MINUTES OF THE JULY 28, 2020, MONTHLY MEETING OF THE BAYLES LAKE HOMEOWNERS ASSOCIATION

The regular meeting of the Bayles Lake Homeowners Association Board of Directors was held at Lakeview Country Club, Loda, Illinois, on Tuesday, July 28, 2020, at 7:00 p.m.

Directors Present: President Jim Bash, Vice President Allan Lee, and board members Jerry Bauman, Tom Parker, Paul Zajec, Rod Banks, Stephen Hennessy, Jerry Grodesky, Scott Wilen.

President Jim Bash welcomed everyone after roll call. Comments:

• Jim Bash thanked the board members, employees, and guests for practicing social distancing and appreciated those who chose to wear facial coverings.

• Jim Bash indicated he had planned on introducing our new Maintenance / Grounds Supervisor John Chaddock, but he is sick so we will meet him at the August meeting.

Approval of Minutes: The minutes from the June 23, 2020 board meeting were reviewed and corrections made.

• Jim Bash asked for a motion. Tom Parker motioned to approve the minutes as corrected, seconded by Jerry Grodesky, and the minutes were approved.

Treasurer’s Report: Pam Zajec presented the June Treasurer’s Report of Receipts and Disbursements, which were discussed.

• Jim Bash asked for a motion. Rod Banks motioned to receive the report, seconded by Jerry Bauman, and the report was accepted.

The June board bills were presented, totaling $13,978.56 which were discussed.

• Jim Bash asked for a motion. Tom Parker motioned to approve the bills to date, and review of bills over $1,000.00, seconded by Jerry Bauman, and the motion was approved.

The accounts receivable list was presented and discussed. ($18,979.10) (68). Pam reminded the BOD that these dues are not late as there are a few more days left in the month and she is expecting a large return in the coming days.

ADDITIONAL SECURITY REPORT

6/28/20 Around 8:30 p.m. while on the lake I saw a large group of young adults throwing rocks on Newell Dam into the lake. I was on the east side heading toward them when they took off on a golf cart and I believe 5 bicycles. I headed to my home to get to my car to locate them. After patrolling I did not find them.

6/29/20 Report from 322 Sunrise Drive at 1:41 a.m. of a large group of young adults were in the pavilion with the lights turned on and that a picnic table was turned over. I went to the pavilion and checked it out. When I arrived, the lights were turned out and a picnic table was turned over and there was no one there. I proceeded down Kaufman Drive and saw a flashlight flicker and went to 330 Kaufman. It was there I saw these young men. I identified myself and asked them to stop but they kept on walking between the house and shrubs. I went back to my car and called Dave Harlow to assist me.

When Dave arrived, I went to the door and knocked, and 3 young men came to the door. I asked them if they were in the pavilion and if they had turned on the lights and turned over the picnic table. The young men acknowledged being at the pavilion and that they turned on the lights and turned over a picnic table. They were very apologetic. I then asked them if they were on Newell Dam throwing rocks into the lake at approximately 8:30 Sunday evening. They told me that it was them at Newell Dam and that they were throwing rocks. Again, they were very apologetic. I then asked them to go to the pavilion with Dave and me where I turned on the lights and checked to see if there was damage and had them turn over the picnic table. No damage was found, and the three boys returned to 330 Kaufman Drive.

Maintenance: John Chaddock was sick, Rod Cardinal presented this report:

Assisted Bob with Dumpster Day. We filled three 20-ton dumpsters & one 15-ton dumpster & 2 trailers full of metal recycling.

Took Aluminum cans to G&S recycling.

Mowed, trimmed trees, and weeded along both sides of Newell Dam.

Trimmed tree line and cleared ground vegetation along West entrance road.

Disassembled Samurai trimmer and replaced blades with new and lubricated slides. Assembled trimmer and preformed operational check-OK.

Performed weed control by spraying the West entrance road, lake shoreline including the south lake shoreline.

Mowed & weeded (twice) park areas in front of maintenance building.

Mowed & weeded Memorial Park.

Weeded & mowed around trees in all parks and along East & West entrance roads. Some areas in parks were skipped due to Bee nest & swarming activity. Will try those areas later this week.

Performed hydrant flushing with Rod Banks. Found 2 hydrants leaking. Hydrant locations- Thompson Park & in front of Zajec residence. Repair kits are on order via Rod Banks.

Consistent Brush pile management. Since Dumpster Day I have noticed an increase in illegal dumping activity consisting of furniture, grass, dirt, concrete, a basketball goal/pole and railroad ties. I would like to explore the possibility of installing a trail camera to assist in identifying the individuals that are abusing this service, so they can be reminded of the rules via letter or email. Rules are clearly posted on the entrance gate post.

Consulted with AHW John Deere for a tractor repair. Repair was covered under warranty and repair was made on site in less than 24 hours, outstanding service turnaround. The reverse directional pedal became inoperable during use which caused the tractor to become stuck due to its location. The Gator was used to tow the tractor from its stuck location and be repositioned so it could be operated in forward drive only. After inspection it was found that the reverse pedal had sheared at its drive engagement pivot point.

Received report from Rod Banks that water was leaking from the pneumatic compressor that services the water tank at the West Well House. Inspected compressor & water tank for leak. Found the pneumatic inlet swing valve (check valve) on the water tank bypassing. Brought compressor offline and shut off air/water supply at tank. Removed valve and disassembled- cleaned, lapped gate plate & seat. Assembled valve and installed on water tank, hooked air supply back to tank and brought compressor online. Operational check is satisfactory with no leaks noted. System is inspected for leaks every 2 days. A replacement valve is on order but has not been installed.

Finance: Jerry Grodesky presented:

Jerry Grodesky and Pam Zajec presented the BOD with the yearly Financial Review from Feller & Kuester, CPAs LLP, Champaign. Based on the Feller & Kuester review, we comply with general accounting standards. Those standards require Feller & Kuester to perform a procedural

review for assurance that no material modifications need to be made to our financial statements. We conform with accounting principles generally accepted in the United States.

• Jim Bash asked for a motion. Tom Parker motioned to receive the Annual Financial Review Report, seconded by Jerry Bauman, and the report was accepted.

Jerry stated that he has been in contact with several surveying companies in east central Illinois and found that Krause Surveying, Cullum, Illinois has the best surveying rates and residents that might need a survey should consider contacting them. They will provide our residents with a “Bayles Lake Discount” and charge about $650.00. He asked that an article be added to the next newsletter making our residents aware of this option.

Jerry continues to research grant money and other funding options to help BLHOA keep its costs low on some of our future infrastructure projects. He asked the BOD and attending residents that if they become aware of these options to let him know so he can investigate them.

Stephen Hennessy stated that he continues to research possibilities setting up a 501(c)3 charitable foundation for BLHOA. He has had conversations with an attorney and has another meeting scheduled this week. At the moment this is being done with no cost to BLHOA. He should have more information at the August BOD meeting.

Rod Cardinal noted that at the June BOD meeting comments were made regarding the need for improving our infrastructure project operational reserve funds. One possible plan / option noted was that with the recent July 1 HOA dues assessment bills that were sent out, we expect to receive about $68,000.00 for this quarter. If, for example, the board was able to take 5% or 10% of this amount at the beginning of the quarter and add it to our reserves, this would be a way to build this account.

Water & Sewer: Rod Banks presented:

Water

Completed-IEPA Notification – by Mark LeClair, water samples from 5 homes for testing of copper and lead in their drinking water. Test results will be available later this month.

Tours of both well houses were conducted for the board members which reviewed the equipment and operation of the water supply system. Many questions were raised during the tour which were answered in a summary report which was distributed to the group by email.

An important recommendation was made by Pittsburgh Tank and Tower Group (PTTG) for removal of external rust and an application of protective acrylic paint on the west water storage tank. The cost for the remedial work is $7,983. There were questions brought up last meeting about the warranty. The warranty is for one year since problems that may arise would occur in the first year. Normally, the coating should last for 10-15 years. They requested that the tank be drained to prevent condensation on the tank surface. This is not desirable so we are planning to wait until fall when humidity is low so draining will not be necessary. We will need to supply a

small dumpster for waste paint cans and other construction waste. The entire exterior tank surface will be cleaned and painted which will take two days. Two additional days are needed for the paint to cure. I would like to move forward with this remediation work.

• Jim Bash asked for a motion. Rod Banks motioned to move forward with the remediation work proposed by PTTG, seconded by Jerry Grodesky, and the motion was approved.

Several improvements besides tank painting are planned for the west well house. Gutter guards will be installed for $2,446. The roof will be upgraded to a steel roof with a ridge vent for added ventilation. The existing attic insulation that has fallen away will be replaced. The roof and insulation work were quoted as $2,600. The interior lighting will be improved. The sight glass will be replaced. An emergency eye wash station is being considered given potential exposure to chlorine and fluoride treatment chemicals.

For the east water tank replacement project, Farnsworth is proposing a Professional Service Agreement with specific phases and specific time and material not-to-exceed costs for each phase. We would review the proposal, make any changes, and then agree to the cost of only the first phase. The first phase includes a schematic design with tighter cost estimates and costs for loan applications. We are still waiting on Farnsworth for the agreement.

Metropolitan Industries, Inc. Romeoville, IL, visited Bayles Lake to discuss tank replacement at the east well house. They suggested many potential ideas in building and equipment design and construction that interested us. They are preparing an initial engineering report free of charge for us to review.

Brown water contamination along Lakeview Drive is a current problem for four homes along Lakeview Drive. The Farnsworth Group has agreed to prepare a preliminary evaluation with recommendations for a general approach to a solution. I should receive a proposal in August for our review. I have had discussions and previews with Central Underground Technology, Inc. in Champaign and they are also submitting a proposal in early August.

Two flushing hydrants need repair. Repair kits have been ordered and should be received in early August. We will repair the hydrants ourselves at a good cost savings.

He will also be checking into renting a commercial grade dehumidifier for the west well house to help reduce the humidity inside the facility. We would use this during the summer months.

Sewer Work

Murle Roy jetted a 175-foot section of sewer collection line from a cleanout port at 456 Wolfe Drive along east Rulison Drive after a backflow problem was reported. Afterward, water levels and flows in the port and in a downstream keg at 476 Rulison Drive were observed to be normal.

Mapping of Bayles Lake Community

The building of the infrastructure map is continuing. A total of 513 features have been located by GPS with photos and data and incorporated into the map. A total of 92% of the resident water shutoff valves have been added to the map. Next to locate are the sewer kegs.

We received an invoice for our annual ArcGIS Online license due by October at a cost of $700.

Lakes & Parks: Tom Parker presented:

Tom Parker stated that he had completed this year’s lake water testing program and had received the report. We currently use PDC Laboratories in Peoria for Lake Water Quality Assessment and Certification / recreational purposes.

• Each June seven samples of lake water are collected at different spots from the lake and are tested for fecal coliform/e. coli, nitrate, ammonia, phosphorus and 19 additional different chemicals.

• Tests look for water quality problems or disease-causing pathogens that may pose a health risk for infants, children, and adults while swimming.

• PDC Laboratories uses the Illinois Department of Public Health (IPDH) testing protocol established in the Swimming Pool and Bathing Beach Code, based on guidelines from the U.S. Environmental Protection Agency for Recreational Waters. We continue to be well within their current limits.

Tom indicated that he had received a preliminary copy of the report from Marine Biochemist and the lake shocking / fish sampling project:

On June 4, 2020, a survey of the fish population within Bayles Lake in Loda, IL, was conducted utilizing an electro-fishing boat. The lake is approximately 132 surface acres in size. The boat was equipped with three fiberglass rods with electrodes, which extended out in front of the boat creating an electric field powered by an onboard AC generator with a DC pulse converter. Fish swimming through this electric field were briefly stunned allowing them to be netted and placed in a holding tank. Shocking surveys were completed in 4 designated areas along the shoreline of the lake. The size and species of each fish sampled were recorded for data analysis, and recommendations for any changes to harvesting, stocking, and or structure enhancements are provided in the report.

A total of 457 fish of 11 different species in the lake were sampled. Water clarity was poor with a Secchi depth reading of only 1 foot due to a planktonic bloom, but dissolved oxygen was present down to 13 feet.

Species sampled during the survey included , , green sunfish, channel catfish, white , bullhead, yellow bass, walleye, gizzard shad, golden shiner and striped

bass. Data accumulated during the survey was processed, analyzed, and graphically represented in the report via graphs and charts

Lake Recommendations

Recommendations for the lake are multi-fold. First, it is recommended to install structures throughout the lake to encourage better predator to prey relations, and for spawning. Structures should be of durable, nonbiodegradable materials set in 3 to 8 feet of water as well as in shallow areas to promote spawning. Spawning structure should consist of shallow gravel basins where such substrate is limited.

Stocking of largemouth bass is highly recommended as this species only showed 2 specimens during the survey. More game fish will assist in keeping the significant populations of non- gamefish, such as shad and yellow bass, down. Additional electro-fishing surveys can be done to remove larger shad and yellow bass aiding in their population control. Both species are of limited forage value for gamefish when they grow beyond the 6-inch range.

Stocking a walleye is recommended since only 3 adult specimens were sampled with little indication of spawning. Walleye are desirable and can help in keeping the shad and yellow bass in check.

Stocking of channel catfish can be done since the catch rate was well below the recommended levels from the 2013 survey. No were noted during the survey, but as mentioned in the 2013 recommendations, they can assist in keeping white catfish and bullhead numbers down.

The bluegill and crappie populations were down, and sizes were mostly in the smaller size classes. Stocking of should not be done until largemouth bass populations rebound.

Electro-fishing can assist in removal of smaller panfish, but the emphasis on any electro-fishing removal efforts should be focused on shad and yellow bass along with any bullhead or rough fish that may feed upon fish eggs.

It is also recommended to allow beneficial aquatic vegetation to grow along shoreline areas in order to create more structure. Native aquatic plants provide habitat for fish. Optimum plant cover is normally 15 to 25% of the total surface area. It is recommended that native plants be allowed to grow to a certain extent in the lake with only selective control measures to limit invasive species such as Eurasian Watermilfoil or non-selective control measures to address excessive native plant and/or algae growth.

Dissolved oxygen should be monitored on a regular basis. Monitoring should also be conducted for planktonic algal and other aquatic plant growth. Excessive planktonic algae and/or aquatic plant growth can cause dissolved oxygen crashes negatively impacting fisheries. Aerating a lake of this size is possible but would require advanced budgeting and planning.

Tom said that aquatic specialists, Marine Biochemist, would be treating the duck weed issue at the end of Etty-Kay Bay this week. He has been in contact with the nearby residents advising them of the treatment plan.

Rod Cardinal stated that the county highway shoreline / erosion control project is underway.

Rod also indicated that the dredging work in Bays 1-4, with ILM continues to move forward.

It was noted that Glad’s Tree Service had completed its tree removal work, 10 pine trees, 5 oak trees were taken down and removed from Bayles Lake property.

Rod added that Adkins Stump Removal should begin their stump removal work on August 1 and will be grinding out 22 stumps. Maintenance and Grounds will level the leftover chips and eventually seed and mulch these areas.

Roads & Drainage: Paul Zajec presented:

Paul Zajec stated that the drainage work on Weaver Court had been completed by Murle Roy Construction and had been paid.

Paul indicated that Chandler Excavation would begin their drainage work on Rulison Drive, Wolfe Drive and Ocala Drive after August 1.

Paul said that United Paving would begin their asphalting repair work mid-August.

Paul fielded several comments and complaints about the speed bump that was installed near 563 Sunrise Drive. He said the speed bump was installed as a safety device with the goal of slowing down traffic on a tight curve. There had been a couple incidents earlier this summer that had residents living in that area concerned and had asked for help. He said that this has been an effective tool and the bump was going to stay in place until this winter but was open to other ideas.

Several residents offered suggestions to improve travel in the area. Ideas like adding a stop sign or creating a divided road concept were presented. The idea of creating a golf cart / bicycle opening in the middle was presented and he would investigate this option with our maintenance and grounds supervisor. This opening would be about 5 feet wide or a little less. Cars, trucks, etc. would still have to slow down as one wheel would still have to cross the bump. Golf carts would have to slow down to navigate the opening.

Rules & Regulations: Jerry Bauman presented:

Jerry Bauman reviewed a previous safety complaint regarding the age of golf cart drivers. He talked about several examples from other States that had been provided at previous BOD meeting and comments from various insurance companies. Laws regarding public roads and private roads had also been discussed. He listened to various comments from the residents attending the meeting and he cited a response from our attorney Ellen Lee.

• “On the issue of BLHOA liability to a cart operator if they get injured, that would likely be the same as a walker or jogger getting injured, and the standard is an unreasonably dangerous condition resulting from negligence on the part of the HOA, like perhaps a big pothole. I don't think the age of the driver makes any difference in this regard.”

Jerry recommended the current rule remain in place for now because the BOD could not agree upon any change.

• Jim Bash asked for a motion. Jerry Bauman motioned to keep the wording in our rules and regulation regarding this topic the same, seconded by Tom Parker, and the motion was approved.

Jerry Bauman introduced a comment from Ray Soltysiak, Building Permit Inspector. Ray would like to add the first sentence, as underlined, to the rules and regulations.

• "Variance requests may be considered by the Bayles Lake Homeowners Association Board of Directors on an individual basis and not on historical precedent”. The majority of the Bayles Lake Homeowners Association Board of Directors must approve any variances from these rules. The Board of Directors may consult with neighbors where a variance is contemplated, and the affected neighbors may be required to sign a form consenting to the variance."

• After a brief discussion, Jim Bash asked for a motion. Stephen Hennessy motioned to add this wording in our rules and regulations, seconded by Scott Wilen, and the motion was approved 8-1.

Jim Bash noted that the new wording will be published in our October Newsletter and then added to our rules and regulations.

Allan Lee stated the homeowner at 302 Weaver Court would have the old dock pipes removed before the August BOD meeting.

Jason and Alicia Moser, 531 Karr Lane, are seeking a variance from the following section of our Rules and Regulations:

Building Permits - General Requirements

1) Easements and Building Line Restrictions

a. Maximum Lot Coverage

A lakeside lot set back of at least twenty (20) feet is required from the farthest projection of the house including walkway, patio or ground level deck.

The homeowner is requesting a variance to build a lakeside addition to this residence. Due to the limited lot depth on this side of the property, the addition will result in a setback distance of about sixteen (16) feet.

The Building Permits Committee is recommending approval of this 14-foot x 20-foot home addition.

A question was asked if the new structure would interfere with any neighbors site lines of the lake…the response was no. A question was asked if a property survey needed to be done…the response was no. The property pins were exposed, and the new addition is well with in the homeowner’s property lines. A question was asked if there is any BLHOA infrastructure on the lakeside of the current home that would be compromised…the response was no.

• After a brief discussion, Jim Bash asked for a motion. Allan Lee motioned to approve this variance request, seconded by Jerry Bauman, and the motion was approved.

Therese Wyman, 136 East Lucy Goff Lane, presented the BOD with information regarding her building an inground swimming pool at 142 East Lucy Goff Lane.

The Chairperson of the Building Permits Committee and his committee members as well as our Building Inspector have reviewed the site. Everyone agrees that as long as it is built on 142 East Lucy Goff Lane and not on Bayles Lake Homeowners Association property and they meet all the zoning specifications and permitting requirements of Iroquois County, they should be able to proceed as they wish with a new inground swimming pool.

The BOD also had the opportunity to review a supportive letter from attorney Ellen Lee. The Bayles Lake Homeowners Association Board of Director’s supports this request.

• Jim Bash asked for a motion. Tom Parker motioned to approve support, seconded by Jerry Grodesky, and the motion was approved.

Old Business:

Rod Cardinal and Pam Zajec were asked to provide a review of the July 3-5 weekend activities of fireworks, music on the lake and lighted boat flotilla. Both felt this year’s events were among the best that Bayles Lake has enjoyed in several years. The fireworks seemed a little brighter and louder, three bands participated in the Music on the Lake program and the evening, lighted boat parade, was a huge success. Both agreed it would be hard to duplicate for next year but is looking forward to the challenge. Both thanked the board for their support.

Jim Bash stated that a third letter-general appearance letter had been sent to 1502 Golf Drive and the household renovation items on patio area has been cleaned up.

There has been no response from the homeowner, and he will refer this situation to Ellen Lee and ask her for help in contacting the residents and hopefully some improvements take place soon.

Jim Bash began a discussion regarding the of Annual HOA Meeting, September 21, 2020 at the Robinson Pavilion, 6:00 p.m. Should we continue to plan for this meeting?

This meeting was originally scheduled for May 4. Due to the Covid-19 pandemic our meeting was postponed and rescheduled for September 21.

However, our By-Laws and Phase 4 of Governor Pritzker’s “Restore Illinois” plan are in conflict which led the board to consider cancelling this meeting. The BOD felt the health, safety and well-being risks are still too uncertain to have a large gathering and we typically have 75-100 people attend this meeting.

Our By-Laws states the following information: Page 28 / 29

ARTICLE IV - MEETING OF MEMBERS

SECTION 1. THE ANNUAL MEETING. The Annual Meeting shall be held the first Monday of May.

• SECTION 3. QUORUM. Fifty (50) or more Members present at any meeting or represented by proxy shall constitute a quorum. If a quorum is not present at any meeting of the Members, a majority of the Members present may adjourn the meeting from time to time without further notice.

• Gatherings: All gatherings of 50 people or fewer are allowed.

Ellen Lee will be consulted but pending her review the BOD moved to cancel the 2020 Annual HOA Meeting. The next HOA meeting is scheduled for May 3, 2021.

• After discussion, Jim Bash asked for a motion. Tom Parker motioned to approve cancelling the 2020 Annual HOA Meeting, seconded by Stephen Hennessy, and the motion was approved.

New Business:

Jerry Grodesky suggests to the board that it might be time to review the current pontoon boat motor requirements and consider increasing Pontoon motor horsepower:

(5) Maximum Motor Restrictions, Page 4, a. Pontoon boats – 10 h.p. b. Run-about and fishing boats 12 or more feet long – 8 h.p. c. Run-about and fishing boats less than 12 feet long – 6 h.p. d. Canoes, paddleboats and other such boats may only use a battery-operated electric motor as an alternative source of power. e. Owners of sailboats that are 16 feet in length or less may use a trolling motor as alternative power when not under sail. f. Owners of sailboats over 16 feet in length may use a trolling motor or a boat motor up to 8 h.p. in size as an alternative power source when not under sail.

Jerry says in his research of other lakes of comparable size our lake could handle a pontoon boat motor increase to 15 h.p. to 20 h.p. or even 25 h.p. He says this comment comes up with almost every prospective new homeowner and visitor to our lake.

Rod Cardinal indicated that Saturday, July 3, 2021, 9:00 pm will be the next fireworks event. No rain date has been set yet.

Jim Bash discussed a resident having a Black Lives Matter sign in front of her house, next to her front door. After a brief discussion, the BOD agreed to work with the resident and leave the sign in place.

Rod Cardinal said the Robinson Pavilion is “Plan B” for the Peterik Wedding at Memorial Park / Robinson Pavilion / Healey Park on September 25-27. The family, 498 Sunrise Drive, hopes to have a lakeside wedding and would only need the pavilion in case of inclement weather. There would be 50 people or less at the wedding.

Rod Cardinal updates the following information:

• August 15, “Music on the Lake”, a community event, 3:00 p.m-6:00 p.m. The music will be provided by residents Tedd and Ramona King, combining the gifted "The JMT Trio" and the legendary “Back Paige’s”. Enjoy an awesome music show from your boat on the lake, drop your anchor near the dock at 1004 Parker Terrace.

• SEPTEMBER 6, “Music on the Lake”, a community event, “The Bygone’s” return to Bayles Lake. Residents Katrina Cheney and Bill Dick, 518 Sunrise Drive, are hosting a lake-front party on Sunday, 1:00-3:30 pm, September 6, and invite the Bayles Lake community to float over to their boat dock area and share in the great music of The Bygone’s.

Rod Cardinal indicates that an updated and revised calendar has been emailed to all residents and they will also receive an additional email reminder.

Jim Bash asked for any additional business for the board, and hearing none, he asked for a motion to adjourn. Meeting was adjourned on motion by Tom Parker, seconded by Stephen Hennessy, at 8:58 p.m.
