EPA Staff Report EEZ000006 Chatham Rock Phosphate Limited Marine Consent Application August 2014 Executive Summary On 14 May 2014, Chatham Rock Phosphate Ltd (CRP) lodged an application with the Environmental Protection Authority (EPA) for a marine consent. Consent is being sought by CRP to mine phosphate nodules from the Chatham Rise, initially within CRP’s 820 km2 mining permit area for the first five years. In future, CRP’s proposed mining may occur within a wider area (5,207km2) for up to a further 30 years. The proposed mining activity, using a conventional drag-head to remove up to 0.5 m of the seabed, has the potential to adversely affect benthic communities, pelagic species, marine mammals, seabirds, human health, commercial fisheries and Māori/Moriori cultural interests. The EPA staff consider that the proposed mining activity would result in two primary environmental effects: the direct effects associated with the extraction of “living” and non-living natural material which will destroy the seabed down to a sediment depth of 0.5 m, and the discharge of mine tailings that would generate a suspended sediment plume, some of which would deposit on the seabed. The proposed marine consent area on the Chatham Rise provides habitat for a biologically diverse benthic community, including protected species, such as stony corals, other sensitive species including sponges, bryozoans and brachiopods and unique species such as giant isopods and bivalve molluscs. Many of these species perform important ecosystem services by providing habitat for a diverse and abundant range of other species. The proposed mining activity would result in the total destruction of these species and their habitats within the mined area, with the potential for minimal recovery (if any) of many of these species. -

Royal Society for the Protection of Birds, The Lodge, Sandy, Bedfordshire, UK. 2 Executive Summary As a result of international concern over the cause and level of seabird mortality in longline fisheries, the United Nations Food and Agricultural Organisation (FAO) Committee of Fisheries (COFI) developed an International Plan of Action-Seabirds. The IPOA-Seabirds stipulates that countries with longline fisheries (conducted by their own or foreign vessels) or a fleet that fishes elsewhere should carry out an assessment of these fisheries to determine if a bycatch problem exists and, if so, to determine its extent and nature. If a problem is identified, countries should adopt a National Plan of Action – Seabirds for reducing the incidental catch of seabirds in their fisheries. South Georgia and the South Sandwich Islands (SGSSI) are a United Kingdom Overseas Territory and the combined area covered by the Territorial Sea and Maritime Zone of South Georgia is referred to as the South Georgia Maritime Zone (SGMZ) and fisheries within the SGMZ are managed by the Government of South Georgia and South Sandwich Islands (GSGSSI) within the framework of the Convention on the Conservation of Antarctic Marine Living (CCAMLR). -

AUSTRALIAN 114 BIRD WATCHER AUSTRALIAN BIRD WATCHER 1989, 13, 114-117 A Bulwer's Petrel Bulweria bulwerii in Victoria by MIKE CARTER1 and TIM REID2 130 Canadian Bay Road, Mt Eliza, Victoria 3930 2Flat 2/61 Fawkner Street, St Kilda, Victoria 3182 Summary A Victorian record of Bulwer's Petrel Bulweria bulwerii is documented and discussed in relation to previous reports in the Australian region and vagrancy in the Atlantic. The observation A Bulwer's Petrel Bulweria bulwerii was seen at sea near Portland in south-western Victoria on 14 September 1986. It was flying among massed feeding seabirds at 38 ~l'S, 141 "34 'E, five nautical miles south-south-east of Cape Nelson. The sounder aboard the 12.8 m long fishing vessel engaged on an RAOU Seabird Group excursion indicated the depth of the ocean floor to be 75 m. Thus we were above the continental shelf in inshore waters. The bird was under observation for only a few minutes just before 0830 h E.S.T., but was well seen and scrutinised for diagnostic characters when it was realised that it was either one of the all-dark 'sooty' storm-petrels Oceanodroma spp. or a Bulwer's Petrel. The closest it approached the boat was about 50 m. The light was dull because of the heavily overcast skies but as the bird passed to the south and west of our position, the sun was behind us so viewing conditions were advantageous. Although the bird hugged the surface of the sea, it was only occasionally lost from view behind waves until it changed direction, headed away from the boat and disappeared. -

Olson Received 10 February 1999 The Kerguelen Petrel {Pterodroma brevirostris auct.) is an inhabitant of stormy southern seas, breeding at the islands of Kerguelen, Crozet, Marion, Tristan da Cunha, and Gough. Like the bird itself, its specific and generic nomenclature has been through some rough weather. The Kerguelen Petrel was long placed among the gadfly petrels of the genus Pterodroma (formerly Aestrelata or Oestrelata). Imber (1985) used characters of the upper intestine, supplemented with data from Mallophaga and behavioural traits, to show that the Kerguelen Petrel was not closely related to Pterodroma. He resurrected Mathews' (1942) name Lugensa for it and placed it among the fulmarine petrels, a treatment that has had influential followers (e.g. Sibley & Monroe 1990). Imber's observations were preceded by those of Harper (1973) who noted major differences between skulls of the Kerguelen Petrel and Pterodroma mollis, which, along with P. inexpectata and P. ultima, had been thought to be a close ally (Jouanin & Mougin, 1979). My own examination of skeletons of the Kerguelen Petrel showed this species to be very different from all available taxa of Pterodroma, and more similar to fulmarines in certain characters, such as in the configuration of the distal end of the humerus. On the basis of mitochondria! DNA sequences, Nunn (1994) reported the Kerguelen Petrel to be a fulmarine and not part of the genus Pterodroma. He referred it to the genus Lugensa. In a subsequent phytogeny based on the same kinds of data (Nunn & Stanley 1998), Lugensa was still separated from Pterodroma but was placed nearer the shearwaters (Puffinus and Calonectris). -

The list uses the New Zealand Threat Classification System, which provides greater resolution of naturally uncommon taxa typical of insular environments than the IUCN threat ranking system. New Zealand taxa are here ranked at subspecies level, and in some cases population level, when populations are judged to be potentially taxonomically distinct on the basis of genetic data or morphological observations. -

First documented at-sea records of “intermediate morph” Soft-plumaged Petrel Pterodroma mollis and clarification of polymorphism in the species. Marine Ornithology 43: 161–164. The Soft-plumaged Petrel is a gadfly petrel that occurs widely across the southern oceans and exhibits plumage polymorphism. Pale- bellied individuals make up the vast majority of the species, while dark individuals are relatively rare. Intermediate forms are rarer still and, according to some authors, known only from museum specimens. We describe a number of at-sea records of intermediate-plumaged individuals seen off southwest Western Australia, including a previously undocumented streaked variant. Our observations indicate that plumage polymorphism within the species covers a continuous spectrum of variation between typical pale and wholly dark individuals. Abstract The research field of genetics provides useful tools to investigate the biology of species that are difficult to observe and study and are especially valuable in guiding the conservation of endangered species. The Chatham Island Täiko (Tchäik, Pterodroma magentae) is the world’s most endangered seabird with an estimated population size of just 120-150 birds, including only 8-15 breeding pairs. This thesis used genetic techniques to investigate aspects of Täiko biology and relationships in order to aid Täiko conservation. The mitochondrial cytochrome b gene and duplicated regions of domain I of the mitochondrial control region were DNA sequenced in almost the entire known Täiko population. -

THE SUBANTARCTIC ISLANDS OF NEW ZEALAND & AUSTRALIA 31 OCTOBER – 18 NOVEMBER 2011 TOUR REPORT LEADER: HANNU JÄNNES. This cruise, which visits the Snares, the Auckland Islands, Macquarie Island, Campbell Island, the Antipodes Islands, the Bounty Islands and the Chatham Islands, provides what must surely be one of the most outstanding seabird experiences possible anywhere on our planet. Anyone interested in seabirds and penguins must do this tour once in their lifetime! During our 18 day voyage we visited a succession of tiny specks of land in the vast Southern Ocean that provided an extraordinary array of penguins, albatrosses, petrels, storm-petrels and shags, as well as some of the world’s rarest landbirds. Throughout our voyage, there was a wonderful feeling of wilderness, so rare these days on our overcrowded planet. Most of the islands that we visited were uninhabited and we hardly saw another ship in all the time we were at sea. On the 2011 tour we recorded 125 bird species, of which 42 were tubenoses including no less than 14 forms of albatrosses, 24 species of shearwaters, petrels and prions, and four species of storm- petrels! On land, we were treated to magical encounters with a variety of breeding penguins (in total a whopping nine species) and albatrosses, plus a selection of the rarest land birds in the World. Trip highlights included close encounters with the Royal, King and Gentoo Penguins on Macquarie Island, face-to-face contact with Southern Royal Albatrosses on Campbell Island, huge numbers of Salvin’s and Chatham Albatrosses
