INTRODUCTION [2] The appellant claims to have a well-founded fear of being persecuted in Iraq on account of his former Ba’ath Party membership in the rank of Naseer Mutakadim, and due to his father’s position as Branch Member of the al-Amed Organisation for the Ba’ath Party in City A. He fears persecution at the hands of members of the Mahdi Army – a Shi’a militia group in Iraq, the police who collaborate with them, and the Iraqi Government that is infiltrated by militias. [3] The principal issues to be determined in this appeal are the well- foundedness of the appellant’s fears and whether he can genuinely access meaningful domestic protection. 2 THE APPELLANT’S CASE [4] What follows is a summary of the appellant’s evidence in support of his claim. It will be assessed later in this decision. Background [5] The appellant is a single man in his early-30s. He was born in Suburb A in City A. He is one of three children, the youngest of two boys. -

IRAQ 2019 HUMAN RIGHTS REPORT EXECUTIVE SUMMARY Iraq is a constitutional parliamentary republic. The 2018 parliamentary elections, while imperfect, generally met international standards of free and fair elections and led to the peaceful transition of power from Prime Minister Haider al-Abadi to Adil Abd al-Mahdi. On December 1, in response to protesters’ demands for significant changes to the political system, Abd al-Mahdi submitted his resignation, which the Iraqi Council of Representatives (COR) accepted. As of December 17, Abd al-Mahdi continued to serve in a caretaker capacity while the COR worked to identify a replacement in accordance with the Iraqi constitution. Numerous domestic security forces operated throughout the country. The regular armed forces and domestic law enforcement bodies generally maintained order within the country, although some armed groups operated outside of government control. Iraqi Security Forces (ISF) consist of administratively organized forces within the Ministries of Interior and Defense, and the Counterterrorism Service. The Ministry of Interior is responsible for domestic law enforcement and maintenance of order; it oversees the Federal Police, Provincial Police, Facilities Protection Service, Civil Defense, and Department of Border Enforcement. Energy police, under the Ministry of Oil, are responsible for providing infrastructure protection. Conventional military forces under the Ministry of Defense are responsible for the defense of the country but also carry out counterterrorism and internal security operations in conjunction with the Ministry of Interior. The Counterterrorism Service reports directly to the prime minister and oversees the Counterterrorism Command, an organization that includes three brigades of special operations forces. The National Security Service (NSS) intelligence agency reports directly to the prime minister. -

Humud Analyst in Middle Eastern and African Affairs March 9, 2016 Congressional Research Service 7-5700 www.crs.gov RS21968 Iraq: Politics and Governance Summary Iraq’s sectarian and ethnic divisions—muted toward the end of the 2003-2011 U.S. military intervention in Iraq—are fueling a major challenge to Iraq’s stability and to U.S. policy in Iraq and the broader Middle East region. The resentment of Iraq’s Sunni Arabs toward the Shiite- dominated central government facilitated the capture in 2014 of nearly one-third of Iraqi territory by the Sunni Islamist extremist group called the Islamic State (IS, also known as ISIL, ISIS, or the Arabic acronym Da'esh). Iraq’s Kurds are separately embroiled in political, territorial, and economic disputes with Baghdad, but those differences have been at least temporarily subordinated to the common struggle against the Islamic State. U.S. officials assert that the Iraqi government must work to gain the loyalty of more of Iraq’s Sunnis—and to resolve differences with the Kurdistan Regional Government (KRG)—if an eventual defeat of the Islamic State is to result in long-term stability. Prospects for greater inter- communal unity appeared to increase in 2014 with the replacement of former Prime Minister Nuri al-Maliki with the current Prime Minister, Haydar al-Abbadi. Although both men are from the Shiite Islamist Da’wa Party, Abbadi has taken some steps to try to compromise with Sunnis and with the KRG. However, a significant point of contention with the KRG remains the KRG’s marketing of crude oil exports separately from Baghdad. -

Therefore, the conflict "is a competitive situation in which the parties are aware of the inconsistencies and inconsistencies of positions and visions." John GALTHUNG (conflict triangle): The conflict is seen as an equilateral triangle, and it is called the three corners of its sides: angle of contradiction, angle of perception, angle of behavior. A - Contradiction: The situation that crystallizes the incompatibility of goals and interests between the parties. B) Perception: refers to the process of conceptualizing misconceptions about themselves (vision), and perception of each other. Behavior refers to the crystallization of contradiction and narration into behavior on the ground, usually embodied in the form of threat or oppression and the use of armed violence (war). The Department of Defense (DOD) regularly updates total U.S. military death and wounded statistics from Operation Iraqi Freedom (OIF), as reflected in CRS Report RS21578, Iraq: Summary of U.S. Casualties. However, no Iraqi or U.S. government office regularly releases statistics on Iraqi civilian deaths, Iraqi police deaths, or Iraqi security forces deaths. Statistics on these topics are sometimes available through alternative sources, such as nonprofit organizations, or through statements made by officials to the press. Many of the estimates included in this report are incomplete or have been released by non-governmental sources. Because these estimates are based on varying time periods and have been created using differing methodologies, readers should exercise caution when using these statistics and should look on them as guideposts rather than as statements of historical fact. This report will be updated as needed. Country Policy and Information Note Iraq: Actors of protection Version 1.0 December 2020 Preface Purpose This note provides country of origin information (COI) and analysis of COI for use by Home Office decision makers handling particular types of protection and human rights claims (as set out in the Introduction section). It is not intended to be an exhaustive survey of a particular subject or theme. It is split into two main sections: (1) analysis and assessment of COI and other evidence; and (2) COI. These are explained in more detail below. Assessment This section analyses the evidence relevant to this note – i.e. the COI section; refugee/human rights laws and policies; and applicable caselaw – by describing this and its inter-relationships, and provides an assessment of, in general, whether one or more of the following applies: • A person is reasonably likely to face a real risk of persecution or serious harm • The general humanitarian situation is so severe as to breach Article 15(b) of European Council Directive 2004/83/EC (the Qualification Directive) / Article 3 of the European Convention on Human Rights as transposed in paragraph 339C and 339CA(iii) of the Immigration Rules • The security situation presents a real risk to a civilian’s life or person such that it would breach Article 15(c) of the Qualification Directive as transposed in paragraph 339C and 339CA(iv) of the Immigration Rules • A person is able to obtain protection from the state (or quasi state bodies) • A person is reasonably able to relocate within a country or territory • A claim is likely to justify granting asylum, humanitarian protection or other form of leave, and • If a claim is refused, it is likely or unlikely to be certifiable as ‘clearly unfounded’ under section 94 of the Nationality, Immigration and Asylum Act 2002. -

Overview The literature on improving security in Iraq is mostly focused on military analysis with relatively few insights and recommendations to be found on improving formal policing and the government systems that underpin them. Research for this report was unable to find literature on informal policing mechanisms with the exception of some recommendations relating to private security companies and ethnic militia. This annotated bibliography, therefore, looks at a range of material on security and policing and identifies key messages and recommendations from it. Much of the material is from a small number of US-based experts and tends to not reflect the current context but instead provides general suggestions for approaches to reform. Within the literature there seems to be a number of common themes and recommendations: . Supporting the judiciary and improving investigative capability: There is a need for greater security for the judiciary and improving legal education and the capacity of lawyers, as well as greater support for investigative capacity (US Department of Defense, 2010; Perito & Kristoff, 2009). In particular there was the suggestion of greater investigation, prosecution and conviction following attacks on minorities (Chapman, 2012). Improving police-community relations: This can be through setting up joint committees with representatives from both the police and the community (Chapman, 2012). Some organisations and authors support a shift towards community policing (IOM, 2014; Santana, 2008).
