    1 Nigeria – Attacks on Justice 2000 Nigeria Human rights concerns and problems with the administration of justice still exist, as Nigeria remains a country in transition. However, a new Constitution provided appropriate safeguards for the independence of the judiciary and they were respected in practice. Military courts and special tribunals were disbanded and there was more respect for due process and the Rule of Law. The human rights situation improved substantially with the democratic election of a civilian government. Nigeria underwent a radical change in 1999, moving to a popularly elected civilian government for the first time in sixteen years. Nigeria had been led by General Abdusalam Abubakar in an transitional military government formed after General Sani Abacha's death in June 1998. In presidential elections held in February 1999, retired General Olesegun Obasanjo won 62.8% of the vote and was inaugurated as President on 29 May 1999. The 1999 Constitution of the Federal Republic of Nigeria created a federal system of government consisting of 36 states and established a separation of powers between the arms of government. Section 4 vested the legislative powers of the federation in a National Assembly consisting of a Senate and a House of Representatives. The Senate consists of three popularly elected senators from each state and one from the Federal Capital Territory of Abuja. The House of Representatives contains 360 popularly elected members. The National Assembly sits for a period of four years. The executive power of the Federation is vested in the President, who is assisted by the Vice President and the other Ministers of Government.

Aaron, LL.M, BL Legal Research Officer National Institute for Legislative and Democratic Studies National Assembly, Abuja ABSTRACT Pre-election litigations involving intra-party conflicts seem to have taken a front-burner in the electoral process of Nigeria, especially since the advent of the current democratic dispensation. Hitherto, at least going by a paucity of reported cases on intra-party conflicts, pre-election litigations between members of political party was a rarity. However, in the last few years there has been a phenomena upsurge in such matters with significant impact on the electoral process of the country. Using the recent decisions of the Supreme Court in pre-election litigations involving members of the All Progressives Congress (APC) in Rivers and Zamfara States, this paper reviews the trajectory of intra-party pre-election litigations and advocates for a reinvention of previous Supreme Court jurisprudence which views such disputes as political questions for which courts should prudentially decline jurisdiction.

DEMOCRACY IN NIGERIA Michael P. Seng* On December 31, 1983, a military coup marked the end of Nigeria's sec- ond attempt to goven itself under a democratic constitution. In his maiden broadcast to the nation on January 2, 1984, the new head of state, General Mohammed Buhari cited the country's continuing economic ills as the leading cause for the coup; he also referred to the former civilian administration as "corrupt, inept and insensitive" and complained that the last elections held in the fall of 1983 were not free.' The new military regime was received by the populous with general rejoicing and the Nigerian press warmly welcomed the intrusion of the military into Nigeria's political evolution.2 Yet just months before the coup, the Western press and diplomats were dubbing the 1983 elections "a victory for democracy." 3 Nigeria, with an esti- mated population of 90,000,000, was the fourth largest multi-party democracy in the world, and one of the few countries in Africa where citizens had the right to vote for a choice of candidates, any of whom could have won.4 Nige- ria, whose 1979 Constitution was patterned after the American presidential system, was expected to be the showcase for an American style democracy in Africa and to provide an example for the rest of the continent.

Nigeria is a federation of thirty states. The Nigerian Constitutions of 1979 and 1991 provide for a National Assembly and a Senate at the federal level. At the state level, there exists a Senate and a House of Representatives. The Constitutions also provide for a President to be the Nigerian Head of State and for a State Governor in each of the 30 states. There are separate federal and state courts and one Supreme Court. Every state is divided into counties generally called local government areas. Each local government area is administered by a chairman and a council of twenty members. The courts in each state are controlled by the state government. Each state government has a Chief Justice who also acts as the State Minister of Justice.
