REVISION TO PROCEDURE 12.010, ROLL CALL AND PERSONNEL INSPECTION Procedure 12.010, Roll Call and Personnel Inspection has been revised. The Department began the transition to the Smith and Wesson M&P 2.0 pistol beginning in June, 2019. The M&P 2.0 is not equipped with a magazine safety disconnect, which will adversely affect the safety of Department members during the current iteration of roll call. A review of best practices, with the intent of keeping the safety of Department members and citizens the top priority, has resulted in the following changes to the conduction of roll calls: • Removed the command “Raise Pistols.” o Officers will continue to remove the magazine from the firearm, as well as the extra magazines from the magazine pouch, to be inspected. o After the inspecting supervisor passes, officers will replace the magazines. • “Stand-by for Weapons Inspection” command added. o Officers will raise their pistols partially out of the holster as the inspecting supervisor approaches. o The inspecting supervisor will ensure a bullet is loaded through the chamber indicator port. • Officers will be responsible to ensure their weapons are clean, oiled, operable, and loaded PRIOR to responding to roll call. • Removed weekly weapon inspection. o Officers will ensure their primary duty weapon is clean, oiled, operable, and loaded PRIOR to responding to roll call every day. This is the same practice currently utilized for officers responding to court and off-duty details. This revision is effective immediately. Personnel should review Procedure 12.010 in its entirety. The revised procedure is available on the Department intranet and web page. 2. REVISIONS TO PROCEDURE 12.020, UNIFORMS, RELATED EQUIPMENT, AND PERSONAL GROOMING; PROCEDURE 12.025, AUTHORIZED WEAPONS; PROCEDURE 12.815, COURT APPEARANCES, JURY DUTY, AND OTHER HEARINGS; AND PROCEDURE 19.140, OUTSIDE EMPLOYMENT The Department began the transition to the Smith and Wesson M&P 2.0 pistol beginning in June, 2019. Additionally, all officers are being equipped with the Nightstick TWM-850XL weapon mounted light and Sabre Red MK3 OC chemical irritant. The above listed procedures have been revised to reflect the equipment changes. 2 Colonel Eliot K. Isaac, Police Chief June 13, 2019 The following key revisions have been made: • The Nightstick TWM-850XL weapon mounted light is mandatory for uniformed officers issued the Smith and Wesson M&P 9mm 2.0 pistol o Officers in non-uniformed assignments and those at the rank of captain and above are exempt from carrying the weapon mounted light . Officers in non-uniformed assignments working uniformed, outside employment details are required to utilize the weapon mounted light . SWAT members may carry weapons and weapon accessories on duty as authorized by the SWAT and Tactical Coordination Unit’s Standard Operating Procedures o Must be mounted on the weapon prior to reporting for duty and remain mounted for the duration of the officer’s tour of duty o Officers will continue to carry an additional light source for situations which do not require the use of a firearm • Officers working outside employment details will carry the Department issued Smith and Wesson, 9mm, Military and Police pistol (or 2.0, once issued) o The use of the M&P compact pistol as a primary weapon while working outside employment details is prohibited These revisions are effective immediately. Personnel should review these procedures in their entirety. The revised procedures are available on the Department intranet and web page. 3. REVISION TO PROCEDURE 12.110, HANDLING SUSPECTED MENTALLY ILL INDIVIDUALS AND POTENTIAL SUICIDES Procedure 12.110 has been revised. • Pursuant to 6th Circuit Court case, Hill v. Miracle, a subject having a mental health crisis should not be charged criminally, even if force is used against them. • Officers are advised that criminal charges for lower level offenses are dependent on the facts and might benefit from discretion used by the officer on scene if little harm to others or property was caused. This revision is effective immediately. Personnel should review Procedure 12.110 in its entirety. The revised procedure is available on the Department intranet and web page. 4. REVISION TO PROCEDURE 12.275, REMOVAL OF ABANDONED JUNK MOTOR VEHICLES AND OVERTIME PARKED VEHICLES Procedure 12.275, Removal of Abandoned Junk Motor Vehicles and Overtime Parked Vehicles, has been revised to adhere to the 6th U.S. Circuit Court of Appeals ruling on the enforcement practice of tire-marking. 3 Colonel Eliot K. Isaac, Police Chief June 13, 2019 • Officers will mark the pavement at the front and back of a vehicle’s tires in lieu of marking the tire itself. • Form 368, Abandoned Vehicle Sticker, will be placed on a vehicle after it is determined a violation has occurred. • Minor updates have been completed to reflect current processes. The revision is effective immediately. Personnel should review Procedure 12.275 in its entirety. The revised procedure is available on the Department intranet and web page. 5. REVISION TO PROCEDURE 12.545, USE OF FORCE Procedure 12.545, Use of Force, has been revised to reflect the issuance of the Sabre Red MK3 OC chemical irritant as well as the following key changes: • TASER downloads will be conducted twice annually: o April 1 – September 30, download completed by October 20 o October 1 – March 31, download completed by April 20 • Sabre Red MK3 OC chemical irritant revisions: o Should be aimed at the subject’s face and deployed in 1-2 second bursts. o Uses a NON-FLAMMABLE formulation and is compatible with the use of the TASER. • Revised use of force reporting guidelines for consistency and current processes. This revision is effective immediately. Personnel should review Procedure 12.545 in its entirety. The revised procedure is available on the Department intranet and web page. 4 Colonel Eliot K. REMINDER TO ADHERE TO PROCEDURE 12.270, IMPOUNDING, MOVING, AND RELEASE OF VEHICLES, FOR DISPATCHES TO ABANDONED VEHICLES ON PRIVATE PROPERTY The Emergency Communications Center (ECC) has observed an increase in supervisors cancelling citizens’ complaints of abandoned vehicles left unoccupied on private property. Supervisors are reminded to dispatch on these calls for service for investigation and follow the steps outlined in Procedure 12.270, Section B.11: 11. Vehicles parked on private or public property without consent of the owner: a. For vehicles parked on private property, or public property under the control of non-city government agency (e.g., Board of Education, Metropolitan Housing Authority): 1) If the vehicle is obstructing driveways, loading docks, fire lanes, ingress, or egress, try to locate the owner and have the vehicle moved immediately. If unable to locate the owner, impound the vehicle. Include a brief investigative summary and the property owner's name who requested the vehicle removed in the Tow Mod under the Impound tab, Comments or Recovery Details box. a) Issue citations for any applicable violations. 2) If the vehicle is occupying a parking space or appears to be abandoned but not blocking ingress, egress, loading dock, etc., run a computer check to see if it is stolen, wanted, etc. Tow only if there is a computer hit. a) Do not tow delinquent vehicles from private property. 5 Colonel Eliot K. Isaac, Police Chief June 13, 2019 b. For vehicles on private property, other than City property, and not stolen or wanted, try to find the vehicle owner to move the vehicle. Advise the property owner of the towing provisions under ORC 4511.681, Parking Prohibitions on Private Property, and 4513.60, Abandoned Vehicles. If the property owner follows these guidelines, the vehicle can be towed at the vehicle owner's expense. 1) For abandoned junk vehicles on private property, refer to Procedure 12.275, Removal of Abandoned Junk Motor Vehicles and Overtime Parked Vehicles. 7. S.T.A.R.S. DATA Attached to these Staff Notes is the most current Strategic and Tactical Analytic Review for Solutions (STARS) Data. Department personnel are directed to review this information to ensure they remain familiar with crime patterns and trends occurring within the City and their areas of responsibility. 8.
