INTERPRETING THE QUR’AN AND THE CONSTITUTION: SIMILARITIES IN THE USE OF TEXT, TRADITION, AND REASON IN ISLAMIC AND AMERICAN JURISPRUDENCE Asifa Quraishi* INTRODUCTION Can interpreting the Qur’an be anything like interpreting the Constitution? These documents are usually seen to represent overwhelming opposites in our global legal and cultural landscapes. How, after all, can there be any room for comparison between a legal system founded on revelation and one based on a man-made document? What this premise overlooks, however, is that the nature of the founding legal text tells only the beginning of the story. With some comparative study of the legal cultures that formed around the Qur’an and the Constitution, a few common themes start to emerge, and ultimately it turns out that there may be as much the same as is different between the jurisprudence of Islam and the United States. Though set against very different cultures and legal institutions, jurists within Islamic law have engaged in debates over legal interpretation that bear a striking resemblance to debates in the world of American constitutional theory.1 We will here set these debates next to * Assistant Professor, University of Wisconsin Law School. In the first chapter I deal with the fixed punishments or Mal hududrl; four punishments are discussed: the punishments for theft, armed robbery, adultery and slanderous allegations of unchastity. The other two punishments which are usually classified as "hudud11, i.e. the punishments for wine-drinking and apostasy are dealt with in the second chapter. The idea that they are not punishments of "hudud11 is fully ex- plained. Neither of these two punishments was fixed in definite terms in the Qurfan or the Sunna? therefore the traditional classification of both of then cannot be accepted. -

Pemikiran Ibnu Sahnun Tentang Belajar Mengajar Al-Qur’an 193 PEMIKIRAN IBNU SAHNUN TENTANG BELAJAR MENGAJAR AL-QUR’AN Ahmad Ubaedi Fathuddin* Abstract: Ibn Sahnun was the first Islamic leaders in which his thoughts was concentrated in the areas of education, especially teaching the Qur’an to early childhood. The highlighting of Sahnun’s was based on the notion that the Qur’an is the source of knowledge, and learning at an early age would be so attached and rooted in the child. Through Adab al-Mu’allimin, it is known that the thought of Ibn Sahnun seemed complete and programmed well, especially for the classical era in which only a few leaders who pursued the field of education. And of those concepts can be found some things that are still relevant for today, especially about the emphasis on methods of reading, memorizing and understanding in studying the Qur’an, as apparent in the method of iqra ¸ qira’ati, and amtsilati, and the permissibility of a Qur’an teacher to receive, take or set wages from his students Kata kunci: Ibnu Sahnun, belajar-mengajar, al-Qur’an. References to further information are given under both the names of the authors and the names of their works. The list is restricted to authors from Southeast Asia who wrote in Malay or in Arabic on traditional Islamic subjects. These dimensions are studied from the perspective of Sunni Islam in revolutionary and post-revolutionary Egypt on the basis of a fieldwork conducted in Al-Azhar Mosque in Cairo in 2012-2014, as well as of works by classical and contemporary Islamic scholars. This study of Shari’a is guided by the following questions: What kind of political subjectivity is enabled by Islamic jurisprudence when dealing with revolutionary protests, power, and order? What kind of spirituality is entailed by Shari’a rules? To what extent is Shari’a a kind of law distinct from contemporary state law that gives shape to a form of ethical life based on the relationship between acts of worship and -
The Search for Knowledge: Andalusi Scholars and Their Travels to the Islamic East
THE SEARCH FOR KNOWLEDGE: ANDALUSI SCHOLARS AND THEIR TRAVELS TO THE ISLAMIC EAST María Luisa Ávila Escuela de Estudios Árabes, CSIC Granada In Andalusi biographical dictionaries, the portrait of the individual scholar follows a pre-established outline, centered upon his place of birth, the names of his masters and disciples, the places he visited during his “period of formation” and his career and, eventually, his positions in the administration. Information about his personal attitudes or family ties is nearly always absent in these sources, mainly interested as they were, in the position of scholars as transmitters of knowledge. For Andalusi scholars, traveling to the Islamic East was an essential step in their period of formation, at least during the first centuries of the history of al-Andalus. Biographers, then, dutifully recorded the names of Eastern masters and places visited by scholars during these journeys to the East, coupled also with the pilgrimage to Mecca. This kind of biographical information offers a prosopographical material of outstanding interest, the analysis of which sheds a welcome light on the formative years and study patterns of Andalusi scholars. On this occasion I will restrict the analysis to the oldest of Andalusi biographical dictionaries, that of Ibn Harith al-Khushani, known as Akhbar al-fuqaha, wa-l-muhaddithin,1 a basic source for the study of intellectual life in al-Andalus during the ninth and tenth centuries.2 Through the study of the prosopographical material in this dictionary I intend to establish, first, the age at which scholars began their period of formation; second, when the travel to the East (the rihla) was usually undertaken, and, finally, how long these scholars stayed in the East. -

REPLY TO “ABU ALQAMA” AND HIS NEFARIOUS ATTACKS ON A NARRATION FROM MALIK ALAL----DARDARDARDAR Praise be to Allah that is due from all grateful believers, a fullness of praise for all his favours: a praise that is abundantly sincere and blessed. May the blessings of Allah be upon our beloved Master Muhammad, the chosen one, the Apostle of mercy and the seal of all Prophets (peace and blessings of Allah be upon them all); and upon his descendants who are upright and pure: a blessing lasting to the Day of Judgment, like the blessing bestowed upon the Prophet Ibrahim (alaihis salam) and his descendants. May Allah be pleased with all of the Prophetic Companions (Ashab al-Kiram). Indeed, Allah is most worthy of praise and supreme glorification! In this reply the following narration will be analysed in refutation of a pseudo-Salafi’s claims that it is weak and contains an unknown narrator (majhûl) by the name of Malik al-Dar in its chain of transmission (isnâd). The following has been presented here (sunniforum.com) by one of the brothers in documenting the evidences used to endorse the validity of Tawassul. Imam al-Bayhaqi related with a sound (sahih) chain the following: It is related from Malik al-Dar, `Umar's treasurer, that the people suffered a drought during the successorship of `Umar, whereupon a man came to the grave of the Prophet and said: "O Messenger of Allah, ask for rain for your Community, for verily they have but perished," after which the Prophet appeared to him in a dream and told him: "Go to `Umar and give him my greeting, then tell him that they will be watered. -
