STATE OF FLORIDA CONSTRUCTION LAW COMPENDIUM Prepared by William F. Fink Wicker, Smith, O’Hara, McCoy & Ford, P.A. Grove Plaza Building, 5th Floor 2900 Middle Street (S.W. 28th Terrace) Miami, FL 33133 (305) 448-3939 www.wickersmith.com P. David Brannon Carr Allison 305 S. Gadsden Street Tallahassee, FL 32301 (850) 222-2107 www.carrallison.com Revised 2012 This outline includes a general overview of Florida’s construction law. The discussion of any particular topic is not an exhaustive analysis of all the statutory or common law related to the particular topic but is intended to give a general understanding of the issues. Please consult one of the Florida based USLAW attorneys for assistance with any specific fact pattern and/or issue. I. Breach of Contract Claims I-A: Choice of Law Clauses Florida recognizes a cause of action in the construction context for breach of contract claims. See Metrics Systems Corporation v. McDonald Douglas Corporation, 850 F. Supp. 1568 (N.D.Fla. 1994). The issue of liability is determined on a case by case basis dependant upon the language of the contract at issue. Typically, Florida law will apply to a Florida contract, especially when the terms of the contract itself dictate that Florida law will apply. However, under Florida law, “the law chosen by the contract applies so long as ‘there is a reasonable relationship between the contract and the state whose law is selected and the selected law does not conflict with Florida law or confer an advantage on a non-resident party which a Florida resident does not have.’” Id.

The Legacy Press www.thelegacypress.com 1 of 50 The Enterprising S. H. Goetzel: Antebellum and Civil War Publisher in Mobile, Alabama Cathleen A. Baker Whether concerned with the historical record, print culture, Southern literature, or book collecting, scholars have regarded Austria-born Sigmund Heinrich Goetzel as a significant publishing figure in the Deep South, both in the late antebellum period and during the Civil War. Although the firm operated as a publishing house for only eight years, its imprint is one of the best-known to collectors of rare books, and particularly to collectors of Confederate imprints. All of the Goetzel publications are now scarce, and some of them are of great rarity.1 Goetzel’s two publishing firms—S. H. Goetzel & Co. and S. H. Goetzel—are known primarily through twenty-eight publications. These include a map, a broadside, several pamphlets, and numerous books, representing a variety of literary genres: historical and contemporary novels, essays, poems, military and agricultural manuals, an ordinance code book, travel books, political treatises, sermons, and a spelling book. While most of the Civil War imprints were reissues of northern- and English-published titles, quite a few of the antebellum works were original titles. Over the four years of the war’s duration, a number of Cotton City entrepreneurs were engaged in occasional publishing, but only S.

  • U.S. President's Committee for Hungarian Refugee Relief
DWIGHT D. EISENHOWER LIBRARY ABILENE, KANSAS U.S. PRESIDENT’S COMMITTEE FOR HUNGARIAN REFUGEE RELIEF: Records, 1957 A67-4 Compiled by Roland W. Doty, Jr. William G. Lewis Robert J. Smith 16 cubic feet 1956-1957 September 1967 INTRODUCTION The President’s Committee for Hungarian Refugee Relief was established by the President on December 12, 1956. The need for such a committee came about as a result of the United States’ desire to take care of its fair share of the Hungarians who fled their country beginning in October 1956. The Committee operated until May, 1957. During this time, it helped re-settle in the United States approximately 30,000 refugees. The Committee’s small staff was funded from the Special Projects Group appropriation. In its creation, the Committee was assigned the following duties and objectives: a. To assist in every way possible the various religious and other voluntary agencies engaged in work for Hungarian Refugees. b. To coordinate the efforts of these agencies, with special emphasis on those activities related to resettlement of the refugees. The Committee also served as a focal point to which offers of homes and jobs could be forwarded. c. To coordinate the efforts of the voluntary agencies with the work of the interested governmental departments. d. It was not the responsibility of the Committee to raise money. The records of the President’s Committee consists of incoming and outgoing correspondence, press releases, speeches, printed materials, memoranda, telegrams, programs, itineraries, statistical materials, air and sea boarding manifests, and progress reports. The subject areas of these documents deal primarily with requests from the public to assist the refugees and the Committee by volunteering homes, employment, adoption of orphans, and even marriage.

  • Florida Historical Uarterly
The Florida Historical uarterly APRIL 1970 PUBLISHED BY THE FLORIDA HISTORICAL SOCIETY FRONT COVER “A View of Pensacola in West Florida” is a black and white engraving published and dedicated by George Gauld to Sir William Burnaby, rear admiral and commander of the British fleet at Jamaica. From the British ensigns on the vessels and the flag flying from the flagstaff, this is obviously a picture of Pensacola during the British period. Since Gauld’s name is not mentioned in any reference sources as an engraver, and since such a skill is not mentioned in his book, it is unlikely that he was the engraver of this picture, but he probably drew the sketch of the scene from which it was made. The engraving is in the Prints and Photographs Division, Library of Congress. Gauld, surveyor of the coasts of Florida, was born in 1732 at Ardbrack, Bamffshire, and he was educated at King’s College, Aberdeen. In 1763 he was appointed to make a survey of all newly acquired English territory in the West Indies, and in March of the following year he sailed aboard the Tartar for Jamaica to join Burnaby’s fleet. In August 1764 he accompanied Sir John Lindsay to Pensacola and he may have made a sketch of the harbor at that time. He was a friend of Philip Pittman, author of The Present State of the European Settlements on the Mississippi . (1770), and Thomas Hutchins whose An Historical Narrative and Topogaphical Description of Louisiana, and West-Florida was published in 1784. They helped him draft charts and plans of West Florida.
