Description of Proposed Development Construction of access road to facilitate further development of land zoned for Industry. 2. Site and Surrounding Area The site is located within existing zoned land as identified in the Derry Area Plan 2011 and within Zoning IND 5 - Campsey. The proposal is to extend the existing access into these lands. The site is located to the west of Campsey Industrial Estate and is accessed off McLean Road. It is bounded to the north by the vacant Fruit of the Loom factory. This flat undeveloped land is currently used for grazing sheep and fronts the Clooney Road to the south. To the south west of the site there is a dwelling at 80 Clooney Road. The site is adjacent to the White Horse Hotel and there is a Red Cross office unit which bounds the western side and is accessed off the Donnybrewer Road. Objections / Representations None received to date 6. Relevant Site History A/2007/0758/F, Construction of new access, Campsie New Lands, Courtauld Way, Londonderry. Approved 3/1/2008. This previous approval was for access into the site and the current proposal will continue this road access further into the site. 7. Policy Framework Derry Area Plan 2011 Strategic Planning Policy Statement for Northern Ireland (SPPS) (released Monday 28th September 2015) supersedes PPS 1 General Principles, however the guiding principle of what PPS 1 aimed to achieve in terms of public interest is supported through the SPPS. Planning Policy Statement 3 - Access, Movement and Parking Planning Policy Statement 4 - Planning and Economic Development 8. Consultee Responses Consultee responses: Transport NI – have no objections subject to a condition for private streets (see conditions under Section 11 of Report). Environmental Health – have no objections subject to a condition regarding construction works and deliveries to the site (see conditions under Section 11 of Report). Appendix 6 Health and Safety Executive and BGE (NI) - The application site is within the North West Gas Pipeline Consultation Zone. Health & Safety Executive (HSE) and BGE (NI) were consulted for their views. HSE have no objection to the development as the NW pipeline is 270 metres away from the proposal. BGE (NI) Gas suppliers confirmed that the proposal falls outside their permanent wayleave and will not compromise the safety and integrity of the pipeline. Figure 4: Access Road Details 9. Planning Assessment and Other Material Considerations Planning Policy Derry Area Plan 2011 Policy IND1 Assessment of Industrial Proposals. The scale of the development, any impact on amenity, heritage or nature conservation interest, the design and layout of the scheme, and whether the proposal is appropriate to the character of the area or settlement has been considered and there are no concerns and the access arrangements are acceptable. Appendix 6 Policy IND 3 Development within Existing Industrial Estates The Department will normally approve industrial development in existing industrial estates so as to make full use of existing infrastructure. This proposal will enable access into these lands for future industrial purposes. Policy IND 4 Environmental Impact The potential impact on the environment has been assessed and Environmental Health and the Health and Safety Executive have no issues. PPS 3 - Access, Movement and Parking. The proposal meets the planning policies for vehicular access and Transport Ni have no issues with the proposal subject to condition. PPS4 – Planning and Economic Development This Policy sets out the planning policies for economic development uses and indicates how growth associated with such uses can be accommodated and promoted in development plans. This proposal for access into lands zoned for industry will facilitate future economic growth in this area and meets the criteria in Policy PED9 – General Criteria for Economic Development. The site lies within Zoning IND 5 Campsey and comprises 20 hectares of flat land immediately to the north of Clooney Road. The proposal is an extension of an access already approved under planning application A/2007/0758/F. This approval has been implemented but has not yet been completed. This proposal will ensure a safe and convenient road system into a site that is zoned for industry. Any future infrastructure or development will be able to use the new access road and will ensure the convenient use of any industrial development. 10. Conclusion and Recommendation Having considered all material considerations, including the development plan, relevant planning policies and consultations, it is recommended to the Planning Committee that permission should be approved subject to the following conditions: 11. Conditions 1. As required by Section 61 (1) (a) of the Planning Act (Northern Ireland) 2011, the development hereby permitted shall be begun before the expiration of 5 years from the date of this permission. Reason: Time Limit 2. The Private Streets (Northern Ireland) Order 1980 as amended by the Private Streets (Amendment) (Northern Ireland) Order 1992. The Council hereby determines that the width, position and arrangement of the streets, and the land to be regarded as being comprised in the streets, shall be as indicated on Drawing No. 05Rev1 (503325GK/P05 Rev A) bearing the date stamp 15th June 2015. Reason: To ensure there is a safe and convenient road system within the development and to comply with the provisions of the Private Streets (Northern Ireland) Order 1980. Appendix 6 3. No construction works, or deliveries to site, shall be undertaken outside of the following hours: • Monday – Friday: 07.30 - 22.00 • Saturday: 09.00 - 22.00 And at no time on a Sunday. Reason: In the interest of residential amenity..
