VENTAS en Pista del Pabellón Verde Lunes 12 de Abril Salida de Ejemplares (a confirmar) 5 CONDICIONES DE VENTA 1.- Los animales incluidos en el presente catálogo, se venden conforme a las condiciones habituales de venta que corresponden a su tipo, cuyas características más importantes se detallan en el presente. Queda entendido por tanto, que cada persona que parti- cipe concurriendo al local de venta o haciendo ofertas para adquirir algún animal, acepta en todos sus términos las condiciones generales y particulares del remate. 2.- Al darse comienzo al remate, el martillero anunciará las condiciones particulares que regirán para el mismo, sin perjuicio de las condiciones generales aquí mencionadas.- 3.- La comisión es del 7% mas IVA (21%) al Comprador. * IVA recargo adicional para Sujetos No Categorizados: 10,5%. 4.- Los animales serán vendidos a la vista de los interesados, sin perjuicio de ello, todos los animales que salgan a la venta podrán ser revisados por todos los interesados, por sí o por medios de los profesionales que correspondan y designen.- Dicha revisación podrá realizarse en el local de venta el día del remate hasta la iniciación del mismo.- - Por lo expresado precedentemente, todo comprador adquiere el animal que tiene a la vista, en el estado en que se encuentra, el que se considerará conocido por el interesado aceptándolo con todos sus atributos y virtudes, pero con los posibles defectos, deficiencias o anomalías, que pudiere presentar.- . 5.- Con posterioridad a la adjudicación del animal, en ningún caso, el vendedor o la firma rematadora, aceptaran reclamos que tengan por objeto rescindir o resolver la operación, obtener una quita en el precio, demorar el cumplimiento de pago o formalida- des; reclamar daños y perjuicios o cualquier “otra pretensión” fundada en deficiencia o errores de pedigree, catálogo, propaganda, estado físico, orgánico, reproductivo o funcional del animal que hubiere sido adquirido. 6.- El pago del precio del animal adjudicado/adquirido deberá realizarse “al contado”, el mismo día de la compra, salvo que con anterioridad al inicio de la subasta, el ofertante, comprador/adquirente haya peticionado a la firma rematadora y obtenido de esta conformidad escrita del vendedor, para que en el caso de resultar comprador, pueda realizar el pago correspondiente de forma y con plazos distintos al aquí establecido. Se entenderá a las concesiones otorgadas a quien lo solicita, como “concesiones particula- res” y por lo tanto no serán extensivas a los restantes “compradores” o a todas las compras que efectúe un mismo comprador. 7.- Toda persona que resulte compradora de uno o más animales, previo a retirarse del local de venta, deberá cumplir, con las siguientes obligaciones y formalidades: a).- Suscribir la documentación correspondiente a su compra (Boleta de venta, Contrato de Compra, Título de Deuda, Pagarés, etc), para ello deberá exhibir su documento de identidad, constancia de inscripción AFIP, constituir un domicilio e informar un teléfono de contacto. Además brindará toda la información que fuera necesaria en relación al retiro y destino de el/los animal/es, b).- Pagar el “precio” de compra; la “comisión de remate”, e IVA que corresponda; el sellado total o gastos que correspondiera, por la documentación que instrumenta la operación. c).- Pagar todo gasto que el animal pudiera generar, con posterioridad a su adjudicación en remate. d).- Cumplidas todas las formalidades, retirar el animal adquirido del local de ventas dentro de las 24 horas de finalizado el remate. Desde el momento en que el martillero adjudica el animal en el martillo, dicho comprador queda a cargo exclusivo del mismo corriendo por su cuenta todos los gastos y/o responsabilidades sobre dicho animal. El incumplimiento de alguna de las obligaciones antes enumeradas precedentemente facultara, previa intimación por 48 horas al domicilio denunciado en el boleto de compra, al vendedor y/o a la firma rematadora a dejar sin efecto la operación y recuperar el animal, disponiendo inmediatamente del mismo, para su venta o lo que estimare conveniente, con derecho a reclamar daños y perjuicios por esta “resolución” por culpa del comprador. En este caso, toda suma que el comprador hubiere abonado con motivo de su compra, quedará a favor del vendedor, como pago “a cuenta” de indemnización, sin perjuicio de reclamar toda otra suma que correspondiera. 8- Aquella persona que habiendo efectuado ofertas, resulte adquirente y manifieste que la misma la realiza “en comisión” o para terceras personas o que resuelve fraccionar la compra y/o facturación de la misma con otros compradores, adquiere y acepta por este solo hecho su carácter de deudor solidario y responsable por el pago de la totalidad de la operación junto con aquellos que resulten compradores y/o a quienes se le emita la factura correspondiente a la operación. La transferencia de el/los animal/es adquiridos será entregada para su inscripción solo cuando se haya cumplido con la totalidad de las obligaciones asumidas. 6 SALES CONDITIONS 1.- The animals included in this catalog, will be sold according to the common conditions of the sales relating to this kind of transaction. The most important terms and conditions are stated in detail below. It is understood that each one of the persons who participate and assist to the sale store or make offers to acquire certain animals, accept in full all the terms and conditions, whether general or particular, of the auction. 2.- Once the auction is initiated, the auctioneer (martillero) shall announce the particular conditions which will be ruling the auction, without prejudice of the general conditions mentioned herein.- 3.- The commission is of 7 % plus VAT (21%) to the Purchaser. * VAT surcharge for non – resident foreign: 10,5%. 4.- The animals shall be sold in the sight of the interested parties. Notwithstanding, all the animals that are for sale could be revised by all the interested parties, or by the professionals they appoint.- Such revision could be performed in the sale store on the date of the auction until the initiation of the auction.- In connection with the abovementioned matters, all purchasers acquire the animal they have in sight, in the manner the animal is, and it shall be considered that the animal is well-known and acknowledged by the interested party, and that the interested party accepts all the attributes and virtues of the animal, with its possible defects, deficiency or anomalies the animal could have. 5.- After the sale of the animal, the seller or the Auction Firm shall not accept any claim which pretends to rescind or terminate the transaction, obtain a discount in the price, or delay the compliance of the payment or formalities; claim for damages and prejudices or any “other pretension” based in the deficiency or mistakes relating to the pedigree, brochure, publicity, physical state, organic, reproductive or functional of the animal which has been acquired. 6.- The payment of the price relating to the acquisition of the animal shall be made “in cash”, on date of the purchase, except that before initiating the auction, the bidder/ purchaser, has requested the Auction Firm and the seller has issued his conformity in wri- ting, so that in case the bidder results to be a purchaser, he can make the payment in the manner and in the terms different to the ones stated herein. It shall be considered as “particular concessions” the concessions granted to the persons who have requested, and therefore, they shall not be applicable to other purchasers nor to the other transactions done by the same purchaser. 7.- Each one of the persons who has purchased one or more animals, before leaving the sale store, shall comply with the following obligations and formalities: a).- Sign the documentation relating to the purchase Boleta de venta (Sale Agreement), Contrato de Compra (Purchase Agree- ment), Título de Deuda (Debt Titles), Pagarés (Promissory Notes), etc., in such connection the purchaser shall show his ID (docu- mento de identidad), copy of the registration with the AFIP (Argentine Federal Tax Boureau), constitute a domicile and provide a telephone number for contact. In addition, the purchaser shall submit all the information necessary for the removal and destiny of the animal/s, b).- Pay the “purchase price”, the “auction commission”, plus VAT (Value Added Tax), and the costs for stamp tax and expenses relating to the documents that have been executed regarding the transaction.
