1.0 INTRODUCTION The Town of North Attleborough is the operator of a small municipal separate storm sewer system eligible for coverage under the General Permit for Stormwater Discharges from Small Municipal Separate Storm Sewer Systems in , hereinafter called the “PERMIT”. The Town is submitting a Notice of Intent (NOI) to obtain authorization under the permit, effective July 1, 2018. In conjunction with submitting the NOI application, the permittee is required to consider impacts on endangered or threatened species covered by the U.S. Fish and Wildlife Service (USFWS) and provide a determination of effects to listed species. 1.1 PURPOSE OF THE BIOLOGICAL EVALUATION The purpose of this biological evaluation is to assess effects of proposed action on biological resources. Proposed actions include existing stormwater discharge related activities which cause, contribute to, or result in stormwater point source pollutant discharges and measures to control, reduce or prevent stormwater pollution from these Stormwater discharges including the citing, construction, operation and implementation of Best Management Practices (BMPs). All activities proposed are required by the Permit.

2.0 PROJECT DESCRIPTION Stormwater runoff is the leading cause of water pollution in the United States. Precipitation that flows over impervious surfaces collects pollutants and discharges untreated into a surface waterbodies. The overall goal of the project is to meet the requirements of the permit which include six minimum control measures to reduce pollution in stormwater runoff. The Six Minimum Control Measures are as follows:

1. Public Education and Outreach 2. Public Participation/Involvement 3. Illicit Discharge Detection and Elimination (IDDE) 4. Construction Site Runoff Control 5. Post-Construction Runoff Control 6. Pollution Prevention/Good Housekeeping

The permit specifies what the Town must do to comply with each measure, building upon the practices implemented through the 2003 MS4 General Permit for operations and maintenance of the Town’s storm sewer system. 2.1 WHAT Many of the proposed activities are already being implemented through the 2003 MS4 General Permit and there are no new structural BMPs proposed at this time. BMP activities proposed at this time by the Town are identified below for each of the required six minimum control measures.

Public education and outreach: Mailings, Website updates, events, phone contact, site visits, and/or other means to educate the four target audience groups identified by the permit (1)residents, (2) Businesses, Institutions and Commercial Facilities, (3) Developers/Construction, (4) Industrial Facilities.

Public involvement and participation: Provide opportunity to the public for annual review of the stormwater management plan and posting of stormwater management plan on website. Provide and advertise a household hazardous waste/used oil collection day in town annually.

Investigation for illicit discharge detection and elimination programs: Develop a sanitary sewer overflow inventory and create/update the storm sewer system map. Conduct dry and wet weather screening and sampling of outfalls. Create a written IDDE program and implement catchment investigations involving manhole inspection and flow sampling.

Construction Site Runoff Control: Create written procedures of site plan review, inspection and enforcement and begin implementation. Adoption of requirements for construction operators to implement a sediment and erosion control program. Adoption of requirements to control wastes, including but not limited to, discarded building materials, concrete truck wash out, chemicals, litter, and sanitary wastes

Post-Construction Runoff Control: Adopt procedures to require submission of as-built drawings and ensure long term operation and maintenance. Identify at least 5 permittee-owned properties that could be modified or retrofitted with BMPs to reduce impervious areas. Develop a report assessing existing local regulations to determine the feasibility of making green infrastructure practices allowable when appropriate site conditions exist. Develop a report assessing requirements that affect the creation of impervious cover. Ensure any stormwater controls or management practices for new development and redevelopment meet the retention or treatment requirements of the permit and all applicable requirements of the Massachusetts Stormwater Handbook

Good housekeeping and pollution prevention: Create written Operation and Maintenance (O&M) procedures for parks and open spaces, buildings and facilities, and vehicles and equipment including an inventory of these permitee-owned facilities. Create Stormwater Pollution Prevention Plans (SWPPPs) for maintenance garages, transfer stations, and other waste-handling facilities. Create written O&M procedures for operations and maintenance of MS4 infrastructure including: establishing a schedule for cleaning catch basins and sweeping all streets and permitee-owned parking lots, establish and implement a programs for repair and rehabilitation of MS4 infrastructure, minimizing the use of road salt and inspection and maintenance procedures and frequencies for stormwater treatment structures. 2.2 WHERE BMP activities are to be conducted at or on existing permittee-owned infrastructure and facilities within the designated MS4 area as shown on the attached map. Permittee-owned infrastructure includes drainage pipe, structures and outfalls, roadways and parking lots and structural stormwater quality BMPs. Permittee-owned facilities include parks and open space, buildings and facilities and vehicles and equipment storage areas. 2.3 WHEN These BMPs will be implemented over the 5 year term of the permit, effective July 1, 2018 and expiring on June 30, 2023. By Year 2 of the permit, all activities listed above are required to be ongoing. 2.4 WHO The Needham Department of Public Works will be responsible for managing and implementing all BMP activities related to the Permit. DPW will consult with and engage the Conservation Commission,

Planning/Zoning departments, Board of Health and outside contractors and consultants as needed to carry out the requirements of the Permit.

3.0 ACTION AREA DESCRIPTION

3.1.1 PROJECT AREA The project area is the MS4 area within the Town and its receiving waters as identified on the map. The immediate area of the project(s) includes the existing permittee-owned infrastructure and facilities within the designated MS4 area as shown on the attached map. Permittee owned infrastructure includes drainage pipe, structures and outfalls, roadways and parking lots and structural stormwater quality BMPs. Permittee owned facilities include parks and open space, buildings and facilities and vehicles and equipment storage areas.

4.0 LISTED OR PROPOSED SPECIES According to the Information for Planning and Consultation (IPaC) website, there are no critical habitats as designated under the Endangered Species Act (ESA) within the project area under the jurisdiction of the US Fish and Wildlife Service. The Town of North Attleborough is located inland and there are no activities covered under the Permit which affect areas under the jurisdiction of NOAA Fisheries. Therefore, no critical habitat has been identified within the Town of North Attleborough or other wildlife habitat will be impacted by activities authorized under this Permit. The project area is within the range of one listed species, the Northern Long Eared Bat (NLEB). The activities covered under this permit will not remove trees ≥3 inches dimeter at breast height and are not within the “buffer” of a NLEB hibernacula or maternity roost tree shown on the latest map generated by the Commonwealth of Massachusetts (current through November 29, 20161). No new structural BMPs are proposed and no alteration of land, either disturbed or undisturbed, will occur.

5.0 EFFECTS ANALYSIS Appendix C to the MA MS4 general permit (Endangered Species Guidance) provides step by step guidance to aid applicants with the U.S. Fish and Wildlife Service ESA Eligibility Process. We have followed the steps of Appendix C for the Endangered Species Act determination and believe we are eligible for certification under Criterion C based on the following: ∂ Our action area contains the species of Northern Long-eared Bat AND ∂ Our assessment of discharge and discharge-related activities indicated that there would be “no effect” on listed species or critical habitat AND ∂ We agree that, if during the course of the permit term, we plan to install a structural BMP not identified in the NOI we will conduct an endangered species screening for the proposed site and

contact the USFWS if it is determined that new activity “may affect” or is “not likely to adversely affect” listed species or critical habitat under their jurisdiction.

6.0 CONCLUSION AND DETERMINATION OF EFFECTS The basis for our assessment of “no effect” is that all discharges identified in the NOI are an existing condition currently subject to the 2003 MS4 General Permit. BMP activities proposed at this time are limited to public education and outreach, public involvement and participation, investigation for illicit discharge detection and elimination programs, outfall inspection and monitoring, procedures and regulations for stormwater runoff control, good housekeeping and pollution prevention for municipal facilities and MS4 infrastructure operations and maintenance such as cleaning catch basins and drainage pipes and street sweeping. There are no new structural BMPs proposed at this time and any new BMP construction will be evaluated for effect on endangered or threatened species at the time it is proposed.

The purpose of the Act is to provide a means whereby threatened and endangered species and the ecosystems upon which they depend may be conserved. A Biological Assessment is required for construction projects (or other undertakings having similar physical impacts) that are major Federal actions significantly affecting the quality of the human environment as defined in the National Environmental Policy Act (42 U.S.C. 4332(2) (c)). For projects other than major construction activities, the Service suggests that a biological evaluation similar to a Biological Assessment be prepared to determine whether the project may affect listed or proposed species and/or designated or proposed critical habitat. Recommended contents of a Biological Assessment are described at 50 CFR 402.12.

If a Federal agency determines, based on the Biological Assessment or biological evaluation, that listed species and/or designated critical habitat may be affected by the proposed project, the agency is required to consult with the Service pursuant to 50 CFR 402. In addition, the Service recommends that candidate species, proposed species and proposed critical habitat be addressed within the consultation.
