PARISH OF & DISTRICT ANGLICAN CHURCH ST PAUL’S RECTORY LEASING ORDINANCE 20181

AN ORDINANCE to authorise the leasing of the building known as the St Paul’s Rectory in the Queanbeyan & District Anglican Church Parish in the Diocese of Canberra and Goulburn.

RECITALS

1. The property known as the St Paul’s Rectory situated at 1290 Old Cooma Road, Googong, in the State of is properly vested in the Property Trust. 2. The St Paul’s Rectory is currently vacant and will not be required until after the appointment of a new Rector and Assistant Priest in the Parish of Queanbeyan & District Anglican Church. 3. The Parish Council of the Parish considers that it is desirable for the security of the St Paul’s Rectory and as a source of income to the Parish for the St Paul’s Rectory to be rented until the new Rector and Assistant Priest are appointed. 4. The Rector, Churchwardens and members of the Parish Council of the Parish of Queanbeyan & District Anglican Church have consented to this Ordinance.

BISHOP-IN-COUNCIL, in its capacity as the Standing Committee of the Synod and in exercise of its powers under section 26 of the Anglican Church Trust Property Act 1917 (NSW) and under section 3 of the Synod (Delegation of Functions) Ordinance 1998, therefore enacts:

1. Name of Ordinance

1.1 This Ordinance is the Parish of Queanbeyan & District Anglican Church St Paul’s Rectory Leasing Ordinance 2018.

2. Dictionary 2.1 In this Ordinance, unless it is clear that another meaning is intended: Land means the land and buildings situated at 1290 Old Cooma Road, Googong, in the State of New South Wales and known as the St Paul’s Rectory as more particularly specified in the Schedule to this Ordinance; Lease means any lease entered into under sub-section 3.1; Parish means the Parish of Queanbeyan & District Anglican Church in the Diocese of Canberra and Goulburn; Rectory means the buildings erected on the Land. Note: The Dictionary included in the Diocesan Legislation Ordinance 2007 provides a definition of the following terms:  Anglican Diocesan Services  Bishop-in-Council  Diocese  Parish Council  Property Trust  Synod

3. Lease of Land 3.1 The Property Trust is directed and authorised to enter into a lease of the Land in accordance with the Standard Form Residential Tenancy Agreement consistent with the appendices to the Residential Tenancies Regulation 2010 (NSW).

3.2 Despite sub-section 3.1, the Property Trust is authorised for the purposes of this Ordinance to insert into the Lease details of the parties, term, rent, rental bond and such other matters as may be necessary or desirable following and in accordance with the agreement made under sub-section 3.3.

3.3 The Anglican Diocesan Services shall, in consultation with the Parish Council of the Parish, agree with any tenant wishing to enter into the Lease such terms and conditions as may be appropriate for the Land, including as to the term, rent and rental bond, provided that the term is set having regard to the need for the Land to be available on the appointment of a new Rector and Associate Priest to the Parish.

3.4 Any two members of the Property Trust are authorised to insert the details required under sub-section 3.2 into and to execute the Lease on behalf of or for the Property

Trust in accordance with the agreement made under sub-section 3.3 on production of a certificate of the General Manager of Anglican Diocesan Services that the Lease is in accordance with this Ordinance.

4. Application of Proceeds 4.1 The Property Trust shall apply the rental from the Lease as follows: (a) first, to the costs of this Ordinance; (b) second, to the costs of the Lease; and (c) third, to the costs of any outgoings, maintenance and other landlord obligations under the Lease.

4.2 Subject to sub-section 4.1, the Property Trust will apply the balance of the rental received under the Lease for the general purposes of the Parish as requested by its Parish Council.

5. Expiry 5.1 This Ordinance expires twelve months after the Bishop assents to it.
