PETITION FOR RULE MAKING

Desert Sky Media, LLC (“Desert Sky”), licensee of Station ‘M), Laughlin,

Ncvatla, by its counscl, and pursuant to Section 1.401 of the Commission’s Rules, hereby requests that the Commission amend the FM Table of Allotments to delete Channel 300C at

Laughlin, Nevada, allot Channel 30OC to Meadview, Arizona as that community’s first local service. and modify the license of KVGS to retlect operation on Channel 300C at Meadview. If this Petition is granted, Desert Sky will file an application for Channel 300C at Meadview and will construct thc authorized facilities if its application is granted. The following table summarizes the changes requested in this Petition:

A. Technical Analysis

I. As demonstrated in the Enginecring Statement, Channel 300C can be allotted to

Mcadview, Arizona at coordinates 35-50-1 I North Latitude, I 14-10-08 West Longitude consistent with Section 73.207 ofthe Commission’s Rules. See Exhibit E, Figure 1. A 70 dBu signal can be provided to Meadview from the proposed reference point. See Figure 2. The

relocation of KVGS to Meadview will result in a net gain in population of 508,331 persons

within the 60 dBu signal from the station. See Figure 3. No white or gray area will be created,

but a small portion of the loss area will receive fewer than five aural services. See Figure 4.

This is consistcnt with other reallotments granted hy the Commission. See Seappoo.~and

Tillamook. Oregon, I5 FCC Rcd I0899 (2000); Detroit Lakes and Barnesvillc. Minnesola, I6

FCC Rcd 22581 (2001); Earlc, Arknnsas. e/ a/., IO FCC Rcd 8270 (1995).

B. Change in Community of License

2. Desert Sky desires to change the community of license of Station KVCS from

Laughlin to Meadview under the guidelines set forth in Amendmcnl e/he Commission’s Rulcs

Regarding Modlfictrrion OfFM and TVAulhorizations Io Specilj, a Ncw Communitv OfLieensc, 4

FCC Rcd 3870 (1989), rceon grnnlcd in part, 5 FCC Rcd 7094 (1990) (“Communi@ of

Lic.cnsc”). Thcre, the Commission stated that a station may change its community of license

without subjecting the license to other expressions of interest if (1) the proposed allotment is

mutually exclusive with the current allotment; (2) the current community of license will not be

dcprivcd of its only local service; and (3) thc proposed arrangement of allotments is preferred

under the Commission’s allotment priorities. These criteria are met here. First, the proposed use

of Channel 3OOC at Meadview is mutually exclusive with the current use of Channel 300C at

Laughlin. See Figure I. Second, Laughlin will not be deprived of its only local service because

it will continue to be served by Station KLSQ(AM).’ Third, the provision of a first local servicc at Meadview (population 1,500) under Priority 3 will rcsult in il preferential arrangement of allotments ovcr the retention of a second local service at Laughlin (population 7,076) under

3. Meadview is not located in an Urbanized Area and the proposed 70 dBu contour of KVGS will cover less than 50% of any Urbanized Area, thus avoiding any concern with the relocation of stations from rural to urbanized areas. See Headland, Alabama and Chattahoochee,

Florida, 10 FCC Rcd 10352 (1 995).

4. The Town of Meadview is a rural community located in Mohave County at the natural end of the National Park as the River flows into Lake Mead.

Mcadview is the only community located within the Lake Mead National Recreation Area.

According to Suzann Newell. Secretary of the Meadview Area Chamber of Commerce, the population of Meadview is approximately 1,500. The U.S. Post Office associates ZIP Code

86444 with Meadview, and operates the Meadview Main Post Office. Meadview also has its own local volunteer tire department offering tire, rescue, EMS and other services to area rcsidents. Meadview is home to the Meadview Baptist Church and Meadview Community

Church. See Exhibit 1.

5. Meadview is home to a variety of businesses and commercial establishments.

Somc of these businesses identify with the community by using “Meadview” on their name, for cxample: Meadview Lake Realty, Meadview Lake Motel, Meadview Market, Meadview RV

Park and Meadview Sand & Gravel. Other local businesses includes the Canyon End Motel, Ace

Hardware. Action Builders Supplies, Crow’s Nest Restaurant, Ken’s Pizza Plus and ShqePest

Control. Among the civic associations located in Meadview are the Meadview Chamber Of

Commerce and a Veterans of Foreign Wars Post. Meadview events include an annual car show.

The Mohave County Library System has operated the Meadview Community Library since

3 1989. The library is open three days a week and has a collection of over 4,000 items, including audio cassettes, hooks, newspapers and video cassettes. Located in Meadview, Pearce Ferry

Airport serves the community and is owned by the National Park Service. See Exhibit 1.

6. If this Petition is granted, Desert Sky will file an application for Channel 300C at

Meadview and expeditiously construct the facilities.

11. CONCLUSION

Grant of this petition is in the public interest because Meadview, Arizona will receive its first local service with a net gain in population served of more than a half-million persons.

Desert Sky reiterates that if the Commission grants this petition, it will file an application and construct the authorized facilities. The Commission should promptly issue a Notice of Proposed

Rule Making as described herein.

Corn- Events Local Information April 5 is the date of the annual Car Show. This year's Crow's Nest Car Show is expected to be bigger and better than ever. The Meadview Chamber of Commerce is sponsoring a raffle with one or two Las Vegas or Laughlin casino packages, dinners, and a variety of prizes provided by Chamber members. The National Park Service and Blue Water Network reached an agreement to extend the date for banning personal watercraft (PWC) from the 1.ake Mead National Recreation Area. The extension allows unrestricted PWC use until ApriL20, 2003.

It will be possibly sooner than 2007 that the 2,000 foot steel and concrete bridge that Yellow Pages will be part of the Hoover Dam bypass will open.

On October 21,2002 the governors of Nevada and Arizona, along with members of Congress and federal officials met during a ceremony to start working on the Hoover Dam bypass. The $235 million dollar project starts with the relocation of two power lines and twelve electricity transmission towers presently blocking the path of the bridge.

From Kingman, Arizona go west on highway 93. On highway 93 turn north at mile post 42 on to Pierce Ferry Road and drive 40 miles to Meadview. About 65 miles from downtown Kingman.

Pierce Ferry Road is county highway 25 and is paved the entire length. Watch out for COWS on the road!

Meadview is located in north west Arizona at the point where the Grand Canyon ends and Lake Mead starts. At 3500 feet elevation Meadview enjoys summers a little cooler than

the low lying deserts and winters a little warmer than the mountain areas.

A little background information on Lake Mead, the Lake Mead Recreation Area and the Grapevine Mesa.

Lake Mead National Recreation Area:

Boating on Lake Mead is at its best at this end of the lake. Crystal clear water, fantastic scenery, miles of open water and clean beaches. Peace and solitude are yours for the asking - and the fishing is great.

Lake Mead National Recreation Area has over 3000 square miles of environmentally protected riparian scenery (according to the 1998 "Information Please" Almanac, Lake Mead is the largest National Recreational Area in the US with an acreage of almost 1% million acres).

Beginning at the east border are the Grand Wash cliffs which rise to 6000 feet. The cliffs are the gateway for the Colorado River as it leaves the Grand Canyon and becomes Lake Mead. The lake is 115 miles long, terminating at Hoover Dam - the tallest dam in the Western Hemisphere. The dam rises 726.4 feet from bedrock to the paved road across this mile long concrete marvel.

Lake Mead is America's largest man made lake covering 229 square miles with a storage capacity of 30 million- acre feet of water. The 500 miles of shoreline changes dramatically from one area to the next with steep cliffs, deep coves, sandy beaches and always a vast panorama of photographic opportunities. The eastern end of the lake is fabled for its fishing. Fish to be caught include striped bass which can reach monster sizes up to 60 pounds, large mouth bass, catfish and bluegill.

In the coves or on the cliffs that line the lake, you could see the majestic desert bighorn sheep. The rams are a

The wild burros, descendants of those left behind by discouraged prospectors, drink at the water's edge, as do cougars, bobcats and coyotes. Few nights pass without a serenade from a family of coyotes. Badgers, cottontails, and the wily black-eared jackrabbit, and even deer can be found within the park boundaries. Antelope are quite rare, but are seen occasionally.

Gambel's quail thrive in our area, sometimes numbering the hundreds as they search for seeds under the brush. In season, bird watchers can find over 250 species of birds ranging from 5 kinds of humming birds to the osprey, golden eagle, and even the bald eagle. There are 60 species of waterfowl including ducks, herons, brown pelicans, geese, coots, terns, and the small swan like billed grebe. Songbirds, owls, hawks, ravens and the turkey vulture are constant visitors to the area.

At Grapevine Springs you will find beds of the scarlet monkeyflower. The yellow wild columbine trails over the cliffs at Columbine Falls. Throughout the rest of the area you will find desert plants that survive our dry climate with only 6 inches of yearly moisture. This falls as rain during July and August, and again in February, but we have had snowfalls of 2 to 5 inches during the winter months on rare occasions.

TheGrapevine Mesa

On the Grapevine Mesa the chaparral includes creosote bush, rabbit bush, cat claw, Joshua, yucca and large cholla, plus many flowering cactus.

The extensive Joshua forest that you drive through from highway 93 to Meadview is the largest of its kind in the United States and boasts some magnificent specimens of this unusual tree. For more information on the peculiarities of the Joshua Trees click on: Joshua Trees

In the dry washes of the mesa you can spend many hours digging for gold - and you can find it! A 12-ounce nugget was found by a weekend gold seeker a couple of years ago and dozens of others have found smaller nuggets and flakes.

You can visit the awesome beauty of the Grand Canyon on the Hualapai Indian Reservation and marvel at the Colorado River, far below, still carving the canyon ever deeper even as you watch. The beauties of the Canyon can be combined with a nice trip in a Conestoga wagon or horseback riding.

A VERY3HORTHISTORY OF THE AREA

The Grapevine Wash has long been well traveled and is known as the Ute trail from the Colorado River south to Hopi and across into . In more recent history the Mormons used this trail to trek their trade wagons to the Hopi and Navajo villages.

In the 1820s Jedidiah Smith crossed the Virgin River, (Virgis as it was known then) and then across the Colorado to reach the California territory. In 1869 John Wesley Powell (1834-1902, geologist, explorer, and one-armed civil war veteran) led his band of explorers through the Grand Canyon past Pearce Ferry and South Cove and they ended their river trip where the Virgin enters the Colorado.

Boulder Dam was started in 1931 and finished in 1935. Over 90 men died during its construction. In 1953 the dam was renamed for Herbert Hoover who was president when it was originally conceived. Henry J. Kaiser, a

ship builder, was the contractor on the dam. The lake was named for Elwood Mead, commissioner for Reclamation in the early 1930s.

Hoover Dam traffic update % Startins April 15, 2002, Recreational Vehicles will be allowed to cross Hoover Dam if the vehicles and contents can be "easily inspected" (whatever that means!). If an officer at the Dam's checkpoints believes any vehicle is a threat, that vehicle will not be allowed to cross. % Boats cannot approach closer than one-half mile to the dam on the downstream (river) side and approximately one mile on the upstream (reservoir) side.

Pierce Ferry is closed for boat launching due to the low water. It is rumored that our water is being taken to fill reservoirs (Hemet?) in California to water golf courses?). Of course there are still miles an 6 miles of deep water in the lake and in the coves.

Jet Skis: The NPS has amended the regulations on "Personal Water Craft" from using Lake Mead and oing up the Grand Canyon. Contact www.nps.gov/lame Por more information. As of ri ht now PWCs can be used on Lake Mead until April IO, 2803. The rangers are not going to cite you for not Yellow Pages having an entrance sticker since there is not an entrance station in your area but you will get cited for not have (sic) a lake use sticker on your boat. Local Information Land for the Meadview development was purchased in 1960. Portions of that land were later determined to be inside the Lab Mead National Recreation Area and that land was exchanged inland parcels. Meadview now has around 800 homes with sor 1500 residents.

Meadview lies at elevations between 31 00 and 3500 feet, 10 n south of Lake Mead, between Kingman, AZ and Las Vegas, N\ The Ute Trail, used for centuries by Indians crossing the Color; River, is in Grapevine Wash located east of Meadview. The tra continued to the south of Grapevine Wash with one branch continuing to the west at Cottonwood and the east branch cros Hualapai land to reach the Hopi.

Harrison Pearce (or Pierce), in penance for his participation in Mountain Meadows Massacre in 1857, was sent by the LDS church in 1860 to run a ferry across the Colorado at the Ute Tr crossing.

Pearce Ferry is now a boat ramp and is the preferred landing fl raft trips through the Grand Canyon. The Hualapai Indian trips Business in always use PearCe Ferry. Other ferry crossings were set up - Bonelli, Scanlon, etc. but al were covered by the waters of Lake Mead when that lake was formed after the building of Boulder Dam (now known as Hoov Dam) in 1935.

Yellow Pages Hoover Dam is a concrete dam 726 feet above bedrock built in Boulder Canyon of the Black Mountains. The lake is 110 miles and influences the rush of the waters of the canyon 60 miles u( into the canyon - in fact rafters, unless using motorized boats, dislike the slow rafting down the last 60 miles of their 287 mile

and use speed boats to off-load passengers 60 miles above th lake.

South Cove boat ramp was built and paved in 1965/66 over a period of 15 months and at a cost of over 1 million dollars. At tt time it was the largest construction ever undertaken by the National Park Service. The road to South Cove is paved and ir recent years the boat ramp area has been greatly expanded ai improved. South Cove is 60 miles above Hoover Dam. South C and Temple Bar are the only Arizona boat ramps on Lake Mea above Hoover Dam.

East of Pearce Ferry, 750 feet above the water in Lower Granii Gorge, is Sloth Cave (also called Rampart Cave). Once home the Giant Sloth 40,000 years ago, the cave was used as a laboratory by the U of A, the National Science Foundation and Smithsonian Institute to study that animal. A fire in 1976 raged months and caused much damage to this study area. The NPS built a steel gate across the entrance to the cave to restrict put access.

Bat Cave is located approximately 75 miles above Hoover Dam, in the Grand Canyon. In the 1930s, bat cave was a source for hardy men to dig bat guano which was bagged and loaded into ferry barges and sold as fertilizer, especially for roses. In the 1950s a steel cable carried a gondola across the 7500 feet of the canyon, 2500 feet above the water, transporting the guano until the guano ran out and the mine closed. In 1963 a jet plane from Nellis AFB hit the cable cutting it in two. The plane made it back to Nellis even though the tail was damaged. In 1995 the NPS wanted to destroy the cable towers and remove the dangling cables, but efforts by local residents forced the cancellation of those plans.

Cultural History

Cultural History Overview Local Information Human history in this area extends back more than 10,000 years to man’s arrival in the Southwest. The first people that can be positively identified in this region were known as the Basketmakers. They were probably forerunners of the Pueblo Indians who were farmers and traders.

% 40,000+ years ago - Pleistocene fauna found in an old stream channel. Presence of Man not established. % 30,000-15,000 years ago - a shallow lake existed near Tule Springs. % 13,000-11,000 years ago - probable evidence of Man with extinct Pleistocene fauna. % 11,000 years ago - definite evidence of Man.

So, at present, we can say that Man might have been in the Lake Mead area more than 20,000 years ago, probably here about 13,000 years ago, and definitely here by 11,000 years ago.

The recorded history of the area began in 1826, when Jedediah Smith passed through on his first Southwest Expedition in search of beaver. Other early explorers were John C. Fremont, Lt. Edward Business in Beale, Lt. Joseph C. Ives, and Major John Wesley Powell. Meadview The explorers were followed by colonization and exploitation. Mormon farm settlements and roaring mining camps sprang up along the rivers and in the mountains. Lake Mead was named in honor of Dr. Elwood Mead. As Commissioner of Reclamation from 1924 - 1936, he drafted new specifications for a giant project that would dam the Colorado River, impound the world’s (at that time) largest Yellow Pages artificial lake and provide flood control, irrigation supply and power generation. That project was Boulder Dam. We know it by a Later name change as Hoover Dam.

In 1935, Hoover Dam was completed and Lake Mead formed, covering such historic Mormon sites as Callville, Rioville, and St.

Meadview Area History

The Meadview area includes the areas of South Cove, Pearce Ferry, and Grand Wash.

Meadview is a small community located on the southern boundary of the recreational area and about 10 miles from both Pearce Ferry and South Cove. It is almost an inholding, being surrounded on three sides by recreational area lands.

The community is of recent origin, having been started around 1960 as a retirement community .

Pearce Ferry was started in 1863 by Jacob Hamblin, bought by Pearce in 1876, and operated until 1891. This area became popular again during the Grand Canyon-Boulder Dam tours in the 1940's. A concession maintained a floating dock, supply depot, dining room, and had elaborated plans for improvement. The tour boats left Hemenway, stopped at Pearce Ferry, continued to Rampart Cave (discovered in 1916 by Willis Evans) and then on 12 miles into the Grand Canyon. The tour cost $101. With the filling of Lake Mead, a delta formed at Pearce Ferry. This silting in, followed by the lowering of the lake level after 1941, forced the concession to be abandoned. Scenic flights were also part of the tourist trade in the 1930s and 1940's with airplane landing on the strip at Pearce Ferry. Pearce Ferry is about 17 miles upstream from South Cove and serves as the primary terminus for river runners floating through the Grand Canyon. An undeveloped launching ramp allows boaters access to the lower gorge of the Grand Canyon. Primitive camping is allowed.

Mike Scanlon's Ferry, started in 1881, which was later bought by Tom Gregg, crossed the Colorado River at the area now known as Gregg's Hideout.

South Cove does not have a history pre-dating the establishment of the recreation area. After the recreation area was established, a new paved road was constructed as a spur road off the Pearce Ferry road, extending down to the lake where a paved launch ramp was constructed.

Echo Bay History

Salt mines now under Lake Mead waters in the Echo Bay area, as well as near former St. Thomas, were once mined by Indians. The miners, using stone tools, would chip a circular groove into the salt, forming a knob which they would break off and carry away for their use and for trading.

In 1864, Anson Call journeyed down the Virgin River to the Echo Bay area. He followed Echo Wash for a few miles, then turned back to the Colorado, where he picked the site of Callville for the Mormon Steamboat Dort.

In recent years, Moapa Valley ranchers have grazed their cattle in the Echo Wash, near the Bitter Springs, and in Bitter Springs Valley. h~p://www. meadview. i ti fo/More'X20History.htm 2/28/2003 MEADVIEW.INF0: Gencric Page Page 3 of 4

Echo Bay is near the old confluence of the Virgin and Colorado Rivers, where Powell ended his 1869 journey. Armijo, Smith, Odgen, and others followed the Virgin River to the Colorado River, passing close to Echo Bay.

Overton Beach History

The Basketmaker Indians lived at the Lost City, also called Pueblo Grande de Nevada, on the Muddy River near the Virgin, probably before 500 A.D. Over the years, the Indians built pit houses and, later, two and three story houses. The earlier tribes hunted and gathered their food, while later people farmed extensively. The last were occupants of a large Mesa House before they disappeared by 1150 A.D. Pueblo Grande de Nevada, or Lost City, is an unfortunate choice of names, since it applies to the whole complex of villages scattered along the VirginlMuddy Valleys. "Mesa House" is the term used for the last occupational period in the area - again the people were living in a number of villages during the Mesa House period ca A.D. 1100-1150. Surveys and excavations of Lost City began in 1924 under the Southwestern Museum, most of the work being done from 1935-1938. Many artifacts and reconstructed pueblo houses are now at the Lost City Museum in Overton. Lake Mead waters cover the original site.

In 1865, the Mormons established St. Thomas, at the junction of the Muddy and Virgin Rivers. The colonists farmed, raised cotton, and worked with the Paiutes. Tax probtems with the new State of Nevada developed in 1870. All but one family, Daniel Bonelli, returned to . Three families returned in 1880, followed by others. In 1912, there was enough business to have a railroad branch built to St. Thomas. The town became the halfway stopping point on the Old Arrowhead Trail, having a hotel, good meals, and a reliable garage. Re-routing U.S. 91 and ceasing operations of Grand Gulch copper mine in the 1930's hurt the town's economy. Life returned more to normal with the discovery of a silica sand deposit, beginning operation of a salt mine, and the discovery of the Lost City. But then the Hoover Dam project was started. Evacuation notices were posted on everything for five years. No one left until rising water was spotted in the Virgin Canyon. Many of the buildings were moved to towns on higher ground. On June 11, 1938, the waters had been in the town for five days. The postmaster cancelled thousands of "last day" envelopes before he Left for dry ground. Sometimes, when the lake gets low enough, buildings, dead trees, and rusted machinery can be seen.

Located three miles south of St. Thomas, on the west side of the Virgin, was the famous mountain of salt. This necessity, also found in many caves in the area, was probably the reason for the site of the Lost City. Over the years, it has grown to fantastic proportions - 3 miles long, all salt, and that as clear as glass. Its names include Big Salt Cliff, Salvation Salt, Salt Point, and Salt Mountain. Lake Mead waters now cover this huge salt deposit, as well as most of the caves. No wonder our water is a Little on the hard side!

In 1939, Overton Beach was one of the three National Park Service areas of the Boulder Dam National Recreation Area to have facilities.

Temple Bar History

Daniel Bonelli left St. Thomas after it was abandoned in 1871. He built his home at

Junction City, at the mouth of the Virgin River, and renamed it Rioville. Bonelli raised cattle and agricultural crops, and mined salt for sale to the miners from Temple Bar to El Dorado. Bonelli recognized another need, so Rioville also became known as Bonelli's Ferry. The ferry operated until 1920. Rioville had a store, post office, and a Pony Express station. Daniel Bonelli is credited with naming "The Mormon Temple'' at Temple Bar.

The Temple Bar Mining Company produced placer gold from 1894 to 1898. After having problems securing driftwood from the river, they shipped the needed timbers from Kingman. The miners picked up their mail at Rioville.

Many Indian artifacts are found in the Temple Bar area, such as a large pottery bowl discovered in 1974.

History : The Meadview Station I.ibrary was opened in 1989. the library serves a community of six bundrcd pcople. The library has a collection of over 4,000 items, including audio cassettes. books, magazines, newspapers, and video cassettes. and is open to the public 11 hours per week.
