Baltimore, Maryland January 2019 © 2019 David Dagan All rights reserved i Abstract This dissertation argues that mass incarceration in the United States occurred through a process of fragmented state-building. Institutional fragmentation both spurred the political will and critically enabled the bureaucratic capacity to imprison at a mass scale. By fragmentation, I mean both federalism (the division of authority among levels of government) and the separation of powers (the provision of independent political bases for different actors within a single level of government). The argument has three major parts. First, the local arena played a critical role in the rise of law-and-order politics, as fragmentation carved up the American polity in ways that amplified punitive impulses and muffled competing voices. Second, institutional fragmentation created a type of moral hazard by allowing actors with an interest in ramping up punishment to do so with little or no regard to the problem of prison crowding. When the crowding problem did become salient, it was in a crisis context that biased politicians toward underwriting mass imprisonment by building more cells. Third, prosecutors played a critical role in this fragmented state-building by out-organizing and out-lobbying rival actors in the criminal-justice system. Using archival documents and news accounts, the dissertation offers a detailed case study of these dynamics at work in Pennsylvania. It also examines the federal politics of criminal justice during the Reagan administration and the emergence of professional associations of prosecutors. Introduction In 1833, Gustave de Beaumont and Alexis de Tocqueville submitted their report “On the Penitentiary System in America” to the French government. Though it has been overshadowed by Tocqueville’s Democracy in America, the prison study was the actual purpose for which the duo had been sent to the United States. Beaumont and Tocqueville began the report by preparing their continental readers to expect complexity and contradiction in the American system. “By the side of one state, the penitentiaries of which might serve as a model, we find another, whose jails present the example of every thing which ought to be avoided,” they observed. They added that such differences showed up not just across states, but within single states such as Pennsylvania, where modern penitentiaries existed alongside archaic dungeons. “These shocking contradictions proceed chiefly from the want of unison in the various parts of government (within a state),” they wrote. “Being almost as independent of each other, as the states themselves, it results that they hardly ever act uniformly and simultaneously.”1 The result, Beaumont and Tocqueville found, was that “the best and the most 1 Gustave de Beaumont, Francis Tocqueville, and Francis Lieber, On the Penitentiary System in the United States and Its Application in France (Philadelphia: Carey, Lea and Blanchard, 1833), 14, http://archive.org/details/onpenitentiarysy00beauuoft. V) . 1 vicious prisons are found in the United States.”2 Nearly 200 years later, their judgment would likely be less mixed, and less positive. Regional differences remain important, but American prisons and jails have largely converged on a punitive mean that includes what is likely the world’s highest incarceration rate; notoriously brutal conditions of confinement; and persistent resort to extreme penalties such as capital punishment and life without parole.3 And while Beaumont and Tocqueville had little to say about the racial disparities they observed in prisons, the problem remains glaring and central to debates today.4 Why did the “land of the free” become the jailer to one-quarter of the world’s 2 In fact, Beaumont and Tocqueville endorsed only with caution even the “progressive” prisons that relied on strict discipline and isolation, such as the penitentiaries of New York and Pennsylvania. Incomplete data make it difficult to know if authoritarian regimes such as China or North Korea have higher rates of incarceration. In 2014, the high range of a United Nations- reported estimate for the North Korean prison population, including ordinary and political prisoners, was 200,000, yielding a total incarceration rate of 125.6, far below U.S. levels. In any case, comparison to such regimes is of little value because their practices are qualitatively different. The U.N. conservatively estimates an annual death rate of 10 percent in North Korea’s political prisons, and estimates as many as 400,000 dead over a thirty-year period. (2) How has the political centralization of the twentieth century affected socially cohesive community and public policy for “sensitive” issues, which require such cohesion to become settled? The author attempts to answer these questions via articulating and defending the following thesis: Socially cohesive community (i.e., a mode of intrinsically valuable friendship community that can develop around shared thick-level values and that is often associated with political activity and local interaction) was a possibility for local- level communities during the colonial and founding periods of American history; whereas, when the colonies/States were grouped together as an aggregate union, they did not constitute a true nation or single community of individuals. Hence, such “union” lacked a common good (and, a fortiori , it lacked a thick-level common good necessary for social cohesion). Through the course of American history, the political system has been centralized or transformed from a federal system into a de facto unitary system, and this change has undermined the possibility of social cohesion at the local level.

In order to fully understand early American history, culture, and literature, it is crucial to explore the literature produced by this group. Nonetheless, the sheer number of literary works produced by Germans in America makes such a task as difficult as it is important. This project participates in the recovery of German-American literature by focusing on German-language stories written in and about American contact zones. I begin in eighteenth-century Pennsylvania and follow new waves of immigrants south and west in the nineteenth century. I argue that German-American writers used transnational genres (the captivity narrative, the frontier romance, and the urban mystery novel) to articulate the transports and traumas of their transnational experiences. In Chapters 1 and 2, I look at German-language captivity narratives of the French and Indian War. I argue that writing captivity narratives allowed German settlers to negotiate their culturally liminal place in Pennsylvania as a racially privileged but culturally marginalized group, to come to terms with the transnational traumas of captivity and religious persecution, and to define and police constantly shifting communal boundaries.

    The Declaration of Independence: About the Signers (Continued) The Signers of the Declaration of Independence All of the colonies were represented in Philadelphia to consider the delicate case for independence and to change the course of the war. In all, there were fifty-six representatives from the thirteen colonies. Fourteen represented the New England Colonies, twenty-one represented the Middle Colonies and twenty-one represented the South- ern Colonies. The largest number (9) came from Pennsylvania. Most of the signers were American born although eight were foreign born. The ages of the signers ranged from 26 (Edward Rutledge) to 70 (Benjamin Franklin), but the majority of the signers were in their thirties or forties. More than half of the signers were lawyers and the others were planters, merchants and shippers. Together they mutually pledged “to each other our Lives, our Fortunes and our sacred Honor.” They were mostly men of means who had much to lose if the war was lost. None of the sign- ers died at the hands of the British, and one-third served as militia officers during the war. Four of the signers were taken captive during the war and nearly all of them were poorer at the end of the war than at the beginning. No matter what each of these men did after July 1776, the actual signing of the Declaration of Independence which began on August 2 ensured them instant immortality. The following gives a bit of information about each signer AFTER the signing of the Declaration of Independence. At the heart of this black politics were efforts to assert the right of free African Americans to citizenship in their native United States. Claims on the ambiguous notion of citizenship were important to free blacks both as a means of improving their own lives and as a way to combat slavery. The dissertation begins with the organized black protest against the founding of the American Colonization Society. The contest over the notion, advanced by the ACS, that free blacks were not truly American, or that they could not ever be citizens in the land of their birth, powerfully shaped the language and tactics of black politics. The dissertation ends with the enlistment of black troops in the Civil War, a development which powerfully shaped subsequent arguments for full black citizenship. It argues that in this period, free African Americans developed a rhetorical language of black nativism, the assertion that birth on American soil and the contribution of one’s ancestors to the American nation, had won for African Americans the right to be citizens of the United States.

But if he succeeds in this, it is because the social and political elements of the Machine were there ready to hand' The victory of Simon Cameron in the senatorial contest had insured the permanence of Pennsylvania's "Republican Revolution." In 1867, he set about the task of harmonizing the conflicting inter- ests of the Allegheny and Philadelphia "rings" on whom depended the precarious political balance in the state. For the Curtis-McClure faction of the party, the senatorial defeat was the major event in their political lives. Never again would they rise so near the seat of power they once enjoyed.
