RETSSAMFUNDET STÅR FOR FALD I POLEN 20 ”Vi skal huske på, at retssamfund og demokrati aldrig må tages for givet”. Det er en uddannelse, som i høj grad handler om at overlevere god advokatskik fra generation til generation – men i lige så høj grad lære, hvordan arbejdet i en retssal fungerer. Det er nemlig en stor del af advokatens dna, som ingen kan læse sig til i en bog. Det er og bliver et håndværk. I dette nummer af Advokaten sætter vi fokus på to grupper af advokatfuldmægtige, som uddanner sig til forsvars- eller familieretsadvokater. Praksis ved domstolene er i dag sådan, at de kan møde i mindre sa- ger, hvis dommeren vurderer, at de kan give klienten kvalificeret advokatbistand. Hvad der er kvalificeret advokatbistand afhænger af en konkret vurdering fra sag til sag. Det betyder samtidig, at det kan være vanskeligt som advokatfuldmægtig at få mulighed for at møde i alvorlige strafferets- og familieretssager, hvor der er risiko for fængselsstraf eller for at miste sin forældremyndighed. Fra byretspræsidenternes side lyder det, at sagen i retten bliver ført for klientens og samfundets skyld, ikke på grund af fuldmægtigens uddannelse. Det kan vi fra advokatside naturligvis ikke være uenige i, da det er advokatens fornemste opgave at varetage klientens interesser. Men når det er sagt, mener jeg, at samfundet på den anden side har en stor interesse i, at alle advokater er dygtige og godt forberedte. Samfundet har også en interesse i, at der hele tiden kommer nye, dygtige advokater til, som kan overtage stafetten fra de ældre og fortsat sikre klienterne den bedst kvalificerede advokatbistand. Det opnår vi kun, hvis vores fuldmæg- tige bliver involverede i specialiserede opgaver og får chancen for at få praktisk erfaring fra retten. Som advokat Katrine W. Gottlieb foreslår, så lad os få en debat om problemet. Både af hensyn til de unge fuldmægtige, der brænder for arbejdet med straffesagerne, men også fordi det grundlæggende er et problem for retssamfundet, hvis vi ud- danner for få forsvarsadvokater. Det kan i sidste ende betyde, at klienter ikke kan få en kvalificeret forsvarer, og det kan vi ikke acceptere i en retsstat. På nogle områder har vi det, som lidt misvisende betegnes som advokaters “møderetsmonopol”, hvilket i korthed betyder, at advokater har eneret på at repræsentere andre i retten. Og jeg MORTENFOTO: HOLTUM vil godt slå helt fast, at den ordning ikke er sat i verden for advo- katernes skyld – tværtimod. Den skal derimod tilgodese hensynet til sagens parter og til domstolene. Så lad os tage en fordomsfri debat om, hvordan vi fortsat kan leve op til de berettigede forventninger til os, som parterne og domstolene har om et højt kvalitetsniveau i retssagsbehandlingen. The uncanny in Howard Hawks’s The Big Sleep Christophe GELLY Dealing with The Big Sleep as a work fraught with uncanny representations now seems self-evident, after so many critics—whether in the field of literary or film studies— unsuccessfully strove to recapture the true development of the criminal plot unravelled by Marlowe: one piece still insists on being missing and points to the unsatisfactory closure of the text as well as the movie. It may be the mystery around Owen Taylor’s death, a minor character (but are there really minor characters in the detective genre, before the final solution supposedly sets up the characters’ roles for good?), or the main criminal protagonist in the movie, Eddie Mars, whose guilt is problematic in the plot. In other words, the disturbing, uncanny quality in the novel and the movie stems from this problematic closure and from the mystery on who did what precisely in the story—hence this quality derives from a debunking of the genre as self-contained and purely self-explanatory, an “ideal” of the text by which the text fails to abide.

Darby Dyar, Astronomy Approved By: Christopher Condit, Geology CE Type: Departmental Honors Project Using a gridded version of maritan topography with the computer program Gridview, this project studied the depth-diameter relationship of martian impact craters. The work encompasses 361 profiles of impacts with diameters larger than 15 kilometers and is a continuation of work that was started at the Lunar and Planetary Institute in Houston, Texas under the guidance of Dr. Walter S. Keifer. Using the most ‘pristine,’ or deepest craters in the data a depth-diameter relationship was determined: d = 0.610D 0.327 , where d is the depth of the crater and D is the diameter of the crater, both in kilometers. This relationship can then be used to estimate the theoretical depth of any impact radius, and therefore can be used to estimate the pristine shape of the crater. With a depth-diameter ratio for a particular crater, the measured depth can then be compared to this theoretical value and an estimate of the amount of material within the crater, or fill, can then be calculated. The data includes 140 named impact craters, 3 basins, and 218 other impacts. The named data encompasses all named impact structures of greater than 100 kilometers in diameter.

    APPENDIX I LUNAR AND MARTIAN NOMENCLATURE LUNAR AND MARTIAN NOMENCLATURE A large number of names of craters and other features on the Moon and Mars, were accepted by the IAU General Assemblies X (Moscow, 1958), XI (Berkeley, 1961), XII (Hamburg, 1964), XIV (Brighton, 1970), and XV (Sydney, 1973). The names were suggested by the appropriate IAU Commissions (16 and 17). In particular the Lunar names accepted at the XIVth and XVth General Assemblies were recommended by the 'Working Group on Lunar Nomenclature' under the Chairmanship of Dr D. H. Menzel. The Martian names were suggested by the 'Working Group on Martian Nomenclature' under the Chairmanship of Dr G. de Vaucouleurs. At the XVth General Assembly a new 'Working Group on Planetary System Nomenclature' was formed (Chairman: Dr P. M. Millman) comprising various Task Groups, one for each particular subject. Large alluvial fan deposits on Mars record relatively recent habitable surface conditions (≲3.5 Ga, Late Hesperian – Amazonian). We find net sedimentation rate <(4-8) μm/yr in the alluvial-fan deposits, using the frequency of craters that are interbedded with alluvial-fan deposits as a fluvial-process chronometer. Considering only the observed interbedded craters sets a lower bound of >20 Myr on the total time interval spanned by alluvial-fan aggradation, >103-fold longer than previous lower limits. A more realistic approach that corrects for craters fully entombed in the fan deposits raises the lower bound to >(100-300) Myr. Several factors not included in our calculations would further increase the lower bound. The lower bound rules out fan-formation by a brief climate anomaly. Therefore, during the Late Hesperian – Amazonian on Mars, persistent or repeated processes permitted habitable surface conditions. 1. Introduction.
