Abstract: This report recommends that the Committee notes the applications detailed in Appendix 1 of the report granted by the Director of Planning & Transport in accordance with the Scheme of Delegation detailed in Standing Orders.

1.0 RECOMMENDATION

1.1 The Committee is asked to note the applications, detailed in the Appendix, granted approval under delegated powers.

2.0 INTRODUCTION

2.1 In terms of the Scheme of Delegation to officers, the Director of Planning & Transport is authorised to approve planning applications in accordance with the Development Plan, the Local Plans or established policies and where there are no objections, except those which raise a general issue affecting a large area, or are of major land or economic development significance.

3.0 APPROVALS

3.1 Attached as an Appendix is a list of applications granted under delegated authority during the period to 9 March 2005 to 6 April 2005.

4.0 FINANCIAL IMPLICATIONS

4.1 There are no financial implications.

5.0 HUMAN RIGHTS IMPLICATIONS

5.1 There are no Human Rights issues arising directly as a result of this report.

8 That any proposed garage shall be set-back a minimum of 6 metres from the heel-line of the adjacent footway

9 That the rainwater run-off from the dwellinghouse be directed to a soakaway system to the satisfaction of the building control authority.

10 That no breaches be made in the boundary hedging without the prior consent of the planning authority

11 That none of the existing trees within the site be felled, topped, lopped or otherwise interfered with without advance discussion with and without the prior written consent of the Director of Planning & Transport.

12 That no development takes place until there has been submitted to and approved by the planning authority, a scheme of landscaping, including, where appropriate, an indication of all existing trees and hedgerows on the land and details of these to be retained and cleared, together with the measures for their protection in the course of development.

13 That all planting comprised in the approved details of landscaping be carried out in the first planting season following the completion of the development or at earlier stages and any plants or trees which within a period of five years from the commencement of the use die; are removed or become seriously damaged or diseased, shall be replaced in the next planting season with others of a similar size and species.

8 That prior to the commencement of any work on the site, a scheme for the management and maintenance of open spaces within the development be submitted to and approved by the Council.

9 That, prior to the commencement of works on site, the following shall be submitted for the approval of this Planning Authority;

(a) colour of stain for all timber fencing; (b) details of paviors; (c) details of external finishing materials for dwellinghouses and boundary walls; (d) details of materials for hard landscaping areas; (e) details of windows; (f) details of where existing stonework is to be re-used throughout the development.

10 That the developer shall afford access at all reasonable times to any archaeological organisation acceptable to the planning authority and shall allow them to observe work in progress and record items of interest and finds. Notification of the commencement date, information as to whom the planning authority should contact on site and the name of the archaeological organisation retained by the developer shall be given to the planning authority in writing not less than 14 days before development commences.

11 That, prior to the occupation of any of the houses, footways ex-adverso the site on Lower Balmain Street and South Esk Street shall be reconstructed to a minimum width of 1.8 metres, to the standards of Angus Council's Director of Roads and this planning authority

12 That, prior to the completion of the last house in this development, the proposed roadway through the development shall be bounded by an unbroken footway 1.8 metres wide, formed and constructed in accordance with the standards of Angus Council's Director of Roads and this Planning Authority

2 That the application for approval of the reserved matters specified herewith shall be made to the Planning Authority before:-

(a) the expiration of three years from the date of the grant of outline planning permission; (b) the expiration of six months from the date on which an earlier application for reserved matters approval was refused; or (c) the expiration of six months from the date on which an appeal against such refusal was dismissed, whichever is the latest.

Only one application for approval of reserved matters (under (b) or (c) above) may be made after the expiration of a three year period mentioned in sub-section (a).

3 That the development hereby approved must be begun not later than:-

6 That, prior to the commencement of demolition works, details of the previous use(s) of the buildings and details of materials used for their construction shall be submitted for the approval of the Director of Planning & Transport and any contaminants found shall be removed from the site, prior to the commencement of construction of the dwellinghouses, to the satisfaction of the Director of Environmental & Consumer Protection and this Planning Authority

7 That provision be made within the site for the parking of two private cars per dwelling.

8 That a vehicular turning space be provided within each site to allow vehicles to enter and leave each site in a forward gear

9 That the existing vehicular access to the north and west of the site shall be maintained, to the satisfaction of the Director of Planning & Transport

10 That the building(s) be single or one and a half storeys in height.

11 That the dwellinghouses be aligned with No. 1 Loanhead Cottages to the south

12 That the roof(s) be finished in blue slates or an alternative material giving a similar appearance and agreed in consultation with the Director of Planning & Transport prior to commencement of construction.
