The purpose of these documents is to provide information about the Government’s fiscal intentions for the year ahead and the wider fiscal and economic picture. The documents released on Budget day are as follows: Budget at a Glance The Budget at a Glance is an overview of the Budget information and contains the main points for the media and public. This summarises the Government’s spending decisions and key points raised in the Budget Speech, the Wellbeing Budget 2021, and the Budget Economic and Fiscal Update. Wellbeing Budget 2021 The Wellbeing Budget 2021 is the main source of Budget information. It sets out the Government’s priorities for the Budget, the approach taken to develop it, and a summary of all initiatives included in Budget 2021. It also contains reports on fiscal strategy and child poverty, as required by the Public Finance Act 1989. These outline respectively the Government’s short-term fiscal intentions and long-term fiscal objectives, and how the Government is progressing towards its child poverty targets. The Summary of Budget Initiatives document is included as an annex. Budget Speech The Budget Speech is the Budget Statement the Minister of Finance delivers at the start of Parliament's Budget debate. The Budget Statement generally focuses on the overall fiscal and economic position, the Government’s policy priorities and how those priorities will be funded. -

Introduction to volume 1 The Senators, the Senate and Australia, 1901–1929 By Harry Evans, Clerk of the Senate 1988–2009 Biography may or may not be the key to history, but the biographies of those who served in institutions of government can throw great light on the workings of those institutions. These biographies of Australia’s senators are offered not only because they deal with interesting people, but because they inform an assessment of the Senate as an institution. They also provide insights into the history and identity of Australia. This first volume contains the biographies of senators who completed their service in the Senate in the period 1901 to 1929. This cut-off point involves some inconveniences, one being that it excludes senators who served in that period but who completed their service later. One such senator, George Pearce of Western Australia, was prominent and influential in the period covered but continued to be prominent and influential afterwards, and he is conspicuous by his absence from this volume. A cut-off has to be set, however, and the one chosen has considerable countervailing advantages. The period selected includes the formative years of the Senate, with the addition of a period of its operation as a going concern. The historian would readily see it as a rational first era to select. The historian would also see the era selected as falling naturally into three sub-eras, approximately corresponding to the first three decades of the twentieth century. The first of those decades would probably be called by our historian, in search of a neatly summarising title, The Founders’ Senate, 1901–1910. -

377 Bicameralism in the New Zealand context Andrew Stockley* In 1985, the newly elected Labour Government issued a White Paper proposing a Bill of Rights for New Zealand. One of the arguments in favour of the proposal is that New Zealand has only a one chamber Parliament and as a consequence there is less control over the executive than is desirable. The upper house, the Legislative Council, was abolished in 1951 and, despite various enquiries, has never been replaced. In this article, the writer calls for a reappraisal of the need for a second chamber. He argues that a second chamber could be one means among others of limiting the power of government. It is essential that a second chamber be independent, self-confident and sufficiently free of party politics. I. AN INTRODUCTION TO BICAMERALISM In 1950, the New Zealand Parliament, in the manner and form it was then constituted, altered its own composition. The legislative branch of government in New Zealand had hitherto been bicameral in nature, consisting of an upper chamber, the Legislative Council, and a lower chamber, the House of Representatives.*1 Some ninety-eight years after its inception2 however, the New Zealand legislature became unicameral. The Legislative Council Abolition Act 1950, passed by both chambers, did as its name implied, and abolished the Legislative Council as on 1 January 1951. What was perhaps most remarkable about this transformation from bicameral to unicameral government was the almost casual manner in which it occurred. The abolition bill was carried on a voice vote in the House of Representatives; very little excitement or concern was caused among the populace at large; and government as a whole seemed to continue quite normally. -

February 27, 1969 MEMORANDUM OPINION FOR THE STAFF ASSISTANT TO THE COUNSEL TO THE PRESIDENT The immediate question facing the President is what position he should take with respect to the Watershed Protection and Flood Prevention Act enacted in 1954 (Pub. L. No. 83-566, 68 Stat. 666). Between 1954 and 1966 several hundred watershed projects were processed under this law. In 1966 the Johnson Admin- istration objected on constitutional grounds to a provision of the Act requiring committee approval of project plans before appropriations are made. The section provides: No appropriation shall be made for any plan involving an estimated Federal contribution to construction costs in excess of $250,000, or which includes any structure which provides more than twenty-five hundred acre-feet of total capacity unless such plan has been ap- proved by resolutions adopted by the appropriate committees of the Senate and House of Representatives . Id. § 2 (as amended, codified at 16 U.S.C. § 1002(2)). President Johnson submit- ted a bill to Congress to repeal this section and to substitute a provision requiring the Executive to report projects to the committees 30 days before work could be begun. This legislation was not enacted. It is our understanding that, pursuant to President Johnson’s instruction, numerous proposed watershed projects have been held in abeyance despite the fact that the congressional committees approved the projects and that non-itemized funds were appropriated by Congress. -

4 The crisis of 1974–75 In 1975, Australia experienced the most discussed and most important constitutional crisis in the history of the Commonwealth.60 In its immediate aftermath, Howard (1976: 5) concluded that the crisis had precipitated ‘a fundamental redistribution of power between the two Houses of the national parliament and between Parliament and the executive.’ In retrospect, his assessment has proven to be exaggerated. It is doubtless true, however, that the crisis has continued to reverberate through the thinking of Australian politicians ever since. Even more than a quarter of a century later, the events of 1975 continue to evoke strong, sometimes passionate, reactions.61 The events of 1974 The December 1972 elections had produced the Labor Party (ALP) Government of Prime Minister Gough Whitlam, which enjoyed a secure though not overwhelming majority in the House of Representatives over the long-standing parliamentary coalition of the 60 For contemporaneous accounts, see Kelly (1976) and Oakes (1976); for the recollections and self-justifications of key participants, see Whitlam (1979), Kerr (1978), and Barwick (1983); for a retrospective account, see Kelly (1995). How the events of 1975 could have unfolded as they did has continued to intrigue political observers and scholars alike. In an otherwise captivating book on Australia in the Twentieth Century, for example, Philip Knightley (2000: 269–282) concludes that the CIA was complicit, and perhaps even instrumental, in a conspiracy that led to Whitlam’s ouster. But then Kelly (1976: 1) reports that Whitlam himself had raised the spectre of CIA involvement. 61 In 1991, more than 15 years after the events discussed here, a national survey of voters were asked whether the Governor-General had been right or wrong to dismiss the Whitlam Government. -

A rich picture is painted of this ongoing struggle through a case study of the Australian Greens with vivid descriptions presented on organisational leadership issues by Australian state and federal Green members of parliaments. What emerges from the data is the Australian Green MPs’ conundrum in retaining an egalitarian and participatory democracy ethos while seeking to expand their existing frame of leadership to being both more pragmatic and oriented towards active involvement in government. -

Sub-national Second Chambers and regional representation: International Experiences Submission to Kelkar Committee on Maharashtra By Rupak Chattopadhyay October 2011 The principle of the upper house of the legislature being a house of legislative review is well established in federal and non-federal countries like. Historically from the 17th century onwards, upper houses were constituted to represent the legislative interests of conservative and corporative elements (House of Lords in the UK or Senate in Bavaria or Bundesrat in Imperial Germany) against those of the ‘people’ as represented by elected lower houses (e.g. House of Commons). The United States became the first to use the upper house as the federating chamber for the country. This second model of bicameralism is that associated with the influential ‘federal’ example of the US Constitution, in which the second chamber was conceived as a ‘house of the states’. It has been said in this regard that federal systems of government are highly conducive to bicameralism in which a senate serves as a federal house whose members are selected to represent the states or provinces, with each constituent state provided equal representation. The Australian Senate was conceived along similar lines, with the Constitution guaranteeing each state, again regardless of its population, an equal number of senators. At present, the Australian Senate consists of 76 senators, 12 from each of the six states and two from each of the mainland territories.60 The best contemporary example of a second chamber which does, in fact, operate as an effective ‘house of the states’ is the German Bundesrat, members of which are appointed by state governments from amongst their members, with each state having between three and six representatives, depending on population.
