    Separating State from Church: A Research Guide to the Law of the Vatican City State* Stephen E. Young** and Alison Shea*** Mr. Young and Ms. Shea discuss the unique situation of the Vatican City State in legal research. They provide an overview of the founding documents and the constitutional structure of the world's smallest sovereign nation, a discussion of the complex nature of the Vatican's internationalstatus, and a bibliographic essay covering the materials most likely to be available in law librariesin the United States. 1 The Vatican City State (VCS), an enclave of Rome and a sovereign monarchical- sacerdotal state comprising slightly less than nine hundred individuals, 1 presents a difficult challenge for the legal researcher wishing to separate the affairs of the city state from those of the Catholic Church. The VCS is a distinct legal jurisdiction, but the inexorable intertwining of the Church-in the form of the Holy See2-with the VCS only serves to obfuscate the jurisdictional boundaries that lie between church and city state. 2 This article will explore the resources used in researching the laws of the VCS. The article begins by describing the founding of the city state in 1929 and analyzing the documents that comprise its constitution. This is followed by a description of the sources of law, the branches of government, and the treatment of the VCS in international law. The article concludes with a short bibliographic essay. Although the structure and governance of the Catholic Church are inevitably linked to the VCS through the Holy See, the focus of this article will be on the temporal aspects of the jurisdiction.

M.L.J. Wissenburg Abstract The Lateran Treaty of 1929 between Italy and the Roman Catholic Church constitutes the creation of Vatican City State. This thesis gives an account of the negotiations leading up to the signing of the Treaty. The creation of the City State draws our attention to two specific concepts: statehood and the separation of Church and state. The Catholic perspective on these concepts is presented and compared to other dominant theories of the concepts The Catholic perception of statehood in the early 20th century was based on the work of Fr. Taparelli, a Jesuit scholar who was heavily inspired by Thomas Aquinas (1225-1274). The thesis concludes that there is a discrepancy between this theoretical conception of statehood, and the creation of Vatican City State. This can be explained by the fact that obtaining statehood was instrumental to the Holy See’s ambition of becoming sovereign. Catholic doctrine on the relation between Church and state has always rejected the idea of a full separation. Papal teachings have traditionally promoted a differentiation between a spiritual and temporal sphere of power, each supreme in its own domain, but cooperating in harmony. Depending on one´s interpretation, the creation of Vatican City is in line with this doctrine. I. The Historical Development of Law in the Church. There are basically 5 historical periods in the history of the development of law in the Church. These are as follows: 1. The Early Christian Community (1-8 centuries). The early Christian Church, at least in Jewish sectors, incorporated the laws of the Old Testament into its life and practices. In the Old Testament, there were laws, which focused on the worship of the Jewish people, laws concerned with dietary regulations, and moral laws given by God for his people. In the earliest writings of the New Testament, laws appear. St. Paul, the first writer of the New Testament, presents lists of moral and disciplinary directives to be observed by all believers. He speaks at some length on marriage, the giving of directives for the moral life, and on amending the Jewish ritual practices of the early Christians, so that Christianity would not simply remain a Jewish sect. The early Church councils made determinations that were fairly specific and localized. They sought to offer specific solutions to specific problems now being faced by the growing Church. Many early canonical decisions and legislation was made from local, regional and provincial councils, such as the Synod of Elvira (in about the year 300). After the Edict of Constantine (313), the Church began another stage of development, since it was now free to grow and expand beyond the borders of the Roman Empire, without fear of persecution.

    Nicholas Doublet Cardinal Pietro Gasparri and Italian Fascism A Historiographical Reading Abstract By the time of his death, Pietro Gasparri’s place in history was assured. Already dur­ ing his lifetime, in fact, and in the period immediately following his death, one sees the development of a certain tendency among historians that has, in diverse ways, condi­ tioned all subsequent interpretation of his person and actions. The fact that his crowning achievement, the Lateran Treaty and concordat, marked what the Fascist regime consid­ ered one of its own greatest triumphs, which it sought to exploit on both the national and international scene, coupled with the censorship in effect at the time, assured a par­ ticularly ideological – which is to say, a strongly apologetic – reading of this figure. The present study considers the manner in which the understanding of this relationship has been treated over the decades from the period following Gasparri’s death to the works published following the opening of the Vatican Archives relating to the pontificates of Benedict XV and Pius XI, for whom he served as secretary of State. Furthermore, the nationalistic perspectives of the time, bolstered by the philo-fascist attitudes of the greater part of Italian Catholicism, meant Gasparri was largely associated with a specific context, namely Italy, and a single issue, the Lateran Pacts. However, over the subsequent decades, other facets of Gasparri’s work and the complexity of relations between the Holy See and Italy have gradually come to light. The aim of this study is to pull together an overview of the ways in which different historians, studying the Holy See’s relations with the Italian Fascist regime, have approached the person and actions of Pietro Gasparri and his emergence as a key figure in the successive pontificates of Benedict XV and Pius XI.
