The case originated in an application (no. 65480/10) against the Federal Republic of Germany lodged with the Court under Article 34 of the Convention for the Protection of Human Rights and Fundamental Freedoms (“the Convention”) by the political party “Partei Die Friesen” (“the applicant party”), on 1 November 2010. 2. The applicant party was represented by Mr Wilhelm Bosse, a lawyer practising in Osnabrück. The German Government (“the Government”) were represented by their Agent, Mr H. J. Behrens, of the Federal Ministry of Justice. 3. The applicant party alleged, in particular, that it was discriminated against by the 5% threshold applied at the parliamentary elections in the Land of Lower Saxony. 4. On 15 May 2013 the application was communicated to the Government. THE FACTS I. THE CIRCUMSTANCES OF THE CASE 5. The applicant party was founded in 2007 and is based in Aurich. It claims to represent the interests of the Frisian minority in Germany but limits its political activities to the Land of Lower Saxony (Niedersachsen) where the East Frisians traditionally settle. -

The members of national minorities are German na- tionals and therefore part of the German legal order. They enjoy all rights and freedoms granted under the Basic Law without any restrictions. Post-Vernacular Language Use in a Low German Linguistic Community
Journal of Germanic Linguistics 21.2 (2009):131–147 doi:10.1017/S1470542709000221 Post-Vernacular Language Use in a Low German Linguistic Community Gertrud Reershemius Aston University In a time of rapid shift and loss of smaller, regional and minority languages it becomes apparent that many of them continue to play a role as post-vernacular varieties. As Shandler (2006) points out for Yiddish in the United States, some languages serve the purpose of identity building within a community even after they have ceased to be used as a vernacular for daily communication. This occurs according to Shandler through a number of cultural practices, such as amateur theatre, music and folklore, translation, attempts to learn the language in evening classes, etc. This paper demonstrates that the paradigm developed by Shandler for Yiddish can be applied to other linguistic communities, by comparing the post-vernacular use of Yiddish with Low German in Northern Germany. It focused on the linguistic strategies that individuals or groups of speakers apply in order to participate in a post-vernacular language community. 1. Introduction Language(s) may be the most important factor in the construction of social identity for an individual and for a community (Joseph 2004). The most striking example is probably the rise of the modern nation state in close connection with the development of overarching, dominant standard languages. But lesser used languages, too, have the potential to contribute to an individual’s or a community’s sense of identity, either positively as an emblem, or negatively as a stigma (Bourdieu 1992:220– 229). -

Strasbourg, 4 December 2002 ECRML (2002) 1 European Charter for Regional or Minority Languages APPLICATION OF THE CHARTER IN GERMANY A. Report of the Committee of Experts on the Charter B. Recommendation of the Committee of Ministers of the Council of Europe on the application of the Charter by Germany The European Charter for Regional or Minority Languages provides for a control mechanism to evaluate how the Charter is applied in a State Party with a view to, where necessary, making Recommendations for improvements in its legislation, policy and practices. For this purpose a Committee of Experts is established in accordance with Article 17 of the Charter. Its principal task is to report to the Committee of Ministers on its evaluation of compliance by a Party with its undertakings, to examine the real situation of the regional or minority languages in the State and, where appropriate, to encourage the Party to gradually reach a higher level of commitment. The Committee of Ministers considers and adopts any recommendation it deems necessary in relation to a given Party, based on suggestions for recommendations from the Committee of Experts. To facilitate this task, the Committee of Ministers adopted, in accordance with Article 15.1, an outline for the initial periodical report that a Party is required to submit to the Secretary General. The report shall be made public by the State in accordance with Article 15.2. The outline requires the State to give an account of the concrete application of the Charter, the general policy for the languages protected under its Part II and in more precise terms all measures that have been taken in application of the provisions chosen for each language protected under Part III of the Charter. -

ADVISORY COMMITTEE ON THE FRAMEWORK CONVENTION FOR THE PROTECTION OF NATIONAL MINORITIES Strasbourg, 19 March 2015 ACFC/OP/IV(2015)003 Fourth Opinion on Germany adopted on 19 March 2015 EXECUTIVE SUMMARY The institutional framework of protection of minority rights in Germany has been strengthened in recent years. The authorities at federal and Land level continue to provide substantial support to the preservation and development of minority languages and cultures. Steps have been taken to increase support provided to Danish minority schools as well as to teaching in and of Sorbian and Frisian in the traditional settlement areas of these national minorities. The Federal Anti- Discrimination Agency has made considerable efforts to raise awareness of the anti- discrimination legislation in place. While the adoption of a package of measures to promote the integration and participation of Sinti and Roma in Germany is welcome, more emphasis is needed on achieving full and effective equality in practice and on evaluating the implementation of this package. There have been worrying developments as regards public manifestations of racism and xenophobia. Despite counter-demonstrations as well as statements of condemnation by the authorities, manifestations of antisemitism, anti-Gypsyism, and anti-Muslim and anti-immigrant sentiments are reported to be rising, as well as attacks against asylum-seekers. Outside the traditional settlement areas of national minorities, the general public’s awareness of minority cultures and languages remains low. Access to media in minority languages and the use of minority languages in contacts with local administrative authorities remain problematic, and further efforts are needed to ensure that the offer of teaching in and of minority languages, especially Sorbian and Frisian, is adequate and sustainable. -
