No. 4606.

An Act to sever certain Land in the Parish of Moorpanyal from the Municipal District of the City of Geelong and to annex the said Land to the Municipal District of the Shire of Corio and for other purposes. [\2th December, 1938.]

Preamble. HEREAS by section two of an Act passed in the No. 54 s. 2. W twenty-first year of the reign of her late Majesty Queen Victoria intituled " An Act to restrict the Boundaries of the Town of Geelong and to make further provision for defining the Wards thereof" the Town of Geelong was declared as from and after the passing of that Act to consist of a certain portion of land including the land No. 54 Schedule C. described in Schedule C to that Act, being the land Schedule. described in the Schedule to this Act:

And whereas at the time of the passing of the said Act the land described in the Schedule to this Act consisted of a site for slaughter houses and a site for a market for wild cattle for the use and convenience of the inhabitants of the said town :

And whereas the land described in the said Schedule is no longer used for the purposes aforesaid, but by No. 3091 as amended by virtue of the provisions of the Geelong Harbor Trust Act No. 4231 8. 0 (1). 1928 as amended by sub-section (1) of section six of the Geehng ami Melbourne Harbor Trusts Act 1934 the said land has been sold in fee-simple to International Harvester Company of Australia Proprietary Limited :

SSSh And whereas by Order in Council dated the eighth day 1!i10 of ^MSO!01"' ' December One thousand nine liundrecl and ten the Town of Geelong was declared a city under the designation of the City of Geelong:

And whereas the land described in the Schedule to this Act is entirely separated from the prmcipal part of the municipal district of the City of Geelong and, except as to 3 GEO. VI. ] Moorpanyal Land. [No. 4606 697

to that part of its boundary which is formed by the shores of Corio Bay, is wholly bounded by the Shire of Corio :

And whereas it is expedient that the land described in the Schedule to this Act be severed from the municipal district of the City of Geelong and annexed to the municipal district of the Shire of Corio : Be it therefore enacted by the King's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say) :—

1. This Act may be cited as the Moorpanyal Land Act short titio. 1938.

2. 4. Notwithstanding anything in this Act or in any Provisions^ other Act or enactment, the provisions of the Local ^/p^y^ Government Acts and in particular, without affecting the described m ,. ,., <• • , i •• p T» i. Preamble. SCHEDULE. Sections 2, 3. Land to be severed from the municipal district of the City of Geelong and annexed, to the municipal district of the Shire of Corio. Parish of Moorpanyal, County of Grant: Commencing at the north-west angle of Allotment 272 (now part of Crown Allotment 6B) ; bounded thence by said Allotment 272 and a line, being the Corio Shire boundary, bearing easterly in an arc of a circle whose centre lies sixteen chains southerly, to the shore of Corio Bay; by that shore bearing south-westerly to a point in line with the east boundary of Allotment 272 aforesaid ; by a line, being the Corio Shire boundary, bearing northerly to the south-east angle of said Allotment 272 ; and thence by that Allotment, being the Corio Shire boundary, bearing S. 54° 0' W. five chains thirty-seven links, S. 87° 0' W. sixty-four links and north to the point of commencement.
