V., Sandwiesenstraße 35, 64665 Alsbach-Hähnlein, ver- treten durch den Vorstand, dieser vertreten durch Matthias Müller, – Antragsteller – w e g e n Zulassung zur bundesweiten Veranstaltung des Fernsehspartenprogramms „HOPE Channel deutsch“ hat die Kommission zur Ermittlung der Konzentration im Medienbereich (KEK) auf Vorlage der Hessischen Landesanstalt für privaten Rundfunk und neue Medien (LPR Hessen) vom 18.11.2008 in der Sitzung am 13.01.2009 unter Mitwirkung ihrer Mitglieder Prof. Dr. Sjurts (Vorsitzende), Albert, Dr. Bauer, Prof. Dr. Dörr, Prof. Dr. Gounalakis, Dr. Hornauer, Lang- heinrich, Dr. Lübbert, Prof. Dr. Mailänder, Prof. Dr. Schneider, Dr. Schwarz und Prof. Thae- nert entschieden: Der von dem Stimme der Hoffnung e. V. mit Schreiben vom 26.08.2008 bei der Hessischen Landesanstalt für privaten Rundfunk und neue Medien (LPR Hessen) beantragten Zulassung zur Veranstaltung des bundesweit verbreiteten Fernseh- spartenprogramms HOPE Channel deutsch stehen Gründe der Sicherung der Meinungsvielfalt im Fernsehen nicht entgegen. 2 Begründung I Sachverhalt 1 Zulassungsantrag Der Stimme der Hoffnung e. V. hat mit Schreiben vom 26.08.2008 bei der LPR Hessen die Zulassung für eine bundesweite Ausstrahlung des Spartenprogramms HOPE Channel deutsch für die Dauer von zehn Jahren beantragt. Die LPR Hessen hat der KEK den Antrag mit Schreiben vom 18.11.2008 zur medienkonzentrations- rechtlichen Prüfung vorgelegt. 2 Programmstruktur und -verbreitung 2.1 Das Programm HOPE Channel deutsch ist als 24-stündiges Spartenprogramm im Bereich „Religion“ geplant, wobei die Schwerpunkte des Programms auf Informati- on, Lebenshilfe, Kultur und Musik liegen sollen. Ziel soll sein, christliche Werte und Glaubensvorstellungen zu vermitteln. 2.2 Die Verbreitung des Programms ist digital über Satellit (Astra) und über das Internet (Live-Stream) geplant. 3 Antragsteller 3.1 Der Antragsteller verfolgt nach dessen Satzung, vorgelegt in der Fassung vom 03.12.2007, „ausschließlich und unmittelbar gemeinnützige und kirchliche Zwecke. Er dient insbesondere der Nutzung der Massenkommunikationsmittel für die Verbreitung der biblischen Wahrheit“ (§ 2 Abs. 1 der Satzung). Der Satzungszweck soll dabei u. a. verwirklicht werden durch die Verkündigung des Evangeliums durch Massenkommunikationsmittel wie z. B. Radio, Fernsehen, Internet sowie die Her- stellung von Bild- und Tonträgern (§ 2 Abs. 2 lit. a, b). XXX … Der Antragsteller hat daneben eine aktuelle Mitgliederliste vorgelegt. Da- nach setzen sich die Vereinsmitglieder aus insgesamt 17 Landes- und Gebietsver- bänden der Freikirche der Siebenten-Tags-Adventisten zusammen, die wiederum durch insgesamt zehn Vertreter repräsentiert werden. Drei dieser Vertreter sind gleichzeitig Vorstandsmitglieder. 3 3.3.1 Der Verein Stimme der Hoffnung e. V. wurde als gemeinnütziger Verein 1972 ge- gründet. Der Verein ist eine Institution der Freikirche der Siebenten-Tags-Adven- tisten. Der Ursprung der Vereinstätigkeit geht auf das Jahr 1948 zurück, als mit der Veranstaltung von Radiosendungen begonnen wurde. Der Antragsteller unterhält heute das „Medienzentrum Stimme der Hoffnung“ in Darmstadt, zu dem eine Blin- denhörbücherei, das „Internationale Bibelstudien-Institut“ sowie Studios für Video- und Tonproduktionen gehören. Der Antragsteller betreibt den Radiosender „HOPE Channel“ auf Grundlage einer Lizenz der LPR Hessen vom 25.03.2008. In den vergangen Jahren hat der An- tragsteller zudem Inhalte für die Programme HOPE Channel Europe (ca. 10 Std./Woche), Bibel TV und rheinmain.tv (1 Std./Woche) zugeliefert. Auf der Inter- netseite hopechannel.de bzw. hopechannel.eu stellt der Antragsteller zudem in ei- ner Medienbibliothek ausgewählte Inhalte zum Abruf („on demand“) bereit. 3.3.2 Unter der Dachmarke „HOPE Channel“ werden von dem „Adventist Television Net- work“ am Sitz der „Weltkirchenleitung“ der Adventisten in Silver Spring, Maryland, USA, weltweit insgesamt sieben Programme veranstaltet (HOPE Channel auf eng- lisch, auf spanisch Esperanza TV für Nord- und Zentral-Amerika sowie Nuevo Tiempo für Süd-Amerika, Novo Tempo auf portugiesisch, SperantaTV auf rumä- nisch sowie HOPE Channel Europe und HOPE Channel International). Die Verbrei- tung erfolgt über Satellit (Hotbird) sowie als Live-Stream über das Internet (www.hopetv.org). HOPE Channel Europe erreicht nach eigenen Angaben 110 Mio. Haushalte in Europa, Nordafrika, dem Mittleren Osten und dem Westen Russlands. II Verfahren Die Vollständigkeitserklärung des Antragstellers liegt vor. Der LPR Hessen wurde Gelegenheit zur Stellungnahme gegeben. 4 III Medienkonzentrationsrechtliche Beurteilung 1 Bestätigungsvorbehalt der KEK Nach § 20 Abs. 1 Satz 1 RStV bedürfen private Rundfunkveranstalter einer Zulas- sung. Fragestellungen der Sicherung der Meinungsvielfalt werden von der KEK nach Vorlage durch die zuständige Landesmedienanstalt gemäß § 37 Abs. 1 Satz 1 RStV beurteilt. 2 Zurechnung von Programmen Dem Antragsteller ist das von ihm veranstaltete Programm HOPE Channel deutsch gemäß § 28 Abs. 1 Satz 1, 1. Alt. RStV zuzurechnen. 3 Vorherrschende Meinungsmacht HOPE Channel deutsch verfügt mangels Ausstrahlung noch über keine Zuschauer- anteile. Nach dem dargelegten Sachverhalt gibt es keine Anhaltspunkte für die Ent- stehung vorherrschender Meinungsmacht. Der beantragten Zulassung des Pro- gramms HOPE Channel deutsch stehen Gründe der Sicherung der Meinungsvielfalt daher nicht entgegen. (gez.) Alagoas Mission ALEXANDRE ACIOLE SALUSTIANO Alexandre Aciole Salustiano Alagoas Mission (ALAG) is an administrative unit of the Seventh-day Adventist Church (SDA), located in the territory of the Northeast Brazil Union Mission (NEBUM). Its headquarters is at Avenida Presidente Roosevelt, no. 167, zip code 57040-600, district of Serraria, in the city of Maceió, state of Alagoas, Brazil. The state of Alagoas is located in the northeast region of Brazil and borders the states of Pernambuco to the north and northwest, Sergipe to the south, Bahia to the southwest, and the Atlantic Ocean to the east.1 The landform of this state consists of the coastal plain to the east, plateau to the north, depression in the midwest, and higher portions in the far west.2 The climate is tropical, humid on the coast and semi-arid in the center and west.3 The vegetation is composed of coastal mangroves, rainforest, and caatinga in the semi-arid region.4 The name of the state was chosen due to the hydrography of the region, which has 19 lakes. The largest ones are the Lakes Mundaú and Manguaba.5 The main river is Sao Francisco, which is also one of the major Brazilian rivers.6 Alagoas also has beautiful blue-pool beaches and warm waters. In The West Central Africa Division, Our Division, we have witnessed this sharp growth to the point of reaching 10 unions in this division! Amen! The church is growing! As we approach the end of year, the project of developing a media center is taking shape because the equipments are available now. Soon we shall be producing outreach programs and also broadcast news whereby sharing news about the wonderful bles- sings of our Father, in our Division, with the entire world. Next year, TV channel “Africa Hope Channel” will be avai- lable! An exclusive channel for Africa! With speakers, programs made in Africa for Africa! Now we can produce programs and be present on our Adventist Hope Channel in Africa! Another blessing is the Congress of Religious Freedom held in Yaounde Camerron. A success! We expected to have 500 participants, but on the first day, we had one thousand five hundred people, and on the last day, 5000 people! Other areas experienced blessings too: Maranatha projects for education, ADRA, AYS, Health, Literature evangelism, Women ministries, etc. God has poured out blessings thus giving the assu- rance of God’s guidance over His church!
