    In the Shadow of Revolution: A Decade of Authoritarian Hardening in Azerbaijan* Cory Welt George Washington University [email protected] July 2014 WORKING PAPER * For citation as a working paper. 1 Over the last ten years, Azerbaijan’s ranking on the “democracy index” of the U.S.-based nongovernmental organization Freedom House has reflected the country’s slide from a “semi- consolidated” authoritarian regime to a “consolidated” authoritarian one.1 This change in regime type has not come suddenly. It has been the result of a gradual hardening of authoritarian governance since 2003, the year Ilham Aliyev became president. It might be difficult at first to grasp the significance of this shift in classification. Azerbaijan was hardly democratic under President Aliyev’s father, Heydar Aliyev, from 1993 to 2003. During the senior Aliyev’s rule, however, the regime allowed at least some freedom to civil society and media. Since then, the regime has become increasingly authoritarian across all indicators, but the collapse of space for nongovernmental forces to engage freely in the public sphere has been especially pronounced. Azerbaijan’s slide into consolidated authoritarianism has coincided with a decade of regime change from below in Azerbaijan’s two neighborhoods of post-Soviet Eurasia and the Middle East. From the color revolutions of 2003-2005 to the Arab Spring of 2010-2011 and Ukraine’s EuroMaidan of 2013-2014, the Azerbaijani government repeatedly has witnessed the fall of less consolidated authoritarian governments all around it. Violence against 2013 SCORES journalists has not abated, and the media are harassed with impunity. PRESS STATUS Although the 2000 Law on Mass Media guarantees freedom of speech and access to information, these rights are not protected in practice. The government’s 2011 National Program for Action to Raise Effectiveness of the Not Free Protection of Human Rights and Freedoms in the Republic of Azerbaijan called for the decriminalization of libel in 2012. Hoping to influence the process, several nongovernmental organizations (NGOs) prepared draft laws, and PRESS FREEDOM SCORE the government opened a public discussion on the topic in October. However, no legal changes were enacted during the year, leaving defamation as a criminal offense punishable by up to three years in prison and hefty fines. 82 The number of defamation suits—and the amount of compensation demanded—significantly increased in 2012; the nonprofit Media Rights Institute (MRI) registered at least 35 cases during the year. In June, the independent LEGAL ENVIRONMENT newspaper Azdaliq was ordered to pay $38,000 for allegedly defaming the head of Baku’s rapid transit system, Tagi Ahmadov, who had originally sought $255,000 in damages. In July, the opposition newspaper Yeni Musavat 27 was ordered to pay $64,000 in damages for allegedly insulting a cannery company, Gilan Gabala.

EXECUTIVE SUMMARY Election Monitoring and Democracy Studies Center (EMDS) and Volunteers International Cooperation Public Union (VIC) conducted long-term observation of the first stage of the 9 October 2013 Presidential Elections (10 August-14 September) of the Republic of Azerbaijan. The monitoring of this stage, which included the pre-election environment and process of nomination and registration of candidates, was carried out in 89 election constituencies and nationwide. Information reflected in this report is collected from 32 long-term observers, presidential candidates and their campaign headquarters, members of election commissions and voters and verified by both organizations. Despite some technical improvements in the process of preparation to the elections, observers noted abuse of administrative resources and lack of improvement with regard to pre-election environment. EMDS and VIC note with concern that legal framework stipulated by the current Election Code and situation of political freedoms prior to the elections, particularly freedom of expression, peaceful assembly and association, create more restricted pre-election environment in comparison with previous elections. The process of nomination and registration of candidates started on 10 August and completed on 9 September. According to the CEC’s information for 13 September, 21 persons received signature collection forms and 14 of them submitted forms. 10 candidates submitting signature collection forms were registered as presidential candidate by the CEC, while 4 persons were refused registration. During the process of signature collection in favor of presidential candidates, violations occurred in previous elections were recorded again.
