BULGARIA 2020 INTERNATIONAL RELIGIOUS FREEDOM REPORT Executive Summary The constitution provides for freedom of religion and conscience. Religious groups may worship without registering, but registered groups receive benefits. The constitution recognizes Eastern Orthodox Christianity as the country’s “traditional” religion, and the law exempts the Bulgarian Orthodox Church (BOC) from registration. In December, the Plovdiv Appellate Court began hearing an appeal by 14 Romani Muslims convicted in 2019 of spreading Salafi Islam, among other charges. Muslim leaders again said several municipalities denied permission to build new or rehabilitate existing religious facilities. The Evangelical Alliance and some other religious groups stated the government did not apply COVID-19 restrictions on religious groups equally, favoring the BOC. The European Court of Human Rights stopped the deportation of three Uyghur Muslims to China. In February, a Shumen court ruled the municipality’s ordinance restricting proselytizing was unconstitutional. A parliamentarian and member of the governing political coalition criticized the ruling, which was being appealed, calling Jehovah’s Witnesses a “dangerous sect.” In February, the Supreme Administrative Court upheld the Sofia mayor’s ban on the annual march honoring Hristo Lukov, leader of a pro-Nazi organization in the 1940s, restricting the event to laying flowers at Lukov’s plaque. The academy of sciences published a report, backed by several government ministries, denying the World War II-era government had sent Jews to forced labor camps but instead had tried to save them from the Nazis. The Jewish nongovernmental organization (NGO) Shalom reported death threats, increased incidents of anti-Semitic hate speech in the context of the COVID-19 pandemic, and periodic vandalism of Jewish cemeteries and monuments. -

Beata Wojna Far from Stability: The Post-Election Landscape in Bulgaria Dariusz Kałan Early parliamentary elections not only will not help restore political stability in Bulgaria but also could further deepen the chaos because of the high dispersion of votes and the expected difficulties with creating a coalition. For a country immersed in crisis, maintaining the post-election stalemate is particularly not beneficial because of the deteriorating economic situation and growing public pressure. Regardless of which party will return to power, one should not expect a significant improvement in Bulgaria’s image in the EU or a positive settlement of the most important issues, including the country’s rapid accession to the Schengen area. Although the winner of the early parliamentary elections of 12 May was the centre-right Citizens for European Development of Bulgaria (GERB, 30% of votes), for all four parties that exceeded the 4% electoral threshold, the results can be seen as satisfactory. GERB, the ruling party in 2009–2013, won for the second time in a row during unfavourable economic and social situations. The similar support for the Bulgarian Socialist Party (27%), which received more than 600,000 additional votes than in 2009, is because of the mobilisation of its permanent electorate and generational changes in the party. Also, for the Movement for Rights and Freedoms (11%), which represents the Turkish minority, and the nationalist Attack party (7%), the results are a confirmation of their stable positions on the political scene. -

Brussels, 14 April 2020 Dear Ms Elżbieta Witek, Marshal of the Sejm of the Republic of Poland, Dear Members of the Polish Parliament, Dear Colleagues, As Members of the European Parliament, we are writing to express our deep concern regarding the Parliamentary Document no 39 on amending the act of June 6, 1997 - the Penal Code - known as the “Stop paedophilia” bill - and Parliamentary Document No 36 on the amendment to the Act of 7 January 1993 on family planning, protection of the human fetus and conditions for the termination of pregnancy -known as “Stop Abortion” bill - that will be debated in a first reading in the Sejm of the Republic of Poland in your sitting of the 15-16 April 2020. We are convinced that measures that roll back protections for women’s human rights and self- determination are of grave concern as they undermine a core European Union value, that of advancing gender equality. Under human rights law measures that undermine or restrict exist- ing rights are not permitted and these draft bills violate Poland’s obligation to ensure ever greater protection of human rights. We are deeply concerned that the “Stop Abortion” bill provide for the prohibition of termina- tion of pregnancy due to severe or fatal foetal anomalies, currently a legal ground for abortion in Poland. Poland’s Act of 1993 on Family Planning, Protection of Human Fetus and the Con- ditions of Legal Pregnancy Termination is one of the most restrictive laws on abortion in the European Union. The bill would in effect result in a near total denial of access to legal abortion in Poland as most legal abortions are performed under this ground. -

INTERNATIONAL ELECTION OBSERVATION MISSION Bulgaria – Early Parliamentary Elections, 11 July 2021 STATEMENT OF PRELIMINARY FINDINGS AND CONCLUSIONS PRELIMINARY CONCLUSIONS The 11 July early parliamentary elections were competitive with fundamental freedoms generally respected. The campaign environment was dominated by mutual accusations of corruption between the former ruling party and the provisional government, and underpinned by law-enforcement’s actions to curb vote-buying. The elections were conducted under an adequate legal framework overall, which was substantially revised shortly before elections, straining electoral preparations and affecting legal certainty. The technical aspects of the elections were managed efficiently, despite the compressed timeframe, COVID-19 pandemic and late adoption of some important procedural regulations. The transparency and accountability of campaign finance were reduced by the deficiencies in oversight and limited reporting requirements. Media offered scant editorial and news coverage of the campaign, impacting voters’ ability to make an informed choice. In the polling stations observed, the voting process was transparent with procedures largely followed. The implementation of machine voting as the only voting method for most voters was generally efficient, with minor malfunctions reported. The legal framework overall provides an adequate basis for the conduct of democratic elections. The May 2021 amendments introduced mandatory machine voting for most voters, established a new Central Election Commission (CEC), removed limitations and changed the criteria for establishing polling stations abroad. While generally welcomed as an improvement, the amendments were introduced shortly before the elections, limiting the time for informing voters on the new procedures and affecting legal certainty, contrary to international good practice. Longstanding ODIHR and the Council of Europe’s Venice Commission recommendations pertaining to key aspects of the electoral process remain to be addressed. -

Summary Early parliamentary elections were held in Bulgaria on July 11th. They came after the results of the regular elections on April 4th failed to lead to the formation of a government, and according to the Constitution, parliament was dissolved and new elections scheduled. The results of the July 11 elections are quite similar to those of April 4. The only difference is that this time the newly formed party of the popular TV presenter, showman and popular singer Slavi Trifonov become first. The name of this political force is "There is such a people." Unfortunately, again the distribution of the number of seats between the six parties that enter the parliament is such that the prospects for forming a stable government are very small, which could lead to a deepening political crisis. Early parliamentary elections were held in Bulgaria on July 11th, just three months after the previous vote in April. The electoral outcome in April led to a situation in which none of the parties in the parliament could gather enough support to form a government. Therefore, according to the country's Constitution, the National Assembly was dissolved and the President appointed a caretaker government and scheduled new parliamentary elections for July 11th.
