Changes in labour law may indicate the nature of change in industrial rela- tions systems in general. Such changes often occur in parallel with a nation’s transition from authoritarian rule to democracy, and tend to be accompa- nied by a shift in economic development strategies away from import-sub- stitution industrialisation to neo-liberal economic policies oriented toward exports. Indeed, these two pressures – democracy and neo-liberalism – are the ‘twin pressures’ for change that work on a country’s economic system (Cook, 1998). This chapter describes and analyses the changes in labour laws during the Reformasi era, after the fall of President Soeharto in May 1998,1 with particular attention to the enactment of the package of three new labour laws: the Manpower Law No. 13/2003, the Trade Union Law No. 21/2000, and the Industrial Relations Dispute Settlement Law No. 2/2004.2 The aim is to explain how and why such changes in labour law in Indonesia have occurred, and what have been the implications for labour. To this end, the chapter will investigate the context that structured the changes, i.e. democ- ratization and neo-liberal economic reform, as well as the contents of the package of the three new labour laws, including comparing them with pre- vious laws and analysing their impact on labour3 and the responses to these changes. -

ISSN 2685-2403 MEDIO Vol 2, No 1, July 2020, pp. 37-61 The Construction of Mass Organization Publication in Islamic News Portals Dwi Latifatul Fajri1, Agus Triyono2 Abstract The issuance of the Government Regulation in Lieu of Law Number 2, the Year 2017 on the Mass Organization, has gained several pros and cons before its legal verification. One of the most significant applications of the regulation is in the disbandment of Hizbut Tahrir Indonesia without undergoing legal process due to the renewal of regulation, namely the contrario actus principle. The news on mass organization regulation also becomes the highlight of Islamic news portals, namely Eramuslim.com, Nu.or.id, and Hidayatullah.com. The three portals are chosen for the study due to their frequent published news on the mass organization and their position at the top ranks for the most-visited news portal (Alexa.com). Despite being the same Islamic-based media, the three portals have distinctive news framing. This study applied the framing analysis model by Zhongdang Pan and Gerald M. Kosicki. The Nu.or.id reported there was much support for the issuance of the mass organization regulation based on the religious context, and many sides are against the peaceful action of 299. Hidayatullah.com claims that the regulation has discriminated against and limited the freedom of speech of mass organizations. Lastly, Eramuslim.com views regulation as a political tool used by the government. Based on Golding and Murdock, Hidayatullah.com and Nu.or.id have organizational interests to carry on their news; therefore, it shows an apparent tendency to take sides. -

KATA PENGANTAR SBSI yang kembali kepada semangat dan jiwa perjuangan 25 April 1992 sewaktu deklarasi di bawah kepemimpinan Muchtar Pakpahan dan Raswan Suryana telah menyelenggarakan kongres ke V yang berlangsung di Hotel Acacia dari tanggal 31 Maret sampai dengan 3 April yang sekaligus dilanjutkan TFO. Kongres telah berhasil menyusun anggaran Dasar dan Anggaran Rumah Tangga yang disesuaikan dengan keadaan baru SBSI sebagai Unitaris sektoral juga memutuskan GBHO, beberapa resolusi kurikulum pelatihan dan prinsip-prinsip dan nilai-nilai perjuangan SBSI. Keputusan-keputusan kongres ini menuntun SBSI untuk berjuang menetapkan diri sebagai organisasi perjuangan dan juga organisasi pekerjaan. Kongres V SBSI mengambil mengambil tema sebagaimana kongres ke IV tahun 2003 yaitu “SBSI Kuat Rakyat Sejahtera”. Tema ini mendorong bahwa SBSI harus kuat agar dia bisa mencapai cita-cita nya atau kalau SBSI mau meraih cita-citanya dia harus menjadi serikat buruh yang kuat. Kalau mau menjadi SBSI yang kuat, dia harus kuat dalam lima program utamanya kosolidasi, advokasi, pendidikan dan pelatihan, tripartite, dan membangun administrasi dan kuangan organisasi yang kuat. SBSI harus terlebih dahulu membangun dirinya menjadi organisasi yang kuat agar dapat meningkatkan system welfarestate selanjutnya mensejahterakan buruh. Untuk membangun SBSI yang kuat, kami menetapkan target yang akan dicapai, yaitu agar terbentuk di seluruh Provinsi dan diseluruh Kota Kabupaten, dan mempunyai anggota minimal kembali 1,7 Juta pada tahun 2018. Sebab pada tahun 2018 SBSI akan memutuskan bagaimana hubungannya dengan perpolitikan karena nasib buruh ditentukan oleh politik. Untuk mencapai membangun SBSI yang kuat itu, kongres juga menetapkan SBSI menjadi pusat gerakan buruh yang bergerak dalam 3 (tiga) sesi yaitu gerakan Union Movement (Gerakan Serikat Buruh yang berpusat pada SBSI), Gerakan Politik yang nanti berfikir pada “Apakah ada organisasi yang mitra simbiose atau partai politik yang simbiose?” atau “SBSI kembali mempunyai partai” dan Gerakan ekonomi kerakyatan yang berpusat pada koperasi. -

(Un)Civil Society and Political Change in Indonesia (Un)Civil Society and Political Change in Indonesia provides a critical ana- lysis of Indonesia’s civil society and its impact on the country’s democratiza- tion efforts that not only takes the classical, pro-democratic actors of civil society into account but also portrays uncivil groups and their growing influ- ence on political processes. Beittinger-Lee offers a revised categorization of civil society, including a model to define the sphere of ‘uncivil society’ more closely and to identify several subcategories of uncivil society. This is the first book to portray various uncivil groups in Indonesia, ranging from vigilantes, militias, paramilitaries, youth groups, civil security task forces and militant Islamic (and other reli- gious) groups, ethnonationalist groups to terrorist organizations and groups belonging to organized crime. Moreover, it provides the reader with an over- view of Indonesia’s history, its political developments after the democratic opening, main improvements under the various presidents since Suharto’s fall, constitutional amendments and key reforms in human rights legislation. Raden Fatah Pagar Dewa Bengkulu Email: [email protected] (08179403094) Abstract : This study aims to examine the social fiqh paradigm of KH Ali Yafi e which is formulated as follows: what is the historical existence of social fiqh paradigm of KH Ali Yafi e in Indonesia? how is the development of social fiqh paradigm of KH Ali Yafi e in Indonesia? Using the ushul fiqih scholarship framework, this study concludes that First, the historical existence of KH Ali Yafie’s thought developed from the tradition of moderate pesantren scholarship, so that his struggle remained within the line of moderate Islamic movements within the Nahdlatul Ulama, to the top post, Rais Aam PBNU. Similarly his role in MUI. Although moderate, but firm stance also remains firmly proven KH Ali Yafi e resigned from Pjs. Rais Aam PBNU because of differences in legal views with KH Abdurrahman Wahid. Second, the thought of fiqh KH Ali Yafie contributed not less because he has given solutions that others do not think of, such as how to make the sciences of history and natural sciences as a knife of analysis in studying the law of fiqih. Similarly his strongly proven national- ism attitude puts the fatwa of KH Hasyim Asy’arie on the obligation to defend the state as a legal fatwa which must be ignored by Muslim scholars and Muslims. Keywords: Ijtihad, law of fiqh, and historical existence. Abstrak: Kajian ini bertujuan untuk meneliti paradigma fiqih sosial KH Ali Yafi e yang dirumuskan sebagai berikut : bagaimana eksistensi historis paradigma fiqih sosial KH Ali Yafi e di Indonesia? bagaimana pembangunan paradigma fiqih sosial KH Ali Yafi e di Indonesia? Dengan menggunakan kerangka keilmuan ushul fiqih, kajian ini menyimpulkan bahwa Pertama, eksistensi historis pemikiran KH Ali Yafi e berkembang dari tradisi keilmuan pesantren yang berciri moderat, sehingga perjuangannya tetap berada dalam garis gerakan keagamaan Islam yang moderat di lingkungan Nahdlatul Ulama, hingga jabatan puncak, Rais Aam PBNU.
