Daipan* Department of Forest Biological Sciences College of Forestry, Benguet State University La Trinidad, Benguet 2601 Philippines Forest cover disturbances continue to occur at a very alarming rate, which greatly contributes to the loss of biodiversity resources. Therefore, an approach to detect and measure historical deforestation would be of utmost importance – particularly in the near real-time forest monitoring and management, biodiversity conservation, and estimation of carbon emissions. This study introduced a simple approach using synthetic aperture radar (SAR) time-series data, primarily the C-band Sentinel-1A (S1A) VH-polarization with a 10-m resolution, in detecting forest cover disturbances from 2016–2019 in Mount Pulag National Park (MPNP), a protected area (PA) within the island of Luzon and a priority biodiversity conservation area. The process involved using codes in Google Earth Engine (GEE) to produce a forest cover disturbance map; a grid-based geospatial and statistical analysis using the geographic information system; and data validation, and determination of possible causes of disturbances using Google Earth Pro (GEP). The results derived from Sentinel-1 data were also compared to existing optical data, which is a Landsat-based generated disturbance map. The output of this paper revealed that a total of 577 forest disturbances, with an equivalent area of 154.58 ha, were detected from a three-year period. For Landsat-generated data, 402 disturbances were detected with an area of 176.07 ha. However, based on the accuracy assessment using positive predictive value (PPV), the radar data produced higher accuracy (80%) compared to the optical data (73%). The visual observation and interpretation of satellite imageries made it clear that the primary drivers of forest cover disturbances in Mount Pulag are agricultural expansion (48%), forest clearings (26%), landslides (12%), slash-and-burn or “kaingin” (12%), and forest fires (2%).     CONTESTED DOMAINS: THE INDIGENOUS PEOPLES RIGHTS ACT (IPRA) AND LEGAL PLURALISM IN THE NORTHERN PHILIPPINES1 June Prill-Brett Introduction The increasing international concerns for sustainable use of natural resources has led to a reappraisal of local peoples’ environmental knowledge and resource management skills. In the Philippines the alarming rate of forest degradation and unsustainable resource management under the centralist state control has largely influenced the granting of state recognition, and implementation of the Indigenous Peoples Rights Act (IPRA, otherwise known as Republic Act No. 8371 of 1997), governing ancestral lands and ancestral domains. The state recognition of indigenous people’s rights to their ancestral lands and domains has been increasingly linked to a policy of ecological conservation and the protection of biodiversity (see F. and K. von Benda-Beckmann 1999; Prill-Brett 2000). In comparison with neighboring countries the Philippines is relatively advanced in recognizing the rights of indigenous peoples (IPs) to their ancestral lands and domains (Aquino 2004: 116). A rapid and continued conversion of forest into agricultural land is observed, particularly for vegetable farming. Traditionally, most of the village total land area was under communal land ownership, but now almost half is under de facto private ownership. This transition in land (including forest) ownership is generally attributed to increased demand for land which is further attributed to changes in peoples’ values towards wealth accumulation rather than redistribution, greater integration to the market economy and a shift towards commercial agriculture. Past forest policies have been ineffective in regulating the landuse largely because they have not reflected local reality, and this appears to be true with the present national forest management strategy of community-based forest management. It is argued that the granting of land titles will improve forest conservation because it will improve the enforcement of forest laws and related contractual agreements. Based on the reality of private land ownership, it is further argued that forest policy in IP land should include private (individual, family or household) forest management.

What are the impacts of development policies on the Indigenous Peoples (IPs) who have retained their pre-colonial common property regime management practices? How are the Indigenous Peoples responding to the changes in development policies that affect traditional land tenure and resource management? What aspects of common property regime is changing, and under what conditions or pressures? What are some lessons learned in understanding the context where common property regime loses its reason for existence in Philippine upland agricultural communities? The paper begins by giving a brief historical background of pre-conquest property regimes and the development of resource management practices associated with each property regime. It goes on to show the changes in the indigenous property system in lowland Philippines under the Spanish colonial period. Under American colonial administration more laws were introduced which required the registration and titling of land and the state management of other natural resources such as forests and minerals. After independence the colonial laws on resource management were adopted by the Philippine Republic such as the Regalian Doctrine, which was used to usurp the common lands of indigenous communities rendering them squatters on “public lands.” The indigenous communities common property became open access leading to unsustainable management with the breakdown of rules for managing natural resources.

    THE PHILIPPINE INDIGENOUS PEOPLES’ STRUGGLE FOR LAND AND LIFE: CHALLENGING LEGAL TEXTS Jose Mencio Molintas I. INTRODUCTION Numerous issues and concerns of indigenous peoples have witnessed significant breakthroughs both locally and internationally in recent decades. Various means of struggle both within and without the formal legal system have been employed. Defending ancestral lands and their resources remains the major issue. Implicit in this battle to protect land and resources is the struggle to preserve indigenous culture and traditions that are so often inextricably linked to the land itself. It is against this background that this article documents and reviews customary practices and land concepts in the Philippines and examines the interface between state laws and custom laws on land within the context of the conflicts over indigenous peoples’ lands. The article employs case studies to discuss the application of state laws to indigenous peoples’ communities and the interaction of the formal legal system the state laws represent with the customs and traditions the indigenous peoples have historically relied upon to dictate the rules regulating the use and alienability of land. Particular attention will be devoted to the Cordillera experience in order to illustrate how community-level efforts to defend indigenous territories can operate either as a mechanism for reform within the state’s existing formal legal framework or as a means of challenging current legal texts and principles at their foundation. This approach is very much in line with the country’s efforts at “reforming the judiciary” as expressed in the Philippine Judiciary’s “Blueprint of Action,” where it called for a “review of existing laws.”1 II.
