ANNUAL REPORT

I, Shalini Singh Nagpal, have the honour of presenting the Annual Report (January–December, 2018) of Chandigarh Judicial Academy before this August body.

It is a matter of pride for all of us that this Academy is considered as a hallmark of standard and quality. The Academy is always marching on the course of achieving its goal of “Proficiency-Performance- Productivity”. During the year, the Academy has made new strides.

Chandigarh Judicial Academy extends heartfelt gratitude to Hon’ble Mr. Justice , Patron-in-Chief, Chandigarh Judicial Academy, Chief Justice of High Court of Punjab & Haryana, our torch bearer and inspiration. The Academy is fortunate to have this opportunity to perform and grow under the expertise of His Lordship.

Chandigarh Judicial Academy is highly grateful to Hon’ble Mr. Justice Jitendra Chauhan, President, Board of Governors, Chandigarh Judicial Academy, Judge, High Court of Punjab & Haryana, our guiding force, committed towards the strategic planning and management of academic programmes of the Academy. Besides this, we acknowledge with gratitude the contribution of Hon’be Mr. Justice A.B. Chaudhari and Hon’ble Mr. Justice Jaswant Singh as Presidents of Board of Governors, Chandigarh Judicial Academy during the year 2018, whose practical and target oriented approach in imparting judicial education has brought dynamic changes in the training methodology.

Chandigarh Judicial Academy is extremely thankful to Hon’ble Mr. Justice Augustine George Masih, Hon’ble Ms. Justice Nirmaljit Kaur, Hon’ble Mr. Justice Arun Palli and Hon’ble Mrs. Justice Lisa Gill, Members, Board of Governors, Chandigarh Judicial Academy, Judges, High Court of Punjab & Haryana. The Academy thrives and flourishes under the able guidance of the Board of Governors.

Chandigarh Judicial Academy thankfully acknowledges the able guidance provided by the Hon’ble Judges and Former Judges of and Hon’ble Judges of State High Courts, who have been very generous in sparing their precious time to visit the Academy as Resource Persons in various Conferences, Workshops and Special Lectures organized during the year.

Chandigarh Judicial Academy extends a special thanks to Dr. Balram K. Gupta, Director (Academics) for his untiring efforts in taking the Academy to the next level and creating an unmatched platform for judicial education for Judicial Officers and other stakeholders of the judicial system, within and across borders.

Chandigarh Judicial Academy is also thankful to all Faculty Members, who have burnt the midnight oil in research, in executing the sessions and shaping the judicial personality of young officers.

I take this opportunity to present Annual Report of the Academy along with Audited Accounts for the Financial Year that ended on 31.03.2017 & 31.03.2018, Balance Sheet, Income & Expenditure, Account Statement & Audit Report for the Financial Year 2017-18 and 2018-19, Budget Estimate of the Academy for the Financial Year 2019-2020.As per Auditor’s Report, the relevant books of accounts are being maintained in accordance with the law. Audited Income & Expenditure Account and the Balance Sheet of the Academy depict true and correct picture of the Accounts.

I take pride in placing before this August House, a synopsis of the main activities undertaken by the Academy during the calendar year, 2018.

E-AWARENESS CONFERENCE THROUGH UNIVERSITIES AND LAW DEPARTMENTS was held on 10.01.2018 at Chandigarh Judicial Academy under the Chairmanship of Hon’ble Mr. Justice Rajesh Bindal, Judge, Punjab and Haryana High Court and was also attended by Mr. Justice Surinder Gupta and Mr. Justice Amit Rawal, Judges of Punjab and Haryana High Court. Dr. Balram K. Gupta, Director (Academics), Sh. Inderjeet Mehta, Director (Administration), Chandigarh Judicial Academy, Dr. Amit Rana, Co- Chairman, Bar Council of India and Dr. Vijender Singh Ahlawat, Chairman, Bar Council of Punjab and Haryana, Sh. Karamjeet Singh, Vice Chairman, Bar Council of Punjab and Haryana, Sh. Tejinderbir Singh, Dr. Gopal Arora, Prof. Shashi K. Sharma, Faculty Members and Ms. Anupamish Modi Virk, Registrar, Chandigarh Judicial Academy were present alongwith others, which included Vice Chancellors, Professors, Registrars of Law Universities and Colleges of Punjab and Haryana. Hon’ble Mr. Justice Rajesh Bindal informed about various steps taken by Punjab and Haryana High Court for creating e-Awareness among litigants, lawyers and general public. His Lordship emphasized educating the law students regarding e-Court facilities available on National Judicial Data Grid as well as High Court and District Court websites. His Lordship informed that ours is the only High Court where interim orders of the District Courts are uploaded on daily basis on the website which are available to the public and is the only website of the High Courts in the whole of India which is given five star rating on National Portal of India. All the representatives of the universities and colleges were asked to give a link of the High Court and NJDG portal on the website of their respective universities and colleges and all kind of help for imparting training to the teachers of law colleges in this regard was assured by His Lordship. Sh. Rajneesh Bansal, Registrar (Computerization) gave presentation by showing the live website of Punjab and Haryana and provided information about the steps to be taken for searching case status

by using different parameters. He further informed that one can get current status of a case by sending SMS on mobile no. 97668-99899. Major General P.K. Sharma retired Director, Amity Law School, Gurugram, suggested that a representative of the Court be sent in the Moot Courts / Model United Nations organized by various Institutions for creating eAwarness of the services available on eCourts portal. The representatives of Law Colleges/ Universities suggested inclusion of eCourts Services in the curriculum of the Law Students unequivocally. Dr. Bindu Jindal, Head & Dean of Maharishi Markandeshwar University, Mullana informed that general public would be made aware of the e-Court services through their TV Channel Khabare Abhi Tak and link on their official website will also be given. Sh. AmitRana, Co-Chairman, Bar Council India appreciated the steps taken by the High Court Computer Committee in creating eAwareness and inviting Law Colleges for the cause.

A DELEGATION OF 47 MEMBERS FROM 30 DIFFERENT COUNTRIES VISITED INDIA IN AN INTERNATIONAL TRAINING PROGRAMME IN LEGISLATIVE DRAFTING. This programme is organized every year by the Bureau of Parliamentary Studies and Training (BPST), Lok Sabha Secretariat. This year they were also attached with the Punjab Legislative Assembly Secretariat from February 11-15, 2018. On February 13, they came for a visit to Chandigarh Judicial Academy. They were accompanied by Dr. K.N. Chaturvedi, former Secretary, Department of Law and Justice, Government of India, Dr. Deepak Gosain, Additional Director (Co-ordination), BPST, Lok Sabha and Mr. Sumit Sabharwal, Research Assistant of Punjab Legislative Assembly, Secretariat. Mr. Arun Kumar Tyagi, Registrar General, Punjab and Haryana High Court was also present during the visit of the delegation to CJA. Mr. Inderjeet Mehta, Director (Administration) welcomed the delegates. Dr. Balram K. Gupta, Director (Academics) addressed the delegation on basic human values which help in contributing and enriching in any domain in which one is engaged. He emphasized that it is not enough to know your field of activity, it is equally important to be a good human being and to nurture human values.

NORTH ZONE REGIONAL CONFERENCE FOR ENHANCING THE EXCELLENCE OF JUDICIAL INSTITUTIONS: CHALLENGES AND OPPORTUNITIES National Judicial Academy in collaboration with Punjab and Haryana High Court and Chandigarh Judicial Academy organized North Zone Regional Conference on Enhancing Excellence of the Judicial Institutions: Challenges and Opportunities on March 17 & 18, 2018. 16 High Court Judges and 90 Judicial Officers from the High Courts of Delhi, Himachal Pradesh, Jammu and Kashmir, Punjab and Haryana, Uttarakhand and Uttar Pradesh participated in the conference. The conference was addressed in different sessions by HMJ A.K. Sikri, Judge, Supreme Court of India, HMJ Rajesh Bindal, HMJ Dr. S.Muralidhar, HMJ A.B. Chaudhari, Justice G.Raghuram, Director, NJA and Dr. Balram K. Gupta, Director (Academics), CJA. In this Regional Conference, the focus was on the Relevance of the Constitution to the District Judiciary and the Constitutional Vision of Justice. Besides this, different sessions were devoted to Elements of Judicial Behavior: Ethics, Neutrality & Professionalism, Social Context Judging as a Controlling Element in Statutory Interpretation & Exercise of Discretion, High Court and District Judiciary: Building Synergies, Access to Justice: Information & Communication Technology in Courts and Access to Justice: Court & Case Management.

TRAINING PROGRAMME ON PC & PNDT (PROHIBITION OF SEX SELECTION) ACT was organized on March 24, 2018 for Judicial Officers from the States of Punjab, Haryana and Union Territory dealing with the cases arising out of the above legislation. 119 Judicial Officers participated in the training programme. They were sensitized on issues like Understanding & Demystifying the PC & PNDT Act, Prohibitory Scope of Sex Selection under PC & PNDT Act, Trial & Procedural Issues under PC & PNDT Act. The different sessions were addressed by Dr. Raju Dhir, Assistant Director, Family Welfare, Punjab, Dr. K.P. Singh, DGP Prisons, Haryana and Justice M.S. Chauhan (Retired), presently, Judicial Member and Judge In-charge, Armed Forces Tribunal, Regional Bench Chandigarh. In the inter-active session, the different Resource Persons of different

sessions and also Dr. Balram K. Gupta, Director (Academics) and Mr.Pradeep Mehta, Faculty Member participated. Mr. Pradeep Mehta co- ordinated the programme.

LECTURE BY DR. VENKAT IYER, BARRISTER Dr. Venkat Iyer, Barrister, Advocate, Professor and Author delivered a Talk on Judicial Ethics – Comparative Perspective based upon his experiences in India and U.K. on April 3, 2018 in the auditorium of Chandigarh Judicial Academy. This lecture was chaired by HMJ A.B. Chaudhari, President, Board of Governors, CJA. HMJ Jaswant Singh, Member, BOG was also present on the occasion. Besides, both the Advocate Generals, Mr. Atul Nanda and Baldev Raj Mahajan, a large number of law officers of both the states attended the lecture. The Judicial Officers of Tricity including the three District and Sessions Judges namely Mr. Balbir Singh, Ms. Archana Puri and Ms. Ritu Tagore were present. Number of Judicial Officers posted in the establishment of Punjab and Haryana attended the talk.

MULTI MEMBER COMMITTEE ON INTER-COUNTRY REMOVAL AND RETENTION OF CHILDREN headed by HMJ Rajesh Bindal, Judge, Punjab and Haryana High Court was set up by the Union Ministry of Women and Child Development. The committee after detailed deliberation and examination of various aspects submitted its report on April 23, 2018. It has recommended the establishment of “Inter-Country Parental Child Removal Disputes Resolution Authority”. Along with its recommendations, the committee has also submitted a draft legislation to the Government. The WCD Ministry will be sharing the report with Ministry of External Affairs, Law Ministry and Ministry of Home Affairs in order to have their inputs. In fact, protecting the rights of parents and children has become a critical issue of national and international importance due to rise in transnational marriages. Dr. Balram K. Gupta, Director (Academics) was also member of the Committee.

CONFERENCE ON JUVENILE JUSTICE (CARE AND PROTECTION OF CHILDREN) ACT 2015 The Chandigarh Judicial Academy organized a Conference on Juvenile Justice Act, 2015 under the auspices of the Hon’ble Juvenile Justice Monitoring Committee of High Court of Punjab and Haryana on April 28, 2018. The keynote address was delivered by HMJ Jaswant Singh, Chairman, JJ Monitoring Committee. The Resource Persons in different sessions were :Mr.Amod K. Kanth, General Secretary, Prayas, Dr. K.P. Singh, DGP, Haryana Human Rights Commission and Mr. Aftab Mohammad, Child Protection Specialist, UNICEF. The presentations were made by Ms. Harpreet K. Jeewan, DSJ-cum-Member Secretary, PSLSA, Ms. Mandeep Pannu, ADJ-cum-Faculty Member, CJA, Mr. Mohit Handa, ACP (Haryana), Dr. Upneet Lalli, Deputy Director, Institute of Correctional Administration, Ms. Sangita Vardhan, Chairperson, Child Welfare Committee and Dr. Sukhda Pritam, PM, JJB. Dr. Balram K. Gupta, Director (Academics) gave the overview of the entire programme covering all the four sessions. Mr.Inderjeet Mehta presented the expression of gratitude. Ms. Mandeep Pannu and Mr.Sundeep Singh, ADJ-cum-Registrar (Administration), High Court were the co-ordinators of the programme. 257 different stakeholders relating to the implementation of JJ Act attended and participated in the conference.

The Second Conference on Juvenile Justice (Care and Protection of Children) Act 2015 was organized on 25.11.2018under the aegis of Hon’ble Juvenile Justice Monitoring Committee, High Court of Punjab & Haryana, for Judicial Officers (Children Court), Principal Magistrates & Members of Juvenile Justice Board, Chairpersons & Members of Child Welfare Committee, Probation Officers and Special Juvenile Police Officers. It was attended by 282 (130 & 152respectively) participants.

4TH REGIONAL CONSULTATION ON THE DRAFT RULES FOR RECEPTION, RETRIEVAL, AUTHENTICATION AND PRESERVATION OF ELECTRONIC EVIDENCE

4th Regional Consultation on the Draft Rules for Reception, Retrieval, Authentication and Preservation of Electronic Evidence involving the High Courts of the northern part of the country was held under the aegis of Hon’ble High Court of Punjab & Haryana on 28.04.2018. Hon’ble Judges from Punjab & Haryana High Court, High Court of Jammu & Kashmir, High Court of Himachal Pradesh, High Court of Delhi, CPCs of aforementioned High Courts and Faculty/Members of National Law Schools of the States and nominated Judicial Officers of Delhi District Courts participated in the consultation.

MEETING OF ALL DISTRICT & SESSIONS JUDGES IN THE STATES OF PUNJAB AND HARYANA, PRESIDING OFFICERS OF FAMILY COURTS AND LABOUR COURTS Meeting of all District & Sessions Judges in the States of Punjab and Haryana, Presiding Officers of Family Courts and Labour Courts was held on 13.05.2018 for discussion on issues pertaining to Action Plan for the year 2017-18, sensitization of the Officers regarding ongoing projects of computerization in District courts and to discuss issues pertaining to pendency of cases.

TWO ACADEMIC PROGRAMMES FOR SRI LANKAN HIGH COURT AND DISTRICT JUDGES Fifth and Sixth Academic Programmes for Sri Lankan Judges were organized during August 11 to 19, 2018. In all, 70 Sri Lankan High Court and District Judges participated in the two programmes. HMJ Priyasath Dep, PC, Chief Justice of Sri Lanka was the Guest of Honour on the occasion of 72nd Independence Day celebrations at the High Court of Punjab and Haryana on August 15, 2018. 70 Sri Lankan Judges also participated in the Independence Day celebrations. The fifth programme was from August 11-13, 2018. The sixth programme was from August 16-19, 2018. HMJ PriyasathDep, Chief Justice of Sri Lanka delivered two Inaugural Addresses in the two programmes, one on Organized Crime and in the second on Restorative Justice. The different sessions were taken by HMJ Madan B. Lokur, Justice Swatanter Kumar, Justice S.S. Saron, HMJ Rajesh

Bindal, HMJ A.B. Chaudhari, HMJ Ajay Tewari, HMJ G.S. Sandhawalia, Justice Rajive Bhalla, Justice Dr. B.B. Parsoon, Dr. Balram K. Gupta, Director (Academics), CJA, Anil Malhotra, Advocate & Author and Neeraj Aarora, Lawyer & International Arbitrator. In the two valedictory programmes, the certificates were given by HMJ A.B. Chaudhary, President, BoG, CJA. The Chandigarh Judicial Academy held a Condolence Meet on the sad demise of Shri Atal Bihari Vajpayee, former Prime Minister of India in the Convention Hall on August 17, 2018 at 9:30 a.m. In this meet, Dr. Balram K. Gupta, Director (Academics) paid rich tributes to the departed soul. Even in death, he was larger than life. His statesmanship. His oratory. His poetry. His humour. All sui generis. He stood the tallest. Above all, a great human being. He will never be forgotten. Hon’ble Mr. Justice Priyasath Dep, Chief Justice, Supreme Court of Sri Lanka also paid his homage to the departed soul and conveyed condolences on behalf of Sri Lanka to the people of India. This Condolence Meet was attended by Mr. Inderjeet Mehta, Director (Administration), the Registrar, the Faculty Members, the Researchers and the Staff Members of Chandigarh Judicial Academy. Moreover, 35 Sri Lankan Judges who were attending the Academic Training Programme at the Academy also were part of condolence meet. Two minutes silence was observed.

LAUNCH OF I.T. INITIATIVES: To facilitate providing e-services to litigants and to ease out the problems being faced by them, Hon’ble High Court launched I.T. initiatives on 19.08.2018. e-Payment of High Court Services, Android based Mobile Application, Online Grievance & Feedback System, Surety Information Management System, Infrastructure Web Application, Crystal Reports Software and eNotices were some of the major I.T. initiatives developed under the guidance of Hon'ble Mr. Justice Rajesh Bindal, Chairman, Computer Committee. Further, to follow up the steps taken pursuant to the earlier meeting dated 13th May 2018, an interactive session was held with all the District and Sessions Judges from the States of Punjab, Haryana and U.T. Chandigarh at Chandigarh Judicial Academy wherein issues pertaining to pendency of

cases, ways and means for early disposal of cases, prioritizing disposal of cases relating to crime against women and children, cases under NDPS Act etc. were discussed. The event was presided over by Hon’ble Chief Justice, High Court of Punjab & Haryana. Hon’ble Mr. Justice Rajesh Bindal, Hon’ble Mr. Justice P.B. Bajanthri, Hon’ble Mr. Justice Rajbir Sehrawat, Hon’ble Mr. Justice Mahabir Singh Sindhu, Hon’ble Mr. Justice Sudhir Mittal, Advocate Generals from the States of Punjab and Haryana, DGP Punjab, DG (HQ) Haryana, DGP, UT, Chandigarh, Chief General Manager, State Bank of India, office bearers of Punjab & Haryana Bar Association etc. were also attended the session.

REGIONAL CONFERENCE ON SECOND NATIONAL JUDICIAL PAY COMMISSION The second National Judicial Pay Commission organizedRegional Conference for the States of Punjab, Haryana, UT Chandigarh and Himachal Pradesh on Nov. 17, 2018 at CJA. The different stakeholders: the State Government, Judicial Officers and Associations – serving and retired participated in the conference. Former SC Judge, Justice P.V. Reddy and J.R. Basant, Senior Advocate and former Judge of the Kerala High Court addressed the conference and interacted with the participants on different issues involved.

SIXTH COLLOQUIUM OF NATIONAL COMPANY LAW TRIBUNAL (NCLT) FOR THE HON’BLE MEMBERS OF NCLT was organized at Chandigarh Judicial Academy from November 21-23, 2018. In the inaugural session, Justice A.K. Mittal, Judge, Punjab and Haryana High Court was the Chief Guest. In his address, Justice Mittal focused on various issues of concern. Justice M.M. Kumar, President, National Company Law Tribunal and former Chief Justice of J&K High Court also addressed the gathering of Hon’ble Judges, Senior Advocates, Chartered Accountants, Company Secretaries : the corporate coparcenary. Besides the inaugural session, the whole programme was divided into nine working sessions. The sessions were taken by Judges and Technical Members of NCLT. Dr. Balram K. Gupta,

Director (Academics), CJA took a session on Judgment Writing, Standard Expression and other related issues.

SECOND NATIONAL CONFERENCE OF THE COMPUTER COMMITTEES OF THE HIGH COURTS was inaugurated on Dec. 8 at Chandigarh Judicial Academy. It was a two days conference. On this occasion, HMJ , Judge, Supreme Court of India, HMJ Krishna Murari, Chief Justice, High Court of Punjab and Haryana, HMJ , Chief Justice, High Court of Himachal Pradesh spoke. They also released the book – IT Initiatives authored by HMJ Rajesh Bindal, Judge, Jammu and Kashmir High Court. Justice Hemant Gupta spoke about the journey of Judicial System from “Courts to e-Courts”. He touched upon the initial resistance to the infusion of information and communication technology into the judicial system. In the ultimate, he was appreciative about the successful journey and the benefits being reaped by the public from the e-Court Project. Chief Justice Murari shared that the judicial system has become more transparent. The detailed information regarding case status and history is now available on the electronic platform. Chief Justice Surya Kant cautioned against over dependence upon technology in the arena requiring application of mind. The speakers duly acknowledged the contribution made by Hon’ble Mr. Justice Madan B. Lokur, Judge, Supreme Court in making the e-Courts Project a great success. On this occasion, the High Court of Punjab and Haryana launched Case Information Software 1.0 for better connectivity with a National Judicial Data Grid. A Souvenir containing articles from all the High Courts compiled by Justice Rajesh Bindal was also released. HMJ Mahesh Grover, Chairman of organizing committee gave the expression of gratitude.

INDUCTION TRAINING PROGRAMME OF NEWLY APPOINTED JUDICIAL OFFICERS Condensed Induction Training Programme for PCS (JB) from the State of Punjab was conducted from 26.02.2018-12.11.2018.

ORIENTATION PROGRAMME FOR NEWLY PROMOTED ADDITIONAL DISTRICT & SESSIONS JUDGES One Month Orientation Programme for 04 promoted Additional District & Sessions Judges from the state of Haryana was conducted from 6.10.2018- 5.11.2018.

TRAINING PROGRAMME ON THE SUBJECT OF EXECUTION FOR THE OFFICERS DEALING WITH EXECUTIONS PENDING SINCE THE YEAR 2010 OR PRIOR THERETO Two training programme on the subject of Execution, for the Officers dealing with executions pending since the year 2010 or prior thereto, were conducted for 84 Judicial Officers from the state of Punjab on 07.07.2018 and for 67 Judicial Officers from Haryana on 21.07.2018. Different sessions were taken by HMJ Surinder Gupta, A.N. Jindal and Justice Dr. B.B. Parsoon.

FAREWELL TO CHIEF JUSTICE SHIAVAX JAL VAZIFDAR WHO WAS PATRON-IN-CHIEF, CJA FROM 15.12.2014 TO 03.05.2018 Chandigarh Judicial Academy organized Farewell Function on April 24, 2018. HMJ A.B. Chaudhari spoke on this occasion and Dr. Balram K. Gupta, Director (Academics) read out the farewell address. The farewell dinner was attended by HMJ T.P.S. Mann, HMJ Rajesh Bindal, HMJ M.M.S. Bedi (past Presidents of BOG, CJA), HMJ A.B. Chaudhari, President, BOG, HMJ R.K. Jain, HMJ Jaswant Singh and HMJ Justice Augustine George Masih, Members, BOG. Besides them, both the Directors, the Faculty and the Registrar were part of the evening function.
