Instead one needs to consider the actors´ capacities to use these institutions. This master dissertation analyses why the legal institutions that came with the democratic transition in South Africa haven´t given better results for the domestic workers. Furthermore, a more profound discussion is given regarding the question; how can collective actors´ level of political capacities serve as an explanation to the perceived challenges with domestic workers´ labour laws. Findings from the study indicate that there have been extensive improvements with the implementation of the domestic workers´ labour laws. However, despite these improvements, the domestic workers are still struggling. And the reason why, may be explained in light of enforcement and content of the laws. The study suggests that the South African Domestic Service and Allied Workers Union´s low level of political capacities to some extent may explain why the legal institutions that came with the democratic transition in South Africa haven´t given better results for the domestic workers.     Political Contestations within South African Migration Governance Khangelani Moyo & Franzisca Zanker December 2020 KEY POINTS South African migration governance has adopted an increasingly securitised approach which also blurs the boundaries between refugees and migrants. Refugee protection is increasingly fragmented, enveloped by an exclusive immigration system and a weak regional approach in terms of free movement. There are a number of political stakes related to refugee and migration governance: o Migration governance is used as leverage in domestic politics. Xenophobic violence against migrant and refugee communities continues routinely. The exclusionary approach works particularly well as a form of leverage in scapegoating the governments failures to address poverty and job creation. A focus on securitisation further concretises an anti-refugee and anti-migrant stance in policy. o The exclusionary approach contrasts to visions of free movement and Pan-Africanism as well as the benefits of “skilled” migration. In practice however, domestic imperatives are still more important and are often strengthened by the approach to foreign policy, such as quiet diplomacy in neighbouring Zimbabwe. More recently, they have resulted in diplomatic tensions with other African countries. o The Department of Home Affairs has a performative relationship with civil society who try to keep them in check. Refugee activists are side-lined where possible and given a negative portrayal. Social xenophobic rhetoric is based on the premises of identity-construction through othering as well as being linked to economic deprivation. These discourses are reinforced both through rhetoric by politicians and the media. o The border town of Musina shows that such rhetoric is not ubiquitous and a more proactive role for political and community leaders to change the public discourse on the contributions made by migrants to communities is possible.

Protestors claim that they protest over lack of ‘service delivery’ and water is one of the elements of service delivery. In 2012 the frequency, geographical spread and violence of service delivery-related social protests in post-apartheid South Africa reached unprecedented levels. Water service delivery issues rose in prominence among various reasons cited for protests. While this ascendance is remarkable, grievances over water services are not new.     DEMOCRATIC MARXISM DEMOCRATIC MARXISM SERIES Series Editor: Vishwas Satgar The crisis of Marxism in the late twentieth century was the crisis of orthodox and van- guardist Marxism associated mainly with hierarchical communist parties, and imposed, even as state ideology, as the ‘correct’ Marxism. The Stalinisation of the Soviet Union and its eventual collapse exposed the inherent weaknesses and authoritarian mould of vanguardist Marxism. More fundamentally, vanguardist Marxism was rendered obsolete but for its residual existence in a few parts of the world, as well as within authoritarian national liberation movements in Africa and in China. With the deepening crises of capitalism, a new democratic Marxism (or democratic his- torical materialism) is coming to the fore. Such a democratic Marxism is characterised in the following ways: • Its sources span non-vanguardist grassroots movements, unions, political fronts, mass parties, radical intellectuals, transnational activist networks and parts of the progressive academy; • It seeks to ensure that the inherent categories of Marxism are theorised within constantly changing historical conditions to find meaning; • Marxism is understood as a body of social thought that is unfinished and hence challenged by the need to explain the dynamics of a globalising capitalism and the futures of social change; • It is open to other forms of anti-capitalist thought and practice, including cur- rents within radical ecology, feminism, emancipatory utopianism and indigenous thought; • It does not seek to be a monolithic and singular school of thought but engenders contending perspectives; • Democracy, as part of the heritage of people’s struggles, is understood as the basis for articulating alternatives to capitalism and as the primary means for con- stituting a transformative subject of historical change.

Partnering with PASSOP and Access Chapter 2, the sessions were open to individuals who felt subjective salience with the broad categories of African, ‘foreign’ in South Africa, male, and experiencing same-sex desire. The guided sessions created temporary spaces which explored what it means to legally and socially belong in South Africa as ‘LGBTI foreigners’. Drawing on the narratives of the participants and the issues shared, the reportback emphasises that the enabling conditions surrounding the Constitution need to be multi-sited. The Constitution and supporting structures are framed as being inaccessible for many, contrasting formal equality with daily experiences in the country. It begins to shape steps towards an intersectional understanding of sexual and national belonging in a context of violent structural and substantive unbelonging and institutionalised homophobia and xenophobia.
