BACKGROUND

On December 3, 2019, the City Commission authorized the Mayor and City Clerk to execute a construction contract with Trinium, Inc., of Manhattan, , for construction of the Douglass Activity Center. The architectural plans, prepared by Bruce McMillan Architects, identified an area within the building for a mural.

On October 8, 2020, the Douglass Center Advisory Board reviewed a draft Request for Proposals (RFP) for mural installation at the Douglass Activity Center and appointed two members to a Selection Panel.

On January 8, 2021, the City of Manhattan published a Request for Proposals for a mural installation at the Douglass Activity Center. The mural is to be approximately 14 feet wide by 11.5 feet high and will be located on the second floor of the newly constructed building. The RFP stated:

The mural’s theme should speak to the cultural and historical legacy of the area while celebrating and honoring the strength and resilience of the Black community. The mural should celebrate social justice, the creative cultural landscape, and changing attitudes toward racial equality. This mural will be the pinnacle of the Douglass Activity Center and will instill a sense of pride for the City’s diverse demographic.

On March 1, 2021, the City received seven submissions from interested artists. One submission was incomplete and was disqualified. The other six qualifying submissions were shared with a Selection Panel which included members of the Douglass Center Advisory Board, Arts and Humanities Advisory Board, community and business leaders, City staff, and arts administrators.

DISCUSSION

On March 22, 2021, the Selection Panel met to review each applicant’s work samples and rate each proposal based on the evaluation criteria listed in the RFP. Following the process outlined in the RFP, the Selection Panel ranked the submissions and recommended the top three proposals to the Douglass Center Advisory Board for further consideration. The Selection Panel unanimously rated the submission by EuGene V. Byrd III as their top choice.

On April 9, 2021, the Douglass Center Advisory Board met to review the three semi-finalist entries recommended by the Selection Panel. The Douglass Center Advisory Board agreed with the recommendation of the Selection Panel and unanimously recommend to the City Commission the submission by EuGene V. Byrd III as their top choice for the Douglass Activity Center Mural Project. The Advisory Board also requests that the artist’s project statement describing the mural content be installed with the mural as an educational and interpretive element.

The proposed mural features several scenes that pay homage to Black history in Manhattan. The artist describes several key features of the mural that “shows changing attitudes toward racial equality in Kansas.” According to the proposal, the mural will pay homage to the Douglass Pool, Black students’ contributions prior to desegregation and Kansas State Black graduates, Benjamin “Pap” Singleton and the Exodusters who migrated to Kansas, the Bethel A.M.E Church, Black veterans, and the #BlackLivesMatter movement. The mural is to be completed by June 12, 2021 and will be unveiled as part of the 2021 Celebration.

FINANCING

The proposed cost of the mural installation is $13,500. The original construction proposal by Trinium, Inc. included a $10,000 allowance for mural installation. This amount has been change ordered out of their contract and is available for the Mural Project with the additional $3,500 being paid from the Special Parks and Recreation Fund. In 2020, temporary notes were issued for the total costs for the Douglass Center Activity project with permanent financing to begin in 2024 for 10 years. Payments for the project will come from the Bond and Interest Fund.

ALTERNATIVES

It appears the Commission has the following alternatives concerning the issue at hand. The Commission may:

1. Accept the recommendation of the Douglass Center Advisory Board and authorize City Administration to finalize and the Mayor and City Clerk to execute an Agreement for Public Art with EuGene V. Byrd III, of Marietta, Georgia, in an amount not to exceed $13,500, for installation of artwork for the Douglass Activity Center Mural Project (PR1706). 2. Deny the recommendation. 3. Modify to meet the needs of the Commission. 4. Table the request.

RECOMMENDATION

City Administration recommends the City Commission accept the recommendation of the Douglass Center Advisory Board and authorize City Administration to finalize and the Mayor and City Clerk to execute an artist contract with EuGene V. Byrd III, of Marietta, Georgia, in an amount not to exceed $13,500, for installation of artwork for the Douglass Activity Center Mural Project (PR1706).

Public Comments: Chief Butler updated the committee on crime statistics and two new programs: Safe CAM and the Next-door neighborhood app.

Office Ryan Doehling updated on a possible traffic study for the area now that the Activity Center is open.

Wyatt Thompson, Assistant Director of Manhattan Parks and Recreation shared the City is working on parking construction design and some of this will be covered to address patron safety and reduce speed. He is working with Public Works. Decision was made to wait until Wyatt completes his work and gets back to the Advisory Board.

Directors Report: David Baker thanked everyone who participated in the Douglass Activity Center grand opening as it was a grand success. To date, 191 have signed up for their free access to the facility and 33 have signed up for the fitness area membership.

The closing hours were moved to 8:00 p.m. as the Activity Center had seen no used after 7:30 p.m. This allows to adjust the hours of staff and have better coverage.

Riley County Health Department will be administering the Johnson & Johnson vaccine at the Douglass Center on Friday, April 9, 2021 from 3:00 p.m. – 5:00 p.m. Dave indicated they would not be able to provide this community service if it had not been for our new facility that allowed the growth to meet meeting our community needs.

Advisory Chair Report: Debbie Nuss explained the 3 sections of concern in the Douglass Advisory Board Ordinance Bylaws. 1) Composition of the Board 2) Human Rights Board ex- offico and 3) Advisory Board powers. After much discission, Board members will review the bylaws and discuss at the May meeting. Dave. Baker will make sure that all members receive a copy of the bylaws to review prior to next month’s meeting.

Douglass Activity Mural Project: Wyatt Thompson gave an overview of the project and presented the top three entries selected by the committee that was made up of 2 Advisory Board members, Arts and Humanities Council and the community at-large. There were 7 submissions with one being disqualified

for not providing required information. The committee selected work by Eugene Byrd III as their first choice, work of Blane Stafford second, and Dan Toro the third choice. Wyatt presented the submissions to the Douglass Center Advisory Board for their recommendation to be taken to the City Commissioners for approval. The Douglass Center Advisory Board unanimously recommended to the City Commission that the artist concept by Mr. Eugene Byrd III be accepted as their ultimate choice. Connie Birdsong made the motion, second by Maureen Sheahan. The vote carried 4-0 for approval.

The Advisory Board members requested along with the mural; an artist project statement describing the mural content will also be installed with the mural as an educational/interpretive component. This could include, but not be limited to include broad stroke of the mural content that pays homage to the black history of Manhattan and includes items such as first public – first public black swimming pool – Bethel AME Church.

The mural will be unveiled on Saturday, June 19, 2021 during the Manhattan Juneteenth Celebration.

Other Business: Everybody Counts will occur August 7, 2021 taking into consideration masks and social distancing. Anyone interest in helping this year is more than welcome to attend the meeting from noon to 1:00 p.m. on Thursday, May 27.

AGREEMENT FOR PUBLIC ARTWORK

This Agreement is entered into this day of , 2021, by and between the City of Manhattan, Kansas, a municipal corporation (“City”), and EuGene V. Byrd III, (“Artist”).

WHEREAS, the City desires to obtain artistic services for the design, fabrication and installation of a painted mural for the Douglass Activity Center Mural, City Project #PR1706, located at the City’s Douglass Activity Center, 925 Yuma Street, Manhattan, Kansas (“Project Site”); and,

WHEREAS, Artist is qualified, capable and prepared to perform the necessary artistic services as described in this Agreement; and,

WHEREAS, following a competitive selection process, Artist was selected to design, fabricate and install at the Project Site the proposed Mural, which is described and illustrated in attached Exhibit A to this Agreement, incorporated by reference; and,

WHEREAS, the parties wish to undertake the obligations in this Agreement.

NOW THEREFORE, in consideration of the mutual promises contained herein, the parties agree as follows:

1. Artist’s Services A. Artist agrees to perform all services and furnish all supplies, material, and/or equipment necessary to design, fabricate and install the Mural known as [insert pending or final artwork name] at the Project Site, as requested in the City’s Request for Proposals (“RFP”), attached as Exhibit B. Artist agrees to perform all services in a professional manner and in strict compliance with this Agreement. B. The parties agree that Exhibits A and B establish the themes, location, dimensions, placement, and similar requirements for the Mural. Artist agrees to substantially comply with the requirements set forth in the Exhibits. C. Artist shall not provide any services or materials not described by this Agreement, unless Artist obtains prior written consent from the City. If the City gives prior written consent for additional services, the City shall compensate Artist with a fee mutually agreedDraft upon by the parties prior to performance of the additional services. Any additional services or materials provided by Artist without the City’s prior written consent shall be at Artist’s own risk, cost, and expense, and Artist shall not make a claim for compensation from the City for such work. D. Artist agrees to participate in interviews, videos, photographs, social media, and other media related to the Mural through December 31, 2021. Artist agrees that the City may use Artist’s name and likeness for educational and promotional purposes related to the Mural, the Douglass Center, and/or the City of Manhattan. E. Artist agrees to share multimedia content produced by the City over Artist’s existing social media networks, using tags provided by the City, through December 31, 2021. F. On or before December 31, 2021, Artist agrees to provide a maintenance and conservation report to the City that describes the materials and products used and any required care and upkeep for the Mural. Artist agrees that the Mural must be durable, taking into consideration that the Project Site is a public recreational

1 of 7 space. Artist agrees that any required care or upkeep will be reasonable in terms of time and expense. G. The parties agree that Artist performs all Services under this Agreement as an independent contractor and not as an agent or employee of the City. When at the Project Site, Artist agrees to comply with the ordinances, rules and regulations that apply to the general public at the Project Site.

2. Redesign or Revisions of Artist’s Services A. This Agreement is executed following selection of Artist’s proposed Mural through a competitive process. Artist and/or the City may make final adjustments to the proposed Mural following selection. Artist shall submit a final design of the Mural to the City within ten days of execution of this Agreement, and the City shall timely notify Artist if revisions are necessary for the Mural to comply with Exhibits A or B, with other applicable ordinances or regulations, or for other reasons such as ensuring the integrity of the Mural or its installation at the Project Site. Following the parties’ agreement upon revisions, or if no revisions are necessary, the City shall notify Artist of approval of the final design. B. If Artist desires to change the approved final design, Artist agrees to present proposed changes to the City for prior review and approval. Artist must provide a detailed description of any significant changes in the artistic expression, design, dimensions and materials of the Mural that is not permitted by, nor in substantial conformity with the already approved design. A significant change is any change which materially affects installation, scheduling, site preparation or maintenance of the Mural, or the concept of the Mural as represented in the already approved design. C. The City reserves the right to direct revision of fabrication or installation of the approved final design at the City’s discretion. Artist shall advise the City of additional costs and time delays, if any, in performing the revision, before Artist performs the revised services. If revisions of the Services are necessary due to Artist’s error or omission, Artist shall provide the services and materials associated with such fabrication and installation revisions, at no additional cost to the City.

3. Fabrication and Installation at the Project Site and Acceptance by the City A. Prior to installation, the City agrees to timely prepare the wall surface at the Mural site (level-4 drywall finish, painted with “Ceiling Bright White,” Sherwin Williams color SW 7007).Draft During installation, the City agrees to provide a secure storage space at the Project Site for storage of Artist’s supplies, materials, and/or equipment. B. The City gives Artist the right of entry to the Project Site for inspection prior to and during Mural installation. Provided that, Artist’s right of access, including scheduling, shall be in coordination with the City to ensure that reasonable rules are followed to ensure safety and to minimize disruption to City operations at the Project Site. C. During installation, Artist agrees to prepare and safeguard the Mural site each day for safety and general cleanliness. At the end of each workday, Artist agrees to leave the Mural site clean and free of obstacles. D. Artist bears the risk of loss or damage to the Mural at all times prior to the City’s final written acceptance of the completed Mural. D. Artist shall notify the City when Mural installation is complete. The City shall inspect the Mural and timely notify Artist of any necessary revisions to fabrication or installation, which shall proceed subject to Section 2 of this Agreement. When the

2 of 7 City approves the completed Mural, the City shall notify Artist of its acceptance of the completed Mural in writing. Following acceptance of the completed Mural, the City is responsible for the care and maintenance of the Mural. The City agrees to install an artist plaque at the Project Site, recognizing the Mural and Artist’s name, to be maintained until such time the Mural is changed, modified, destroyed, removed, moved, replaced, or transported.

4. Compensation & Audit by the City A. As consideration for providing the Services, the City shall pay Artist $13,500.00. Artist acknowledges and agrees that the total cost to complete the Project shall not, in any way, exceed $13,500.00 without prior written approval by the City. B. The City shall pay Artist in two payments: one-half of the total fee shall be paid upon executive of this Agreement, and the other half shall be paid upon the City’s written acceptance of the completed Mural. C. Artist shall provide the City with Artist’s Tax Identification Number and any proof of such number as requested by the City to process payments. D. At the City’s request, Artist shall permit the City, or any authorized representative of the City, at all reasonable times, to access and examine all records, books, papers or documents related to Artist’s performance under this Agreement.

5. Schedule & Delay A. Unless otherwise directed by the City, Artist shall commence performance of the Services upon execution of this Agreement. B. Time is of the essence for the performance of the Services, and Artist acknowledges that the completed Mural is intended to be unveiled at the Juneteenth Celebration on June 19, 2021. Artist shall complete installation of the Mural no later than June 12, 2021. Artist shall perform the remaining Services, as described in Section 1(D), (E) and (F), through December 31, 2021. C. Neither the City nor the Artist shall be in default of the Agreement for delays in performance caused by circumstances beyond the reasonable control of the non- performing party, including, but not limited to, unusually severe weather conditions, floods, tornadoes, earthquakes, fires; wars, riots and other civil disturbances; strikes, lockouts, and other labor disturbances; or judicial restraint. Should such a circumstance occur, the non-performing party shall, within a reasonable time, give the other party written notice describing the circumstances and the anticipated date to resume performanceDraft of the Agreement. D. If Artist’s performance is delayed due to delays caused by the City, Artist shall have no claim against the City for damages or payment adjustment other than an extension of time to perform the Services.

6. Term & Termination A. The effective date of this Agreement shall be the date of execution, when the Agreement is signed by both parties. This Agreement shall terminate on or before December 31, 2021, upon completion of all Services to the satisfaction of the City. B. The City may terminate this Agreement without cause with five (5) days written notice to the Artist. The City shall compensate Artist for the Services that have been completed to the City’s satisfaction as of the date of termination, and provide reimbursement for any direct expenses upon Artist providing documentation to the City. C. If Artist’s death or incapacity occurs prior to substantial completion of the Mural, the City may, at its option: (a) assign Artist’s obligations to another artist to

3 of 7 complete the Mural; or (b) terminate this Agreement and remove, destroy, or otherwise alter the incomplete Original Mural. If option (a) is chosen, the Artist or Artist’s heirs retain the rights provided in Paragraph 9, but the Original Mural is subject to the City’s ownership and control as otherwise set forth in this Agreement. If Artist’s death or incapacity occurs after substantial completion of the Mural, but prior to the City’s final acceptance, the City may, at its option: (a) assign Artist’s obligations to another artist to complete the Mural; or (b) send a written notice to Artist, or Artist’s heirs, of acceptance of Title of the Mural in its current form. In either option, the Artist or Artist’s heirs retain the rights provided in Paragraph 9, but the Original Mural is subject to the City ownership and control as otherwise set forth herein.

6. Artists’ Representations and Warranties A. Warranties of Title. Artist represents and warrants as follows: i. The Mural is solely the result of the artistic effort of Artist; ii. The Mural is unique and original and does not infringe upon any copyright or violate the rights of any person or third party; iii. The Mural (or any duplicate thereof) has not been accepted for sale elsewhere; iv. Artist has not sold, assigned, transferred, licensed, granted, encumbered or utilized the Mural or any element thereof or any copyright related thereto which may affect or impair the rights granted pursuant to this Agreement; v. Artist has the full power to enter into and perform this Agreement and to make the grant of rights contained in this Agreement; vi. Artist shall perform all services in accordance with all applicable laws, regulations, or ordinances, and with the necessary care, skill and diligence; and, vii. The representations and warranties shall survive the termination of this Agreement. B. Warranties of Quality and Condition. Artist represents and warrants that Artist shall perform all services shall be performed in accordance with professional “workmanlike” standards and free from defective or inferior materials and workmanship, for one year after the date of the City’s written acceptance of the Mural. Draft 7. Insurance A. Artist shall purchase and maintain, at its expense, insurance coverage as required in this Section for the term of this Agreement. The failure to purchase and maintain the minimum insurance required herein shall constitute a material breach of this Agreement upon which the City may immediately terminate or suspend this Agreement. Compliance with the insurance requirements set forth in this Section shall not limit the liability of the Artist in any way. B. Commercial General Liability: Artist shall purchase and maintain insurance with a minimum limit of $1,000,000 for each occurrence and $2,000,000 in the general aggregate. C. Artist shall furnish any or all insurance certificates to the City, adding the City as an additional insured.

8. Indemnification

4 of 7 Artist shall indemnify and hold harmless the City, and its departments, elected officials, officers, employees and agents, from and against all liability, suits, actions, proceedings, judgments, claims, losses, liens, damages, and injuries, (including attorneys’ fees and other expenses of litigation, arbitration, mediation or appeal), which in whole or in part arise out of or have been connected with, Artist’s negligence, error, omission, recklessness, or wrongful or criminal conduct in the performance of the Services, including performance by Artist’s employees, agents and subcontractors.

9. Ownership & Intellectual Property Rights A. Title to the Original Mural shall pass to the City upon the City’s written final acceptance and payment for the Mural. At such time, Artist shall complete a Transfer of Title form substantially similar to the example form attached as Exhibit C. B. The Artist retains all rights under the Copyright Act of 1976, 17 U.S.C. §101 et seq., as the sole author of the Mural for the duration of the copyright. C. Because the Mural, in its final dimension, shall be unique in the nation, Artist agrees not to make any additional exact duplicate reproductions of the Mural, nor shall Artist grant permission to others to do so except with prior written permission of the City. D. Artist grants to the City and its assigns an irrevocable license to reproduce the Mural in print, photograph, video, films or recordings, for use for typical, non- commercial City purposes, including but not limited to promotion, education, publicity, development, fundraising, publication and presentation, in all media formats that exist now and may be developed in the future. City shall make reasonable efforts, based upon the media format and nature of the reproduction, to ensure that all reproductions of the Mural provide credit to Artist. E. Artist shall use best efforts in any public showing or professional resume use of reproductions to acknowledge that the Mural is an original artwork commissioned by the City of Manhattan, Kansas. F. The City shall not be held responsible for any third party infringement of Artist’s copyright and has no responsibility for protecting Artist’s intellectual property rights.

10. Waiver of Rights The provisions of this paragraph shall apply to modify Artist’s rights of attribution and integrity as set out in the Visual Artists Rights Act, 17 U.S.C §§106A and 113(d) (“VARA”), and any rights arisingDraft under federal or state law or under the laws of another country that convey rights of the same nature as those conveyed under VARA, as against the City and its agents. The City has the absolute right to change, modify, destroy, remove, relocate, move, replace, transport, repair or restore the Original Mural located at the Project Site, in whole or in part, in the City’s sole discretion.

11. Notices A. All notices required by this Agreement shall be in writing, and unless otherwise directed by this Agreement, shall be sent to the addresses as set forth in this Section. B. 12. Non-Discrimination During the term of this contract, Artist shall comply with the following Non-Discrimination- Equal Employment Opportunity/Affirmative Action Program Requirements: A. During the performance of this contract, Artist shall comply with all the provisions of the Civil Rights Act of 1964, as amended; The Equal Employment Opportunity Act of 1972; Presidential Executive Orders 11246, 11375, 11131; Part 60 of Title 41 of the Code of Federal Regulations; the Age Discrimination in Employment Act of 1967; the Americans with Disabilities Act of 1990 and laws, regulations or amendments as may be promulgated thereunder. B. Requirements of the State of Kansas: i. Artist shall observe the provisions of the Kansas Act against Discrimination (Kansas Statutes Annotated 44-1001, et seq.) and shall not discriminate against any person in the performance of work under this Agreement because of race, religion, color, sex, disability, national origin, ancestry or age except where age is a bona fide occupational qualification reasonably necessary to the normal operation of the particular business; ii. In all solicitations or advertisements for employees, Artist shall include the phrase, "Equal Opportunity Employer", or a similar phrase to be approved by the Kansas Human Rights Commission; iii. If Artist fails to comply with the manner in which Artist reports to the "Kansas Human Rights Commission" in accordance with the provisions of K.S.A. 44-1031, and amendments thereto, Artist shall be deemed to have breached this Agreement and it may be canceled, terminated or suspended, in whole or in part, by the City; iv. If Artist is found guilty of a violation of the Kansas Act against Discrimination under a decision or order of the Kansas Human Rights Commission which has become final, Artist shall be deemed to have breached this Agreement and it may be canceled, terminated or suspended, in whole or in part, by the City.Draft

13. Miscellaneous Provisions A. Governing Law. This Agreement shall be governed and construed in accordance with the laws of the State of Kansas. B. Venue and Jurisdiction. The parties agree any legal action arising out of this Agreement shall be filed in the Riley County, Kansas, District Court. C. Entire Agreement. This Agreement, including attachments incorporated herein by reference, represents the entire Agreement and understanding between the parties, and this Agreement supersedes any prior negotiations, proposals or agreements. Unless otherwise provided in this Agreement, any amendment to this Agreement shall be in writing and shall be signed by the City and Artist, and attached hereto. D. Severability. If any part, term or provision of this Agreement, or any attachments or amendments hereto, is declared invalid, void, or enforceable, all remaining parts, terms and provisions shall remain in full force and effect.

6 of 7 E. Waiver. The failure of either party to require performance of this Agreement shall not affect such party’s right to enforce the same. A waiver by either party of any provision or breach of this Agreement shall be in writing. A written waiver shall not affect the waiving party’s rights with respect to any other provision or breach. F. Assignment by Artist. Artist shall not assign any interest in this Agreement without the City’s prior written consent. If Artist assigns an interest in this Agreement without the City’s prior written consent, such assignment shall be void, and City may immediately terminate or suspend this Agreement. G. Successors and Assigns. Subject to Paragraph 13(F), this Agreement shall be binding upon the heirs, executors, administrators, successors and assigns of the parties. H. Third Parties. The Services to be performed by Artist are intended solely for the benefit of the City. Nothing contained herein shall create a contractual relationship with, or any rights in favor of, any person or entity not a signatory to this Agreement.

CITY OF MANHATTAN REQUEST FOR PROPOSAL DOUGLASS ACTIVITY CENTER MURAL Project # PR1706

I. Background Information The City of Manhattan is a vibrant community of nearly 55,000 residents in northeast Kansas, two hours from Kansas City. Manhattan is home to Kansas State University, a leading academic, research, and collegiate athletics institution, as well as Manhattan Christian College and Manhattan Area Technical College. An additional asset is the adjacent Fort Riley U.S. Army installation, home of the 1st Infantry Division.

The City of Manhattan, Kansas, with the input and participation of the City’s Arts and Humanities Advisory Board (AHAB) and the Douglass Center Advisory Board (DCAB), seeks proposals for a public art mural project. Artists are invited to submit a proposal for this exciting opportunity to provide a large-scale work of art to be created inside the new Douglass Activity Center, currently under construction at 925 Yuma Street, in Manhattan, Kansas.

II. Douglass Center History Yuma Street in Manhattan is rich with Black history and culture. Beginning with the establishment of the Bethel A.M.E. Church by the Exodusters in 1879, continuing through the new Douglass Activity Center expected to open in spring of 2021, the neighborhood's buildings and activities have brought together many generations of Black families.

Founded in 1904, the Douglas School served several generations of Black students prior to desegregation. The building is now known as the Douglass Center Annex, offering community space for tutoring and mentoring programs, meetings, and public services. Built in the 1940s, the Douglass Community Center originally served as a United Service Organization for WWII soldiers. The only swimming pool open to Black residents at that time was located in Douglass Park, on the grounds where the new Douglass Activity Center is being constructed. Other notable structures are the Kaw Blue Masonic Lodge and the historic Pilgrim Baptist Church.

Today, the Douglass Center continues to be a vital and vibrant part of the Manhattan community. Its presence continues to be essential for Black students at KSU and soldiers stationed at Fort Riley, but it has evolved over the years to encompass education, recreation, fellowship, and kinship for all members of the community. The construction of the new Douglass Activity Center provides the opportunity to represent, celebrate, and honor the rich history of the Black community within Manhattan. III. Location The mural is located on an east-facing interior wall on the second floor of the newly constructed Douglass Activity Center at 925 Yuma Street, in Manhattan, Kansas.

IV. Design & Themes The City is invested in the area, with recent investments in the Douglass Community Center and Annex, and the new Douglass Activity Center to be completed in spring of 2021. This mural project represents a unique opportunity for the selected artist to create a piece of public art representing the Black community in Manhattan.

The mural’s theme should speak to the cultural and historical legacy of the area while celebrating and honoring the strength and resilience of the Black community. The mural should celebrate social justice, the creative cultural landscape, and changing attitudes toward racial equality. This mural will be the pinnacle of the Douglass Activity Center and will instill a sense of pride for the City’s diverse demographic.

V. Site Photos & Dimensions The mural area is highlighted below in red. The area measures approximately 14-feet wide by 11.5-feet high.

VI. The City of Manhattan shall be responsible for the following:

• Preparing the wall surface (level-4 drywall finish, painted with “Ceiling Bright White,” Sherwin Williams color SW 7007) • Providing a secure storage space for any materials (paints, brushes, rollers, etc.) • Access to the building • Artist plaque to be installed on site

VII. The selected artist(s) shall be responsible for the following:

• Materials and supplies (paint, brushes, rollers and the associated accouterment), • Design, fabrication, and installation of the mural • Preparing and safeguarding the site each day of work for safety and cleanliness • Required clean-up of installation site at end of each workday, leaving site clean and free of any obstacles • Proof of liability insurance coverage

VIII. The selected artist(s) will be required to:

• Agree to participate in interviews, videos, photographs, social media, and other media related to the mural. Agree to allow the City of Manhattan to use artist(s)’ name and likeness for educational and promotional purposes related to the mural, the Douglass Center, or the City of Manhattan. • Share multimedia content, produced by the City of Manhattan, over the artist’s social networks tagging @ManhattanParksAndRec, @CityofMHK, @DouglassCenterMHK @and using the hashtags #mhkprd, #mhkart #dcstrong, #historicdouglasscenter, #douglassmural. • Execute the contract provided by the City. If a contract is awarded to a proposer, the contract will require the assignment of the artist’s copyright interest in the mural to the City of Manhattan, and further require a waiver of rights pursuant to 17 U.S.C. § 106A. All persons awarded and or entering into contracts with the City of Manhattan shall be subject to and are required to comply with all applicable City, State, and Federal provisions pertaining to nondiscrimination, equal employment opportunity, and affirmative action on public contracts.

X. Budget The proposal must include a total project budget breakdown not to exceed $13,500 to complete the mural. Total budget should include artist fees, travel-related expenses, materials and supplies, fabrication, installation, and other associated costs.

XI. Criteria, Selection, and Grading Process All entries must be the original work of the submitting artist. Artist’s proposals will be evaluated based on artistic merit, community impact, and managerial capability. The City of Manhattan will convene a diverse Selection Panel including Douglass Center Advisory Board members, AHAB board members, community and business members, City staff, and arts administrators. The Selection Panel will review each applicant’s work samples and proposal based on the “evaluation criteria” listed below.

All completed project submissions will be evaluated on a 100-point scale based on the criteria outlined below. Each member of the Selection Panel will grade each proposal individually and the aggregate score will be used to determine merit and advancement in the selection process:

• Success in addressing the project theme and intent in the mural design (0-10 points) • Concepts and ideas in the artist’s mural design show creativity, originality, and uniqueness (0-20 points) • Inherent artistic quality, skill, and craftsmanship exhibited by proposed and past work (0-20 points) • The design is responsive to the physical site dimensions and location (0-20 points) • Artwork is appropriate for placement in a diverse, family-oriented site (0-10 points) • Demonstrated knowledge and experience of public art creation and the collaborative process of public art design (0-10 points) • Artist's proven track record/ability to complete the work on time and within the budget (0-10 points)

Based on the above grading criteria, the top three (3) highest scoring artists will be selected as semi-finalists. In the event of a tie in the top three scores, each of the tying artists will be selected as semi-finalists. Members of the Douglass Center Advisory Board will review the semi-finalists at a public meeting and make a final recommendation that is in the best interests of the Douglass Center and the City. The City Commission will have final approval and authorize the City to enter into a contract with the selected artist.

XII. How to Apply The following must be submitted via online form, in-person, or mailed submission:

• A project statement describing your approach and intention for this mural project, how your proposal relates to the desired mural themes, and project budget. Please include (1-4) images of your proposal (sketches, digital design, and/or mock-ups). • Artist Statement of Interest: Submission must include an Artist Statement of Interest (no more than one page in length) that specifically addresses your perspective on, and interest in, participating in

the Douglass Activity Center Mural Project for the City of Manhattan, and your personal connection to the Black community and the proposed mural themes. • Resume/CV: Submission shall include a current resume or CV that outlines your professional accomplishments as an artist. If submitting as a team, individual resumes should be submitted for each team member. • Professional References: Minimum of three (3), but no more than five (5), references familiar with your work and working methods. This list should include the reference’s name, address, email, and phone number. • Work Samples: Applicants are required to submit (3-6) visual representations (no larger than 1 MB each) of your past artwork appropriate to this project. Please include a list of the submitted project images with descriptions that clearly explain both the projects and images. Acceptable files types include .PDF, .TIFF, .JPEG, .JPG, .PNG, and .GIF. Artists applying as a team should include samples of each artist’s work.

Artist Statement of I was born and in Wichita, KS and I’ve been an artist my whole Interest life. I built a reputation as an artist while in high school, but I came to the realization early that if I wanted to make it as an artist that I would have to leave Kansas. In high school I always realized love from the Black community but not from my high school. At the time I would draw and paint a lot of rappers that I liked. The school would never show any of my work claiming the work was all gang related. I was painting people like De La Soul, Tribe

1 Called Quest, Redman etc, these rappers were the forest from being gang related. But because they were Black, and my teachers didn’t take the time to research who these Black people where they labeled all my work as unable to show. Immediately after graduation I left.

I always wanted to come back home and have a show or create public art for my home state, the opportunity was never there. I gave up on the idea, until I came across this submission and I felt like it was GOD’s plan. Representation matters, and I think it’s important for a Black Kansas native to paint this mural. I connect with the project not just because I’m Black but I have educators and military family, my ancestors are Exodusters and also because I can’t swim. I’ve thought about my lack of swimming and other Black people for years. Although it’s the source of jokes for some, it’s not funny at all. My grandfather couldn’t go to public pools (or public beaches) so he couldn’t teach my father to swim. My father couldn’t go to public pools either, so he couldn’t teach me to swim. I broke the cycle with my daughter, I made to point to keep her in swimming lessons when she was 5. She swims like a fish. Me, I’m still learning. The fact that the site is on the grounds of the first Black public pool in Kansas is important to me. It means something.

As I got older, I learned Gordon Parks was born in Kansas. I learned Langston Hughes lived in Kansas until the end of his first marriage. These are some of the greatest artistic minds of our time. Living in Kansas I never knew this, why aren’t these Black men celebrated in Kansas? This information would’ve meant the world to me as a young Black artist from Kansas. But knowing it now fills me with pride to be from Kansas, I no longer feel like I was born in the wrong state. Representation matters. This isn’t just another gig for me. This is legacy. If I’m awarded the job, I will paint my finest mural ever and make Kansas proud.

EuGene Vidal Byrd III was born in Wichita, KS the last of three children of Ella Mae and Eugene from dirt county roads of Ok- mulgee and Tulsa, OK. EuGene was early influenced to draw by 70’s album covers; comic books and Native throws. His mother being an interior decorator and artist herself always encouraged EuGene to pursue his art. But growing up in the 80’s during the gangbang creak era, from a low-income environment it took awhile for EuGene to fully embrace his artistic calling. After high school EuGene attended cSouthern University in Baton Rouge, LA to study business. After a disappointing year, EuGene was finally ready to take his art serious. In 1996 he packed his bags and moved to Atlanta to study Fine Art and Design.

EuGene received his BFA from SCAD in 2002. Worked as a graphic designer/creative director for 15 years for fortune 500 companies, design agencies, and signage branding manager for Miami Dade and Dubai International Airport projects. After the loss of his sister and mother a successful design career just wasn’t fulfilling enough. In 2016 he left his job and stepped out on faith to fully pursue his art career. EuGene founded Future Dead Artists, and operated FUTURE GALLERY from 2018-2020 in which he mentored artists/curators, curated 20 exhibitions and over 200 artists. EuGene believes that great art and culture inspires us, brings us together and teaches us about ourselves and the world around us as he continues of his path of self dis- covery though art.
