Babiskin* INTRODUCTION For the second time ever, the Supreme Court addressed the affirmative defense of fair use to copyright infringement in the context of parody in Campbell v. Acuff-Rose Music, Inc. ~ The unanimous opinion found a parody rap version of Roy Orbison's song "Oh, Pretty Woman" by the group 2 Live Crew could be a fair use within the exceptions to the protections of the Copyright Act of 1976. 2 The fair use defense is an inconsistent and confusing area that has been called "the most trouble- some [issue] in the whole law of copyright. "3 The Campbell decision helps preserve the flexible, case-by-case analysis intended by Congress and recognizes the value of parody both as a form of social criticism and catalyst in literature. The decision affords wide latitude to parodists, emphasizing the irrelevance of the judge's personal view of whether the parody is offensive or distasteful. It is unclear whether future courts will interpret this holding to be limited to fair use of parody in the context of song, or whether they will construe it more broadly to confer substantial freedom to parodists of all media. It is also unclear what effect this decision will have on the music industry's practice of digital sampling. This article will review the historical background of fair use in the context of parody and the case law preceding the Supreme Court's decision. A detailed discussion of the lower courts' decisions will be followed by analysis of the Supreme Court's decision and its implications for the future.

    Kent’s Sweden, or what a rock band can tell us about a nation OLA JOHANSSON Johansson, Ola (2013). Kent’s Sweden, or what a rock band can tell us about a nation. Fennia 191: 1, pp. 40-57. Helsinki. ISSN 798-5617. The Swedish rock band Kent is not only the most popular band in Sweden, but also perceived as quintessentially Swedish. Using the notion of “everyday na- tionalism” I argue that Kent both represent and actively shape contemporary Swedish national identity co-constitutively with their audience. Three themes are particularly important to understand this Swedishness. Firstly, the band was formed in the city of Eskilstuna but relocated to Stockholm, which illustrates a Swedish journey through class and space. Secondly, Kent interrogates a series of national myths in their songs. They do so using spatial and environmental meta- phors that can be conceptualized as different landscapes − inner, urban, and winter landscapes − representing Sweden. Thirdly, Kent also construct a “public landscape” that reflects on changes in Swedish society, including neoliberal and anti-immigrant tendencies. Dear Yellow Jackets: According to Healthline.com, “The Holidays are supposed to be a time of joy and celebration, but for some people they are anything but.” Additionally, scientist have stated that the most depressing day of the year is actually several weeks after the holidays—the 3rd Monday in January also known as Blue Monday. This year that is January 16th. So despite the lights that shimmered on dark streets and peak through windows, showcasing decorated trees, the holidays and the weeks following can be a time filled with sadness for many. In fact, some statis- tics show that the holidays is one of the most difficult times of the year for some, and this, for several reasons. Those reasons could be anywhere from social isolation all the way to the complexities of holiday grieving over a lost or distant loved one. Others, though it is not obvious, may experience something called “holiday blues.” This is why my HIVE TIME peers and I would like for you to exercise awareness and “LIGHT UP someone’s life!” this holiday season and beyond.
