1. Resumption of the session

The sitting opened at 17.05.

2. Approval of the minutes of the previous sittings

Elena Băsescu had been present at the sitting of 30 November 2011 but her name was not on the attendance register.

The minutes of the sittings of 30 November 2011 and 1 December 2011 were approved.

3. Statements by the President

The President announced that the President of the European Council Herman Van Rompuy would present a report on the latest European Council meeting the following morning and encouraged Members to participate in the debate that would follow.

He also referred to the agreement reached at the Durban Climate Change Conference and emphasised the important and positive role played in that process by the European Union and by Parliament's delegates.

The President reminded the House that it was the 60th anniversary of the signing of the Convention relating to the Status of Refugees and said that Parliament was actively working to ensure that the fundamental rights of refugees were respected. He referred to the situation of refugees at the Choucha refugee camp in Tunisia.

The President also reminded the House that it was the 30th anniversary of the introduction of martial law by the Polish authorities in their attempt to suppress the Solidarity movement which, despite persecution and the arrest of many of its members, had altered the face of Europe, with help from the countries of the West. This showed how important it was today to support the moves towards democracy in North Africa and the Western Balkans. 17.4.2012 EN Official Journal of the European Union C 110 E/3

4. Composition of Parliament (Protocol amending Protocol 36)

Following the entry into force of the Protocol amending Protocol 36 laying down transitional provisions concerning the composition of the for the remainder of the 2009-2014 parliamentary term, Parliament had 18 additional seats.

The authorities of the following Member States had notified Parliament that the following MEPs had been appointed:

Bulgaria: Svetoslav Hristov Malinov, with effect from 01/12/2011;

Spain: Vicente Miguel Garcés Ramón, Dolores García-Hierro Caraballo, Eva Ortiz Vilella and Salvador Sedó i Alabart, with effect from 01/12/2011;

France: Yves Cochet and Jean Roatta, with effect from 07/12/2011;

Italy: Gino Trematerra, with effect from 01/12/2011;

Latvia: Kārlis Šadurskis, with effect from 01/12/2011;

Malta: Joseph Cuschieri, with effect from 01/12/2011;

Austria: Ewald Stadler, with effect from 07/12/2011, and Josef Weidenholzer, with effect from 01/12/2011;

Poland: Arkadiusz Tomasz Bratkowski, with effect from 07/12/2011;

Slovenia: Zofija Mazej Kukovič, with effect from 08/12/2011;

Sweden: Amelia Andersdotter and Jens Nilsson, with effect from 01/12/2011;

The Netherlands had still to appoint the 18th MEP.

Parliament noted these appointments in accordance with Article 12 of the Act concerning the election of Members of the European Parliament by direct universal suffrage.

Under Rule 3(2), until such time as their credentials had been verified or a ruling had been given on any dispute, and provided that they had previously made a written declaration stating that they did not hold any office incompatible with that of Member of the European Parliament, the Members concerned would take their seats in Parliament and on its bodies and would enjoy all the rights attaching thereto.

5. Request for urgent procedure

Council request for the application of urgent procedure (Rule 142) for:

— draft Council Decision on the approval, on behalf of the European Union, of the Declaration on the granting of fishing opportunities in EU waters to fishing vessels flying the flag of the Bolivarian Republic of Venezuela in the exclusive economic zone off the coast of French Guiana (C7-0121/2011 - 08202/2011 – 2010(0392)NLE)

Reason for the request: there was a need to ensure that the activities being carried out under the proposal could continue.

6. Composition of Parliament

Oriol Junqueras Vies had given notice in writing of his resignation as Member of Parliament, with effect from 1 January 2012.

In line with Rule 4(1), Parliament established the vacancy as of the above-mentioned date and informed the national authorities concerned.
