Founders Grotesk and Pitch by Klim Type Foundry, Printed and bound in India, 2019 2018 FOREWORD This is the third edition of The Death Penalty in India: Annual Statistics published by Project 39A at National Law University, Delhi and is a continuation of our efforts to compile comprehensive data on the use of the death penalty in India. Since the first edition in 2017, we have constantly broadened our search strategies and improved upon our data collection systems to accurately track death sentence cases across the country. Despite these efforts, we face significant difficulties because of the poor data collection and maintenance by state institutions. The 162 death sentences imposed by trial courts in 2018 is the highest in a calendar year since 2000. We filed 91 applications under the Right to Information Act, 2005 (RTIs) covering all prison and home departments, and office of the Governors across states to collect information on prisoners sentenced to death. We also regularly mined the High Court and Supreme Court websites to track movement in death sentence cases. Since most Sessions Courts either do not have websites or do not regularly update them, local newspaper reports proved to be the most reliable source of information for tracking death sentences by trial courts in 2018.

He was transferred to the Patna High Court on 08.02.2016 and took over the charge of Acting Chief Justice of Patna High Court on 29.10.2016. He has been reportedly proposed by the Supreme Court collegium to become the Chief Justice of the High Court of Madhya Pradesh. It is submitted that there are serious allegations against Justice Hemant Gupta of amassing huge wealth disproportionate to the known source of income and also of influencing the ongoing investigations against his wife for the charges of money laundering, acquiring properties illegally by creating forged/ sham agreement to sale, evading stamp duty, filing collusive suits for specific performance, transacting through shell companies for layering and structuring the transactions etc.

    SUPREME COURT OF INDIA Re: Filling up vacancies of Judges in the Supreme Court. Against the sanctioned strength of 31 Judges, the Supreme Court of India is presently functioning with 24 Judges, leaving 07 clear vacancies. After extensive discussion and deliberations on a number of occasions, the Collegium unanimously resolves to fill up, for the present, four of these vacancies. The Collegium discussed names of Chief Justices as well as senior puisne Judges of all High Courts, eligible for elevation to the Supreme Court. The Collegium is of the considered view that at present the following persons are more deserving and suitable in all respects than other Chief Justices and senior puisne Judges of High Courts, for being appointed as Judges of the Supreme Court of India: 1. Mr. Justice Hemant Gupta, Chief Justice, Madhya Pradesh High Court (PHC: Punjab & Haryana) 2. Mr. Justice R. Subhash Reddy, Chief Justice, Gujarat High Court (PHC: Telangana & Andhra Pradesh) 3. Mr. Justice Mukeshkumar Rasikbhai Shah, Chief Justice, Patna High Court (PHC: Gujarat), and 4. Mr. Justice Ajay Rastogi, Chief Justice, Tripura High Court (PHC: Rajasthan). In terms of the Memorandum of Procedure, we have consulted our colleagues, whose opinion is considered to be significant in adjudging the suitability of the above-named recommendees for elevation to the Supreme Court. Copies of letters of opinion of our colleagues received in this regard are placed below. While recommending the name of Mr. Justices Hemant Gupta, R. Subhash Reddy, Mukeshkumar Rasikbhai Shah, and Ajay Rastogi, the Collegium has taken into consideration combined seniority on all- India basis of Chief Justices and senior puisne Judges of High Courts, apart from their merit and integrity.
