3. SHELLFISH - GOALS AND OBJECTIVFS

3.1. To ensure conservation and protection of shellfish stocks coastwide through the application of scientific management principles.

3.2. To ensure the optimal use of shellfish stocks in order to meet social and economic objectives of the people of Canada.

3.3. To develop fishing plans consistent with principles of conservation, through a consultative process with users of the resource.

3.4. To preserve, enhance, restore and protect critical aquatic habitat for shellfish production.

3.5. To optimize the quality of shellfish harvested.

4. HISTORY OF THE GREEN SEA URCHIN FISHERY

The green sea urchin dive fishery began in 1987, and effort has increased steadily. Due to the patchy distribution of green sea urchins, most divers use SCUBA diving equipment. These small urchins are shipped whole and live to Japan. There has been occasional interest in processing them for "roe".

The fishery has been managed experimentally by a minimum size limit of 55 mm (now in regulation), limited seasons and quotas. The minimum size limit allows the urchins to spawn at least once before harvesting. There have been some Subarea closures in-season, on the advice of fishermen and from monitoring by fishery officers.

Effort has not been significantly reduced with licence limitation since 1991; total number of divers and diver hours remain high; average catch per unit effort continues to decline. The fishery had the highest landings in 1992, with 49 vessels reporting landings of 1042 t for a landed value of $ 4.4 million. The season length was reduced in all areas in 1993 and 4 days/week set in some areas. As a result total landings in 1993 were 693 t. The 1993 landed value per tonne increased by 29% over 1992 prices, with an average of $2.17/Ib paid to fishers.

Landings from the north coast in 1993 totalled 82 tonnes in 1993, primarily from the Prince Rupert district. Until 1992 most landings were from inside waters of Vancouver Island, primarily from Areas 12, 13, 18, and 19. Minor landings have been reported from the west coast of Vancouver Island, ie. Areas 20, 23, 24 and 27. There have been limited openings in 1992 and 1993, in subareas 12-1, 13-32,13-33 and 13-35, in the vicinity of Kelsey Bay, due to frequent landings of undersize urchins.

There is concern about the stock. Diver catch per unit effort has declined each year since 1989. Quotas were set in 1994 for the south coast (449 t) and further effort controls were recommended for 1995.

5. ENFORCEMENT PLAN

The Department of Fisheries and Oceans has recently reorganized into sector management resulting in the creation of an enforcement sector called Conservation and Protection. The Conservation and Protection Sector has the responsibility to enforce the Fisheries Act and associated regulations, to address conservation, health and safety issues and to maintain proper management and control of the various fisheries. Priorities in enforcement activities are discussed with users in the Sectoral Committee meetings and will be addressed during the 1995 season.

Users of the resource have a responsibility to report violations. Any suspected or actual fisheries, wildlife or pollution violations can be quickly and discretely reported to the appropriate Enforcement Officer by using the toll free Observe, Record and Repon hotline. This toll free number is available 24 hours a day. Confidentiality is assured.

6. ABORIGINAL FISHING PLAN

The Department of Fisheries and Oceans recognizes the importance of fish, including invertebrates, to the aboriginal peoples of British Columbia. Through the Aboriginal Fisheries Strategy, the Department seeks to negotiate, with aboriginal organizations, allocations for food, social and ceremonial purposes. Subject to conservation, these allocations will have priority over allocations for commercial and recreational user groups.

The Department will consult with aboriginal organizations to determine what these allocations should be. In some cases, instead of negotiating allocations, an area may be closed to certain fishing except fishing by an aboriginal organization. These closures may be for the season or for specified times. Whenever possible, the appropriate annual fishing plan will identify such closures. Communal licences will be issued to the aboriginal organization for the fishing.

7. SPORT FISHING PLAN

The recreational harvest of shellfish is regulated via the British Columbia Sport Fishing Regulations made under the Fisheries Act. The regulations are summarized annually in the Briti<;h Columbia Tidal Waters Sport Fishing Guide which lists closed times, bag limits, size limits (where applicable) and closed areas. If necessary, public notices are posted to document closures or changes from the Guide. Closures may be implemented in order to conserve vulnerable stocks, protect the public from consumption of contaminated shellfish or to meet Aboriginal food, social and ceremonial needs. For some species, areas have been closed to commercial harvest or open times for commercial harvest have been delayed to provide an opportunity for the recreational community.

The primary consultative body for the recreational fishing community is the Sport Fishing Advisory Board (SFAB). The SFAB has representatives from all parts of this community including the BC Wildlife Federation and the Sport Fishing Institute of Be. Within the SFAB, a shellfish committee has been established for the south coast region.

No person engaged in sport fishing shall in any day catch and retain more than 12 sea urchins.

8. GREEN SEA URCHIN COMMERCIAL FISHING PLAN FOR 1995

A description of Areas and Subareas referenced in this Plan can be found in the Pacific Fishery Management Area Regulations. Management Area maps are available from local DFO offices.

8.1. MANAGEMENT CHANGES FOR 1995

8.1.1. Quotas

An initial south coast precautionary TAC for 1995 reflects a decrease from estimated 1994 fishing levels. On the advice of the Pacific Review Committee (pSARC), the quotas for 1995 have been reduced to approximately 60% of the five-year average of landings, 1987-1991. Landings may have to be reduced further in the south coast over time.

Precautionary quotas have been set for portions of the north coast and an exploratory fishing protocol will be developed.

8.1.2. Open Times

North Coast: Areas 3 and 4 are scheduled to open January 2, 1995. All other north coast areas will open on request November 6 to December 31, 1995. See section 8.2.2. of this plan.

SOllth Coast: All south coast areas (Areas 11 to 29) will remain closed January 1 to October 31, 1995. Not all areas will be opened at the same time in the fall fishery. See section 8.2.1. of this plan.

8.1.3. Designated Landing Ports - South Coast

Designated landing ports in the south coast will be a condition of licence in 1995. Ports are listed in Section 8.7.1.

8.1.4. Policy and Requirements for Ponding of Green Sea Urchins

The ponding and feeding of green sea urchins is considered to be an aquaculture operation requiring appropriate permits and licences.

Please note:

(i) The collection of green sea urchins requires a "Z-A" Green Sea Urchin Commercial Fishing Licence. All sea urchins must be legal size (greater than or equal to 55 mm in test diameter).

(ii) Due to disease concerns approvals are required prior to movement of green sea urchins to other locations:

(a) To an existing lease site: Any movement of urchins to or from a lease site will require transplant approval (except movement for processing) .

(b) To a temporary site, which is not under tenure. Movement of Green Sea Urchins to holding pens will require transplant approval or a transplant licence.

The green sea urchins must be weighed and validated again, prior to transport to a processing facility. The pond operator will be responsible for the costs of an independent validator.

8.1.5. Catch Reporting - South Coast (Statistical Areas 11 to 29) and North Coast (Statistical Areas 1 to 10)

There is a new requirement for vessel masters to hail their catch on a weekly basis for all days fishing during the preceding seven-day period or portion thereof as follows:

For Areas 11 to 29 - FISHERIFS MANAGEMENT COORDINATOR at 339-2809 between O9OOh and 1200h every Friday morning.

For Areas 1 to 10 - FISHERIFS MANAGEMENT COORDINATOR at 627-3404 every Friday (message recorder available 24 hours).

8.1.6. North Coast Fisheries

An exploratory fishing protocol will be developed for north coast fisheries for green sea urchins in 1995. An observer may be required on the grounds when fishing is being conducted. Only Areas 3 and 4 will be open in January and February 1995.

8.1.7. Closed Areas

A Research - Park Closure at Commorant Channel in Area 12 will be in effect in 1995. General Description of closed area: Stubbs Island, the Plumper Islands, and the Stephenson Islets.

8.2.2. North Coast

Harvest in the North Coast in 1995 is limited in Areas 3 and 4 by precautionary quotas to prevent excessive harvest, while providing fishers the opportunity to explore new areas and identify appropriate habitat. In the Prince Rupert area, which is the only North Coast area for which significant landings of Green Urchins have been reported, harvest is limited at levels of production reported in 1993. Open times are given below.

Consideration will be given to openings in other Statistical Areas upon the request of fishers, but harvest in each Area will be restricted. An exploratory fishing protocol will be developed in consultation with industry prior to the falI fishing period. Open times will be restricted to the period November 6 to December 31 in the exploratory areas. North Coast quotas and openings for 1995 are summarized in the following table:

A Category "Z-A" licence (Green Sea Urchin) is required. All diving and fishing operations must take place from the licenced vessel. All product must be landed on the licenced vessel directly . Vessels used to hold or transport urchins must be inspected and have the appropriate licence.

8.4.2. Species

Green Sea Urchins: Strongylocentrotus droebachiensis.

8.4.3. Gear

Hand picking by divers only is allowed. Suction devices are not permitted to be used.

8.5. SIZE LIMITS

No person shall fish for, catch, kill, or have in possession any Green Sea Urchin that measures less than 55 mm in a horizontal line through or across the longest diameter or greatest breadth of the shell.

8.6. NOTIFICATION PROCEDURE PRIOR TO COMMENCEMENT AND ~ATIONOFAFffimNGTRIP

8.6.1. The master of the vessel shall notify the DEPARTMENT OF FffiHERIFS OPERATIONS CENTER at 666-5066 at least 24 hours prior to fishing and within 24 hours after terminating fishing in an area, of the following information:

(a) Vessel name, operators name and CFV. (b) Species to be fished: green sea urchins. (c) Number of divers. (d) Management Area and Subareas (as defined in the Pacific Fishery Management Regulations). (e) Time and date that fishing will commence or that fishing was terminated.

8.6.2. If he is unable to arrive in his declared fishing area within 24 hours of the stated time, he shall so advise the same office.

8.6.3. Notification shall also be provided 24 hr. prior to moving to a new Management Area.

8.6.4. Upoo completion of fishing in a Subarea, the master of the vessel shall so notify, as above, the same office.

8.7. DFSIGNATED LANDING FORTS AND CATCH REPORTING - SOUTH COAST (MANAGEMENT AREAS 11-29) AND NORTH COAST (MANAGEMENT AREAS 1-10)

8.7.1. Green sea urchins must be landed at one of the following ports:

(a) North Coast: no restrictions.

(b) South Coast - inside waters: Port Hardy Port McNeill Telegraph Cove Horseshoe Bay Kelsey Bay Browns Bay Campbell River Victoria Sooke Sidney

(c) South Coast - west coast of Vancouver Island: Coal Harbour Winter Harbour Tofino

8.7.2. The vessel master shall report that vessel's catch for all days fishing during the preceding seven days or portion thereof as follows:

For Areas 11-29 - Fisheries Management Coordinator at 338-2809 between 0900h and 1200h every Friday morning.

For Areas 1-10 - Fisheries Management Coordinator at 627-3404 every Friday (message recorder available 24 hrs).

The following information is to be reported:

(i) Name of vessel master. (ii) Vessel name and CFV. (iii) Management Area and Subarea fished (as defined in the pacific Fishery Management Area Regulations). (iv) Species caught; i.e. green sea urchins. (v) Amount caught (this can be by dock weight, or by cage with an average weight per cage). (vi) the location in which the green urchins are to be contained (if the urchins are to be held prior to landing and sale).

8.8. CATCH AND FISHING DATA

8.8.1. Harvest Log Data

8.8.1.1. The vessel master must provide and maintain an accurate and true log of daily harvest operations in the logbook authorized for 1995 by the Department of Fisheries and Oceans. DFO authorized logbooks for 1995 are available from I. O. Thomas and Assoc., (604) 291-6340. This log must be accompanied by a chart record of locations fished.

8.8.1.2. The harvest log must be completed by midnight of the day fished and kept aboard the licenced vessel when Green Sea Urchins are being harvested or when Green Sea Urchins are on board. Logbooks must be produced for examination by a fishery officer or guardian.

8.8.1.3. The licence holder registered with the Commercial Licence Unit is responsible to ensure that the vessel master has completed and submitted a copy of the log data. DFO can only release log data to the registered licence holder, and only upon written request.

One copy of the harvest log and chart record must be forwarded each month to:

THE DEPARTMENT WISHFS TO REMIND FISHERS THAT IT IS A CONDITION OF THEIR LICENCE THAT LOGS MUST BE TURNED IN AT THE END OF EACH MONTH FISHED. TO DELAY SUBMISSION OF LOGS BEYOND THAT PERIOD IS A VIOLATION OF A CONDITION OF LICENCE.

8.8.2. Fish Slip Requirements

It is a condition of this licence that an accurate written report shall be furnished on a fish slip of all shellfish caught under the authority of this licence. A report must be made even if the shellfish landed are used for bait, personal consumption, or otherwise disposed. The written report shall be posted not later than seven (7) days after the offloading and sent to:

8.9. OTHER RESTRICTIONS AND GENERAL INFORMATION

8.9.1. Export Requirements

Prior to the export of green sea urchins to any other Province, Territory or Country from British Columbia which have not gone through a federally registered processing plant, an oral report of the following information must be made by telephoning 666-0583 (DFO - Vancouver):

8.9.1.1. Total weight of the sea urchins to be exported. 8.9.1.2. Area of catch. 8.9.1.3. Export destination. 8.9.1.4. Location and expected time of export.

The harviS: log and fish slip conditions of this licence must be complied with, even for sea urchins exported from British Columbia which have not gone through a federaUy registered processing plant.

8.9.2. WCB Seafood Harvesting Certificate

<.~/ -\ CONDITIONS OF 1995 GREEN SEA QRCHIN LICENCE

Pursuant to subsection 22(1) of the Fishery (General) Regulations, and for the proper management and control of the green sea urchin fishery, the following conditions are specified for this 1995 commercial fishing licence: 1. species of fish permitted to be taken: Green Sea Urchin.

2. Fishing gear permitted to be used: Diving gear. Handpicking by diveI,"s only. Suction devices are not permitted to be used. 3. Information that the master of the vessel shall report to the Department of Fisheries and Oceans:

(1) Before and After a Fishing Trip: The vessel master shall notify the Department of Fisheries and Oceans Operations centre, 666-5066, at least 24 hours prior to fishing and within 24 hours after terminating fishing in an area, of the following information:

(a) vessel master's name, vessel name, and CFV #; (b) species to be fished (i.e. green sea urchins); (c) number of divers; (d) Subareas fished (as described in the Pacific Fishery Management Area Regulations); and (e) time and date that fishing will begin or end. (2) Non-arrival on Fishing Grounds: If the vessel is unable to arrive in the declared fishing area within 24 hours of the stated time, the vessel master shall so advise the Operations Centre, 6~6-5066. (3) Moving to a New Fishing Area: The vessel master shall notify the Operations Centre, 666-5066, 24 hours ·prior to moving to a new Area or Subarea. (4) Catch Hails - South Coast: For Areas 11 to 29, the vessel master is responsible for hailing, each Friday between the hours of 09:00 am and 12: 00 noon, that vessel's catch for all days fished during the previous seven (7) days. Hails should be made to Fisheries Management Coordinator (339-2809) and should inclUde the following information:

4. Locations permitted for the landing of green sea urchins from the vessel: Green sea urchins must be landed at one of the following ports: (a) North Coast: No restrictions. (b) South Coast: Port Hardy Port McNeill Telegraph Cove Kelsey Bay Browns Bay Campbell River Sidney Sooke Horseshoe Bay Victoria West Coast of Vancouver Island - Coal Harbour, Winter Harbour and Tofino.

Records that the master of the vessel shall keep: (1) Harvest Logs: (a) The vessel master is responsible for the provision and maintenance of an accurate record, a "log", of daily harvest operations. This log must be completed and submitted in both hard copy and electronic copy. Logbooks, meeting DFO requirements, are available from outside suppliers who, for a small fee, will provide both the logbook and the keypunch service, thus complying with the requirements for a llil..I:d and an electronic copy. This log must be accompanied by a chart record of locations fished. As an alternative to the above, you may provide a log in the same form and providing the same particulars as shown in the fishing log sample attached hereto (see Appendix I). You must also provide an electronic copy, which must be an ASCII file and DOS compatible on a 3 1/2 " or 5" disk. Disks will remain the property of the Department of Fisheries and Oceans. Both the hard copy and the electronic copy of the harvest log must be forwarded each month to the above address. (b) The information shall be recorded in the harvest log no later than midnight for each day fished and the logbook kept aboard the licenced vessel when green sea urchins are being harvested or when green sea urchins are on board. Logbooks must be produced for examination on demand of a fishery officer or fishery guardian. .

(2) Fish Slips: It is a condition of this licence that an accurate written report shall be furnished on a fish slip of all fish caught under the authority of this licence. A

Export requirements: (1) Prior to the export (see 6(3» of green sea urchins which have not gone through a federally registered processing plant, an oral report containing the following information must be made by telephoning the DFO operations Centre, 666-0583: (a) total weight of green sea urchins to be exported; (b) area of catch; (c) export destination; and (d) location and expected time of export.

(2 ) The harvest log and fish slip conditions of this licence must be complied with even for -green sea urchins which have been exported without going through a federally registered processing plant.
