I. BACKGROUND

In 1978 the Reports Analysis Division referred to the Ottice of General Counsel all candidates and committees which tailed to timely file one or more of the following reports: the 1977 year-end report, the 10 day pre-primary report, the 30 aay post-primary report, and the 10 day pre-general report. For those candidates and committees whi'ch did not conciliate, the Commission found probable cause. lk The Commission directed the Office of General Counsel to review-all of the candidates and committees against which probable cause was found and to recommend to the Commission those candidates and committees against which a civil, action should be filed.jl

1/Except for those candidates and committees which failed to file the 1977 year-end report, the Commission did not authorize the filing of civil suits.

2/Four candidates and one committee against which the Coin- mission found probable cause for failure to file reports. of receipts and expenditures are not included in this, report. They are: the Committee Amigos de Jaime Beni'tez,# NF 54 (Puerto Rico); the New York State Voter Registration Drive, NF 59 (New York); the Committee to Elect Louis Nine to Congress, NF 62 (New York); the North Carolina Democratic Inaugural Committee, NF 70 (North Carolina); and Sanford Krasnoff, NF 193 (Louisiana). Civil actions for failure to timely file and for other violations of FECA were brought against the Committee Amigos de Jaime Benitez and Sanford Krasnoff. A civil action for failure to timely file was brought against the Committee to Elect Louis Nine to Congress and a consent decree has been obtained. The New York State Voter Registration Drive was referred to the Audit Division for an audit. Con- ciliation is proceeding for failure to timely file and for other violations of FECA with the North Carolina Democratic Inaugural Committee in MUR 859. ITO. ANaALYSISI

All of the respondents are principal campaign, committees, of candidates who ran for election to federal office in 1976. None of the candidates ran for election to federal. office in- l1i78. The respondent committees appear to be defunct., As none of the respondents filed 1978 quarterly reports there is no indication of financial activity. Because of the inactivity of these committees in the 1978 elections, ttne Office of General Counsel recommends that the Commission not bring a civil action for relief against them, but close thie files. Attachment II lists each respondent and indicates each respondent's filing history and financial activity for 1978. The General Counsel's Office used three criteria in reviewing the respondents. We are recommending the filing

One committee,, Conlin for Congress,, meets all three criteria: failing to timely file both the 10;.day! pre-general election report and the 30 day post-general election report, receiving 42% Of th~e vote in the general election, and having receipts in the amount of $160:b14.

The Office of General Counsel recommends that the Commission bring a civil action for relief against Conlin for-Congress-. Further, we recommend closing the files with respect to all other respondents.

III. RECOMMENDATIONS

The Office of General Counsel recommends the following:

S 434 (a)(1) (A) Ci) of the Federal Election Campaign Act of 1971, as amended (hereafter "the Act.") Specifically, the Commission found probable cause to believe that you failed to file a 10 day pre-primary election report in a timely manner. On March 22, 1979, the Commission also found probable cause to believe that your principal campaign committee, the 21st District Congressional Committee for Bill Mack (hereafter "the Committee") committed a violation of 2 U.S.C. GENERAL COUNSEL'S REPORT

Background This matter was referred to the Office of General Counsel from the Reports Analysis Division. The-original designation of this matter was MUR 634. In that matter respondent candidate Bill Mack had failed to file a 10 Day Pre-Primary Election Report in a timely manner. Subsequent to this referral, this office received a number of other referrals involving Bill Mack's principal campaign committee, the 21st District Congressional Committee for Bill Mack (hereafter "the Committee"). The Committee failed to file its 30 day post primary, its 10 day pre general and its 30 day post general election reports in a timely manner. Candidate Mack, who ran for a seat in the U. S. House of Representatives from the 21st District of Ohio, lost in the general election, receiving 14% of the votes cast. After a number of attempts' at conciliation with candidate bill Mack,, he agreed to file the above 'named reorts including those for the Cozunittee, which hel signed. These reports have been received by the Commission and reveal *no expenditures and no receipts. The Commission approved a modified conciliation agreement on February 2, 1979 which included all the above mentioned, violations of the Act and a civil penalty in the amount of $50.00. We have, however, been unable to conciliate wil;h Mr. Mack in this matter as he refuses to pay any civil penalty. We therefore recommend that the Commission find probable cause that Bill Mack violated 2 U.S.C. S 434(a) (1)(A) (i) and probable cause that Bill Mack's principal campaign committee violated 2 U.S.C. S 434(a)(l)(A)(i) and 2 U.s.c. S 434(a)(l)(A)(ii) for failing to file the above named reports in a timely manner. Recommendation 1. Find probable cause to believe that Bill Mack violated 2 U.S.C. - The attached conciliation agreement represents a slight modification of an earlier agreement which had been approved by the Commission. This new agreement reflect. our efforts to conciliate with the respondents pursuant to our recommenda- tion in NF 181. There we recommended merging conciliation with the respondent committee with ongoing conciliation taking place in NF 93.

This attached agreement includes new language describing the respondent committee's failure to file a 10 day-general election report and a 30 day post-general election report. Paragraphs G. He I and J under section III and paragraphs C CIA and D after WHEREFORE represent the major additions incorporated into this new agreement. On September 13, 1978 the Commission voted to take further action against the for Congress Committee and its treasurer TVed Strickland for violating 2 U.S.C. 5 434(a)(l)(A)(i). The Commission also voted to take further action against candidate Bill Mack for violating 2 U.S.C. 5 434(a)(l)(A)(i). Con- ciliati~n agreements were sent to both the Strickland com- mittee and Bill Mack. Analysis Since this time we have received our conciliation agreement without any changes from treasurer Ted Strickland, signed by him and accompanied by a check for $100, the amount of the civil penalty. This office has recommended in a separate memorandum that the conciliation agreement be accepted and that the matter be closed as to the Ted Strickland for Congress Committee. As for candidate Bill Mck, in addition to his Q* failure to file a ten da pr-election report, his priR cLasapaign committee. was, published as a 30 day post-eIlot, , non filer and was included in MUR 738. In an October 10, 1978 telephone conversation* Mack expressed confusion as to his own reporting responsibilities as distinguished from those of his committee. He also objected to paying a c ivil penalty for his failure to timely file the necessary reports. After being advised As to, what reports were missing, he agreed to have them mailed to the Commission. Mack also agreed in this conversation to sign his committee's 30 day post.%election report and accept responsibility for its late filing. Accordingly, a 10 day pre-election report from candidate Bill Mack and a 30 day post election report from the 21st Congressional Committee for Bill Mack were received by the Commission on October 15, 1978. The reports reveal no contri- butions received and no expenditures made by either Mack or his principal campaign committee. In light of the fact that the reports have been received and in light of the amount of financial activity in the campaign, we recommend that the civil penalty be reduced to $50 and that the attached conciliation agreement be approved. GENERAL COUNSEL' S REPORT

Background

This matter was referred to the Office of General Counsel from the Reports Analysis Division. It concerns candidates and committees that failed to file 30 day post-primary election reports in Ohio. They are the Dennerll 20th Congressional District Committee, the People for Bushong Committee, and the 21st District Congressional Committee for Bill Mack. All three committees were notified by the Commission on July 18, 1978 and on August 4, 1978 of their failure to file 30 day post-primary election reports due on July 6, 1978. The three committees were also included in a press release issued by the Press Office on September 5, 1978 which contained the names of candidates and committees that failed to file these 30 day post-election reports. Analysis

The Denneril 30th Congressional District Committee is the principal campaign committee for Norbert G. Dennerli, Jr. Denerlo a Derato 10jat tho-ppri ? e 1,

12.4% of the votes c~st or 4,741 votes. the IdU file a 10:day pre-prl~ary report sho~ing total::~t 4 $664.08, total expenditures of $663.$39,, and cash ft hiod4 obf .69. In light of these, facts and applying the criteria set forth by the Task Force on Nonfiling Procedure* in 'its Filing Procedures in its May 23, 1978 memorandum, we recomend closing the matter as to the Dennerll 20th Congressional District Committee. The People for Bushong Committee is the principal campaign committee for Thomas F. Bushong. Bushong lost the Democratic primary election in~ the 4th District of Ohio receiving 7,702 votes or 42.4% of the votes cast. Candidate Bushong did file a 10 day pre-election report which revealed no receipts and no expenditures. Again applying the criteria set forth by the Task Force on Nonfiling Procedures, we recommend closing the matter as to the People for Bushong Committee. The 21st District Congressional Committee for Bill Mack ia the principal campaign committee for Bill Mack who was unopposed in the June 6, 1978 primary election. Candidate Bill Mack, chairman of his principal campaign committee, has also failed to file a 10 day pre-primary report (see MUR 634). On September 13, 1978 the Commission voted to take further action against Bill Mack for his failure to file this 10 day pre-primary report, A conciliation agreement witih ,_ civil penalty was also approved,. on October 10,F A.1,0( office contacted Bill Mack and discussed both his t4211ur to file his. 10 day pre-election report and his Cont failure to file its'30 day post-election report. The Commission voted on September 13, 1978 to take further action against the Ted Strickland for Congress Committee for its failure to file a 10 day pre-election report in a timely manner. A conciliation agreement was also approved on that date and sent to the respondent committee. Since then, we have received our conciliation agreement without any changes, signed by the comittee treasurer and accompanied by a check for $100, the amount of the civil penalty. We therefore recommend that the agreement be signed and that the matter be closed as to the Ted Strickland for Congress Committee.

CONCILIATION AGREEMENT

This matter having been initiated by the Commission in the ordinary course of carrying out its supervisory responsibilities, and after an investigation, the Commission having found reasonable cause to believe that the Ted Strickland for Congress Committee and its treasurer (hereafter "respondents") violated 2 U.S.C. S434(a) Cl) (A)Ci);

WHEREFORE, the Commission and Respondent, having duly entered into conciliation as provided for in 2 U.S.C. S437g(a) (5), do hereby agree as follows: I. The Federal Election Commission has jurisdiction over the Respondent and the subject hit~l~t$scase, II. Respondent has had a reasonable opportunity to demonstrate that no action should be taken in this matter. III. The pertinent facts underlying this matter are as follows: A. Respondentsthe Ted Strickland for Congress Committee, is the principal campaign committee for candidate Ted Strickland who won the June 6, 1978 Democratic primary election for a seatin the U.S. House of Representatives from the 6th district of Ohio. B. Respondents' 10 day pro-primary electior x ~ 4e to be f iled no later than May 27, 1978. C. Respondents failed to file their 10 day -prea-ptiR election report by May 27, 1978. D. This matter having been initiated by the Commission in the ordinary course of carrying out its supervisory responsibilities, and after an investigation, the Commission having found reasonable cause to believe that the Ted Strickland for Congress Committee and its treasurer (hereafter "respondents") violated 2 U.S.C. S434(a) (1) (A) (i) ; - WHEREFORE, the Commission and Respondent, having duly entered into conciliation as provided for in 2 U.S.C. S437g(a) (5), do hereby agree as follows:

I. The Federal Election Commission has jurisdiction over the Respondent and the subject matter.of this case. II. GENERAL COUNSEL' S REPORT

BACKGROUND The following candidates and committees were referred, to The Off ice of General Counsel as 10 day pre-primary election non-filers from the state of Ohio: candidate William P. McKenna, the Normile Election Committee, the Ted Strickland for CongressiCommittee, and candidate Bill Mack (see Attachment I). The date of the Ohio primary election was June 6, 1978. on June 3, 1978, the Press Office issued a press release containing the names of the candidates and committees which failed to file these 10 day pre-election reports. Since then, candidate William P. McKenna,the Normile Election Committee, and the Ted Strickland for Congress Committee have filed their 10 day pre-election reports. William P. McKenna finished second in the Democratic primary for a seat in the U.S. House of Representatives from the 17th district of Ohio. McKenna received 11.7 percent of his party's vote. On June 5, 1978, the Commission received from candidate McKenna his 10 day pre-election report. The report revealed n. -expendituresand total receipts of $2:00 oh were then turned over to his committee. Candidate No~en~A'Rs previous reports had likevise reveIa led, no activity. Alo McKenna's principal campaign commaittee had filed its 10 day pre-primary election report prior to the June 3, 1978 date of publication. Michael Normile finished second in the Democratic primary for a seat in the U.S. House of Representatives from the 23rd district of Ohio. Normile received 16.1 percent of the party's vote. The Normile Election Committee filed its 10 day pre-election report on June 21, 1978. This report revealed no expenditures and no receipts for this period by the committee. In light of these facts and applying the criteria established by the Task Force on Nonfiling Procedures in its memorandum dated May 23, 1978,, the Office of General Counsel recommends that no further action be taken against candidate William P. McKenna and the Normile Election Committee as to the nonfllin of their 10 day pre'-primary election reports for the June 6, 1978 Ohio primary election. We recommend closing the matter a~s to them. on June 8, 1978, the Commission received from the Ted Strickland for Congress Committee a 10 day pre-primary election report. The report was due on May 27, 1978. Notification of the committee's failure to file this report had been mailed on May 29, 1978 and May 31, 1978. The report which the Committee filed on June 8 listed receipts in the amount of $1,295.00 and expenditures in the amount of $3,198.00. edStrickland-von the Demo ati~c primarCY faa in the U.S..House of Representatives from the 6th of Ohio. receiving 17,170 votes or. 76.71 percent oft1 votes cast. in a letter dated June 5, 1978, the chairman of the Ted Strickland for Congress Committee stated that the late filing of the 10 day pre-primary report was due to the treasurer moving out of state (see Attachment 11). The letter also advised the Commission that candidate Ted Strickland would:, sign in place of the treasurer. This had been suggested in a telephone conversation on June 5, 1978 (see Attachment III), Candidate Strickland served in this capacity until August 15, 1978 when the Commission received notification that the committee had designated a new treasurer. In light of the fact that Mr. Strickland won the election and because his committee did not file its 10 day pre-primary report in a timely manner, the Office of General Counsel recommends that the Commission take further compliance action against the Ted Strickland for Congress Committee and its treasurer, Ted Strickland. We also recommend approval of the attached conciliation agreement with a $100 civil penalty. This determination is consistent with the the Commission guidelines for nonfilers set forth in its memorandum dated May 23, 1978 which states that further action shall be taken against candidates who win their primary election. Candidate Bill Mack was unopposed in the Republican primary for a seat in the U.S. House of Representatives from the 21st district of Ohio. Notification of his failure to file a 10 day pro-primary election report was mailed on j 9',
