STATEMENT OF REASONS
DISABLED STREET PARKING – BANFF AND BUCHAN AREA
In order to comply with the Disabled Persons’ Parking Places (Scotland) Act 2009, Aberdeenshire Council are required to regularly update the 6 Aberdeenshire disabled street parking area based orders detailing a current list of on-street disabled parking spaces in that area. DISABLED STREET PARKING – BANFF AND BUCHAN AREA
“The Aberdeenshire Council (Disabled Street Parking – Banff and Buchan Area) Order, 2015” is being proposed in accordance with the Disabled Persons’ Parking Places (Scotland) Act 2009 and the Road Traffic Regulation Act, 1984.
The order will amend the current Disabled Street Parking Banff and Buchan Area Order by adding/deleting disabled persons’ parking places for that area. All on-street disabled residents’ spaces in the area will be covered by the order as required by the Disabled Persons’ Parking Places (Scotland) Act 2009 and indicated in the Schedule below. The effect of the order will be to make it an offence for anyone to park in the marked disabled person’s spaces unless they are the holder of a valid blue badge and are using it in accordance with the terms of the national blue badge legislation.

THE ABERDEENSHIRE COUNCIL (DISABLED STREET PARKING – BANFF AND BUCHAN AREA) ORDER, 2015
Aberdeenshire Council, in exercise of the powers conferred upon it under the Road Traffic Regulation Act 1984, and of all other enabling powers, and after consultation with the Chief Constable in accordance with Part III of Schedule 9 to the Act of 1984, hereby makes the following order:-
1. This order may be cited as “The Aberdeenshire Council (Disabled Street Parking – Banff and Buchan Area) Order, 2015”, and shall come into operation on
2. The street parking places specified in Schedule One to this order shall only be used by a disabled persons’ vehicle within the meaning of Section 14 of the Disabled Persons’ Parking Places (Scotland) Act 2009.
3. The street parking places specified in Schedule Two to this order which were included in “The Aberdeenshire Council (Disabled Street Parking – Banff and Buchan) Order, 2014” shall no longer be classed as street parking places that can only be used by a disabled persons’ vehicle and shall hereby be revoked from the date this order comes into effect.
