What Public Holiday Entitlements apply to my employees?

Under the General Retail Industry Award 2010 and the Fast Food Industry Award 2010 (‘the Awards’) any work performed on any of the days listed as public holidays above (whether it is the actual, substituted, additional day or part-day) are paid at the appropriate public holiday penalty rate. Please refer to the NRA produced wage summaries for the current rates.

The General Retail Industry Award 2010 also provides that employees may receive in lieu of the appropriate public holiday penalty either:

• An equivalent day or equivalent time off without loss of pay; or • An additional day or equivalent time as annual leave.

There is not a similar provision under the Fast Food Industry Award 2010 .

Under the National Employment Standards (‘the NES’), employees are entitled to be absent on a public holiday unless the employer has requested the employee to work and the request is reasonable. An employee can only refuse a reasonable request to work if the employee’s refusal is reasonable.

Factors that will be considered in determining whether a request or refusal is reasonable are:

• The nature of the workplace (including its operational requirements) and the nature of the work performed by the employee; • The employee’s personal circumstances, including family responsibilities; • Whether the employee could reasonably expect to be requested to work on the public holiday; • Penalty rates payable; • The type of employment – full time, part time or casual; • Amount of notice given of the request to work; • The amount of notice given by an employee in advance in regard to refusing a request to work.

Under the NES, if an employee is absent on a day or part-day that is a public holiday, the employer must pay the employee at the employee’s base rate of pay for their ordinary hours of work on that day or part day. This provision does not apply to casual employees or part time employees who are not ordinarily rostered to work. For example, a full time employee may ordinarily work 8 hours on a particular public holiday but because of the holiday have only been rostered to work 4 hours. In this situation, the employee would be paid at public holiday rates for 4 hours and receive payment for the other 4 hours they would have ordinarily worked at ordinary rates of pay.

Please note that if a public holiday falls on an employee’s non-working day, the employee is not entitled to any public holiday benefits under the Awards or the NES. This is a change to the public holiday entitlements under many of the old NAPSAs and pre-reform awards that often provided a day off in lieu or an extra day’s wages under these circumstances.

For those employees who employ their employees under a pre-reform certified agreement, AWA, ITEA, workplace agreement or enterprise agreement you will need to refer to the terms of these instruments to determine how these employees need to be paid.

AUSTRALIAN CAPITAL TERRITORY – TRADING HOURS

Trading hours are deregulated in the ACT and therefore there are no trading restrictions on these days.

Trading hours, in Northern Territory, are deregulated however, individual restrictions may apply to certain shopping centres as set by Centre Management. The trading hours for the sale of liquor products, however, are regulated.

Exempt Shops

Exempt shops are specified in the Trading (Allowable Hours) Act 1990 (QLD) (‘Act’). Exempt shops have no prescribed opening or closing times, meaning such stores can trade 24 hours a day, 7 days a week each year.

Independent Retail Shop FACT SHEET: TRADING HOURS Independent retail shops are defined by reference to the number of employees employed. The Act defines this Christmas and New Year 2014-2015 AS AT November 2014 type of shop as follows:

Any shop owned by an individual, partnership, or proprietary company which:

• has no more than 20 people (including the proprietor) on the shop floor at any one time (this does not include customers); AND • if there is more than one shop in Queensland, no more than 60 people are engaged by the owner of the business in that shop and any other shop or shops (this does not include customers).

Independent Retail Shops have very few prescribed opening and closing times. Those independent retail shops that predominately sell food and/or grocery items may trade without restrictions. Independent retail shops that do not sell food and/or groceries must be closed on the following days: o Christmas Day o Good Friday o Anzac Day before 1pm.

On all other days of the year these shops may trade without restriction.

Non-Exempt Shops

These shops are defined as a shop other than: • An Exempt Shop; • An Independent Retail Shop; • An office; or • A stall

Trading hours restrictions, in part or whole, do not apply to particular types of shops and to all shops located in specified areas of the State, where exemptions have been granted.

1. Exemptions for All Shops in Specified Areas of the State:

All shops located in particular government areas can trade on one or both of the restricted days (Christmas Day and Boxing Day). The arrangements vary from area to area. The table on the following pages lists the particular areas that are exempt and describes the nature of the exemption.

All shops located within the Sydney Trading Precinct can trade on Boxing Day. (Note that work on Boxing Day is optional for all employees).

2. Exemptions for Particular Types of Shops:

The following shops are designated as “Exempt Shops”:

• Bookshops, chemists, cake and pastry shops, restaurants, take-away food and drink shops, fruit and vegetable shops, nurseries, newsagencies, pet shops, recorded music, video or DVD shops, cafes, kiosk and souvenir shops; • Certain licensed premises; • Small shops as defined:

A small shop under the Act is identified as follows:

• If the number of people that own the shop does not exceed 2, or one corporation, and the owner or owners of the shop take the profits from the business. • The total number of employees engaged by a small shop must not exceed a total of 4 regular employees, whether working at the same time or different times.

The number of persons engaged in a small shop does not include: • The occupier or occupiers. If the occupier is a corporation, then 2 natural persons who are shareholders of the corporation; or • Any person engaged in an emergency during the absence from the shop for part of a day of a person who is engaged in the shop on that day; or • Any person engaged outside the normal working hours of any person engaged on a full-time basis.

If the owner of a shop is a corporation, or a Director of a corporation, and is engaged in another business, then it fails to comply with the definition of a small shop.

Applications to Trade on Restricted Days (including Boxing Day)

Application may be made to the Director General to exempt any shop from a requirement under the Act to remain closed. The process involves the completion of an Application for Retail Trading on Restricted Days form which requires supporting justification for the proposal. The application must be made at least 28 days prior to the restricted trading day occurring. Please contact NRA for assistance with this process. Additional Christmas Hours – Greater Adelaide Shopping District

Every year the SA Government gazettes extended trading hours for non-exempt shops in the greater Adelaide Shopping District. For 2014, it is anticipated that affected retailers will be able to trade extra hours on the following days:

Exempt Stores

Exempt stores are not obliged to close on any of the public holidays. These stores are defined as shops (except shops selling motor vehicles and boats) that meet the following criteria are exempt from all trading hours restrictions:

1. A shop—

(i) the floor area of which does not exceed 200 square metres; and

(ii) which does not adjoin, and is not adjacent to, a building, with a floor area exceeding one-half the floor area of the shop, that is used as a storeroom for the purposes of the shop;

2.

(a) Shops for the sale of antiques, live fish and aquariums, paintings and crafts, newspapers, books and stationery, pharmaceutical goods, flowers and plants, drinks, ice cream and confectionery, pets and accessories, garden supplies, food consumed on or off the premises, souvenirs, cigarettes, caravans and trailers.

(b)Shops selling foodstuffs, with a floor area not exceeding 400m2, and that does not adjoin a building used as a storeroom with a floor area greater than half that of the shop.

(c)Shops within a squash centre, ten pin bowling alley or golf club, and selling related sporting goods

Provided that for each of the shops listed in (a), (b) and (c) above, no less than 80% of goods sold during the immediately preceding period of seven trading days is made up of sales of the above goods.

3. Hairdressers shop.

4. Service stations, licensed under Section 17 and selling a range of goods common to service stations which could include goods generally stocked by convenience stores.

Regional Shopping Districts

Local government authorities in SA can request that the Minister deregulate trading hours in their particular district.

As a result, trading hours in almost all of South Australia’s regional centres have been deregulated and all shops can trade whichever hours they wish. Towns where shopping hours have been deregulated include:

Angaston, Port Pirie, Pt Augusta, Gawler, Quorn, Hawker, Murray Bridge, Berri, Mt Barker, Renmark, Waikerie, Jamestown, Loxton, Clare, Victor Harbour and Mt Gambier. A full list of deregulated shopping districts is available from the National Retail Association.

Exempt shops are businesses that:

• The Retail Trading Hours Act applies to retail shops in Western Australia, south of the 26 th parallel (Shark th Bay region). The trading hours of shops located north of the 26 parallel are not regulated and there are no restrictions on trading hours;

• Different trading hours apply to different classes or types of shops;

• From 26 August 2012, the special trading precincts of Armadale, Fremantle, Joondalup, Midland and Perth were abolished and replaced by the Perth Metropolitan Area (see map on following pages);

• Different trading hours arrangements may apply in particular local government areas subject to applications made to the Minister by individual local governments;

• Unless special arrangements apply in particular local government areas south of the 26 th parallel (excluding Perth), general retail shops are not permitted to open on Sundays and public holidays. Special trading hours have been set down by the WA Government for the 2014/2015 Christmas/ New Year period as outlined below.

The Retail Trading Hours Act provides for the following classes of shops:

Class of Shop Simple Explanation General retail shop Shops other than special retail shops or small retail shops – typically the larger retailers or national chains Special retail shop Special retail shops are considered necessary for emergency, convenience or recreation goods purposes. ‘Special Retail Shops’ include: • newsagencies and bookshops; • pharmacies; • garden nurseries; • hardware and home improvement shops; • video shops; • art and craft shops; • souvenir and duty free shops; • shops at sports venues; • boating shops; • motor vehicle spare parts shops; and • shops at international standard hotels.

Retailers wanting to trade as special retail shops must apply for a certificate from the Department of Commerce. Small retail shop A ‘ Small Retail Shop’ is a shop owned by up to six people who operate no more than three retail shops, in which up to 18 people work at any one time (persons employed as apprentices are not included in maximum permitted staffing numbers). Retailers wanting to trade as small retail shops must apply for a certificate from the Department of Commerce.
