I. INTRODUCTION The Productive Rural Infrastructure Development Project in the Central Highlands (The Project) is funded by loan from ADB, and Ministry of Agriculture and Rural Development (MARD) is the project owner. This project will be implemented within 05 years (2014 – 2019) and taken place in the 05 provinces (Lam Dong, Dak Nong, Dak Lak, Gia Lai and ) of the Central Highlands. The long-term purpose of Project is contributing to hungry alleviation and poverty reduction programs of the Government through sustainable development of the society, ecology and environment at community levels by developing infrastructures for production, improving socio- economic conditions and living standards of people in the area. The short-term objectives of the project are (i) to rehabilitate and upgrade deteriorated or damaged irrigation systems and rural infrastructures, which are serving for production in 05 provinces of Highlands. (ii) To strengthen management capacity and implementation of ODA projects; strengthen infrastructure management at community, province, district and commune levels to gradually improve living standards and conditions of the poor in the project area in the Central Highlands. (iii) To build models, institutional policies on "water saving irrigation technology for strategic and economic valuable plants" and "management and exploitation of irrigation schemes sustainably with the participation of all economic sectors ". One sub-project of The Project is “Repairing, upgrading Di Linh Western and Eastern reservoirs, flood bypass of Ka La reservoir and productive rural infrastructure in Di Linh district, Lam Dong province”, that will be implemented in Di Linh town (at Western and Eastern reservoirs) and Bao Thuan commune (flood bypass Ka La), Di Linh district, Lam Dong province. Such project areas are distance from 2.3 – 8 km from center of Di Linh district. The objectives of this sub-project are improving livelihood and quality of lives for local people by enhancing effectiveness of rural infrastructures; application of advanced technologies in agriculture; reducing land loss in agriculture; creating stabilized jobs for local people and contributing in poverty alleviation and accessing to basic services including health care, education and financing etc.; reducing travel costs for local people; and contributing in New Rural Development Program. The objectives and scope of this IEE are to (i) assess the existing environmental conditions along and in the vicinity of the subproject; (ii) identify potential environmental impacts from the proposed components; (iii) evaluate and determine the significance of the impacts; (iv) develop an environmental management plan (EMP) detailing mitigation measures, monitoring activities, reporting requirements, institutional responsibilities and cost estimates to address adverse environmental impacts; and (v) carry-out public consultations to documentary issues/concerns that stakeholders may have on the sub-project and to ensure that such concerns are addressed in the sub-project design and mitigation measures. This Initial Environmental Examination (IEE) of the sub-project is prepared to meet the requirements of environmental safety of ADB and the environmental regulations of Government of Vietnam. II. POLICY FRAMEWORK, LEGISLATION AND MANAGEMENT 2.1 ADB policy ADB Safeguard Policy Statement (SPS) 2009 imposes safeguard requirements for all its funded projects. The SPS 2009 clarifies reasons, scope and contents of the environmental assessment. The SPS emphasizes on environmental and social sustainability in progress of economic growth and poverty reduction in Asia and the Pacific, therefore, the objectives of SPS focus on: i. Avoid adverse impacts of projects on the environment and affected people, where possible; ii. Minimize/mitigate and/or compensate for adverse impacts on environment and affected people when avoidance is not possible; and iii. Help borrowers/clients to strengthen their safeguard systems and develop the capacity to manage environmental and social risks. The SPS requires preparing environmental safeguard document in the process of preparing a project including environmental management plan (EMP). The borrower/client needs to monitor EMP implementation. The monitoring will identify outstanding issues of EMP implementation and propose appropriate mitigation measures. Periodic monitoring reports on EMP activities will be submitted to ADB every semi-annual during construction of the project. Moreover, all subprojects under the loan 3032-VIE need to follow the specific guidance on environmental assessment as stated in the Environmental Assessment Review Framework (EARF) of the project, prepared by the project owner and approved by ADB. The subprojects under loan 3032-VIE only categorized as Category B or C will be included in the list of eligible sub-projects for possible funding under the proposed Project. It is anticipated that all eligible sub-projects will fall into Category B, whereby some adverse environmental impacts are expected, but of a lesser. The subproject “Repairing, upgrading Di Linh western and eastern reservoirs, flood bypass of Ka La reservoir and productive rural infrastructure in Di Linh district, Lam Dong province” is selected based on the project’s EARF that may cause the insignificant environmental impacts to the environment and ranked as categorized B. Therefore, an IEE needs to be prepared with an EMP enclosed. 2.2 Environment regulations of Vietnam government The project must also comply with the environmental regulations. The Vietnam legal framework comprises of the following items: - The Law on Environmental Protection adopted by the National Assembly of the Socialist Republic of Vietnam dated January 01, 2015. The law regulates general environmental protection requirements, policies and resources for protecting the environment; - The Law on Labor adopted by the National Assembly of the Socialist Republic of Vietnam dated June 18, 2012 that regulates general requirement on safety and occupational health; - Decree No. 18/2015/NĐ-CP on April 01, 2015 of the Government that regulates on environmental protection planning, strategic environmental assessment, environmental impact assessment (EIA) and environmental protection commitment (EPPs); - Decree No. 38/2015/ND-CP on June 15, 2015 of the Government that stipulates on waste and disposal management; - Decree No. 201/2013/NĐ-CP on November 27, 2013 of the Government that details the Law on water resources;

III.2. SUBPROJECT DESCRIPTION

1. New or innovating Repairing, upgrading reservoirs and rural road infrastructure 8 or upgrading project 2. Components of the Sub-project will repair and upgrade existing reservoirs for irrigation and subproject improving rural transportation by upgrading rural roads. Those activities expected to increase agricultural productivity and improve socio- economic living conditions for local peoples. The details of components include: (i) Repairing and upgrading irrigation including East and West reservoirs of Di Linh district; (ii) Repairing and upgrading rural roads including flood bypass at Ka La reservoir and road on dam crest of West reservoir, which is interconnecting National Highway 20 with head-works of reservoir and main road of district. The volume of East reservoir (0.68*106m3) and West reservoir (1.8*106m3) is categorized as Grade IV (as in QCVN 04:05/2012 of MARD). The design of reservoirs is Grade III, thus reservoirs will increase storage volume from 0.16 x 10 6 m3- 0.24 x10 6m3; 2.1. Repairing and The East Reservoir of Di Linh: the capacity of East reservoir of Di is 0.62 upgrading irrigation: million m3, which supplies water for 100 ha of coffee and crop culvitation area in Di Linh town. The reservoir is now considerably deteriorated. The

The impervious core upstream slope is 3:1 and upstream toe wall is 3 m width; - Upstream slope of dam: Slope coefficient is 3:1 and the slope will be made of reinforced concrete, to avoid water penetration, geotextile sheets are placed under layers of crushed stone and sand. Each layer is 15 cm thick; - Downstream slope of dam: excavate 0.5 – 1.0m to remove termite nests and reduce land erosion by planting grass in hexagon cells and installing water drains, the slope coefficient is =2.75, the toe of wall is 8 m wide; - Dam crest: Dam crest will be used as road. It is designed as wide B = 6 m, reinforced-concrete M250, 18 cm thick based on a sand layer (5 cm). The curb in downstream side is reinforced-concrete M200 and the upstream side is a wall (0.3 m of thickness and 0.5 m of height) to stop the waves; - Flood spillway: break down the existing flood spillway and construct new one 5m of width, made of reinforced-concrete M200, and will also serve as a road. The spillway will be 31.9m of length, 5 – 2.5m of width, with a slope of 0.035 (3.5%) made of reinforced-concrete M200. The stilling basin is 0.5 m of depth, 11.7m of length and made of reinforced-concrete M200. The downstream canal includes 02

DESCRIPTION SUB-PROJECT DATA sections: canal will be 150m of length , 0.005 slope, 2.5m of width; and 04 stairs made of reinforced-concrete M200 at the end of canal (stair will be 12.7 m of length, 2.15 m of height) - Water intakes: the water gate will be rectangular shape (0.8 x 1.2 m), 16.3m of length, located 24.8m downstream of the spillway and made of reinforced-concrete M200. It is operated without pressure and controlled by an upstream flow-regulating valve. 2.2. Repairing and The West Reservoir of Di Linh: the capacity of west reservoir of Di is upgrading irrigation: 1.64 million m3, which supplies water for 200 ha of coffee and crop West reservoir of Di cultivation area in west of Di Linh town. The reservoir is now considerably Linh Town deteriorated. - The main interventions in West reservoir of Di Linh include Soil dam: increasing water penetration resistance of the dam by a wall covering the upstream dam slope; the embankment is done by low penetrative soil (K = 10-5 cm/s); the impervious core of upstream slope is 3:1 and the upstream toe of wall is 3m of width; - Upstream slope of dam: The slope coefficient is 3:1 and made of reinforced-concrete M200 (plates of 2x2 m x10 cm with holes for drainage), to avoid water penetration, geotextile sheets are placed under layers of crushed stone and sand. Each layer is 15 cm of thick; - Downstream slope of dam: excavate 0.5 – 1.0m to remove termite nests and reduce erosion by planting grass in hexagon cells and installing water drains, the slope coefficient is =2.5;

DESCRIPTION SUB-PROJECT DATA - Dam crest: Wide B = 6 m, integrated with road function and constructed by 2 layers of reinforced-concrete 12cm (5 + 7 cm) of thick and based on layer (18 cm thick) of crushed stone. The curb in downstream side of road is made of reinforced-concrete M200 while a wall (0.3m of thickness and 0.5 m of height) is built in upstream to stop the waves; - Flood spillway: upgrading existing flood spillway by: rising spillway threshold + 0.3 m made by reinforced-concrete M250. Demolish existing bridge and construct new one 6.0 m wide crossing above the spillway for transportation function. The wall and base of the spillway are of reinforced-concrete M250, 10 cm thick; - Water intakes: the water gate will be of rectangular shape (0.8 x 1.2 m), 47.7 m long, located 6.5 m from spillway towards of the water stream and made of reinforced-concrete M200. - Road: will be upgraded to grade B in TCVN 210-92 & TCVN 2054:2005, with the width is 4m. The road surface will be 18cm of thick and made of reinforced-concrete M25, which laying on a 5cm sand stratum; - Drains: The drains are in trapezium form (0.4x0.4x1.2m), located where needed with slope > 6% along the roads. Cement M100 will be used for their construction and are connected with new and existing culverts also used for irrigation and drainage in sub-project sites; - Intersections of roads: 04 intersections will be constructed with the same design and specifications of the main roads; - Traffic signs: the warning signs, painted with reflecting material, will be located at dangerous/significant points. Quantity and size of Culverts: 16 culverts cross the upgraded roads, include 4 of rectangular drainage culverts shape culverts and 12 pipe-culverts. The rectangular culverts will be made of reinforced-concrete M250; while pipe culverts are made of reinforced-concrete M200; - Five culverts will be located at intersection with communes road in East reservoir include: 03 rectangular culverts; 02 pipe culverts; - The flood bypass in Ka La reservoir includes 10 new pipe culverts; 14 connecting points with existing pipe culverts; and 01 rectangular

DESCRIPTION SUB-PROJECT DATA culvert; Quantity of bridges There is 01 bridge to be newly constructed over the spillway in East reservoir. The bridge is 22.1m of length and 5 m of width and is made of reinforced-concrete M300; its slab is 20 cm thick. Irrigation and Drainage structure: The current drainage structure in reservoirs and drainage structures ( roads are side drains at the junction of the embankment slopes and the existing irrigation & natural ground with slope > 6% (road drains), they will not be graded. ; drainage structures) Irrigation: Di Linh has 06 reservoirs, they have been built from 1964 – 2002. The Ka La reservoir was built in 2002, the West Reservoir in 1982 and the East reservoir in 1986. These reservoirs are now considerably deteriorated and their irrigation capacity became insufficient, but subproject will involve in upgrading capacity of East and West reservoirs of Di Linh. At the downstream of East and West Di Linh reservoirs there are irrigation canals, serving a total of 300 ha of agricultural area in the Di Linh district, all of them will be not included in the subproject scope; Area of site The sub-project activities will be taken place in existing reservoirs and clearance1 roads. The land to be acquired is 600 m2. According to Report on Land Acquisition Completion and Ethics Minorities of sub-project, there are 04

households in Di Linh town that will be affected by land acquisition. However, the areas of acquired land are just 2% - 5% of total productive land of each household, and these lands are in boundary areas of productive land. The main site clearance consist of demolition of a temporary fence and of some trees. The temporary acquired areas for construction activity is 6.0 ha that will be used for material storage. 0.5 ha for borrow pits and as disposal sites (5.5 ha). However, all these are vacant land. Other roads that The Ka La flood bypass and East Di Linh reservoir’s dam crest road intersect with intersect National Road No 20, which is a main transportation road axis subproject’s roads of the subproject area that results in convenient transportation and increasing access to markets, medical centers/hospitals and schools. There are total of 4 intersections, include 01 intersection in Ka La bypass (at section of Km0+0.00) and 03 intersections in road on East reservoir connecting with 03 commune roads at sections of Km0+0.00, Km0+293.40 and Km1+448.49. The main streams The Dariam river flows along National Highway No.20 (distance to across the road project site is 2 km to West reservoir of Di Linh ). This river passes through Di Linh district with total length of 26.6 km from the East to West - Rivers and then flows into Dargna River. Dariam is the largest river in the district - Reservoirs abundant of water for local irrigation purpose. - Other streams The Da Dung river is upstream of Dong Nai River, starting from the eastern part of Di Linh (at National Highway No.20) towards North-West (19.4 km) and then flowing into Dong Nai River. This river is the natural boundary between Di Linh and Lam Ha districts. Although the river is abundant in water but not much exploited for irrigation. The Dargna river is upstream of La Nga River with 9.3km passing through Di Linh, from North to South. This river is convenient for production purposes and livelihood of local people.

Road will be built in section by section to avoid disruption of travelling of local people. Temporary location Source of materials: and area occupation - Soil: soil for embankment construction in East and West reservoirs and material source and flood bpass Ka La & road to East reservoir dam will be taken from Gung Re borrow pit, capacity : 50,000 m3 . This borrow pit is existing borrow pit in public land area, and has been approved by Di Linh DPC - Reinforcing steel: will be purchased from Bao Loc City; - Asphalt: will be purchased from Da Lat City; - Sand will be purchased from sand mine in Bao Thuan commune of Di Linh District, 8.5 km away from sub-project areas. This sand mine is being exploited and possess the necessary Government’s licenses; - Stones will be purchased from Tam Bo stone quarry in Tam Bo commune, Duc Trong district, and 23 km away from the sub-project areas. This stone quarry is being exploited and has the necessary Government’s licenses; - Electric Power: Extracted from existing grid and supplemented by 04 generators if necessary.

The transport distances from quarries to sites are around 200 to 250 m.

Approximate volume Approximated volume construction materials include 3,083 tons of of construction cement; 267.5 tons of steel; 7,085 m3 of crushed stone; 11,886 m3 of materials sand; 5,760 m3 of free stone; 3,265 m3 of facing stone and other. The details of East and West reservoirs and upgraded roads have shown as following: • East Reservoir of Di Linh: Embanked soil is 20,891 m3; reinforced concrete is 851 m3; cement concrete is 860 m3; sand is 1,780 m3; crushed stone is 1,030 m3; and steel is 68 tons. • West Reservoir of Di Linh: Embanked soil is 6,010 m3; reinforced concrete is 533 m3; cement concrete is 400 m3; sand is 1,440 m3; crushed stone is 810 m3; and steel is 43 tons. • Flood bypass in Ka La reservoir & roads in East reservoir: Embanked soil is 16,405 m3 in Ka La and 2,669 m3 in East reservoir. IV. DESCRIPTION OF EXISTING ENVIRONMENT Results of survey and baseline environment data of the subproject area collected and later updated by the safeguard policy consultant (EPC) in May 2015 are summarized as following: Table 2: Baseline Environment Data

4.1 PROJECT LOCATION Town The subproject locates in the surrounding area of Di Linh Town (East and West reservoirs) and in Bao Thuan commune (Ka La flood bypass)

District Di Linh Province Lam Dong Geographical The sub-project is in Di Linh district of Lam Dong province, including 02 position reservoirs in Di Linh Town and 01 reservoir in Bao Thuan commune. - East Di Linh reservoir is 4.5 km away from downtown towards northeast, with coordinates as following: From X: 11035’54” to X: 11036’19” From Y: 108004’47” to Y: 108004’55” - West Di Linh reservoir keeps distances 2.3 km from downtown towards north—west, with coordinate as following: From X: 11034’45” to X: 11034’47” From Y: 108002’49” to Y: 108003’51” - Flood bypass in Ka La reservoir is located 8 km away from downtown towards southeast, with coordinate as following: From X: 11030’47” to X: 11032’38” From Y: 108016’13” to Y: 108007’43” 4.2 NATURAL ENVIRONMENTAL CONDITIONS The subproject is located in the mountainous area in which there are neither industrial nor mining activities. Local roads are low traffic density. Two main potential air pollutant sources could be traffic vehicle in 02 national roads passed through and some agricultural product processing plants is operating at the center of Di Linh district. As the results from ambient monitoring of Di Linh district’s3 indicated that air quality of Di Linh is good in general, excepted dust concentration (0.31 – 0.62 Air quality mg/m3) at the points close to high traffic road which were exceed the allowed limit (0.3 mg/m3) established by the National technical regulation on Ambient air quality QCVN 05:2013; (See more details in Annex 4a); As monitoring results of 6 samples in approved EIA4, which prepared to meet the requirements of Vietnam government, show that all 6 analyzed indicators of air quality are below permission values stated in QCVN 05:2013/BTNMT (See more details in Annex 4b ). It indicates that ambient air quality of the

( dust =0.018-0.026 mg/l) The noise and vibration pollution was observed at the locations which are close to high traffic volume and agricultural product processing manufactures. But all of them are located far from subproject location. As monitored results of 5 location of Di Linh Division of Environmental and Natural Resource, show that noise and vibration level is much lower allowed Noise and vibration value in national standard. Additionally, 6 samples have been collected and analyzed during EIA preparation (Dec 2015) as the same air quality monitoring locations, and the result indicated noise level of the subproject area is acceptable as much lower than allowed limits by QCVN 26:2010/BTNMT (See more details in Annex 4b). The subproject area is influenced by the tropical monsoon and plateau tropical monsoon climate. The climate is divided into two distinct seasons: - The rainy season is from May to November (accounting for approximately 80-90% of annual rainfall that on average is 1553 mm). - The dry season is from December to April (accounting for approximately 10% to 20% of annual rainfall). According to meteorological data from Bao Loc station: Temperature of these areas as follows: ° Average annual temperature: 20 - 210C ° The highest temperature: 30 - 310C (May, June, July) ° The lowest temperature: 100C (Dec., Jan.., Feb.) Air humidity: ° Humidity average /year: 86% ° The highest humidity month: 90-92% (June – Sept.) ° The lowest humidity month: 79 – 83% (Jan. – Apr.) Sunshine hours: Climate and natural ° Annual average number of sunshine hours is above 2,330 hours and disasters mostly in the dry season (Dec. – April) and fewer sunshine hours in the rainy season (May – Nov.); ° The highest number of sunshine hours per month is 260 hours. ° The lowest number of sunshine hours per month is 132 hours. Wind: wind in area is depended on season and have two types of wind one directed Northeast and the other South-west. ° Average wind speed is 2.3m /s; ° The maximum speed is 28 m/s; Natural Disasters: Main natural hazards in the Central Highlands and in Lam Dong province consist substantially of droughts in the dry season, floods & flashfloods in the rainy season. Other occasional hazards occurred in the past, such as landslides, extreme wind, hail, extreme rainfall and extreme hot days. Because of the geographical location of the Highlands Region, directly impact of tropical storms in Lam Dong province, including Di Linh district, is low. However, tropical storms in East Sea have had some negative impacts on local climate and caused some extreme rainfalls such as in years of 1987, 1994, 1999 and 2000; The extreme rainfalls with high intensity caused landslides in

DATA ITEM SUBPROJECT DATA mountainous/hilly areas such as Tan Nghia commune in 2013, 2014; Tan Thuong commune 2013 and in Da Huoai river banks 2014 etc. of Di Linh district. Droughts have occurred in Lam Dong province but with less extent than those in other Highland provinces, because of its particular microclimate. However, several droughts had been recorded in the recent past, for instance in 2002 that had a severe impact in the areas of Bao Loc, Bao Lam, Da Huoai, Da Teh, Cat Tien districts, resulting in insufficient water for irrigation. The drought in 2015 affected 217 reservoirs in Lam Dong province, including Ka La reservoir, also depriving many of such reservoirs of sufficient water for irrigation. The subproject area is dominated by plateaus and mountains covered by plantation/natural forest and the terrain are topographically complex. The main plains are mostly located along National Highway No.20 and other main roads of district. As results from geological tests, the soil in subproject area include 04 layers: (1) top layer, clay with sand & stone, organic compounds, and vegetables is Topography and from 0.3m to 0.4 m of thickness; (2) clay with brown-red sand & stone, grey- soil brown stone is from 2.5 to 5.2 m of thickness; (3) clay with a little brown-red stone, grey-brown stone is from 0.9 to 9.5 m of thickness; and (4) grey and grey-black basalt stone is from 2.5 to 11.3 m of thickness; The sub-project area has 07 soil categories: alluvial soils (1,980 ha); swampland & peat land (14 ha); grey degraded soils (2,071 ha); basalt soils (5,306 ha); yellowish red soils (117,414 ha); valley soils (1,336 ha); and humid ferrasols (27,367 ha). Surface water The surface water resources include rivers, small streams and reservoirs. resource The area is crossed by the Dariam River (length of 26.6 km); the Da Dung River (19.4 km); Dargna River (9.3 km). Reservoirs include Ka La, Ka La 2, Ka La 3, East Di Linh, West Di Linh reservoirs and Reservoir 109; etc. The above rivers are upstream of Dong Nai & La Nga Rivers and are quite rich in water; Local people are exploiting the surface water resources for both production (mainly agricultural irrigation) and domestic purposes. Surface water Ten samples of surface water had been collected in sub-project areas of 6 quality communes (Dinh Trang Thuong, Tan Chau, Hoa Ninh, Tam Bo, Dinh Lac and Gung Re) and Di Linh Town and 14 parameters have been monitored by Center of Environmental Technology. In addition, 6 other samples of surface water have been collected, analyzed 15 parameters by Vinacontrol in December 2015 during EIA preparation as per government requirements. Both results indicated that the quality of surface water in these areas is good for irrigation purpose. Most monitored values were within the standards for domestics purposes, except for Coliform value of Hoa Ninh & Gung Re and West Di Linh reservoir samples that exceed the allowed limits, as established by National Technical Regulation on surface water quality QCVN 08:2015/BTNMT of MONRE (at Hoa Ninh Commune Coliform bacteria = 24,000 MNP/100ml). (See more details in annex 4a & 4b). Groundwater in sub-project area is normally found at the depth of 3.3 m to 4.7 m. Local people exploit it for domestic purposes Underground water Two (2) samples of ground water with 5 parameters have been collected and analyzed by Vinacontrol in December 2015. The result indicated that the

DATA ITEM SUBPROJECT DATA quality of ground water in the subproject area are within allowed limits as compared with National Technical Regulation on ground water QCVN 09: 2015/BTNMT Flooding Through site visit and public consultation meetings, it has been learned that extreme rainfalls and high intensity rains could cause rivers’ flooding, however, storage capacity of the Di Linh reservoirs could help to reduce flooding downstream in raining seasons. Unfortunately, no data on floods has been recorded in Di Linh. However, no households are living in flood-exposed areas of Dariam crossing Di Linh town. Terrestrial fauna The main flora in the sub-project area are agricultural crops (tea, cashew, and flora paddy, cassava, maize, beans, coffee, pepper, rubber and more.) in which, tea and coffee are the main agricultural products; Terrestrial fauna in the area includes cattle, pigs, chickens, etc.; No protected wild animal are present in the area. Aquatic fauna and Aquatic fauna and flora features could be only found in the Dariam river, its flora tributaries, small streams, Di Linh East & West reservoirs, Ka La reservoir as well as canals system of such reservoirs. However, there are no specific available data of aquatic flora and fauna of these water bodies. Through field visits, it has been learned that aquatic fauna include freshwater fish, shrimp and others, while aquatic flora include water hyacinth, algae and various other grass. No aquatic fauna & flora species are listed in the Red Data Book of Vietnam. Protected areas There is no ecological/protected area within or near the sub-project area in East and West reservoirs of Di Linh town. The Natural Reservation Area of Song Mao (Mao River) is the nearest to the subproject area, but is located as far as 35 to 40 km from Di Linh town. 4.3 ENVIRONMENTAL AND SOCIAL CONDITIONS Unexploded Checking of unexploded bombs and mines (UXO) to ensure safety during bombs, mines construction of the sub-project was completed in November 2015. The land use of sub-project areas in 2013 are as following: - The land use of Di Linh district: o Total natural land: 161,463.84 ha o Agricultural land: 38.25% o Forest land: 53.77% o Specialized land: 1.7% o Residential land: 0.72% o Others: 5.56% Land use - The land use of Di Linh town: o Total natural land: 1,826.63 ha o Agricultural land: 76.38% o Forest land: 0% o Specialized land: 10.79% o Residential land: 7.51% o Others: 5.32% - The land use of Bao Thuan commune: o Total natural land: 23,141.62 ha o Agricultural land: 11.15%

The area in southeast of Ka La flood bypass is forest plantation managed by local people in Bao Thuan commune. Residential area Residents in the sub-project area mostly inhabit the center of the near the communes, especially in Di Linh town, or in areas along the main roads. subproject The shortest distance from residential areas is 20 - 30 m (include areas along National roads No.28, No.20 and other roads of Di Linh town connecting to West & East reservoirs). While around reservoirs the closet distance from residential areas to reservoirs is about 300 – 500 m. Residential areas No.1, No.2, No.3, No.8 and No.9 are surrounding West reservoir, while residential areas No.6, No.7 and No.10 are close to East reservoir. There is no residential area close to Ka La reservoir and the flood by- pass; the nearest residential area is 1 km distant to the reservoir and the by-pass. Road network: Di Linh district has a convenient road network connecting its center (Di Linh Town) to other communes, other provinces (Dak Nong, Ninh Thuan – Binh Thuan) with National Highways No.14, No.20, No. 27 and No.28 passing through. This network creates interconnection and promotes socio-economic development. Irrigation system: The main economy of Di Linh District is agriculture, it justifies the construction of 6 reservoirs. Presently, these systems are degraded since all of them were built 30 years ago (Dong Do builtin 1964, Ka La 2 & 3 in 1974, West Di Linh in 1982, East Di Linh in 1986). Rural Capacity of these 6 reservoirs is now insufficient to serve their agricultural infrastructures areas (75% of district) and endanger the safety of local people during the flooding season. Electric Power & telecommunication: Each commune of the district has its own post office, national grid has reached all the communes of the sub- project and used by 80% of locals. Education: in 2014, 21,333 students in Di Linh attended elementary and high schools: 53.05% of them were female and 46.95% male. Health care: The district center has 01 district hospital, while each commune (17 in total) and 01 town have their own clinic center. At the end of 2013: - Di Linh district had 61,814.8 ha of agricultural land covering 38.25% of the total land while 206.1 ha is utilized for aquaculture in the whole Agriculture and district; aquaculture - Di Linh Town has 1,826 ha of agricultural land, 76.38% of which is not forest-land, a small experimental aqua-product is developed in Di Linh for sturgeon fish;

DATA ITEM SUBPROJECT DATA - Bao Thuan Commune has 23,142 ha of natural land, 11.15% of which is agricultural land and 84.34% is forest-land; o Coffee,tea and flood-rice plantations are the main contributors to the GDP of the Di Linh town and Bao Thuan commune. Di Linh town, because of its advantageous geo-location, is also a trading post of agricultural products; o The feeding sector for pigs, cows, goats, chickens, ducks and other species is being developed. Statistics by the end of 2013 of Di Linh district: - Population: 158,000 inhabitants, with 20,607 people living in urban area and 137,393 in rural area; - Population density: 95 persons/km2; Population - Population growth rate: 1.49% - Minorities: 35.6% - Poverty rate: 9.76% - Labor force: 91,774 people with 46,529 male and 45,215 female; - Average of labor force: 2.38 people/household; Most people living in the sub-project area are Kinh (immigration from the Ethnic minority North) and some local ethnic minorities (including Ede, Mnong, Nung, groups Tay, Mong, Thai, etc.). The minority rate of Di Linh district was 35.6% in 2011. Di Linh district: - Economic structure: agriculture is the main economy of the district (62.5%); industry and services represent 21.2%, followed by construction 16.3%. The economic growth rate is 13.3%, with pro- capital GDP of 24 million VND/year (2011); Livelihood - The total income of District government was VND 311.538 billion; and expenditure was VND 285.868 billion; - Poverty rate reduced by 3.17% from 2010 to 2011; the poverty rate in minorities reduced by 5.98% from 2010 – 2011, to a combined percentage of 18.43%; - Educated labor force consisted of 2,648 persons in 2011. V. ENVIRONMENTAL IMPACT SCREENING 5.1 Positive impacts Implementing the subproject "Repairing, upgrading Di Linh western and eastern reservoirs, flood bypass of Ka La reservoir and productive rural infrastructure in Di Linh district, Lam Dong province" will bring positive impacts on environment and society as follows: - Increase water surface and stabilization of reservoirs will create positive impacts on local climate, especially increasing moisture in dry season of the subproject area ; - It will ensure additional storage of water for irrigation and for potential industrial and valuable plants in Di Linh district, especially during the dry season, improving the growth of plants and trees as well as improving productivity and related income of local people; - It will also contribute to stabilizing groundwater resources around reservoirs when water can be stored in reservoirs; - It will reduce potential emergencies from flood hazards that can be caused by poor functioning of old dams; - The development of rural road infrastructure improves the traffic and links residential to production areas, reducing burden and cost in transporting materials, fertilizers and agriculture products. It also creates favorable conditions for mechanizing agricultural production, bringing scientific advances into the producing areas that will induce cultivation that is more intensive and subsequent increased crop yields. The sub-project also reduces cost of cultivation and labor and improves incomes of local people in the subproject area; - The sub-project will also contribute to improving living conditions, livelihoods and environment in sub-project areas, and to reducing poverty.

5.2 Negative impacts However, the sub-project could also create several negative impacts, especially during construction phase, which need to be managed through appropriate mitigation measures. Temporary land acquisition: Temporary land acquisition of the sub-project is estimated 6.0 ha (including 2.7 ha for West reservoir and 3.3 ha for East reservoir) for reservoirs surface extension, workers’ camps, materials and waste storages and handling but it consists of vacant stretches of land belong to reservoir management agency. The temporarily acquired land will be returned to its original status (vacant) after construction. Affected object(s): 04 HHs in communes of Di Linh town in Di Linh district. II. Construction phase

Description Excavation work, embankment construction and construction materials (soil, sand, stone etc.) storage in East & West Di Linh reservoirs and its canal, bypass could result in debris falling into the reservoirs and irrigation canals in downstream of the reservoirs. These could cause increasing sedimentation in the canal bed, obstructing water flows, which may affect rice fields. Moreover, land slide and soil erosion could appear since vegetable covers are removed and the process can be serious during rainy season. If those wastes are not collected and treated in proper manners, these can contaminate the soil, especially the wastewater with high contaminants, grease and other dangerous substances. Description: No natural reserves, national parks, areas of important ecological value are recorded in subproject area. A forest close to Ka La flood bypass is a coffee plantation whose present eco- balance will not be badly affected by construction activities. 3 borrow pit areas in East & West reservoirs and in Gung Re commune are vacant lands in which only small shrubs without commercial or scientific values are growing. Therefore, the exploitation of soil from such borrow pits will not have any noticeable negative impact on those lands or nearby plantations. Description: According to field surveys, there is no water supply network, no drainage pipe along roads and the electrical lines is sufficiently far from the roads, thus the public infrastructures could be impacts is rural roads which will be used for transport material and wastes. The existing communal roads are made of soil (embankment) and concreted or soil surfaces. Most of these roads are already in degraded conditions that makes traffic is rather difficult. Most roads are narrow and designed for loads of less than 5 tons at maximum. Roads and bridges connecting the sub-project have also designed for small loads too. So, unless the weight of loaded vehicles transporting material to and from work-sites are scrupulously checked and appropriately limited to specifications, these roads and bridges may be damaged. 6.3 Building capacity for EMP implementation The relevant stakeholders need to ensure the EMP implementation as their responsibilities. All CPMU, PPMU Lam Dong, CSC and CC need to appoint officers/staffs to be in charge of environmental management. However, most of these officers/ staffs are also assigned for other works and they are not specialized in environmental management. Thus, to ensure EMP is implemented in compliance with sponsor policies and Vietnamese legislation, these officers/ staffs must be guided/ trained on EMP implementation capacity building. Training on EMP implementation must be held for different groups with different requirements. - PPMU Lam Dong and CSC: The staffs that are in charge of environment will be trained (at least once in the first 3 months of the project) on monitoring and preparing environmental reports. - Construction contractor: Will be trained (immediately after contract signing) on implementing mitigation measures and preparing reports. VII. IMPLEMENTATION RESPONSIBILITY AND REPORTING

7.1 Implementation responsibility

Three agencies directly related to EMP implementation are PPMU Lam Dong, CSC and CC. Public consultation and information disclosure of the subproject have to be implemented continuously from the design phase to the construction phase. It consists in collecting community ideas as well as encouraging local people’ participation in preparing and implementing the subproject’s EMP. IX. GRIEVANCE REDRESS MECHANISM 9.1 Purpose of the mechanism During the deployment of the subproject, local people are informed about environmental protection activities such as EMP. Negative impacts on the environment may occur during the construction and operational phases. Any comments/ suggestions of local people will be solved quickly, transparently in compliance of laws, particularly for affected people by the sub-project. Complaint handling mechanism will be classified by level and responsibilities of involved parties. 9.2 Grievance redress mechanism Per the environmental management frame, there are 03 steps to redress complaint as below: Stage 1: If a household has any complaint, he/she can submit a complaint to the CPC-community monitoring board. CPC will work with CSC and CC to solve complaints. Stage 2: If the complaint is not resolved, the complainant will submit an application to the Di Linh DPC to resolve the complaint. Stage 3: If more than 15 days pass without response from Di Linh DPC, the complainant may submit a complaint to the Lam Dong PPC (through Lam Dong DONRE). Lam Dong PPC will require Di Linh DPC to solve the complaint. In case the complaint is still not resolved, Lam Dong PPC will require environmental police to investigate and requested stakeholders to resolve the complaint. X. CONCLUSION, COMMITMENT AND RECOMMENDATION 10.1 Conclusion

The results of environmental screening and environmental impact assessment show that the sub- project may cause some environmental impacts, but that most of such impacts are insignificant. However, the appropriate mitigation measures have also proposed to manage the negative impacts and maximize the benefit of the subproject. The responsibilities of implementation and monitoring of the stakeholders have also been identified to ensure environmental compliance.

10.2 Commitment

PPMU Lam Dong of the sub-project “Repairing, upgrading Di Linh western and eastern reservoir, flood bypass of Ka La reservoir and productive rural infrastructure in Di Linh district, Lam Dong province” commits themselves to: - Implement requirements of environmental safety as stated in IEE via information dissemination, integrating environmental safety as stated in this IEE in bidding documents in construction and in the CSC contracts; mobilize human resources and monitor internally the IEE compliance; - Report environmental safety implementation to DONRE and CPMU periodically as specified in the IEE; - Compensate and take measures against environmental pollution if there are any problem during operation of the sub-project; - Handle complaints if any.

10.3 Recommendations

Based on the IEE report, the PPMU of Lam Dong would recommend that: - No further environmental assessment is needed because the impacts on environment is insignificant; - Based on IEE, PRI CHP of Lam Dong would like to request functional authorities to give their approval of the IEE for “Repairing, upgrading Di Linh western and eastern reservoir, flood bypass of Ka La reservoir and productive rural infrastructure in Di Linh district, Lam Dong province” sub-project, to create the basis for next implementation steps, ensuring the implementation progress, effectiveness and benefits of the project.
