MINUTES OF THE MAY 26, 2020, MONTHLY MEETING OF THE BAYLES LAKE HOMEOWNERS ASSOCIATION

The regular meeting of the Bayles Lake Homeowners Association Board of Directors (BOD) was held at Lakeview Country Club, Loda, Illinois, on Tuesday, May 26, 2020, at 7:01 p.m.

Directors Present: President Jim Bash, Vice President Allan Lee, and board members Jerry Bauman, Tom Parker, Paul Zajec and Rod Banks

Absent: Stephen Hennessy, Viva Siddall, Jerry Grodesky

Employees Present: Treasurer: Pam Zajec; Administrative Assistant: Rod Cardinal

Absent: Bob Siddall, Gene Miller, Ray Soltysiak. Their absence had been requested by Jim Bash. They have filed a report with Rod Cardinal. Their report will be reviewed and made part of the meeting minutes.

President Jim Bash welcomed everyone after roll call. Comments:

• Reminded the board that the March 24 and April 28 BOD meetings had been cancelled due to the Coronavirus Pandemic and that we would be reviewing board / business activities from February 19 to the present. He noted that the board was practicing social distancing by sitting 6 feet apart and everyone was wearing a mask. • The Bayles Lake community has been kept informed of changes / cancellations via the Bayles Lake website, email blasts and the community has done a great job informing residents of other activity through the Bayles Lake Facebook page. • Stated that he appreciated everyone’s patience and for looking out for their neighbors. • Explained to the Board that the May 4 Annual Meeting was being postponed because of the State of Illinois mandate prohibiting gatherings of larger than 10. Board members recommended that residents be notified that the HOA Meeting has been rescheduled to Monday, September 21. • Jim Bash asked for a motion. Jerry Bauman motioned to approve the date of the rescheduled HOA Annual Meeting, seconded by Tom Parker, and the new meeting date was approved. • Indicated to the BOD that at the end of the board meeting they would need to move to executive session to discuss a personnel issue.

Approval of Minutes: The minutes from the February 18, 2020 board meeting were reviewed and corrections made.

• Jim Bash asked for a motion. Tom Parker motioned to approve the minutes as corrected, seconded by Rod Banks, and the minutes were approved.

• There was no March 24 or April 28, 2020 BOD meeting as previously noted.

Treasurer’s Report: Pam Zajec presented the February Treasurer’s Report of Receipts and Disbursements, which were discussed.

• Jim Bash asked for a motion. Tom Parker motioned to receive the report, seconded by Jerry Bauman, and the report was accepted.

The February board bills were presented, totaling $13,848.49, which were discussed.

• Jim Bash asked for a motion. Tom Parker motioned to approve the bills, seconded by Rod Banks, and the bills were approved.

The April board bills were presented, totaling $7,325.73, which were discussed.

The accounts receivable list was presented and discussed. ($4,742.76) (19).

Pam Zajec noted that for FY 20-21, to date we have received $1,035.00 in contributions. She reminded the board that this was a new line item on the “Report of Receipts and Disbursements”, approved at the February meeting. This is a restricted account and contributions can only be spent on specified items as designated by the contributor.

Pam Zajec indicated that she had requested and had been receiving Certificates of Insurance forms from the various vendors that do business with Bayles Lake.

Visitors:

Jim Bash asked the visitors to introduce themselves and state their reason for attending the meeting. If they have discussion points, he will assign them to various committees to be discussed at that time.

• Information regarding the BOD seeking an Application for Small Business Loan / Paycheck Protection Plan, had been provided to BOD via email, motion by Jim Bash, “Should BOD pursue this”? Not Approved 6 - 1 via email vote.

• Jim Bash noted that during the pandemic the BOD has not laid anyone off and it has been able to meet the payroll obligations. There are a lot of small businesses that have been unable to meet their payroll obligations, are struggling and have a greater need for this.

Water & Sewer: Rod Banks presented:

Water • Request-IEPA Notification – by Mark LeClair, drinking water sample collected from a resident’s home for the Disinfection By-Products Testing Program. Routine testing conducted every 3 years, June 1-30.

• Completed-IEPA Notification – by Mark LeClair, Annual Drinking Water Quality collection requirements. The Consumer Confidence Report has been posted on our website. In 2017, lead and copper levels were found to be below the maximum contaminant level (MCL) allowed. In 2018, seven inorganic contaminants were found to be below the MCL. In 2019, chlorine and radium, a naturally occurring radioactive element, were below the MCL.

• Completed-IEPA Notification – by Mark LeClair, collected water samples for nitrate testing.

• Completed-IEPA Notification – by Mark LeClair, to review and sign off on Asbestos Monitoring.

• Submitted by Rod Cardinal to IEPA / “Notification of Ownership and Responsible Operational Personnel” for our Community Drinking Water Supply.

• Submitted to Pam Zajec / the information from PDC Laboratory / renewing the Contract for Testing Drinking Water.

• Homeowners repaired water leaks in their crawlspaces at 370 Kaufmann Drive, 430 Wolfe Drive, 1424 Country Club Lane, and in the basement at 1426 Country Club Lane.

• The west well house water storage tank will be inspected and cleaned by Pittsburg Tank and Tower Group on Wednesday, May 27th. The tank will be inspected to ensure compliance with governmental requirements. In addition, PTTG will look for sources of contaminants and perform ultrasonic thickness testing. Sediment and debris will be removed. Chlorine disinfection and sample testing will be done before returning the tank to service.

• Farnsworth Group has completed its research into three design options for replacement of the 40-year-old hydropneumatic water tank in the east well house according to current IEPA regulations. Rod has had conversations with the group of Mark LeClair, Bob Siddall, Rod Cardinal regarding this project. BLHOA received a comprehensive report on the descriptions of the options, benefits and drawbacks of each, and estimated costs. Financing alternatives were given. This group will meet again with Farnsworth before the next BOD meeting. A copy of the report will be distributed to all Board members to review for the June 23rd meeting. Mike Friend from Farnsworth will present his findings.

• Brown water contamination along Lakeview Drive is a serious issue that I believe we must address now. Four contiguous homes are affected in a pattern that indicates the local water main has settled in a bowl shape that readily collects sediment. Two homes

in the middle have severe contamination, two outer ones, less so, and all remaining distant homes have clean water. The hydrant is flushed almost weekly. Two options are being considered – installation of a new, traced HDPE pipe in the affected area by directional drilling and forming a complete loop with HDPE using boring/trenching methods. Midwest Underground Technology, Inc. (MUTI) in Champaign and Farnsworth Group will be contacted for consultation.

• Waiting on a quote from Chandler Excavation to repair the flushing hydrant in Thompson Park.

• Review Option-Hiltz Sanitation / portable bathrooms at Robinson Pavilion. Rental of a Porta-Potty unit is $450.00 for the remaining summer / fall events hosted at the pavilion. This cost will be shared with the Bayles Lake Auxiliary.

• Jim Bash asked for a motion. Paul Zajec motioned to approve the Porta-Potty rental, seconded by Allan Lee, and the motion was approved.

Sewer Work • Proof of Septic Inspection / Service Report / Compliance Letters were sent on May 1.

• Homeowner repaired a sewer back up problem at 472 Wolfe Drive.

• Murle Roy jetted the sewer line along 200N road and Sunrise Drive. Water was flowing unimpeded.

• Jim Balk has been asked by phone calls and in writing to finish the area by 158 Sunrise Court with no success. We should examine the area, fill in the hole ourselves, and plant grass seed.

Mapping of Bayles Lake Community • The building of the infrastructure map is proceeding well. The ArcGIS online program has been completely configured for our community with 39 feature layers such as hydrants, kegs, culverts, sewer lines, streetlights, etc. each with its own maintenance/inspection table. A total of 227 features have been located by GPS with photos and placed on the map. In one application, the Lakeview Drive area has been completely mapped out in preparation for consultation with MUTI and Farnsworth on the brown water abatement project. A step-by-step user’s manual has been written for others to be able to use and update the map. Web apps can easily be made to share the map with the public and contractors. Work is continuing to add the rest of the features to the map so it can be used as a valuable tool.

Lakes & Parks: Tom Parker presented:

• Reported that the fish order had been delivered. We received 3,000, 6 to 9-inch

• Reported that Richard Vance was requesting an advance per contract for continuation of shoreline erosion control work, south side of county road 200 north, Email, Motion by Paul Zajec, Approved 9 - 0 via email vote. We are waiting on his invoice.

• Reported that Loda Fire Protection District request to build a level loading pad had been approved 9 - 0 via email vote. The Loda Township and Loda Fire Protect District each approved to pay 1/3 of the cost.

• Reported that the Tree removal plans, 10 - 12 trees, has been delayed due to weather.

• Reported that tree stump removal work, 20 – 22, has been delayed due to weather.

• Reported lake water testing will be completed in June and delivered to PDC Labs in Peoria.

• Followed up report of fish being swept over the spillway due to very high-water levels. They were mostly shad fish and carp, and this was a good thing.

• Followed up report on dead fish in the lake, his theory is these were , catfish and blue gill and their deaths were related to the fact that we have had many fisherman this spring resulting in lots of “catch and release” and some fish were severely traumatized and died. He will continue to follow this item.

• Reported that he is still planning on having the lake shocked and sampled to evaluate the fish population and health.

Rod Cardinal reported that Integrated Lakes Management should be here this week.

Harrison Short, 1426 Country Club Lane, presented information regarding a boat he is building. He provided the BOD with pictures and drawings of this vessel. It will eventually look like a floating “Tiki Boat”. The BOD complimented him on his creativity and stated that we do not have any rules relating to what a boat should look like. The BOD thanked him for asking their opinion, but he did not need their permission regarding the boat. Harrison indicated that he would comply with all state and local rules. He plans to dock this boat at Thompson Park.

Roads & Drainage: Paul Zajec presented:

• Paul has marked 10 areas on Sunrise, Skyline and Sunset Drive for asphalt repair work. He is requesting bids for about 4,500 square feet from United Paving and Prairie Pavement. Depending on the asphalt repair cost will determine if he has any money left to begin to do some additional crack filling.

• Paul is waiting on drainage repair estimates for possible drainage projects at 246 Ocala Drive, 468 Wolfe Drive, 496 Rulison Drive, and 310 Weaver Court.

• Paul Zajec, Rod Cardinal and Bob Siddall met with residents at 106 Sunrise Drive on some drainage issues but agreed that this was an Iroquois County problem. Information will be forwarded to the Iroquois County road commissioner.

Rules & Regulations: Jerry Bauman presented:

Tents in parks. Recall at the last in-person BOD meeting, the Zajec’s were planning an event mid-summer and asked about short-term use of tents for visitors in the parks. In reviewing the rules, we can find no rule that prohibits this. It is suggested that Paul and Pam make a onetime special request to the BOD for approval. The Zajec’s made their request.

• Jim Bash asked for a motion. Tom Parker motioned to approve this special request, seconded by Jerry Bauman, and the motion was approved.

It was suggested that the Zajec’s share this information with their neighbors, so everyone is aware of the special request and activities related to this family event.

Construction of sheds, buildings and garages. An issue arose at the last BOD meeting and we were asked to review the relevant rules pertaining to this subject.

• After the review, the opinion is the current rules are clear, effective and require no alteration or action.

Modify building permit requirements. We propose to change (page 9, 2. a) to: “An official survey document of the pertinent lot must be submitted when any one of the following 3 instances occurs: new home construction, remodeling work that expands the size of the home structure or any change of ownership/possession. Survey lot markers must remain in place and visible during construction.”

• This item was tabled until the June 23 BOD meeting.

Grass clippings and leaves blown into lake. It was suggested we needed clarity / new rule to prohibit this. Our suggestion is we change the wording to the following:

• “. Grass clippings and leaves are not allowed at the burn pile behind the maintenance shed. Leaves can be burned at the designated areas around the lake that are constructed for this purpose each Fall. Grass clippings should not be placed in these leaf burning areas.”

• “∙ Leaves and grass clippings should not be purposely blown into the lake by the homeowner or those employed by the homeowner.”

• Jim Bash asked for a motion. Allan Lee motioned to approve this wording changes, seconded by Paul Zajec, and the motion was approved.

Age of children driving golf carts, etc. In response to a recent formal complaint regarding reckless driving of golf carts by children, Jim Bash asked us to review the current rules.

Our current rule states, “Minimum age for unaccompanied children driving these vehicles is 13. Although strongly discouraged, younger children are allowed to operate these vehicles if accompanied by a BLHOA member with a valid driver’s license.”

From my research, to drive a golf cart on public roads in Illinois, one must hold a valid driver’s (i.e., be at least 16 years old). But there is no guidance or law regarding private roads; the State allows homeowner associations to determine this individually.

Jim Bash thought the wording “although strongly discouraged” is ambiguous. Some states do have regulations, even for private roads and seem to vary between 13 (California and South Carolina) to 16 years old.

For this reason, I propose we leave the age requirement the same but change the language to: “Minimum age for unaccompanied or accompanied children driving these vehicles is 13.”

Building Inspector / Permits: Allan Lee presented:

• Homeowner at 302 Weaver Court will remove the old dock pipes in the lake when his yard dries up as he needs to bring a tractor to his shoreline.

• Allan Lee began a discussion regarding 402 Wolfe Drive and an “Encroachment Resolution”. Regarding this property, Allan and Ray Soltysiak had a meeting with the realtor and residents regarding the sale of a small portion of the BLHOA easement to bring the home into compliance.

• Many years ago, portions of the home were built over the BLHOA property line. The residents have requested a “Quit Claim Deed” and are wishing to sell this home and want to take corrective measures to make this property legal so that future property owners do not have the same problems.

• Allan Lee has prepared a “Encroachment Resolution” that has been reviewed by our attorney that includes a fair market price of $9,271.00. The current assessed value for this property is $1.39 per square foot and 2,218 square feet, which amounts to $3,083.00 assessed value. Fair market value is three times the assessed value which amounts to $9,271.00.

• After negotiating with the residents and in consultation with our attorney, the Building Permits Committee is recommending to the BOD to accept an offer of 50% of the fair market value $4,636.00 to settle this matter.

• After a discussion, Jim Bash stated that this item would need to be approved via a roll call vote and asked for a motion. Tom Parker motioned to approve the 402 Wolfe Drive “Encroachment Resolution”, seconded by Jerry Bauman, and the motion was approved 6 – 0.

The resolution was signed by Jim Bash and will be forwarded to our attorney, Ellen Lee and then the residents.

The residents will be required to file this information at the Iroquois County Recorder’s Office and provide the BOD with a receipt of this filing.

Ray Soltysiak was absent but filed the following report:

• RANDY HENDRICKS - 1611 LAKEVIEW DRIVE - WILL ADD 3' TO EACH SIDE OF THEIR CEMENT DRIVEWAY

• CATHY ROSEN - 520 SUNRISE DRIVE - WILL ADD A 32' X 12' SECTION TO THE NORTH SIDE OF PRESENT DRIVEWAY

• WILLIAM DICK - 518 SUNRISE DRIVE - WILL REPLACE EXISTING DOCK IN THE SAME PLACE BUT WILL MAKE IT PERPENDICULAR TO THE SHORELINE TOTAL LENGTH WILL BE 22'

• BECKE BOUDREAU - 476 RULISON DRIVE - DUMPSTER PERMIT

Randy Hendricks, 1611 Lakeview Drive, after meeting with Ray Soltysiak, presented a “Request for Variance” from a section in Building Permits as he wants to pour a concrete sidewalk over the BLHOA easement and existing sewer collection line, lakeside of the home, from the house to the dock. The homeowner has a family member with a disability and a concrete sidewalk will benefit the persons mobility to and from the lake.

• D. Building Permits, General Requirements, Page 8, #2 Easements and Building Line Restrictions, #b: The structure including walks, patios and decks shall be built inside all designated setback lines.

After a brief discussion, Jim Bash reminded the homeowner that this is the homeowner’s expense and any subsequent repair work to Bayles Lake easement or infrastructure would also be the homeowner’s responsibility. That was acknowledged by the homeowner. The homeowner shall maintain the document and convey it to any future homeowners.

• Jim Bash asked for a motion. Tom Parker motioned to approve the variance request, seconded by Paul Zajec, and the request was approved.

Rod Cardinal noted that the July 3 fireworks show is still being held, 9:00 pm at Newell Dam.

New Business:

Jim Bash stated the Bob Siddall, Maintenance and Ground Supervisor is retiring. He and his wife have acquired a home at Lake Iroquois (LIA) and are in the process of remodeling it with the eventual idea of selling their Bayles Lake home and moving to LIA. Regretfully the BOD will have to hire a replacement. The board thanked Bob for doing a great job for our community. Bob will continue to assist the community until a replacement has been hired and he will also help train the new individual.

• Jim Bash asked for a motion. Allan Lee motioned to accept Bob Siddall’s retirement letter, seconded by Rod Banks, and the letter was accepted. Further discussion would follow in executive session.

Jim Bash stated that Viva Siddall would be resigning from the BOD as a district director effective immediately. A selection / nominating committee will be appointed to fill the three vacancies on the BOD for the HOA Annual Meeting, September 21, 2020.

• Jim Bash asked for a motion. Jerry Bauman motioned to accept Viva Siddall’s resignation letter, seconded by Paul Zajec, and the letter was accepted.

Rod Cardinal, in consultation with attorney Ellen Lee, asked the BOD to consider adding an emergency procedural provision to our By-Laws. A copy had been emailed to all BOD members.

In light of the Covid-19 problems and all of the associated issues it has created, the BOD is advised to add to our By-Laws, Article V – Board of Directors, Section 4, General Powers, to formally allow the Bayles Lake Homeowners Association (BLHOA) President, in light of any declared National and / or State declared emergency or act of unforeseen calamity, to allow the board treasurer to manage the day to day business affairs of the association until directed by the President to resume normal Board of Directors operating procedures.

ARTICLE V – BOARD OF DIRECTORS

SECTION 4. GENERAL POWERS. The Board of Directors shall be responsible for the general management and direction of all affairs of the Association, and shall have the power to adopt such By-Laws, and impose such obligations upon the Members as it may from time to time deem necessary and proper, except as otherwise herein provided. However, acquisition of property, except for delinquency sales, must be approved by a majority vote of the Membership.

The Board President may appoint the Bayles Lake Homeowners Association Board Treasurer, in light of any declared National and / or State declared emergency or act of unforeseen calamity, to manage the day to day business affairs of the association until directed by the President to resume normal Board of Directors operating procedures.

Responsibilities to include maintaining continuity in conducting daily lake business affairs, paying bills, communicating with board members, communicating with residents, communicating with vendors and contractors. The BLHOA Treasurer cannot approve board related items, i.e., contracts, meeting minutes, make changes to our rules and regulations or financial reports, etc.

• After a brief discussion Jim Bash asked for a motion. Paul Zajec motioned to approve adding this procedural provision to our By-Laws, seconded by Tom Parker, and the motion was approved.

Rod Cardinal noted the broken Frontier communication pole was repaired May 15. He thanked Jim Clarage for his assistance.

Rod Cardinal noted that on March 21, a reported possible gas leak near the east entrance / Nicor made repairs.

Rod Cardinal noted that the Lake Iroquois road race scheduled for June 20 has been cancelled due to the corona virus.

Jim Bash stated that “General Appearance” letters and photos had been sent to residents at 1502 Golf Drive and 160 Sunrise Court, encouraging them to clean up piles of debris in their yards. Jim had heard back from 1502 and he would follow up and get a response from 160.

Jim Bash began a lengthy discussion regarding a safety complaint filed by residents from 561 Sunrise Drive. The resident observed a golf cart with a young driver with a parent riding as a passenger, driving too fast around the corner near this resident’s home. At the particular moment traffic on the corner was very congested and given the speed of the golf cart and road congestion almost had an accident with a delivery service vehicle, U-Haul truck, and a Jeep.

Jim Bash asked the Rules and Regulations Committee to review this R/R section. As noted during the Rules and Regulations report:

Our current rule states, “Minimum age for unaccompanied children driving these vehicles is 13. Although strongly discouraged, younger children are allowed to operate these vehicles if accompanied by a BLHOA member with a valid driver’s license.”

From my research, to drive a golf cart on public roads in Illinois, one must hold a valid driver’s (i.e., be at least 16 years old). But there is no guidance or law regarding private roads; the State allows homeowner associations to determine this individually.

Jim Bash thought the wording “although strongly discouraged” is ambiguous. Some states do have regulations, even for private roads and seem to vary between 13 (California and South Carolina) to 16 years old.

• After much discussion, this item was tabled until the June 23 BOD meeting. Jim Bash stated that he would respond to the complaint.

Jim Bash presented a list of Auxiliary event dates.

• Jim Bash asked for any additional business for the board, and hearing none, he asked for a motion to suspend the public meeting and move to executive session to discuss a personnel issue. Jim asked Administrative Assistant Rod Cardinal and Treasurer Pam Zajec to stay for this meeting.

Meeting was suspended on motion by Tom Parker, seconded by Jerry Bauman at 9:12 p.m.

The Board of Director’s returned to public session at 9:32 p.m.

Rod Cardinal reviewed some general information regarding the Maintenance and Grounds position:

• Living at Bayles Lake is preferred. We may expand our search area to Loda, Lake Iroquois and Paxton. • This is an active position March 1 to November 30, paid monthly. • Approximate hours are 8:00 am to 3:00 pm, Monday through Friday. • This position is considered “On Call”, December 1 to February 28, when work around the lake is more infrequent, the hours are documented. This may be related to hydrant flushing, storm damage, water line breaks, sewer issues, etc. • There is some flexibility in this position. • Hourly pay rate to be determined.

Jim Bash asked that the residents be notified via an email blast and that this information will also be posted on the website.

Jim Bash is recommending a closing date of June 23, 2020.

Jim Bash indicated that interviews maybe conducted before the closing date, but no one could be hired prior to the June 23 Board of Directors monthly meeting.
