NYSDEC Certifies Cleanup Requirements Achieved at Brownfield Site

The New York State Department of Environmental Conservation (NYSDEC) has determined that the cleanup requirements to address contamination related to the 1525 Bedford Avenue site (“site”) located at 1519-1535 Bedford Avenue, Brooklyn, NY under New York State's Brownfield Cleanup Program (BCP) have been or will be met. The cleanup activities were performed by Bedford Joint Venture LLC with oversight provided by NYSDEC. NYSDEC has approved a Final Engineering Report (FER) and issued a Certificate of Completion (COC) for the site. Copies of the Final Engineering Report and Notice of the Certificate of Completion are available at the location(s) identified below under "Where to Find Information."

Completion of Project The remedy included:

-Mitigation of Soil Vapor Intrusion (SVI) impacts - On-site buildings have been constructed with a sub-slab depressurization system, or a similar engineered system, to prevent the migration of vapors into the building from soil and/or groundwater.

-Soil Vapor Extraction (SVE) – A Soil Vapor Extraction system was installed to remove volatile organic compounds (VOCs) from the subsurface. The air extracted from the SVE system is then treated prior to being discharged into the atmosphere.

-Soil cover and capping - A two-foot clean soil cover system and demarcation layer was placed in areas not already covered by buildings, sidewalks, and pavement to allow for restricted-residential use of the site.

-An Environmental Easement was placed on the property to restrict land use to restricted residential/commercial/industrial operations and prevent future exposure to any contamination remaining at the site.

Implementation of a Site Management Plan for long term management of residual contamination as required by the Environmental Easement, including plans for: (1) Institutional and Engineering Controls, (2) monitoring, and (3) reporting.

Additional Details In addition to the remedy described above, an Interim Remedial Measure (IRM) was completed at the site in October 2016. An Interim Remedial Measure, is a remedial action that can be conducted without extensive investigation and evaluation. IRM activities consisted of removing approximately 23,000 cubic yards of petroleum contaminated soil from the site. A Community Air Monitoring Plan was implemented at all times during IRM activities, and will continue to be implemented during remediation activities.

Final Engineering Report Approved NYSDEC has approved the FER, which:

1) Describes the cleanup activities completed. 2) Certifies that cleanup requirements have been or will be achieved for the site. 3) Describes any institutional/engineering controls to be used. An institutional control is a non-physical restriction on use of the site, such as a deed restriction, when contamination left over after the cleanup action makes the site suitable for some, but not all uses. An engineering control is a physical barrier or method to manage contamination such as a cap or vapor barrier. 4) Certifies that a site management plan for any engineering controls used at the site has been approved by NYSDEC.

The following institutional controls have been or will be put in place on the site:

-Groundwater Use Restriction -Land Use Restriction -Site Management Plan -Environmental Easement -Institutional Control/Engineering Control Plan -Building Use Restriction -Monitoring Plan -Operation and Maintenance Plan

The following engineering controls have been or will be put in place on the site:

-Cover System -Vapor Mitigation -Air Sparging/Soil Vapor Extraction

Next Steps With its receipt of a COC, the applicant is eligible to redevelop the site. In addition, the applicant:  Has no liability to the State for contamination at or coming from the site, subject to certain conditions; and  Is eligible for tax credits to offset the costs of performing cleanup activities and for redevelopment of the site.

A COC may be modified or revoked if, for example, there is a failure to comply with the terms of the order or agreement with NYSDEC.

Background Location: The 1525 Bedford Avenue site is in an urban area in the Crown Heights neighborhood of Brooklyn. The site is bound by Bedford Avenue to the west, Lincoln Place to the north, multiple-story residential buildings to the east, and and the Transit Authority tunnels to the south.

Site Features: The site occupies an area of approximately 29,076-square-feet, and is currently an active construction site. The site was most recently occupied by a gasoline filling station, a service garage with a cellar level, a two-story retail store/office space and a car wash.

Current Zoning/Use: The site is currently zoned as R7D residential with a C2-4 commercial overlay.

Past Use of the Site: The site has been occupied by auto-related facilities (auto garages/repair, filling stations, car washes) since at least 1924.

Site Geology and Hydrogeology: The site and surrounding area slope to the north and is at an elevation of 135 feet above mean sea level. Regional groundwater flow is relatively flat with a slight gradient towards the north east. Perched groundwater was encountered at depths ranging from 20 to 50 feet below grade surface. The Upper Glacial Aquifer was encountered at 126 to 136 below grade surface. Soil beneath the site consists of fill material underlain by glacial till. The site is underlain by bedrock which consists of fine-grained quartz-feldspar granulite.

Brownfield Cleanup Program: New York's Brownfield Cleanup Program (BCP) encourages the voluntary cleanup of contaminated properties known as "brownfields" so that they can be reused and redeveloped. These uses include recreation, housing, business or other uses.

A brownfield site is any real property where a contaminant is present at levels exceeding the soil cleanup objectives or other health-based or environmental standards, criteria or guidance adopted by DEC that are applicable based on the reasonably anticipated use of the property, in accordance with applicable regulations.
