[63] - 85 CONSTITUTIONAL PATRIOTISM IN LEB ON Maurus Reinkowski* In this paper I will discuss the options of political identity the Lebanese have at their disposal against the background of the German experience. Germany and Lebanon, states at first glance completely different from each other, show some similarity in their historical experience. In the context of this comparison I will discuss constitu- tional patriotism, a political concept in circulation in Germany over the last fifteen years or so, and its potential application in the Lebanese case. Constitutional patriotism, unlike many other concepts originating in the West, has yet not entered the political vocabulary of the Middle East. The debate on democracy and the civil society is widespread in the whole of the Middle East, including Lebanon. Lebanon's political culture, polity and national identity, however, show some peculiar traits that might justify the introduction of the term constitutional patriotism into the Lebanese political debate. As democracy and civil society are both closely linked to the concept of constitutional patriotism they will be treated in the first chapter. The second chapter will be devoted to the question of whether and to what extent Lebanon differs from the mainstream of the modern Middle East's political history. I will venture to draw a parallel with the German "sonderweg" (deviant, peculiar way). The third section will present briefly the German discussion of constitutional patriotism and its innate link to the sonderweg. -

Submission to the Parliamentary Joint Committee on Intelligence and Security on its Review of the Re-listing of Hezbollah’s External Security Organisation under the Criminal Code Act 1995 Dr. Colin Rubenstein AM Executive Director, Australia/Israel & Jewish Affairs Council Introduction This document forms the submission by the Australia/Israel & Jewish Affairs Council (AIJAC) to the Parliamentary Joint Committee on Intelligence and Security (JCIS) on the re-listing of Hezbollah’s External Security Organisation (ESO) under the Criminal Code Act 1995. This document recommends the JCIS approve the re-listing of Hezbollah’s ESO as a terrorist organisation. It further recommends the JCIS to recommend to the Attorney General that the entire Hezbollah organisation, not simply the ESO, be designated a terrorist organisation. It suggests the JCIS makes this recommendation for three reasons: 1. Hezbollah’s leaders have claimed on numerous occasions that while the West makes a distinction between the political and paramilitary wings of Hezbollah, the organisation itself makes no such distinction; 2. Further, the organisation as a whole continues to meet the definition of a terrorist organisation as defined by Australian federal legislation, principally the Criminal Code Act 1995, sections 102.1 and 102.1A; 3. Finally, as an Australian Federal Parliamentary Library Research Note points out, since late 2001 it has been a criminal offence under the provisions of the Charter of the United Nations Act 1945 and the Charter of the United Nations (Terrorism and Dealings with Assets) Regulations 2002, to fund or resource the group. Together, this legislation ratifies Australia’s obligation under UN Security Council Resolution 1373 to suppress the financing of terrorism1. -

Middle East Studies Association (MESA) Conference Washington, DC, November 2014 The Oral History and Memory of Ras Beirut: Exceptional Narratives of Co-existence Maria Bashshur Abunnasr, PhD This paper is a very condensed version of my past dissertation research and my current project on the oral history and memory of Ras Beirut sponsored by the Neighborhood Initiative at the American University of Beirut. For those of you who do not know Beirut, Ras Beirut is the western-most extension of the city and is most renown as the location of the American University of Beirut (AUB) founded by American missionaries in 1866 as the Syrian Protestant College. To many Ras Beirut is a place famous, indeed exceptional, for its association with tolerance, education, and cosmopolitanism. And that association is largely credited to AUB. The focus of this paper, however, is not on AUB’s role in Ras Beirut. It reverses the lens to consider the local community’s role in making Ras Beirut’s past through what I term, “narratives of coexistence.” Comprised of primarily (though not exclusively) Greek Orthodox Christians and Sunni Muslims, Ras Beirut’s local community claims its foundation is based on ta’ayoush, Arabic for coexistence. They consider their history of peaceful coexistence the bedrock of Ras Beirut’s exceptionalism that distinguished Ras Beirut from other parts of Beirut, of Lebanon, and of the region. While they recognize the presence of the AUB as momentous to the future shape of Ras Beirut as a cosmopolitan hub, their narratives insist on the influence, if not the determination, of their 1 coexistence on the missionary choice of Ras Beirut as the site for the College in the first place. -

Addis Analyst in Middle Eastern Affairs February 1, 2011 Congressional Research Service 7-5700 www.crs.gov R40054 CRS Report for Congress Prepared for Members and Committees of Congress Lebanon: Background and U.S. Relations Summary Lebanon is a religiously diverse country transitioning toward independence and democratic consolidation after a ruinous civil war and the subsequent Syrian and Israeli occupations. The United States and Lebanon have historically enjoyed a good relationship due in part to cultural and religious ties; the democratic character of the state; a large, Lebanese-American community in the United States; and the pro-western orientation of Lebanon, particularly during the cold war. Current policy priorities of the United States include strengthening the weak democratic institutions of the state, limiting the influence of Iran, Syria, and others in Lebanon’s political process, and countering threats from Hezbollah and other militant groups in Lebanon. Following Syrian withdrawal from Lebanon in 2005 and the war between Israel and Hezbollah in the summer of 2006, the Bush Administration requested and Congress appropriated a significant increase in U.S. assistance to Lebanon. Since 2006, U.S. assistance to Lebanon has topped $1 billion total over three years, including for the first time U.S. security assistance for the Lebanese Armed Forces (LAF) and Internal Security Forces (ISF) of Lebanon. Several key issues in U.S.-Lebanon relations could potentially affect future U.S. assistance to Lebanon. The scope and influence of foreign actors, primarily Syria and Iran; unresolved territorial disputes; concerns about extremist groups operating in Lebanon; and potential indictments by the Special Tribunal for Lebanon (STL) are among the challenges facing the Lebanese government and U.S. -

Lebanon in the Syrian Quagmire: Fault-Lines, Resilience and Possible Futures Ishac Diwan, Paris Sciences et Lettres Youssef Chaitani, UN ESCWA Working Paper for Discussion The purpose of this paper is to examine the weaknesses and strengths of Lebanon amidst the tensions created by the Syrian conflict that started in 2011. Lebanon’s sectarian governance system has been over 150 years in the making. But the Syrian fire next door, which has taken an increasing sectarian nature, is likely to burn for a long time. With such dire prospects, what is the fate of Lebanon’s governance system? Will it lead the country inexorably towards civil strife? The Lebanese governance system could be described as a horizontal deal among communal oligarchs, supported by vertical organizations within each community. While oligarchs have changed over time, the system itself survived devastating civil wars, endured extensive global and regional influences, and was also undeterred by the projection of power by many external forces, including the Palestinian Liberation Organization, Syria, Iran and Israel. What are the forces at work that make the Lebanese governance system both resilient and resistant to change? In the paper, we use as an analytical framework, which is introduced in section one, the model of limited orders developed by Douglas North and his associates. In section two, we argue that the Syrian civil war is likely to be long lasting. Section three examines the weaknesses and fault-lines of the Lebanese system in light of the Syrian war. Section four explores the factors that continue to contribute to the strength and resilience of Lebanon in spite of the rise in extremist Islamic militancy. -
