Updated Estimated Dollar Shares for Each Class Member The Final Settlement Agreement (FSA) provided estimated percentages of the settlement amount to be distributed to each Class Member in Appendix 2. These share percentages were only estimates because the share percentages were subject to change based on a number of factors identified in the FSA, including a change if additional Class Members were later identified. FSA § VIII.D.1. During the objection period following the Court’s preliminary approval of the FSA, a tribal contractor not previously identified as a Class Member asked to be included in the Class. In response, the Court on December 17, 2015 issued an Order adding 55 newly-identified tribal entities to the class. The 55 additional Class Members will collectively receive 0.2256% of the estimated Net Settlement Amount, causing a minor recomputation of other tribal shares. Within 6 the meaning of 25 U.S.C. § 2803, I am an officer who is empowered by law to conduct investigations, 7 make arrests, and seize property for violations of Title 18, United States Code and Title 21, United 8 States Code. I am assigned to the Western Nevada Agency Office and have been so assigned since 9 March of 2014.     Modoc NF Travel Management Final Environmental Impact Statement Appendix K: Tribal Relations Native American Intergovernmental Affairs: Modoc National Forest, Tribal Relations Program Native American Intergovernmental Affairs Origins The United States and the 562 federally recognized tribes share a unique relationship whose foundation lies in the earliest history of this country. 7 The settlement of the New World began with Native American tribes possessing a clear strategic advantage over the 13 colonies, both militarily and economically; consequently, early American treaties with Indian tribes emphasized both tribal sovereignty and property rights. 8 Also, treaties were intended to deter foreign powers from forging alliances with Native Americans on U.S. promises of protection and trade. 9 Good relations with Indian tribes were paramount to American foreign policy since tribes protected U.S. western and southern borders from European aggressors. 10 The practice of treaty making continued as the country reconstituted itself under the United States Constitution in 1787. 11 Over 371 treaties were negotiated with Native American tribes by special commissioners acting on behalf of the President and under oversight by the War Department until 1849; subsequently, oversight was transferred to the newly established Department of the Interior. 12 The U.S. Senate continued to ratify Indian treaties between 1787 and 1871, which “under the Authority of the United States shall be the supreme Law of the Land.” 13 Treaties are superior to state constitutions and state laws. 14 The U.S. House of Representatives protested their exclusion over the Indian treaty-making process by passing the Indian Appropriations Act of 1871.
