This expanded exclusion allows dozens if not hundreds of dog breeders to keep animals in inhumane (Continued from page 4) conditions, without adequate veterinary care and completely protected from public hunting, security and breeding dog dealers, under view by simply raising and selling pets directly to the public. Investigations have found the Animal Welfare Act ("Act"), 7 U.S.C. §2131 et some of these facilities to be operated in a manner that allows communicable diseases seq.; and, (2) amend regulations under the Act, that such as parvo and distemper to spread, and provides inadequate shelter and currently define the term "retail pet store" in the Act unhealthy sanitary conditions including fetid water, vermin infestation and fecal as all retail pet "outlets." The facility involved was eventually prosecuted and closed down by local authorities. A more recent case involves a breeder in Glendale, West Virginia. This breeder was II. When he was Petitioner, the Doris Day Animal League (DDAL), is a returned to the other owners on October 19, 1994 he was emaciated and dehydrated non-profit, charitable corporation with principal and had severe flea infections, worms, was extremely matted, and needed stitches to offices in Washington, D.C. The DDAL represents a close a wound. The co-owners had tried to solicit help from the local police to membership and mailing constituency of more than investigate complaints regarding odors emanating from the yard, but the police stated 298,000 persons nationwide. The primary goal of that they did not have the authority to act.8 If the kennel were licensed under the Act, it DDAL is to promote humane care and treatment of would be open to inspections and the kennel would be mandated to correct all animals, including animals bred and raised in deficiencies. The agency's interpretation that the term "store" includes all "outlets" has puppy mills for pets or hunting dogs. Petitioner DDAL allowed these and other equally deficient establishments to operate unchecked and for has used substantial resources in seeking to correct the dogs involved to suffer from inadequate housing, food and veterinary care. A the deficiencies in the Animal Welfare Act,1 "store" simply cannot be interpreted to encompass operations that breed, raise or sell regulations under the Act2 and the enforcement of puppies from a backyard, living room or barn. Therefore this interpretation by the regulations promulgated pursuant to the Act. DDAL agency constitutes an unreasonable and arbitrary interpretation of the clear and plain actively participated in the promulgation of meaning of the statute and is therefore contrary to the law. The agency may have regulations under the 1985 amendments to the Act been influenced in promulgating the regulation by the legislative history accompanying and in monitoring the enforcement of the Act as it the 1970 amendments which states that the bill's purpose is to regulate "more people relates to Class "A" dealers. DDAL played a who handle animals. It will, for example, bring into the regulatory framework of the Act significant role in the development of Canadian for the first time . . . wholesale pet dealers (emphasis added)."9 This explanation of the regulations limiting the numbers of sick and diseased expansion of the coverage of the Act is clearly intended as an overview and not as a puppies entering Canada from U.S. Class "A" and limit on the potential for regulation. The section states that it is intended as an Class "B" dealer operations, and has sent the "example" of the expansion of coverage and not a description of the universe of Department of Agriculture over 75,000 petitions and coverage.10 It is reasonable for the author of the legislative history, in seeking to postcards from our members requesting prompt generally characterize a section that excludes retail dealers to state that the section action to reduce the abuses prevalent in the puppy includes wholesale dealers. It is not reasonable, however, for the agency to use this breeding industry. general description to limit coverage only to those entities clearly given as "examples" of intended coverage under the Act. While it is true that a dealer operating as a III. Statement of the Problem breeder but selling to the public directly is not a wholesaler, it is also clear that he or A. Current USDA Regulations Defining "Retail Pet she in most, if not all, cases is not a "store." The Act does not exclude "retail outlets", it Store" as any "Outlet" are Overly Broad and Violate does not exclude "all dealers except wholesalers." It only excludes establishments that Both the Clear Language and the Spirit of the Animal are both (1) retail and (2) stores. Clearly, had Congress intended to limit coverage Welfare Act either to only include wholesalers or to expand the exclusion of retailers to all "outlets," it could have done so. It did not. It is not the intent of the petitioner to seek amendment When Congress first enacted the Animal Welfare Act of the statute to include the casual breeder who sells directly to the public; these in 1966 it was intended to regulate only those entities breeders are excluded from coverage under the Act by the specific exclusion of that sold animals to laboratories and to reduce the individuals who derive no more that $500 gross income from the sale of animals each incidence of pet theft.3 The 1970 amendments year.11 Rather it is the intention of the petitioner to seek regulations that clearly expanded the coverage to include dealers of animals include individuals making a substantial income from the sales of dozens of puppies sold "for use as pets . . ."4 The Congressional each year for whom no protection currently exists by selling directly to the ultimate amendment specifically excluded "retail pet stores."5 consumer. The Department of Agriculture promulgated regulations interpreting the term "retail pet store" to B. The Current Policy of U.S.D.A. To Exclude the Dealers of "Hunting, Breeding and include any retail "outlet" under the 1970 Security Dogs" From the Provisions of the Act Is in Direct Contravention of the Explicit Amendments.6 The arbitrary expansion of the "retail Language of the Statute pet store" exemption called for in the statute to include any "outlet" selling to the consumer The U.S.D.A. has repeatedly stated its "policy" of not regulating hunting dog dealers confounds any reasonable definition of "store" in the under the Animal Welfare Act.12 However, this policy is in conflict with the clear language of the Animal Welfare Act and its supporting legislative history. Just as the (Continued on page 6) 5 (Continued from page 5) Spring, 1997 1970 amendments expanded coverage of the Act to include animals sold for pets, Congress also intended to include under this category dogs sold for hunting, security or limited to those entities that clearly fall within this breeding purposes. The Department did not include these animals under the Act's exemption. All other entities, including retail pet protection when implementing the 1970 amendments. Therefore, when Congress dealers, not operating as stores, should be covered revisited the Act in 1976 to expand coverage to the transportation of animals by air and to and regulated. The policy of the Department to ban animal fighting ventures, it also clarified its intention in the previous bill by including exclude breeders of dogs for hunting, breeding or the following language: (f) The term "dealer" means any person who, in commerce, for security purposes has an even shakier foundation. compensation or profit . . . buys or sells . . . (2) any dog for hunting, security, or breeding The statute expressly calls for the inclusion of purposes . . .13 (g) The term "animal" means any live or dead dog. With respect to a dog these dealers. Yet, inexplicably, the Department the term means all dogs including those used for hunting, security, or breeding has based its exclusion of these animals on its own purposes."14 The agency cites two sources for the basis of its exclusion of some dogs flawed interpretation of the Act to exclude all retail from the provisions of the Act.15 The first is the legislative history related to the 1966 bill outlets. In fact, the exclusion of dogs bred for (referenced in letter as H.R. 13881). However, the 1966 bill only dealt with the sale of hunting, breeding or security purposes is not only animals to medical research and not to any facet of the pet industry. Therefore, this inconsistent with the statute, it is contrary to its provides no justification for this exclusion. The second source is the exclusion of "retail express language. Dogs bred for hunting, security pet store" from the Act in the 1970 Amendments. Clearly Congress did not intend to and breeding purposes fall within the clearly exclude any retail operation, but rather retail stores. This is evidenced by Congress' expressed legislative intent and therefore should be attempts to correct the Department's misinterpretation of the exclusions under the 1970 covered. amendments. Had Congress agreed with the agency's interpretation of the Act to expand the term "store" to include an "outlet" it would have been silent on the issue in the 1976 VI. The Regulatory Change Sought Would Amendments. With regard to dogs used for hunting, security, or breeding, Congress Further the Purpose of the Act made its intent extremely clear in 1976. In the legislative history related to the 1976 The purpose of the Animal Welfare Act is to amendments, the House report recognized the Department's flawed interpretation of the establish humane treatment of dogs by animal 1970 Amendments which were intended to cover hunting, security and breeding dogs by dealers.20 The Act establishes by law the humane stating that "Contrary to the interpretation presently held by the Secretary of Agriculture, ethic that animals should be accorded the basic all dogs, including dogs used for hunting, security or breeding purposes, do fall within the creature comforts of adequate housing, ample food protection of the Act."16 The Department's later analysis that these dogs are not covered and water, reasonable handling, decent sanitation, "since hunting dogs are usually sold at the retail level" flies in the face of the express sufficient ventilation, shelter from extremes of wishes of Congress. Because hunting, security and breeding dogs are rarely if ever sold weather and temperature and adequate veterinary at a retail pet store but, even according to the agency, are sold at the retail level,17 and, care.21 because Congress clearly indicated that the agency's interpretation that hunting dogs are to be excluded is wrong, the only logical interpretation of the Act is that "retail level" sales The inclusion of all dealers who breed dogs, are intended to be included at least as they relate to hunting, security and breeding dogs. including those sold for hunting, breeding or Also, because the exemption relates to dogs sold "as pets" and not to dogs used for security purposes, and with the limited exception of hunting, breeding or security, it should have no application to establishments dealing in retail stores, will assure protection under the Act for these animals.18 Because "breeding dogs" are included in Congress' clarification, and more animals, and therefore, will further its because no Class "A" dealer can operate without buying or selling breeding dogs, all purpose. Class "A" dealers should be covered under the provisions of the Act unless they are breeding in a "retail store." VII. Conclusion For the reasons set forth, Petitioner requests that IV. EVERYBODY has them--first times--and remembering them can bring back a range WELCOME N EW M EMBERS !! of emotions, from terror to exhilaration, from simple pleasure to sweet nostalgia. Although first times seem to decrease in frequency as we get older, they can be a source of renewed wonder at the richness of life. JIM AND J O A NN A RNETT

RESEDA , CA After several years of showing cats in premiership and lurking in the shadows of my

breeder friends, I just helped a little Burmese queen through OUR first litter, and it DEBORAH B ULMER was an experience I will never forget. I would like to share with you what it was IDAHO F ALLS , ID like for me and hope that some of my experience brings back some warm memories

of your first time . . . LINDA E LKJER

LEBANON , OR On an auspicious November Saturday filled with first times, my little queen,

Austriana Aliera, went into heat (after some false signals), and my friend Dawn LUCY H ILLENBRAND Shiley called to invite me to observe the birth of a litter of Norwegian Forest Cats at ALTAMONT , NY her house. I got to Dawn‘s in time to see the birth of all but one of five kittens.

Dawn instructed me in mid-wifery and showed me the various items I would need to KELLY J OHNSON assist in my own kittening. That afternoon, I took Alie, who was by then behaving ALHAMBRA , CA like a little slut, to Erika Graf-Webster‘s A2 to breed. We put Alie with her

intended, and they mated with little fuss as I watched another first time (for both me PATRICIA K OON and Alie!!!). When I picked Alie up the next night, I was pretty sure we had some SEATTLE , WA kittens.

MARCELLE L AROCHELLE I read everything I could find and talked to anyone who would listen to my BEAUPORT , Q UEBEC , C ANADA questions, getting much advice and many tips from experienced breeders. I stayed

calm--until Day 62, when cold fear struck. I frantically reread my books and notes, DR. S USAN L ITTLE and made on-line contact with my wonderful first-time support group. My vet had OTTAWA , O NTARIO , C ANADA pronounced Alie very healthy and said we probably had four kittens. Most

experienced breeders I talked to had echoed my vet‘s assurance that Mother Nature LYNETTE M ASSOW was pretty good at this stuff and the odds were very much in my favor that Alie and MIDDLETOWN , CT I would survive this. I wasn‘t so sure.

MARGARET AND R AY S TEVENS Worried, I visited Alie every few minutes. Her companion was Willie, a sweet CAMPBELL , CA neuter who loves her dearly and is very protective of her; Willie loved the attention

he and Alie were getting, and he got very excited about the preparations. He tested

the nesting area, checked out the heating pads, examined the kittening kit, and reassured Alie. We waited. Alie played with feathers, ran around her room and jumped onto the cat tree, slept in the window, and seemed oblivious to everything.

That night something happened. There follows a transcript of my e-mails documenting in real time my trepidation and my excitement.

We‘re still waiting. Alie sat in my lap while I was going through my fanciers mail, and I felt the kittens moving...the kittening kit is ready to go and we are just waiting (The First Time - Continued) (and I am getting pretty excited--Alie seems kind of calm.) Kathy She started her contractions noticeably about 1:20 this afternoon, and before I Subj: hi--kittens are coming, kittens are coming.... could catch my breath, a was Date 97-01-24 16:09:14 EST coming. 10 National Alliance of Burmese Breeders, Inc. Flat Chestedness in Kittens

ALLERGIC TO CATS? The following is a report on the results of an investigation into flat chestedness in Burmese kittens carried out at the Feline Centre, Langford with From the Detroit Free Press, Jan 7, 1996: particular reference to the role of Taurine in the condition. People who sneeze, itch and get teary-eyed when they get near cats may get help from a Introduction : new vaccine. Researchers from Johns Hopkins Flat chested kittens (FCK) have been reported in most breeds of cat including University in Baltimore report success with a domestic short hairs (DSHs), however they are seen significantly more new immunotherapy that reduces symptoms frequently in Burmese kittens. A similar condition is also reported in Bengal faster and requires fewer injections than cats though its etiology and prognosis may be different. Two thoracic standard allergy shots. deformities are commonly encountered in kittens, Pectus Excavatum (funnel chest) and flat chest. On occasions both conditions are seen in the same kitten. Traditional allergy shots consist of mostly water and extracts of cat dander - the dead skin cells Pectus Excavatum: Occurs in many species including man where it can occur that trigger people's allergies. The new vaccine, as an autosomal dominant. In man there is a strong bias toward males. called Allervax cat, is made with specific Fourteen cases of pectus excavatum are reported in the veterinary literature, allergen parts called epitopes, which maximize eight of which were DSHs and seven of the eight were male kittens. Conventional treatment involves a series of Flat Chest: FCK's have a generally flat, not S-shaped sternum, the rib about 25 shots, followed by boosters every two deformities beginning more cranially (towards the head) creating a sharp weeks for months or even years to build angular deformity at the costochondral junction. If the kitten survives, the deformities usually become less noticeable beyond 3-4 months of age, although the kyphosis may remain. More studies are underway to determine what Several but rarely all kittens in a litter may be affected. dosage is best. Additional results are to be presented in February to the American Academy Mode of Inheritance : of Allergy, Asthma & Immunology. The vaccine Several studies have been undertaken by the Burmese Cat Club (BCC) over would not be commercially available until at the past 15 years to try to establish the cause of flat chests. If flat chestedness least 1998, researchers reported. (From the is an inherited condition with a genetic basis then it would be related to the Medical Tribune) stud used, with a proportion of kittens in a litter affected. The conclusion of the studies strongly suggest that there is a genetic basis but the mode of inheritance is likely to be complex, possibly involving more than one gene, the expression of which may depend on other external factors. The studies showed that 7.7% of all Burmese litters have one or more FCKs. Overall this represents about 2-3% of all Burmese kittens born. The studies also suggested that a stud would have to have sired many FCK-free litters before it would be reasonable to conclude that he would be unlikely to carry FCK factor(s). Similarly, a queen would have to have several FCK-free litters to different studs before she could be similarly classified.

The data also suggests that the FCK factor(s) is widely spread in Burmese cats, perhaps being carried by 2/3rds of all cats. All conclusions from these studies depend on the accuracy of the answers given by the individual breeders. A great variety in the degree of deformity has been seen in different kittens, two FCK were only identified on close examination of the litter. This would tend to give the impression of a lower incidence of flat chests than actually occurs and may have placed some studs and queens in the wrong group in BCC studies. The variability in the degree of deformities again supports the argument that there are multiple factors governing the expression of flat chestedness. Despite these concerns, there is good evidence provided by these studies for the genetic basis of flat chests and that both stud and queen owners need to take responsibility for this condition.

(Continued on page 12) 11 (Flat Chested Kittens continued from page 11) Spring, 1997 There have been some suggestions of a correlation between flat chestedness and a number of other factors such as body type or the use of calcium supplements. The Rainbow Bridge However these links are tenuous, based on quite small groups and may in fact represent the result of attempts to prevent flat chests, e.g. by supplementing the Just this side of heaven is a place called queen during subsequent pregnancies. Study Results : The questionnaire was primarily designed to obtain information of the queens and kittens, particularly FCK's. As such it does not represent a general survey of Burmese cats in the UK.

Stud Cats: Information on stud cats was provided only in relation to a particular queen's litter. 36 stud cats were used siring 53 litters. Of these, 7 studs (9 litters) had 12 (Continued on page 13) National Alliance of Burmese Breeders, Inc. (Flat Chested Kittens continued from page 12) sired no FCK's. Litter size averaged 5.3 kittens, normal for the breed. (Flat Chested Kittens continued from page 14) What Does This Mean ? Queens: 25 of the 28 queens in the survey had one of more FCKs, the remaining 3 Clearly FCKs are a major problem in the queens were all primiparous and could not therefore be classified as non-FCK Burmese breed and cases are appearing in breeders. Kittens : Of the 24 litters with FCKs 11 queens had previous litters with FCKs, 4 had no previous FCK's and for 9 queens, it was their first litter. Of the 46 FCKs where some history was available the most consistent feature (other than the chest deformity) was poor weight gain - seen in 75% of cases. Reduced activity was noted in about 1/3 rd of the kittens. A quarter of kittens has spinal deformities, 4 of 46 also had pectus excavatum. Other defects noted were swollen abdomen(2/46), heart defect(2/46) and splayed limbs (3/46). 26% of all kittens in FCK litters were flat chested, the survival rate of all kittens in these litters was 76%.

Flattening of the chest is rarely present at birth, the average age at which the kittens were recorded as flat chested was 9.5 days. Of the 17 FCK's blood sampled the majority (12) has mild to moderate thoracic deformities, 3 had transient changes and 2 were severely affected. The coat color of most kittens sampled was recorded, it is interesting to note that no FCKs had lilac coats (a double recessive color). Whole Blood Taurine Results : The normal range for whole blood Taurine (WBT) is considered to be between 200 and 600 umol/litre, whether this is also applicable to kittens is unclear as data for a normal range in this group is not available. The majority of Burmese queens (11/14) and all non Burmese queens (4/4) had WBT levels within this range compared to only 12/59 (20%) of Burmese kittens and (6/10) of non-Burmese kittens. Burmese (Continued on page 14) 13 (Flat Chested Kittens continued from page 13) Spring, 1997

The average The genetics of inheritance of flat chest is WBT level in FCKs is higher than that in non-FCKs, 789 umol/litre vs. 702 umol/ litre. WBT levels were not affected by the sex of the kitten or whether the kittens not known, however the possible variations had been weaned. 1. No. A Sable must have at least one Dark gene and at least one Black gene. 2. No. Neither parent has a Black gene to give the kittens. 3. No. Again, a Sable must have at least one Dark gene and at least one Black gene. Neither parent has a Dark gene to give the kittens. 4. Yes, if the blue is carrying champagne AND the champagne is carrying blue. 5. In the same way that "you can't prove a negative", until he actually sires a blue or platinum kitten, you can never know for sure. Statistically, he probably isn't carrying blue, but until he actually sires a blue or platinum, you won't know! There are two crosses where the odds are 1:4 for each of the colors: Sable carrying both Blue and Champagne crossed with Platinum, Champagne carrying Blue crossed with Blue carrying Champagne

CARING FOR YOUR BURMESE PET

Most breeders have their own approaches to the feeding and care of Burmese. Many will provide you with complete instructions on do‘s and don‘ts. There are, however, several generic guidelines to keep in mind:

• Do not provide milk for your kitten or cat as their digestive systems cannot tolerate the lactose in cow‘s milk.

• Do provide plenty of fresh water in a clean bowl.

• Always have a clean litter tray available with fresh litter. Remove the solid material as often as necessary and clean the pan at least weekly.

• Although most Burmese will want to sleep with you (under the covers of course), you may wish to provide a bed for your pet. Wash the bed weekly to Celebrate your Cat‘s Grand keep it clean and fresh.
