83 THE USE OF TANGATA WHENUA AND MANA WHENUA IN NEW ZEALAND LEGISLATION: ATTEMPTS AT CULTURAL RECOGNITION Catherine Iorns Magallanes* This paper discusses the range of uses of the phrases tangata whenua and mana whenua in New Zealand Acts, the issues that have arisen as a consequence, and identifies some suggestions for addressing those issues. Cet article analyse les différentes manières dont les expressions 'tangata whenua,' et 'mana whenua' sont utilisées dans les textes juridiques néo-zélandais. Most people find it impossible to separate language and identity. Language is perceived as the quintessence of a culture. It expresses a unique way of apprehending reality, capturing a world view specific to the culture to which the language is linked. But language is connected to identity in another important way: its presence and use in a community are symbolic of identity, emblems of group existence. Using a language is the ultimate symbol of belonging.1 Māori concepts hardly ever correspond exactly with those Western concepts which they appear, on the surface, to resemble. While there is a degree of overlap, there are usually divergences as well. Even if the denotation – the direct reference – is substantially the same, the connotations are significantly different. Commonly, several sentences of explanation are needed to deal adequately with the similarities and divergences. Totara Reserve REGIONAL PARK Totara Reserve Regional Park Guide to Tracks, Trails and Walks Camping Grounds Welcome to Fern Walk Totara Reserve The Fern Walk, opened in 2000, leads you through the most intact REGIONAL PARK part of the Reserve. You will enjoy kahikatea stands, nikau palm groves, and stunning examples of ancient totara, rimu and rata. Required fitness level – Moderate Walk duration – 3-4 hours Pettifar & Gilchrist Loop Tracks The Pettifar and Gilchrist Loop Tracks lead you down a series of terraces to the Pohangina River. You will pass through kahikatea- dominated forest in the wetter areas, and totara-dominated forest in drier areas. Both walks make use of the Old Coach Road, a section of the original horse and cart track along the Pohangina Valley. An abandoned tree nursery on the Gilchrist Loop Track was the source of most of the large poplars now visible throughout the Pohangina Valley. Required fitness level – Low-Moderate Walk duration – 1-2 hours for each loop track Nature Trails A network of trails behind the camping areas winds through the most varied vegetation in the Reserve. Special features include the ancient totara and matai, and one of the largest trees in the Reserve, located right alongside Churchill Drive! Required fitness level – Low Walk duration – 10 minutes -1 hour Toilet To Ashhurst Track Entrance Fern Walk At 350 hectares Totara Reserve is one of the last and largest remaining stands of the extensive forest that once covered much of the Manawatu Plains. A network of tracks takes you on a journey through the mixed podocarp forest with its tall canopy trees, shrub and forest floor communities, wide variety of birds and animals, and wonderful views of the Ruahine Ranges and Pohangina Valley. -

The reserve has recently become the Manawatu’s first regional park and the Council has responsibility for managing it. These changes require the existing asset management plan (Totara Reserve Management Plan 2009) to be reviewed and updated. The reviewed Asset Management Plan is an important document. Its overall purpose is to provide for the use, enjoyment, maintenance, protection and appropriate development of the reserve within available reserve resources. This provides the community with certainty about the future direction of Totara Reserve and enables Horizons Regional Council to manage it effectively. The reviewed Asset Management Plan has adjusted policy to reflect the vesting of the reserve in Horizons Regional Council and the Council’s management of the reserve. To recognise changes, the Council proposes renaming the reserve Totara Reserve Regional Park. -

Part B - Chapter 4: Tangata Whenua Issues 4 TANGATA WHENUA ISSUES 4.1 RESOURCE MANAGEMENT ACT OBLIGATIONS 4.1.1 It is mandatory for those exercising functions and powers under the RMA to “recognise and provide for the relationship of Maori and their culture and traditions with their ancestral lands, water, sites, waahi tapu, and other taonga" (s.6(e)); to "have particular regard to kaitiakitanga" (s.7(a)); and to “take into account the principles of the Treaty of Waitangi" (s.8). The RMA therefore clearly intends that tangata whenua should have a significant role in resource management and enables tangata whenua to take steps to protect their interests. 4.1.2 Principles of the Treaty of Waitangi, as generally sourced from the Waitangi Tribunal, of particular relevance to the preparation and operation of the District Plan include: (1) the principle of partnership; (2) the duty to consult; (3) the Crown’s obligation to actively protect Maori Treaty rights; and (4) the tribal right of self-regulation. 4.1.3 Section 33(1)(a) of the RMA provides, under certain conditions, for the transfer of functions by a local authority to a recognised Iwi Authority as defined in Section 2 of the Resource Management Act 1991. 4.1.4 Council has recognised a need to take special steps to ensure that tangata whenua concerns and interests are adequately identified before it makes decisions, which could affect these interests. For their part, tangata whenua in Wairoa District have clearly indicated through the consultation process that they desire to play a much greater role in managing the natural and physical resources of the District. -

Why is this important? In Australia, Aboriginal and Torres Strait Islander peoples have experienced a long history of exclusion from Australian history books, the Australian flag, the Australian anthem, and for many years, Australian democracy. This history of dispossession and colonisation lies at the heart of the disparity between Aboriginal and Torres Strait Islander and non-Indigenous Australians today. Incorporating welcoming and acknowledgement protocols into official meetings and events recognises Aboriginal and Torres Strait Islander peoples as the first Australians and Traditional Custodians of Country. It promotes an ongoing connection to place of Aboriginal and Torres Strait Islander Australians and shows respect for Traditional Custodians (source: Reconciliation Australia). In Aotearoa New Zealand, Te Tiriti o Waitangi (The Treaty of Waitangi) created the basis for settlement by the British and provided for the protection of the rights and property of Māori. Obligations under the treaty were not properly recognised and, in 1975, the Waitangi Tribunal was set up to look at breaches by the crown. The Waitangi Tribunal and courts have found that the Māori language — te reo — is a taonga (valued possession) protected by the Te Tiriti o Waitangi and that there is an obligation to take action to safeguard it. -

This article is an open access publication Abstract This paper reintroduces the concept of mass migration into debates concerning the timing and nature of New Zealand’s settlement by Polynesians. Upward revisions of New Zealand’s chronology show that the appearance of humans on the landscape occurred extremely rapidly, and that within decades set- tlements had been established across the full range of climatic zones. We show that the rapid appearance of a strong archaeological signature in the early 14th century AD is the result of a mass migration event, not the consequence of gradual demographic growth out of a currently unidentified earlier phase of settlement. Mass migration is not only consistent with the archaeological record but is supported by recent findings in molecular biology and genetics. It also opens the door to a new phase of engagement between archaeological method and indigenous Maori and Polynesian oral history and tradition. Accessed 14/01/20. ii PREFACE Casting a wary – and increasingly fatalistic – eye over the daily news, it is not a massive stretch to believe that humanity’s collective inheritance is a one-way ticket to hell in a handbasket. Indeed, the Enlightenment-era belief in humans’ inexhaustible capacity for progress and rationality seems more dubious by the day. If anything, many communities around the world appear worse off owing to the unjust and often deadly consequences of decisions made in a distant time or place. The sheer magnitude of acute global crises such as climate change, war, staggering poverty levels, and the cult of so-called ‘alternative facts’ can easily seem both incomprehensible and insurmountable. -

Marlborough’s tangata whenua iwi Introduction Section 62(1)(b)(i) of the Resource Management Act 1991 (RMA) requires resource management issues of significance to iwi authorities in Marlborough to be identified and included in a regional policy statement. As part of the process of preparing the Marlborough Environment Plan (MEP), a series of hui were held with Marlborough’s tangata whenua iwi 1 to determine the resource management issues of significance for them. Three distinct groups of issues were identified through process: • spiritual and cultural issues of fundamental importance that relate to iwi connection to and use of natural and physical resources; • relationship and process issues, including iwi involvement in decision making on resource consent applications and on developing policy to assist in Council’s decision making; and • issues of significance or concern for both iwi and the wider community, such as adequate waste management, transport issues and the protection of people and property from natural hazards, etc. Marlborough’s tangata whenua iwi recognise that all of these issues are interconnected. They believe that Marlborough’s natural and physical resources need to be managed in an integrated and holistic way to achieve a sustainable future. This chapter describes the first two issues and provides objectives and policies to address them. There is a high degree of agreement among Marlborough’s tangata whenua iwi on these issues. However, it is important to note that in
