Executive Summary and List of Recommendations The Commission finds no improvement overall in human rights conditions in China over the past year, and increased government restrictions on Chinese citizens who worship in state-controlled venues or write for state-controlled publications. Citizens who chal- lenge state controls on religion, speech, or assembly continue to face severe government repression. The Commission notes that the Chinese government continued to pursue certain judicial and crimi- nal justice reforms that could result in improved protection of the rights of China’s citizens. Yet these positive steps were clouded by new detentions and government policies designed to protect the Communist Party’s rule and tighten control over society. These de- tentions and policies violated not only China’s Constitution and laws, but also internationally recognized human rights standards. The Chinese government engaged the international human rights community over the past year, hosting visits by the 3,UN 2009 Working Group on Arbitrary Detention, the UN HighApril Commissioner for Human Rights, and v.the Holder, U.S. Commission on on International Reli- gious Freedom, Livpermitting the International Committee of the Red Cross to openin a regional officearchived in Beijing, and committing to a visit byCited the UN Special Rapporteur on Torture in November 2005. Dur- ing her recent05-70053 visit to China, the UN High Commissioner for HumanNo. Rights Louise Arbour said, ‘‘China has declared its commit- ment to human rights and has raised expectations for the country to match its growing prosperity with a firm commitment to advanc- ing human rights.’’ Arbour also expressed concern over China’s commitment to human rights and raised several political prisoners of concern with government officials. China has an authoritarian political system controlled by the Communist Party. Party organizations formulate all major state policies before the government implements them. The Party domi- nates Chinese legislative bodies such as the National People’s Con- gress and fills important government positions at all levels by an internal selection process. Chinese authorities have introduced lim- ited elements of political participation at the lowest levels of gov- ernment to enhance their ability to govern. These elements include direct elections for village and residents committees, local people’s congress elections, and some popular input into the selection of low-level government and Party officials. The Party controls these selection and electoral processes by screening, and often selecting, the candidates. Chinese citizens are attempting to use the limited political space created by official reforms to protect their rights and interests, but Party officials and local governments often suppress these efforts, leading to social unrest. This discourse confirmed the extent to which coerced confessions, police incompetence, pervasive presumptions of guilt, extrajudicial influences on the courts, restrictions on defense attor- neys, and other problems undermine the fairness of the criminal process. Domestic reaction to the wrongful conviction scandals cre- ated new momentum for some criminal justice reforms. Many Chi- nese scholars and officials continue to push for reforms within the boundaries set by the Communist Party and Chinese legal culture and seek to engage foreign counterparts in this process. The Chi- nese government continues to use administrative procedures and vaguely worded criminal laws to detain Chinese citizens arbitrarily for exercising their rights to freedom of religion, speech, and as- sembly. The United Nations Working Group on Arbitrary Deten- tion noted in December 2004 that the Chinese government has not adequately reformed these practices. The Chinese government does not recognize the core labor rights of freedom of association and collective bargaining. The government prohibits independent labor unions and punishes workers who at- tempt to establish them. Wage and pension arrears are among the most important problems that Chinese workers face. The govern- ment issued new regulations seeking to address the problem of unpaid wages and pensions, but in many cases Chinese2009 workers continue to struggle to collect wages and benefits because3, the rel- evant agencies do not

Contrasting information was found in the sources consulted regarding the treatment of Local Church members in Fujian province. The following reports indicate improvements in the treatment of the Local Church within some parts of Fujian province: In February 2009 an elder of the Local Church in Melbourne advised that while the Local Church is viewed as illegal in Fujian province, the arrest of members has decreased. The Elder provided the following advice on the treatment of the Local Church in Fujian province: As we understand it, the local churches in China are viewed differently in each province. Certain provinces allow the local churches to register with the authorities and once they have done so, they are allowed to worship. However, in other provinces, including Fujian province, the local churches are regarded as illegal gatherings, however as we understand from some members who come from this province, there is not much arrests as before. There is now more dialogue between members of the local church and the authorities.1 A November 2008 report by the Country Research Section of the Department of Immigration and Citizenship (DIAC), China’s Protestants and Catholics, also reports on the increased tolerance of the Local Church by government authorities in some areas of Fujian. The report states that some Local Churches now operate legally in Fuzhou and several rural counties in Fujian.

Liu Xiaobo, November 19882 I FROM 1988 to early 1989, it was a common sentiment in Beijing that China was in crisis. Economic reform was faltering due to the lack of a coherent program of change or a unified approach to reforms among Chinese leaders and ambitious plans to free prices resulted in widespread panic over inflation; the question of political succession to Deng Xiaoping had taken alarming precedence once more as it became clear that Zhao Ziyang was under attack; nepotism was rife within the Party and corporate economy; egregious corruption and inflation added to dissatisfaction with educational policies and the feeling of hopelessness among intellectuals and university students who had profited little from the reforms; and the general state of cultural malaise and social ills combined to create a sense of impending doom. On top of this, the government seemed unwilling or incapable of attempting to find any new solutions to these problems. It enlisted once more the aid of propaganda, empty slogans, and rhetoric to stave off the mounting crisis. University students in Beijing appeared to be particularly heavy casualties of the general malaise.

The type of legal action is civil environmental lawsuits, as when herdsmen from Inner Mongolia sue a local paper factory over poisoned groundwater and dead livestock or a Shandong villager demands compensation from a nearby factory for the noise that allegedly killed 26 foxes on his farm. Empirically, this is a close-to-the-ground account of everyday justice and the factors that shape it. The concern and zeal they have for Christianity are reflected in the research, comments and translation of its history, theories, doctrines and persons, as well as stimulating the formation of the openness of recognizing Christianity afresh (or correctly). In this rising tide of Christianity in China, some intellectuals have accepted the “cross” and entered the hall of Christian belief including university students, teachers, writers, painters, scholars and scientists. Some overseas Chinese students had converted even earlier (Li, 1996). Obviously, Christianity has a special attraction for them. They were attracted by the doctrines and teachings, and /or personal eXposure to Christian fellowships, then converted and were baptized. Looking back on the beginning of the 20th century, it was also the intellectuals who started a vigorous “anti-Christian movement”, taking the chance of the May Fourth Movement in 1919 and the New Culture Movement, holding up the banners of “Mr. D” (democracy) and “Mr. S” (science). Generally speaking, they wanted to thrust Christianity aside because they assumed that religion equals superstition and was incompatible with science. They reasoned that science was a necessity if the life of the Chinese people was to be improved and China’s international status be promoted (Li, 1994:195-222).

FENG Chongyi Abstract: The creation of a new administrative institution known as the "Stability Preservation Office" at the central level, which is overseen by the Chinese Communist Party (CCP) Central Committee and has branches at every local level, from streets and townships to enterprises, and has extraordinary powers to override other regular institutions and branches of government, is a clear indication that the Chinese govern- ment's efforts to preserve stabüit)' are not limited to the conventional business of crime control or public security. This paper traces the origin of the discourse and practice of preserving stability and the rights de- fence movement in China, investigating the interplay or interaction be- tween the two. It examines the end and the means of stability preserva- tion, explores whether the measures taken by the government to pre- serve stability or the rights protection actions taken by citizens are the root cause of social unrest, and whether the suppression of discontent or the improvement of human rights and social justice is the better way to achieve social stability in contemporary China.
