World of Boxing V. Don King
Case 1:14-cv-03791-SAS Document 37 Filed 10/01/14 Page 1 of 19 UNITED STATES DISTRICT COURT SOUTHERN DISTRICT OF NEW YORK -------------------------------------------------------- )( WORLD OF BOXING LLC, VLADIMIR HRUNOV, and ANDREY RYABINSKIY, Plaintiffs, OPINION AND ORDER - against - 14-cv-3791 (SAS) DON KING and DON KING PRODUCTIONS, Inc., Defendants. -------------------------------------------------------- )( SHIRA A. SCHEINDLIN, U.S.D.J.: I. INTRODUCTION Plaintiffs Vladimir Hrunov and Andrey Ryabinskiy are Russian boxing promoters who do business as World of Boxing ("WOB"). Defendant Don King ("King") is an American boxing promoter who does business as Don King Productions. On January 28, 2014, King and WOB entered into an Agreement In Principle ("Agreement"), in which King promised to produce Guillermo Jones ("Jones") for a bout against Denis Lebedev ("Lebedev") on April 25, 2014. 1 The See Agreement In Principle ("Agreement"), Exhibit ("Ex.") A to 7/22/14 Declaration of Olga Korobova, Custodian of Records for the World -1- Case 1:14-cv-03791-SAS Document 37 Filed 10/01/14 Page 2 of 19 day the bout was supposed to take place, Jones tested positive for furosemide, an illicit, performance-enhancing diuretic. The positive drug test precluded Jones from competing, and the bout was called off. On May 28, 2014, WOB filed this suit. WOB alleges that King, by failing to produce a clean fighter, breached the Agreement.2 King makes two arguments in his defense. First, he argues that the Agreement only required him to “do everything within his control . to cause Jones’s participation”3 — because Jones’s use of furosemide was not within King’s control, it cannot be grounds for breach. -

Bivol’s world title defense against Joe Smith Jr., (24-2, 20 KOs), will headline the show in a scheduled 12-round clash while Kuzmin will face an opponent to be announced in a ten- round bout. The event is co-promoted with Eddie Hearn and Matchroom Boxing Founded by Andrey Ryabinsky in 2012, World of Boxing has promoted many of the sport’s biggest events featuring numerous members of their roster including heavyweight world title challenger Alexander Povetkin, cruiserweight world champion Denis Lebedev, undefeated welterweight prospect Sergey Lubkovich, former lightweight world champion Edward Troyanovsky and former cruiserweight world champion Grigory Drozd in addition to Bivol and Kuzmin. On September 22, 2018, World of Boxing co-promoted with Matchroom Boxing the World Heavyweight Championship between Anthony Joshua and Povetkin which drew 80,000 boxing fans to Wembley Stadium in London, England and was viewed by a massive international televised audience. Said Ryabinsky, “I’m very happy with the great athletes and tremendous events we’ve been able to promote since 2012. We now enter a new chapter where many of our fighters will be further competing in the United States and we welcome this challenge to fight the best boxers situated in that country.” The philanthropic Ryabinsky also played an extensive financial role in the recovery of Russian heavyweight contender Magomed Abdusalamov who suffered a brain injury following a fight in November 2013, underwriting many of the costs associated with his therapy and family assistance. -

On the scale of pandemics, the novel coronavirus, commonly referred to as COVID-191 – which is currently ravaging the globe – has caused more deaths than any other contagion in our lifetime, and ranks among one of the worst in human history, not only in terms of its virulence, but in economic destruction as well. 1. The virus, which apparently emerged from a seafood and poultry market in Wuhan, China, was first reported in December 2019. a. Since its discovery, the contagion has quickly spread throughout the world like wildfire, killing over 645,0002 people in its path. These figures are increasing prospectively around the world on a daily basis. i. According to early reports from the U.S. National Institute of Allergy and Infectious Diseases, over 200,000-240,000 Americans would be killed by the virus, with millions being infected. 1. The conflict – the most violent since Ukraine re-estab- lished independence in 1991 – was ignited by draconian laws eliminating basic freedoms of speech and assembly that were approved by Parliament in a phony vote on January 16. Faced with arrest and the liquidation of the Euro-Maidan, which had been largely nonviolent, young radicals attempted to storm government buildings on January 19, igniting violence from both sides. “The people were psychologically exhausted after they were called two months ago to a revolution that instead resulted in the establishment of a dictatorship after peaceful protest,” said Petro Oleshchuk, a political science lecturer at Shevchenko National University in Kyiv. “Out of that came complete disappointment that spilled into aggression.” The Ukrainian government responded with a campaign of state terror in which activists were subjected to beat- ings, kidnappings, torture, shootings and murder carried UNIAN The scene on January 20 on Kyiv’s Hrushevsky Street, where violent clashes between the Berkut and protesters (Continued on page 4) broke out on January 19 and were continuing. -
