Short title

1. This notice may be cited as the Taking of Easement Notice (No. 2205) 2011.

Easement to be taken [s.9(7) of the Acquisition of Land Act 1967]

2. An easement is taken over leasehold land described in Schedule 2 by the Chief Executive, Department of Transport and Main Roads, as constructing authority for the State of Queensland, for a purpose incidental to the purpose of transport (rail), in particular, drainage purposes, as from 24 June 2011 and vests in the said Chief Executive, Department of Transport and Main Roads, as constructing authority for the State of Queensland.

Terms and Conditions of Easement

3. The terms and conditions of the easement are set out in Schedule 1.

SCHEDULE 1

Terms of Easement

1. The rights and obligations to be conferred and imposed by each of the proposed easements for drainage purposes over the land described in the schedule are set out hereunder:

The registered proprietor and the registered proprietor’s employees, consultants, contractors or invitees for the time being of the subject tenement over which the proposed easement is to be taken shall not do anything upon, under or over the ground surface area of the subject tenement or carry out any activities or works which may:

(a) prevent the Grantor and all other people authorised by the Grantor from passing over the proposed easement area;

(b) create a nuisance on the proposed easement area;

(c) cause or allow any waste material or rubbish to be deposited on the proposed easement area;

(d) cause ponding or impede, hamper, obstruct or interfere with the natural free flow of storm waters across, along, over or under the ground surface area of the proposed easement;

(e) divert or change the natural and ordinary course of flow of such storm waters; or

(f) impede, hamper, obstruct or interfere with the escape of such storm waters to their natural outlet.

2. The State of Queensland (represented by Department of Transport and Main Roads), the department’s servants and authorised agents and licensees (State) shall have full free and uninterrupted rights and liberty:

(a) at all times and from time to time as it is reasonably necessary, with or without all necessary material, plant and machinery, equipment, carts, lorries, wagons, trucks, vehicles of any description laden or unladen personnel and others, to enter upon and to go, pass and repass over, along, upon or under the ground surface area of the proposed easement at all times by day or night;

(b) to convey water on and over the proposed easement area;

(c) from time to time as needed, to construct, install, extend and thereafter to use, maintain and, where necessary remove or replace, such open or closed drains, culverts, pipelines, channels, manholes, manhole chamber inlets, meters and other associated infrastructure as are necessary for the passage or conveyance of storm water and for any other purpose connected with road drainage on, over, through or under the proposed easement area;

(d) to dig into, sink shafts in, and erect scaffolding on the proposed easement area, and open and break up the soil of the proposed easement area, including the sub-surface and remove and dispose of soil;

(e) to clear the easement area by any means or method, including cutting and removing timber, trees and undergrowth from the proposed easement area;

(f) to construct and maintain on the proposed easement area access tracks, gates and ancillary works as it considers reasonably necessary;

(g) at all times thereafter, to obtain access to the proposed easement area and to the proposed drainage works set out in paragraphs (c), (d) (e) and (f) (Drainage Works); and 24 June 2011] QUEENSLAND GOVERNMENT GAZETTE No. 63 491

(h) generally to do and perform all such other acts and things on, over, through or under the proposed easement area as are reasonably necessary to construct, install, use, inspect, test, service, maintain, repair, add to, replace or remove the proposed Drainage Works and to ensure the natural free flow of the storm waters to their natural outlet.

3. The State must:

(a) promptly make good and repair any damage to the easement area;

(b) manage any erosion on the easement area caused by the State using the easement area under this document; and

(c) if the State undertakes any construction work including digging, sinking shafts and erecting scaffolding on the easement area, as soon as practicable after the works are no longer required by the State remove the work and return the easement area to a condition reasonably suitable for grazing cattle.

DIRECTIVE No. 6/11

1. Title: Graduate program recruitment and selection

2. Purpose: To provide a new basis for the effective and timely recruitment of recent graduates into the Queensland Public Service. The directive will achieve this by: (a) facilitating the use of a portal (single point of application) for graduates applying for graduate programs (b) specifying the requirements for recruiting and selecting graduates for formal graduate programs via the portal. 3. Application: This directive applies to the engagement of graduates for graduate programs, as: (i) public service officers engaged under section 119 of the Public Service Act 2008, (ii) temporary employees engaged under section 148 of the Public Service Act 2008, and (iii) general employees engaged under section 147 of the Public Service Act 2008.

4. Legislative Provision: Public Service Act 2008 – sections 27, 28, 29, 30, 53, 98, 119, 120, 126, 147 and 148.

5. Effective date: 27 June 2011

6. Definitions: Engage is to employ an applicant as a public service officer, temporary employee or general employee. Graduate is a person who has recently been recognised by a university as having completed the requirements of a bachelor degree or higher degree. Graduate program is a formal program designed for the recruitment, selection and development of graduates. The program is operational for a minimum of 12 months and is considered a workforce planning strategy to attract and retain specialist skills.

7. Directive:

7.1 Relationship with directive on recruitment and selection (a) A number of provisions of the directive on recruitment and selection apply to the recruitment and selection of graduates for graduate programs. These are: (i) Section 6 – Definitions (ii) Section 7.1 – Role evaluation (iii) Section 7.2 – Role description (iv) Section 7.6 – Exemptions from advertising (v) Section 7.7 – Recurring vacancies 500 QUEENSLAND GOVERNMENT GAZETTE No. 65 [24 June 2011

(vi) Section 7.8 – Continuous applicant pools (vii) Section 7.9 – Assessments of applicants (viii) Section 7.10 – Referee checking (ix) Section 7.11 – Pre-employment checks (x) Section 7.14 – Gazette notification (xi) Section 7.17 – Confidentiality, documentation and reporting (b) A number of provisions of the directive on recruitment and selection do not apply to the recruitment and selection of graduates for graduate programs. These are: (i) Section 7.4 – Vacancy advertising – targeted (ii) Section 7.5 – Vacancy advertising – specified (iii) Section 7.13 – Additional requirements for senior executive and senior officer roles (iv) Section 7.15 – Direct appointment to roles at a higher level (c) The following provisions of the directive on recruitment and selection have been amended for this directive. These sections are: (i) Section 7.3 – Vacancy advertising – general (ii) Section 7.12 – Post-selection feedback (iii) Section 7.16 – Appointment of a temporary employee to tenured status at level (iv) Section 7.18 - Transition These sections are referenced against the amended section in this directive. (d) Where any inconsistency exists, this directive shall prevail over the directive on recruitment and selection, for the recruitment and selection of graduates for graduate programs only.

7.2 Advertising graduate programs (7.3 Vacancy advertising – general – recruitment and selection directive) (a) As a minimum, all graduate programs must be advertised on the Queensland Government Graduates website – www.graduates.qld.gov.au (‘the graduate portal’) for no less than 10 whole working days. (b) Clause 7.2 (a) does not prevent an agency from promoting their graduate program vacancies using other graduate related marketing strategies. (c) If an agency is likely to and/or has been unable to successfully recruit graduates for a graduate program through the portal due to the specialist nature of the vacancy/vacancies, the chief executive may approve that a graduate program position/s are advertised in accordance with the Recruitment and Selection Directive.

7.3 Post selection feedback (7.12 Post-selection feedback – recruitment and selection directive) (a) Graduate applicants who are interviewed are to be advised they are entitled to request feedback. (b) Feedback is to be provided to any interviewed applicant who seeks it. (c) Interviewed applicants who request feedback should receive timely, specific and constructive feedback from a member of the selection panel sufficient to explain why they were not successful.

7.4 Notification of selection outcome (a) All interviewed applicants are to be notified individually of the outcome of the recruitment and selection process, within five working days of the delegate’s written decision. (b) All other applicants are to received notification in writing of the outcome of the recruitment and selection process, in a timely manner following the completion of the process.

7.5 Appointment to tenured status following graduate program (7.16 Appointment of a temporary employee to tenured status at level) Where a graduate has been appointed on a temporary basis, a chief executive will, by agreement, convert a graduate to tenured status at level on or before the completion of the graduate program in accordance with the following criteria: (a) The graduate program was advertised in accordance with the provisions of this directive, and (b) The temporary employee or general temporary employee has successfully completed the graduate program over a continuous period of not less than one year, and (c) The temporary employee or temporary general employee is assessed as having demonstrated performance of a sufficiently high standard that advertising the role would be unlikely to yield a superior candidate, and (d) The suitability of an agency’s own employees requiring placement has been considered in accordance with the directive on employment arrangements following workplace change. (e) Where clause 7.2(c) has applied and a graduate appointed from a vacancy advertised in accordance with the directive on recruitment and selection is not eligible for appointment to tenured status at level under this provision.

7.6 Appeals (a) The directive relating to appeals applies to appointments made under this directive. (b) Each selection for a role must document the date on which applications were distributed to the panel following approval being given to fill a vacancy.

(c) Applicants who are otherwise eligible to appeal (in accordance with the directive relating to appeals) may do so if their application is received prior to the date of distribution of applications to the panel. (d) Where a right of appeal against an appointment is provided for in the Public Service Act 2008 and the directive relating to appeals, the appointment must be published in the Gazette within one month of the delegate’s written decision.

7.7 Transition (a) Where, prior to the commencement of this directive, a graduate program has been advertised in accordance with the directive relating to recruitment and selection, the assessment and selection of graduates must be completed in accordance with the directive relating to recruitment and selection. (b) Graduates appointed under a graduate program conducted in accordance with the directive relating to recruitment and selection (prior to the release of this directive) may be considered for appointment to tenured status in accordance with section 7.5 at any time following the commencement of this directive. (c) Any agency not participating in the use of the portal during the phased implementation period must continue to undertake graduate recruitment in accordance with the directive relating to recruitment and selection. A graduate appointed from a vacancy advertised in accordance with the directive on recruitment and selection during the phased implementation period is eligible for appointment to tenured status in accordance with section 7.5 of this directive.

PUBLIC HOSPITALISATION TABLE OF COSTS

INTRODUCTION This table of costs commences 1 July 2011. This table of costs sets out the procedures, conditions and costs applicable for the treatment of workers under the workers’ compensation statutory scheme as public inpatients in Queensland public hospitals.

This table of costs is based on the National Hospital Cost Data Collection (NHCDC) Cost report for Round 13 published in November 2010, with charges established on a cost recovery basis. Queensland Health provides data to the national data set and the yearly increase is applied to the current prices. Q-COMP will review any adjustments according to the NHCDC report and re- gazette a table of costs when appropriate.

APPLICATION This table of costs applies only to the costs of the services provided to a worker who is admitted to a public hospital (an inpatient) as a public patient on or after 1 July 2011.

This table of costs applies only to worker’s compensation claimants receiving treatment for the worker’s injury in a public hospital as a public patient under the care of a public hospital doctor.

This table of costs and guidelines exclude claimants under the statutory workers’ compensation system electing to be treated as private patients and all workers’ compensation common law claimants. Private patient fees for statutory claimants are documented in the Queensland Health services regulations and can be found at: http://www.legislation.qld.gov.au/LEGISLTN/CURRENT/H/HealthServR02.pdf The common law only patients are charged under compensable third party fees when treated in the public hospital sector.

[NOTE: To be admitted to a public hospital as a private patient, the worker must elect to be treated as a private patient by a doctor of their choice. Unless prior approval is obtained from the insurer, Queensland Health will bill the worker for the cost].

EXTENT OF INSURER’S LIABILITY For non-elective hospitalisation an insurer will be liable for the cost of public hospitalisation for not more than 4 days. After this time, an insurer will be liable if the insurer considers the non- elective hospitalisation is reasonable having regard to the worker’s injury. In determining what is reasonable, an insurer must have regard to the medical determination made by the worker’s treating medical practitioner.

It is recognised that for non-elective hospitalisation, Queensland Health will provide services, in many cases, before the claimant has made a claim. Accordingly, insurers will be making a retrospective assessment of the reasonableness of a stay of more than 4 days.

An insurer is liable for costs of elective hospitalisation to the extent it is agreed to by the insurer under arrangements entered into between the insurer and the worker (or someone for the worker) before the public hospitalisation. An insurer’s liability for public hospitalisation includes the provision of the facility as well as medical treatment provided at the hospital.

The insurer must pay the cost of public hospitalisation and medical treatment whether the public hospitalisation is provided at one time or at different times. Page 4 518 QUEENSLAND GOVERNMENT GAZETTE No. 65 [24 June 2011

For an inpatient of a public hospital, a discharge summary report is included in the cost of hospitalisation.

In some situations, Queensland Health will make arrangements with private hospitals (contracted hospitals) to provide inpatient services for and on behalf of Queensland Health. These services will be billed by Queensland Health under this table of costs.

DEFINITIONS The following definitions apply -

contracted hospital means a hospital that provides public health services to a patient under a contractual arrangement with the State, but does not include- (a) a public sector hospital under the Health Services Act 1991; or (b) a Mater Misericordiae Public Hospital.

elective hospitalisation means hospitalisation involving a treatment or procedure decided on by a worker or the worker’s doctor that is of advantage to the worker, but is not fundamental in the treatment of the worker’s injury.

hospital includes a day hospital.

hospitalisation, of a worker, means the admission of the worker in a private hospital or public hospital for medical treatment for the worker’s injury.

private hospital means a hospital to which a worker is admitted as a private patient.

private patient means a worker who is a patient of a private doctor at a hospital that is not a contracted hospital. [NOTE: To be admitted to a public hospital as a private patient, the worker must elect to be treated as a private patient by a doctor of their choice. Unless prior approval is obtained from the insurer, Queensland Health will bill the worker for the cost].

public hospital means a hospital to which a worker is admitted as a public patient.

public patient means a patient who is not a private patient.

An inpatient in a public hospital is a public patient admitted at a public hospital and includes admission as a public patient to a Mater Misericordiae Public Hospital or transferred to a contracted hospital.

Length of stay The length of stay is calculated by subtracting the date the patient is admitted from the date of separation. All leave days*, including the day the patient went on leave are excluded. A day is measured from midnight to 2359 hours and includes full and partial days. A patient admitted and separated on the same day (a “same day” patient) is allocated a length of stay of one day. *A leave day is where a patient is away from a hospital overnight, eg to have a meal with family at Christmas.

Queensland Health operates a large number of hospitals that are grouped according to the level of complexity and intensity of services offered. These are detailed on page 11.

INPATIENTS

1. INPATIENT SERVICES

Inpatient charges for public workers’ compensation patients include the following services:

 Appropriate accommodation; shared ward, or single room if deemed clinically necessary  Hospital hotel services, eg. meals  Medical care provided by public hospital doctors  Nursing care  Pathology and imaging  Pre-operative and post-operative care whilst an inpatient in hospital  Theatre use, theatre consumables, in-theatre care and surgical implants  All pharmaceutical and dressings including those issued on discharge- however the worker may be required to make a co-payment, which may be reimbursed by the insurer  Allied health services  Discharge planning services  Aids and appliances including those necessary for effective discharge- these may be loaned or given to the patient, depending on the facility  Clerical and administrative support  Discharge summary report

Under section 213(4) of the Workers’ Compensation and Rehabilitation Act 2003, the workers’ compensation medical certificate or nurse practitioner workers’ compensation medical certificate must be free of charge. As such, medical certification is provided at no additional charge.

Inpatient charges for public workers’ compensation patients do not include emergency department or outpatient charges.

2. INPATIENT FEE TYPES

Queensland Health adopts a casemix-based pricing model for most acute public inpatients and a specified bed day fee for other types of public patients.

Admitted services are charged according to the hospital category and the patient diagnosis. There are three categories of inpatient fee types:

1. Small Hospitals (Hospital Group X) – handle acute, sub-acute and non-acute 2. Sub and Non-Acute (Hospital Groups A,B,P,T) 3. Acute (Hospital Groups A,B,P,T)

2.1 SMALL HOSPITALS 2.1.1 Small Hospitals - Group X Hospital Fees

These are smaller facilities in rural and remote areas. Treatment provided in these facilities is costed on a per day basis irrespective of the diagnosis category or the type of treatment. For all admissions the invoice will multiply the number of days by the per day cost for that day. This applies to acute, sub-acute and non-acute types of care.

Some types of treatment that a patient may receive are not considered “acute”. These types of care include rehabilitation, palliative care and maintenance care. The following fees and item numbers are for sub and non-acute care provided by hospitals in categories A, B, P and T. The fee is derived by multiplying the worker’s length of stay by the per day rate for the relevant type of care.

2.3 ACUTE CARE 2.3.1 Acute Care Fees - Hospital Groups A, B, P, T

Patients receiving acute care in Hospital Groups A, B, P, T have their fees calculated under a case-mix basis. This type of fee relates specifically to the condition for which the patient was treated and for how long they were treated. The case-mix fee for public hospitalisation will be determined by three key elements: -

- Hospitalisation category – with its relevant base rate; - Diagnosis category (DRG code) – the type of condition as described by the Diagnosis Related Group with its applicable cost weighting; and - Length of stay (LOS) – the worker’s length of stay in hospital compared and adjusted to the average for that DRG via “trim points”.

An average length of stay and “trim points” have been calculated for each diagnosis category (DRG code). The average length of stay and cost weighting may vary between hospital groups.

The extra long stay per day rates take into account the variances in infrastructure between hospital groups.

Trim points

The trim points are calculated as follows:

 Low trim point – the point where it has been calculated ten percent of all stays fall below. For an individual DRG, at least ninety percent of the patients would have a length of stay greater than or equal to the low trim point.

NB. The distribution for most DRGs is so skewed that the low trim point is usually just one day. For these DRGs there will be no short stay outliers. There are 505 (of 665) DRGs where the low trim point is one day.

 High trim point – the point where it has been calculated ninety-five percent of all stays fall below. For an individual DRG, it means that ninety-five percent of the patients will have a length of stay less than or equal to the high trim point.

 Extra high trim point – the point where it has been calculated ninety-eight percent of all stays fall below. For an individual DRG, it means that ninety-eight percent of the patients will have a length of stay less than or equal to the extra high trim point.

Formulas

Depending on where the length of stay falls in relation to the trim points, there are four different formulas which may be used to calculate the casemix fee.

1. Inlier – length of stay falls between the low and high trim points (inclusive)

Fee = DRG cost weight x Base rate

2. Short Stay Outlier – length of stay falls below the low trim point

Fee = Actual length of stay x Inlier Fee Low Trim Point

3. Long Stay Outlier – length of stay is above the high trim point and less than or equal to the extra high trim point. A long stay per day rate is applied to each DRG type (medical, surgical or other in each hospital category A, B, P and T).

AUCTION NOTICE SALE OF LAND FOR OVERDUE RATES LOCAL GOVERNMENT (FINANCE, PLANS AND REPORTING) REGULATION 2010

Tablelands Regional Council hereby gives notice to you that in accordance with the provisions of Chapter 2, Part 12, Division 3 under section 76 of the Local Government (Finance, Plans and Reporting) Regulation 2010 and by authority of a resolution passed by Council on 2 March 2011, land described in the attached schedule (Schedule A), for which you are the registered owner, will be sold by public auction (see resolution below) "That Council: Sell such land listed in Schedule A (attached to these Minutes as Appendix 4) due to the rates which have accrued on the rateable lands remaining unpaid for three (3) years or longer, in accordance with section 74 of the Local Government (Finance, Plans and reporting) Regulation 2010." The public auction will take place at 10am on Thursday 14 July at the PCYC Hall, 136 Walsh Street Mareeba, unless the sum of all overdue rates and charges, and any further amounts outstanding including interest accruing up to the date of payment and all expenses incurred by the Council in connection with the proposed sale are sooner paid.
