I asked him what he had said. Father Clarke looked at us and said very seriously, “I told him, ‘You have wonderful medi- tative practices, but your metaphysics are terrible!’” The Thomist of the Strict Observance then attempted, well, to enlighten him. I’m not sure I agreed with everything Father Clarke said about metaphysics or Thomas Aquinas, but that impulse to bring Thomism to bear on intellectual projects and problems out there in the world was remarkable to me. The tribe of old-fashioned Thomists is often logos 21:4 fall 2018 6 logos fiercely protective of their master in such a way as to ward off any- body attempting to bring him out of the thirteenth, the greatest of centuries, and into our own milieu. I do not doubt the intellectual seriousness, the learning, or the rigor of their work.

    THE 1962 VATICAN INSTRUCTION “CRIMEN SOLLICITATIONIS,” PROMULGATED ON MARCH 16, 1962 Observations by Thomas Doyle, O.P., J.C.D. November 1, 2006 1. The recently revealed (2003) Vatican document outlining the procedures for dealing with cases of solicitation of sex by priest-confessors has caused a swell of alarm and surprise on the part of survivors, attorneys and others. 2. This document was issued by the Congregation of the Holy Office in March, 1962. It was presented by the Prefect, Alfredo Cardinal Ottaviani, to Pope John XXIII for the Pope’s approval. This is the normal manner of receiving Papal approval for documents of this nature. It was then sent to all the bishops in the world. The bishops were admonished to maintain strict confidentiality about the document and ordered not to allow it to be reproduced or commented upon. 3. Crimen Sollicitationis remained in effect until 2001 when the Vatican published a new set of procedures for prosecuting especially grave canonical crimes, including certain sexual crimes committed by the clergy. Two official documents were issued. The first was an apostolic letter of Pope John Paul II, known by its Latin title Sacramentorum sanctitatis tutela, by which the actual norms were promulgated. This letter, dated April 30, 2001, was followed on May 18, 2001 by an official document that set forth the norms. This latter document was signed by Cardinal Josef Ratzinger, prefect of the Congregation for the Doctrine of the Faith. Both documents refer to certain serious canonical crimes and among those is sexual abuse by clerics. These documents represent revised procedures to be used by Bishops and major religious superiors in response to allegations of clergy sexual abuse.

Malebranche's Augustinianism and the Mind's Perfection Abstract This dissertation presents a unified interpretation of Malebranche’s philosophical system that is based on his Augustinian theory of the mind’s perfection, which consists in maximizing the mind’s ability to successfully access, comprehend, and follow God’s Order through practices that purify and cognitively enhance the mind’s attention. I argue that the mind’s perfection figures centrally in Malebranche’s philosophy and is the main hub that connects and reconciles the three fundamental principles of his system, namely, his occasionalism, divine illumination, and freedom. To demonstrate this, I first present, in chapter one, Malebranche’s philosophy within the historical and intellectual context of his membership in the French Oratory, arguing that the Oratory’s particular brand of Augustinianism, initiated by Cardinal Bérulle and propagated by Oratorians such as Andre Martin, is at the core of his philosophy and informs his theory of perfection. Next, in chapter two, I explicate Augustine’s own theory of perfection in order to provide an outline, and a basis of comparison, for Malebranche’s own theory of perfection.

    Aquinas and the Cry of Rachel John F. X. Knasas Suffering and Hope Conference University of St. Thomas November 10-13, 2005 I examine Jacques Maritain’s critique of a Thomistic explanation of suffering from his 1942 Marquette Aquinas Lecture, St. Thomas and the Problem of Evil.1 In sum, at Summa Theologiae I, 48, 2c, Aquinas argues that God permits evils for the perfection of the universe. Evils are the concomitant of corruptible things. And corruptible things belong to the perfection of the created order which requires every grade of goodness. Using the Biblical personage of Rachel, who has lost her children to the soldiers of King Herod, Maritain poignantly observes that Aquinas’ reason would never satisfy a mother suffering the loss of her child. What can be the value of the perfection of the universe in comparison to the loss of a young and innocent human being? And so, according to Maritain, one must balance 48, 2, with Summa Contra Gentiles III, 112, in which Aquinas describes the rational creature as a person.2 This description means that the rational creature is more like a whole than a part thereof. Hence, in the perspective of the human as person, Martian concludes that human suffering is “an utter anomaly”3 that is better understood as the unfortunate result of the rational creature’s free refusal of divine love, i.e., as a result of original sin. In my opinion, neither of Maritain’s two reasons hold. First, SCG III, 112, never ascribes to humans the exalted sense of person used by Maritain.

TE VELDE A distinctive feature of Aquinas's Summa contra Gentiles is the central role the author assigns to natural reason in his project of manifesting the truth of Christian faith. Reason is supposed to give a rational account of the truth of what faith professes about God, to arrive at a veritas demonstrative!,) which will be shown to accord with the Christian religion. It is mainly because of this emphatic and what seems to be a rather presumptuous role of natural reason that the work has occasioned so much discussion and, consequently, diversity of opinion among the interpreters of Aquinas's thought. Is the Contra Gentiles, insofar as reason is the leading principle of the investigation, to be regarded as a kind of 'philosophical' summa) as it was sometimes labeled in the past? The objection immediately arises that the fourth book explicitly deals with those truths of faith which are above reason. And further, on account of its declared subject-matter—the truth of the Catholic faith—it seems unmistakably a theological work or, more exactly, a work in which the truth of Christian faith is expounded and defended. Those who stress the theological character of the work, a work written from the point of view of faith, usually refer to what seems to be the original title: "On the Truth of the Catholic Faith against the Errors of the Infidels."1 1. The faithful of every genera- tion must determine what it means for them to be bound by a law of love. To begin with, Christians need a good idea of whatC love is. They need a conception that is informed by the tradition and by the best and worst of their own experiences, which they re- flect upon in light of broader humanistic and scientific inquiry. Without an adequate conception of love, one cannot meaningfully say that one is acting from obedience to the love command, choosing to act in light of love as an end, acting from love as a motive, or seek- ing to become a more loving person. CHRISTIAN ETHICS OF LOVE The language of love appears frequently in the history of Christian thought, but prior to the 20th century few thinkers sought to define love or specify how it is best conceived by persons who identify as Christians.1 Over the past century, more attention has been focused on clarifying what love is, sorting out its various forms, and arguing about which form best represents the Christian ideal.

    SACRAMENTORUM SANCTITATIS TUTELA POPE JOHN PAUL II APOSTOLIC LETTER GIVEN MOTU PROPRIO by which are promulgated Norms concerning the more grave delicts reserved to the Congregation for the Doctrine of the Faith The Safeguarding of the Sanctity of the Sacraments, especially the Most Holy Eucharist and Penance, and the keeping of the faithful, called to communion with the Lord, in their observance of the sixth commandment of the Decalogue, demand that the Church itself, in her pastoral solicitude, intervene to avert dangers of violation, so as to provide for the salvation of souls “which must always be the supreme law in the Church” (Codex Iuris Canonici, can. 1752). Indeed, Our Predecessors already provided for the sanctity of the sacraments, especially penance, through appropriate Apostolic Constitutions such as the Constitution Sacramentum Poenitentiae, of Pope Benedict XIV, issued June 1, 1741;[1] the same goal was likewise pursued by a number of canons of the Codex Iuris Canonici, promulgated in 1917 with their fontes by which canonical sanctions had been established against delicts of this kind.[2] In more recent times, in order to avert these and connected delicts, the Supreme Sacred Congregation of the Holy Office, through the Instruction Crimen sollicitationis, addressed to all Patriarchs, Archbishops, Bishops, and other local Ordinaries “even of an Oriental Rite” on March 16, 1962, established a manner of proceeding in such cases, inasmuch as judicial competence had been attributed exclusively to it, which competence could be exercised either administratively or through a judicial process.
